(1) These Regulations may be cited as the Control of Covid-19 (No.3) Regulations, 2021. (2) These Regulations come into force on 22nd September, 2021.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_2\", \"num\": \"2.\", \"text\": \"Definitions 2. (1) In these Regulations \u2014 \u201capproved laboratory\u201d means \u2014 (a) United Kingdom Accreditation Service (UKAS) accredited laboratories; (b) laboratories of the National Health Service of the United Kingdom; (c) Joint Commission (JC) accredited laboratories; (d) Joint Commission International (JCI) accredited laboratories; (e) International Organization for Standardization (ISO) accredited laboratories; Regulation 2 SL 67 of 2021 (f) Commission on Office Laboratory Accreditation (COLA) accredited laboratories; (g) National Public Health laboratories; or (h) other government approved providers; \u201capproved vaccine course\u201d means \u2014 (a) a vaccination programme provided by the Cayman Islands Health Services Authority; (b) a vaccination programme provided by a registered practitioner, a health care facility, or a medical tourism facility and which is approved by the Chief Medical Officer; and (c) any other vaccination programme which is approved by the Chief Medical Officer for use against the virus and which is listed in a notice published by the Chief Medical Officer in the Gazette, in any other official Government website or in any other official means of communication; \u201cCaymanian\u201d has the meaning assigned by section 2 of the Immigration (Transition) Act (2021 Revision); \u201cCayman Islands Health Services Authority\u201d means the Cayman Islands Health Services Authority established under section 3 of the Health Services Authority Act (2018 Revision); \u201ccivil partner\u201d has the meaning assigned by section 2 of the Civil Partnership Act, 2020; \u201ccustoms and border control officer\u201d means a public officer appointed under section 6 of the Customs and Border Control Act (2021 Revision) and includes any police officer or other person assisting the Customs and Border Control Service in any assigned matter; \u201cnegative polymerase chain reaction (PCR) test\u201d means a test which shows that the person in respect of whom the test was administered had a swab taken from the upper airways which gave a negative result by polymerase chain reaction (PCR) testing for the detection of the virus; \u201cresident\u201d means a person who has legal and ordinary residence in the Islands in accordance with the Immigration (Transition) Act (2021 Revision); \u201csecurely verified\u201d means verified by employing technological solutions of international standards which are \u2014 (a) approved by the Medical Officer of Health; and (b) designed to reduce and eliminate fraud; \u201cship\u201d means every description of vessel used in navigation; \u201ctourist visitor\u201d has the meaning assigned by section 2 of the Immigration (Transition) Act (2021 Revision); \u201cunvaccinated person\u201d means \u2014 Regulation 3 SL 67 of 2021 (a) a person who has not at least fourteen days prior to the person\u2019s date of arrival in the Islands, completed an approved vaccine course; or (b) a person who has not completed an approved vaccine course; \u201cvaccination certificate\u201d means a document which is provided as evidence that the person in respect of whom the document is issued was administered an approved vaccine course; and \u201cvirus\u201d means the virus known as SARS-CoV-2 which causes the disease known as Covid-19.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_3\", \"num\": \"3.\", \"text\": \"Restrictions on arrival of unvaccinated persons to the Islands 3. (1) The following are the categories of unvaccinated persons who may be allowed entry into the Islands under this regulation \u2014 (a) an unvaccinated person who is a Caymanian or resident of the Islands; and (b) an unvaccinated person who is \u2014 (i) a child of a Caymanian or resident of the Islands or a child under the guardianship or care of a Caymanian or resident of the Islands; and (ii) who is travelling with the Caymanian or resident of the Islands. (2) Subject to paragraph (7) and notwithstanding any other law, a person referred to under paragraph (1) who wishes to enter the Islands shall \u2014 (a) obtain in relation to that person and a child who is five years of age or older and travelling with the person, if applicable, a sample from the upper airways to be tested by a polymerase chain reaction (PCR) test for the virus no more than seventy-two hours prior to the departure of the person\u2019s flight to the Islands; (b) upon arrival in the Islands, provide a customs and border control officer with medical certificates which \u2014 (i) show that the person and the child who is five years of age or older and travelling with the person, if applicable, had a negative polymerase chain reaction (PCR) test for the virus of a sample from the upper airways no more than seventy-two hours prior to the departure of the flight of the person and the child, if applicable, to the Islands; and (ii) specifies the name and address of the approved laboratory where the test was performed; and (c) comply with the directions of the Medical Officer of Health with regard to any testing \u2014 (i) of the person; or (ii) of a child who is travelling with the person, for the virus prior to leaving any place or facility of quarantine or isolation. Regulation 3 SL 67 of 2021 (3) Subject to paragraph (7) and notwithstanding any other law, where a person referred to under paragraph (1) arrives in the Islands that person shall be required by a customs and border control officer, in respect of the person, and the child, if applicable \u2014 (a) to complete a medical and travel questionnaire in such form as is provided by the Medical Officer of Health; and (b) to undergo a medical examination if the customs and border control officer considers that a medical examination is necessary. (4) Subject to paragraphs (6) and (7), where a person and a child, if applicable, referred to under paragraph (1) arrive in the Islands, the person, and the child if applicable, shall \u2014 (a) remain in isolation for a period of not less fourteen days at a private residence or such other place or facility of quarantine or isolation as specified by the Medical Officer of Health; and (b) be subject to such directions as are provided by the Medical Officer of Health until the person and the child, if applicable, receive a negative result in relation to the polymerase chain reaction (PCR) test administered to the person prior to leaving any place or facility of quarantine or isolation. (5) Where \u2014 (a) upon arrival in the Islands, a person and a child, if applicable, referred to under paragraph (1) are allowed to isolate at a private residence in accordance with paragraph (4)(a); and (b) there are other occupants who reside at the private residence who intend to stay at the residence during the period of isolation with the person and the child, if applicable, the other occupants shall, for such period as may be determined by the Medical Officer of Health, which period shall be no less than fourteen days, be subject to such directions as are provided by the Medical Officer of Health. (6) Where a person or a child, if applicable, referred to under paragraph (1) arrives in the Islands and the person or the child, if applicable, tests positive for the virus or shows respiratory symptoms or symptoms of the virus, the person or the child, if applicable, shall be managed at a place and in such manner as specified by the Medical Officer of Health until the Medical Officer of Health determines that the person is no longer a health risk to the public. (7) Paragraphs (1), (2) (3) and (4) do not apply to the crew of any ship or aircraft but for the purpose of the prevention, control or suppression of the spread of the virus \u2014 (a) a crew member of a ship or aircraft which arrives in the Islands after the date of commencement of these Regulations shall comply with the Regulation 4 SL 67 of 2021 directions of the Medical Officer of Health with regard to isolation and any testing and health monitoring; and (b) where \u2014 (i) a crew member of a ship or aircraft which arrives in the Islands after the date of commencement of these Regulations is directed to isolate at a private residence; and (ii) there are other occupants who reside at the private residence who intend to stay at the residence during the period of isolation with the crew member, the other occupants shall comply with the directions of the Medical Officer of Health with regard to isolation and any testing and health monitoring. (8) A person who contravenes this regulation commits an offence and is liable on summary conviction to a fine of ten thousand dollars or to imprisonment for a term of two years, or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_4\", \"num\": \"4.\", \"text\": \"Restrictions on arrival of vaccinated persons to the Islands 4. (1) The following persons who, at least fourteen days prior to the person\u2019s proposed date of arrival in the Islands, have completed an approved vaccine course may be allowed entry into the Islands under this regulation \u2014 (a) a person who is a Caymanian or resident of the Islands; (b) a person who is \u2014 (i) a child of a Caymanian or resident of the Islands or a child under the guardianship or care of a Caymanian or resident of the Islands; and (ii) who is travelling with the Caymanian or resident of the Islands; or (c) a tourist visitor or other visitor. (2) Subject to paragraph (8) and notwithstanding any other law, a person referred to under paragraph (1) who wishes to enter the Islands shall \u2014 (a) provide a sample from the upper airways to be tested by a polymerase chain reaction (PCR) test for the virus no more than seventy-two hours prior to the departure of the person\u2019s flight to the Islands; (b) upon arrival in the Islands, provide a customs and border control officer with \u2014 (i) a vaccination certificate; and (ii) a medical certificate which \u2014 (A) shows that the person had a negative polymerase chain reaction (PCR) test of a sample from the upper airways no more than seventy-two hours prior to the departure of the person\u2019s flight to the Islands; and Regulation 4 SL 67 of 2021 (B) specifies the name and address of the approved laboratory where the test was performed; and (c) comply with the directions of the Medical Officer of Health with regard to any further testing for the virus prior to leaving any place or facility of quarantine or isolation. (3) Subject to paragraph (8) and notwithstanding any other law, where a person referred to under paragraph (1) arrives in the Islands, that person shall be required by a customs and border control officer, in respect of the person or the person\u2019s dependants \u2014 (a) to complete a medical and travel questionnaire in such form as is provided by the Medical Officer of Health; and (b) to undergo a medical examination if the customs and border control officer considers that a medical examination is necessary. (4) Subject to paragraphs (6) and (7), where a person referred to under paragraph (1) who satisfies the criteria set out in that paragraph arrives in the Islands, the person shall \u2014 (a) remain in isolation for a period of not less than \u2014 (i) seven days, where the vaccination certificate \u2014 (A) is issued by the Cayman Islands Health Services Authority; or (B) can be securely verified; and (ii) ten days, where the vaccination certificate cannot be securely verified, at a private residence or such other place or facility of quarantine or isolation as specified by the Medical Officer of Health; and (b) be subject to such directions as are provided by the Medical Officer of Health until the person receives a negative result in relation to the polymerase chain reaction (PCR) test administered to the person prior to leaving any place or facility of quarantine or isolation. (5) For the purpose of paragraph (4)(a), the Medical Officer of Health shall permit a person referred to under paragraph (1) to isolate at a private residence at which there are other occupants, where \u2014 (a) the other occupants at that private residence have completed an approved vaccine course and at least fourteen days have elapsed since the completion of each occupant\u2019s approved vaccine course; and (b) the other occupants at the private residence comply with the directions of the Medical Officer of Health, including directions with regard to isolation and testing for the virus. (6) Where a person referred to under paragraph (1) arrives in the Islands and the person tests positive for the virus or shows respiratory symptoms or symptoms Regulation 4 SL 67 of 2021 of the virus, the person shall be managed at a place and in such manner as specified by the Medical Officer of Health until the Medical Officer of Health determines that the person is no longer a health risk to the public. (7) Where a person referred to under paragraph (1) who arrives in the Islands (\u201cthe vaccinated person\u201d) intends to isolate with an unvaccinated person \u2014 (a) the vaccinated person shall, for such period from the date of arrival as may be determined by the Medical Officer of Health, which period shall be no less than fourteen days, for the purpose of surveillance by the Medical Officer of Health \u2014 (i) remain at a private residence or such other place or facility of quarantine or isolation as specified by the Medical Officer of Health; and (ii) be subject to such directions as are provided by the Medical Officer of Health; and (b) the unvaccinated person shall, for such period as may be determined by the Medical Officer of Health, which period shall be no less than fourteen days, be subject to such directions as are provided by the Medical Officer of Health, including directions with regard to isolation of the unvaccinated person and testing of the unvaccinated person for the virus. (8) Paragraphs (1), (2) (3) and (4) do not apply to the crew of any ship or aircraft but for the purpose of the prevention, control or suppression of the spread of the virus \u2014 (a) a crew member of a ship or aircraft which arrives in the Islands after the date of commencement of these Regulations shall comply with the directions of the Medical Officer of Health with regard to isolation and any testing and health monitoring; and (b) where \u2014 (i) a crew member of a ship or aircraft which arrives in the Islands after the date of commencement of these Regulations is directed to isolate at a private residence; and (ii) there are other occupants who reside at the private residence who intend to stay at the residence during the period of isolation with the crew member, the other occupants shall comply with the directions of the Medical Officer of Health with regard to isolation and any testing and health monitoring. (9) For the purpose of paragraph (3), \u201cdependant\u201d means, in relation to a person referred to under paragraph (1) \u2014 (a) the spouse or civil partner of that person, or one of the following relations of that person, namely a child, step-child, adopted child, grandchild, parent, step-parent, grandparent, brother, sister, half-brother, half-sister, Regulation 5 SL 67 of 2021 being, in each case, wholly or substantially dependent upon that person; and (b) except where the spouse, civil partner or relation referred to under subparagraph (a) is \u2014 (i) a Caymanian or resident of the Islands; or (ii) a child of a Caymanian or resident of the Islands or a child under the guardianship or care of a Caymanian or resident of the Islands and who is travelling with the Caymanian or resident of the Islands, as applicable, a spouse, civil partner or relation who, at least fourteen days prior to the proposed date of arrival in the Islands of the spouse, civil partner or relation, has completed an approved vaccine course. (10) A person who contravenes this regulation commits an offence and is liable on summary conviction to a fine of ten thousand dollars or to imprisonment for a term of two years, or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_5\", \"num\": \"5.\", \"text\": \"Offence of providing false medical certificate or false vaccination certificate 5. (1) A person who, in the purported discharge of the requirement under regulation 3(2)(b) or 4(2)(b)(ii), provides a customs and border control officer with a false or forged medical certificate commits an offence and is liable on summary conviction to a fine of ten thousand dollars or to imprisonment for a term of two years, or to both. (2) A person who, in purported compliance with regulation 4(2)(b)(i), provides a customs and border control officer with a false or forged vaccination certificate commits an offence and is liable on summary conviction to a fine of ten thousand dollars or to imprisonment for a term of two years, or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_6\", \"num\": \"6.\", \"text\": \"Power to exempt persons from compliance with regulations 3 or 4 6. (1) Subject to paragraph (2), the Medical Officer of Health may exempt a person or category of persons from any of the requirements in regulations 3 or 4. (2) A person who is exempted under paragraph (1) \u2014 (a) shall comply with the directions of the Medical Officer of Health with regard to isolation and any additional health monitoring for the purpose of the prevention, control or suppression of the spread of the virus; and (b) who tests positive for the virus or shows respiratory symptoms or symptoms of the virus shall be managed at a place and in such manner as specified by the Medical Officer of Health, until the Medical Officer of Health determines that the person is not a health risk to the public. (3) Where the Medical Officer of Health exempts a person or category of persons from any of the requirements in regulation 3 or 4, the Medical Officer of Health Regulation 7 SL 67 of 2021 shall ensure that, not less than once in every three month period, the Cabinet is notified of \u2014 (a) the number of exemptions granted during that three month period; (b) the nature of each exemption granted; and (c) the person or category of persons to whom the exemption has been granted. (4) A person who contravenes paragraph (2) commits an offence and is liable on summary conviction to a fine of ten thousand dollars or to imprisonment for a term of two years, or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_7\", \"num\": \"7.\", \"text\": \"Powers, duties and functions of the Medical Officer of Health 7. (1) In carrying out powers, duties and functions under these Regulations, the Medical Officer of Health has all the powers, duties and functions specified in Part VI of the Act and shall exercise any other relevant powers, duties and functions specified \u2014 (a) under regulation 12 of the Public Health (Communicable Diseases) Regulations (1997 Revision) which a medical officer would otherwise be required to exercise; and (b) under the Public Health (Quarantine) Regulations (2021 Revision) which a quarantine officer would otherwise be required to exercise. (2) Subject to paragraph (1)(b), the Public Health (Quarantine) Regulations (2021 Revision) shall apply for the purposes of these Regulations with any necessary modifications. (3) Where a person is found to have presented a false or forged vaccination certificate under these Regulations, the person, shall, from a date and for such period as may be determined by the Medical Officer of Health, for the purpose of surveillance by the Medical Officer of Health, remain at a place or facility of quarantine or isolation specified by the Medical Officer of Health and be subject to such directions as are provided by the Medical Officer of Health.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_8\", \"num\": \"8.\", \"text\": \"Police powers 8. (1) A police officer may require a person to answer any questions to enable the police officer to ascertain who the person is and whether the person is complying with these Regulations, and where the person does not satisfy the police officer that the person is complying with these Regulations, the police officer may \u2014 (a) detain the person and inform the Medical Officer of Health or a person designated by the Medical Officer of Health of the fact that a person has been so detained; and (b) convey the person to a place or facility of quarantine or isolation, if so directed by the Medical Officer of Health. (2) The powers in paragraph (1) may be exercised where a person is at any place. Regulation 9 SL 67 of 2021 (3) For the purposes of exercising the powers in paragraph (1), a police officer may enter any place or facility of quarantine or isolation, including a private residence specified as such under these Regulations, or a multi-dwelling premises in which such a private residence is located. (4) A police officer may use reasonable force, if necessary, in the exercise of the police officer\u2019s powers under this regulation.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_9\", \"num\": \"9.\", \"text\": \"Payment for place or facility of quarantine or isolation 9. (1) Subject to paragraph (2), a person who is required to stay in a place or facility of quarantine or isolation which is operated by Government is liable to pay for any costs associated with the person\u2019s accommodation in such a place or facility. (2) The following persons who provide evidence that they reside in the Islands and who are required to stay in a place or facility of quarantine or isolation which is operated by Government are not required to pay the costs of accommodation at that place or facility \u2014 (a) a person who provides evidence that the person is a returning student; (b) a person who provides evidence that the person\u2019s travel was for the purposes of government business; (c) a person who provides evidence that the purpose of the person\u2019s travel was to represent the Islands in a sporting event as part of a national team; (d) a person who provides a medical certificate signed by a medical practitioner that the person travelled overseas in order to obtain medical services; (e) a person who is a parent, guardian or caregiver who provides evidence that the person travelled overseas for the purposes of taking the person\u2019s child, or a child in the person\u2019s care to \u2014 (i) an overseas educational institution; or (ii) represent the Islands in a sporting event as part of a national team; and (f) a person who provides evidence that the person had responsibility to take a child or an adult overseas to obtain medical services. (3) For the purposes of this regulation \u2014 \u201cchild\u201d means \u2014 (a) a person under the age of eighteen; and (b) a person between the age of eighteen and twenty-four years who is receiving instruction at an educational establishment or undergoing training for a trade, profession or vocation, whether or not while in gainful employment; and \u201cparent\u201d includes a step-parent and a foster parent. Regulation 10 SL 67 of 2021\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_10\", \"num\": \"10.\", \"text\": \"Medical certificate or vaccination certificate may be submitted by electronic means 10. (1) For the purposes of these Regulations, where a person is required to submit a medical certificate or a vaccination certificate, the certificate may be recorded in electronic form and submitted by electronic means. (2) For the purposes of this regulation, \u201celectronic\u201d has the meaning assigned by section 2 of the Electronic Transactions Act (2003 Revision).\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_11\", \"num\": \"11.\", \"text\": \"Repeal of the Control of Covid-19 (No. 2) Regulations, 2021 11. 1\n\nc\nSL 67 of 2021\nPage 5\n\nCAYMAN ISLANDS\n\nPublic Health Act\n(2021 Revision)\nCONTROL OF COVID-19 (NO.3)\nREGULATIONS, 2021\n(SL 67 of 2021)\nIn exercise of the powers conferred by section 34 of the Public Health Act (2021 Revision)\nthe Cabinet makes the following Regulations \u2014\n1.\nCitation and commencement\n1.\n(1) These Regulations may be cited as the Control of Covid-19 (No.3) Regulations,\n2021.\n(2) These Regulations come into force on 22nd September, 2021.\n2.\nDefinitions\n2.\n(1) In these Regulations \u2014\n\u201capproved laboratory\u201d means \u2014\n(a)\nUnited Kingdom Accreditation Service (UKAS) accredited laboratories;\n(b) laboratories of the National Health Service of the United Kingdom;\n(c)\nJoint Commission (JC) accredited laboratories;\n(d) Joint Commission International (JCI) accredited laboratories;\n(e)\nInternational\nOrganization\nfor\nStandardization\n(ISO)\naccredited\nlaboratories;\n\nRegulation 2\nControl of Covid-19 (No.3) Regulations, 2021\n\nPage 6\nSL 67 of 2021\nc\n\n(f)\nCommission on Office Laboratory Accreditation (COLA) accredited\nlaboratories;\n(g) National Public Health laboratories; or\n(h) other government approved providers;\n\u201capproved vaccine course\u201d means \u2014\n(a)\na vaccination programme provided by the Cayman Islands Health Services\nAuthority;\n(b) a vaccination programme provided by a registered practitioner, a health\ncare facility, or a medical tourism facility and which is approved by the\nChief Medical Officer; and\n(c)\nany other vaccination programme which is approved by the Chief Medical\nOfficer for use against the virus and which is listed in a notice published\nby the Chief Medical Officer in the Gazette, in any other official\nGovernment website or in any other official means of communication;\n\u201cCaymanian\u201d has the meaning assigned by section 2 of the Immigration\n(Transition) Act (2021 Revision);\n\u201cCayman Islands Health Services Authority\u201d means the Cayman Islands\nHealth Services Authority established under section 3 of the Health Services\nAuthority Act (2018 Revision);\n\u201ccivil partner\u201d has the meaning assigned by section 2 of the Civil Partnership\nAct, 2020;\n\u201ccustoms and border control officer\u201d means a public officer appointed under\nsection 6 of the Customs and Border Control Act (2021 Revision) and includes\nany police officer or other person assisting the Customs and Border Control\nService in any assigned matter;\n\u201cnegative polymerase chain reaction (PCR) test\u201d means a test which shows\nthat the person in respect of whom the test was administered had a swab taken\nfrom the upper airways which gave a negative result by polymerase chain\nreaction (PCR) testing for the detection of the virus;\n\u201cresident\u201d means a person who has legal and ordinary residence in the Islands\nin accordance with the Immigration (Transition) Act (2021 Revision);\n\u201csecurely verified\u201d means verified by employing technological solutions of\ninternational standards which are \u2014\n(a) approved by the Medical Officer of Health; and\n(b) designed to reduce and eliminate fraud;\n\u201cship\u201d means every description of vessel used in navigation;\n\u201ctourist visitor\u201d has the meaning assigned by section 2 of the Immigration\n(Transition) Act (2021 Revision);\n\u201cunvaccinated person\u201d means \u2014\n\nControl of Covid-19 (No.3) Regulations, 2021\nRegulation 3\n\nc\nSL 67 of 2021\nPage 7\n\n(a)\na person who has not at least fourteen days prior to the person\u2019s date of\narrival in the Islands, completed an approved vaccine course; or\n(b) a person who has not completed an approved vaccine course;\n\u201cvaccination certificate\u201d means a document which is provided as evidence that\nthe person in respect of whom the document is issued was administered an\napproved vaccine course; and\n\u201cvirus\u201d means the virus known as SARS-CoV-2 which causes the disease\nknown as Covid-19.\n3.\nRestrictions on arrival of unvaccinated persons to the Islands\n3.\n(1) The following are the categories of unvaccinated persons who may be allowed\nentry into the Islands under this regulation \u2014\n(a)\nan unvaccinated person who is a Caymanian or resident of the Islands; and\n(b) an unvaccinated person who is \u2014\n(i)\na child of a Caymanian or resident of the Islands or a child under the\nguardianship or care of a Caymanian or resident of the Islands; and\n(ii) who is travelling with the Caymanian or resident of the Islands.\n(2) Subject to paragraph (7) and notwithstanding any other law, a person referred\nto under paragraph (1) who wishes to enter the Islands shall \u2014\n(a)\nobtain in relation to that person and a child who is five years of age or\nolder and travelling with the person, if applicable, a sample from the upper\nairways to be tested by a polymerase chain reaction (PCR) test for the virus\nno more than seventy-two hours prior to the departure of the person\u2019s flight\nto the Islands;\n(b) upon arrival in the Islands, provide a customs and border control officer\nwith medical certificates which \u2014\n(i)\nshow that the person and the child who is five years of age or older\nand travelling with the person, if applicable, had a negative\npolymerase chain reaction (PCR) test for the virus of a sample from\nthe upper airways no more than seventy-two hours prior to the\ndeparture of the flight of the person and the child, if applicable, to the\nIslands; and\n(ii) specifies the name and address of the approved laboratory where the\ntest was performed; and\n(c)\ncomply with the directions of the Medical Officer of Health with regard to\nany testing \u2014\n(i)\nof the person; or\n(ii) of a child who is travelling with the person,\nfor the virus prior to leaving any place or facility of quarantine or isolation.\n\nRegulation 3\nControl of Covid-19 (No.3) Regulations, 2021\n\nPage 8\nSL 67 of 2021\nc\n\n(3) Subject to paragraph (7) and notwithstanding any other law, where a person\nreferred to under paragraph (1) arrives in the Islands that person shall be\nrequired by a customs and border control officer, in respect of the person, and\nthe child, if applicable \u2014\n(a)\nto complete a medical and travel questionnaire in such form as is provided\nby the Medical Officer of Health; and\n(b) to undergo a medical examination if the customs and border control officer\nconsiders that a medical examination is necessary.\n(4) Subject to paragraphs (6) and (7), where a person and a child, if applicable,\nreferred to under paragraph (1) arrive in the Islands, the person, and the child if\napplicable, shall \u2014\n(a)\nremain in isolation for a period of not less fourteen days at a private\nresidence or such other place or facility of quarantine or isolation as\nspecified by the Medical Officer of Health; and\n(b) be subject to such directions as are provided by the Medical Officer of\nHealth until the person and the child, if applicable, receive a negative result\nin relation to the polymerase chain reaction (PCR) test administered to the\nperson prior to leaving any place or facility of quarantine or isolation.\n(5) Where \u2014\n(a)\nupon arrival in the Islands, a person and a child, if applicable, referred to\nunder paragraph (1) are allowed to isolate at a private residence in\naccordance with paragraph (4)(a); and\n(b) there are other occupants who reside at the private residence who intend to\nstay at the residence during the period of isolation with the person and the\nchild, if applicable,\nthe other occupants shall, for such period as may be determined by the Medical\nOfficer of Health, which period shall be no less than fourteen days, be subject\nto such directions as are provided by the Medical Officer of Health.\n(6) Where a person or a child, if applicable, referred to under paragraph (1) arrives\nin the Islands and the person or the child, if applicable, tests positive for the\nvirus or shows respiratory symptoms or symptoms of the virus, the person or\nthe child, if applicable, shall be managed at a place and in such manner as\nspecified by the Medical Officer of Health until the Medical Officer of Health\ndetermines that the person is no longer a health risk to the public.\n(7) Paragraphs (1), (2) (3) and (4) do not apply to the crew of any ship or aircraft\nbut for the purpose of the prevention, control or suppression of the spread of the\nvirus \u2014\n(a)\na crew member of a ship or aircraft which arrives in the Islands after the\ndate of commencement of these Regulations shall comply with the\n\nControl of Covid-19 (No.3) Regulations, 2021\nRegulation 4\n\nc\nSL 67 of 2021\nPage 9\n\ndirections of the Medical Officer of Health with regard to isolation and any\ntesting and health monitoring; and\n(b) where \u2014\n(i)\na crew member of a ship or aircraft which arrives in the Islands after\nthe date of commencement of these Regulations is directed to isolate\nat a private residence; and\n(ii) there are other occupants who reside at the private residence who\nintend to stay at the residence during the period of isolation with the\ncrew member,\nthe other occupants shall comply with the directions of the Medical Officer\nof Health with regard to isolation and any testing and health monitoring.\n(8) A person who contravenes this regulation commits an offence and is liable on\nsummary conviction to a fine of ten thousand dollars or to imprisonment for a\nterm of two years, or to both.\n4.\nRestrictions on arrival of vaccinated persons to the Islands\n4.\n(1) The following persons who, at least fourteen days prior to the person\u2019s proposed\ndate of arrival in the Islands, have completed an approved vaccine course may\nbe allowed entry into the Islands under this regulation \u2014\n(a)\na person who is a Caymanian or resident of the Islands;\n(b) a person who is \u2014\n(i)\na child of a Caymanian or resident of the Islands or a child under the\nguardianship or care of a Caymanian or resident of the Islands; and\n(ii) who is travelling with the Caymanian or resident of the Islands; or\n(c)\na tourist visitor or other visitor.\n(2) Subject to paragraph (8) and notwithstanding any other law, a person referred\nto under paragraph (1) who wishes to enter the Islands shall \u2014\n(a)\nprovide a sample from the upper airways to be tested by a polymerase\nchain reaction (PCR) test for the virus no more than seventy-two hours\nprior to the departure of the person\u2019s flight to the Islands;\n(b) upon arrival in the Islands, provide a customs and border control officer\nwith \u2014\n(i)\na vaccination certificate; and\n(ii) a medical certificate which \u2014\n(A) shows that the person had a negative polymerase chain reaction\n(PCR) test of a sample from the upper airways no more than\nseventy-two hours prior to the departure of the person\u2019s flight\nto the Islands; and\n\nRegulation 4\nControl of Covid-19 (No.3) Regulations, 2021\n\nPage 10\nSL 67 of 2021\nc\n\n(B) specifies the name and address of the approved laboratory\nwhere the test was performed; and\n(c)\ncomply with the directions of the Medical Officer of Health with regard to\nany further testing for the virus prior to leaving any place or facility of\nquarantine or isolation.\n(3) Subject to paragraph (8) and notwithstanding any other law, where a person\nreferred to under paragraph (1) arrives in the Islands, that person shall be\nrequired by a customs and border control officer, in respect of the person or the\nperson\u2019s dependants \u2014\n(a)\nto complete a medical and travel questionnaire in such form as is provided\nby the Medical Officer of Health; and\n(b) to undergo a medical examination if the customs and border control officer\nconsiders that a medical examination is necessary.\n(4) Subject to paragraphs (6) and (7), where a person referred to under paragraph\n(1) who satisfies the criteria set out in that paragraph arrives in the Islands, the\nperson shall \u2014\n(a)\nremain in isolation for a period of not less than \u2014\n(i)\nseven days, where the vaccination certificate \u2014\n(A) is issued by the Cayman Islands Health Services Authority; or\n(B) can be securely verified; and\n(ii) ten days, where the vaccination certificate cannot be securely\nverified,\nat a private residence or such other place or facility of quarantine or\nisolation as specified by the Medical Officer of Health; and\n(b) be subject to such directions as are provided by the Medical Officer of\nHealth until the person receives a negative result in relation to the\npolymerase chain reaction (PCR) test administered to the person prior to\nleaving any place or facility of quarantine or isolation.\n(5) For the purpose of paragraph (4)(a), the Medical Officer of Health shall permit\na person referred to under paragraph (1) to isolate at a private residence at which\nthere are other occupants, where \u2014\n(a)\nthe other occupants at that private residence have completed an approved\nvaccine course and at least fourteen days have elapsed since the\ncompletion of each occupant\u2019s approved vaccine course; and\n(b) the other occupants at the private residence comply with the directions of\nthe Medical Officer of Health, including directions with regard to isolation\nand testing for the virus.\n(6) Where a person referred to under paragraph (1) arrives in the Islands and the\nperson tests positive for the virus or shows respiratory symptoms or symptoms\n\nControl of Covid-19 (No.3) Regulations, 2021\nRegulation 4\n\nc\nSL 67 of 2021\nPage 11\n\nof the virus, the person shall be managed at a place and in such manner as\nspecified by the Medical Officer of Health until the Medical Officer of Health\ndetermines that the person is no longer a health risk to the public.\n(7) Where a person referred to under paragraph (1) who arrives in the Islands (\u201cthe\nvaccinated person\u201d) intends to isolate with an unvaccinated person \u2014\n(a)\nthe vaccinated person shall, for such period from the date of arrival as may\nbe determined by the Medical Officer of Health, which period shall be no\nless than fourteen days, for the purpose of surveillance by the Medical\nOfficer of Health \u2014\n(i)\nremain at a private residence or such other place or facility of\nquarantine or isolation as specified by the Medical Officer of Health;\nand\n(ii) be subject to such directions as are provided by the Medical Officer\nof Health; and\n(b) the unvaccinated person shall, for such period as may be determined by\nthe Medical Officer of Health, which period shall be no less than fourteen\ndays, be subject to such directions as are provided by the Medical Officer\nof Health, including directions with regard to isolation of the unvaccinated\nperson and testing of the unvaccinated person for the virus.\n(8) Paragraphs (1), (2) (3) and (4) do not apply to the crew of any ship or aircraft\nbut for the purpose of the prevention, control or suppression of the spread of the\nvirus \u2014\n(a)\na crew member of a ship or aircraft which arrives in the Islands after the\ndate of commencement of these Regulations shall comply with the\ndirections of the Medical Officer of Health with regard to isolation and any\ntesting and health monitoring; and\n(b) where \u2014\n(i)\na crew member of a ship or aircraft which arrives in the Islands after\nthe date of commencement of these Regulations is directed to isolate\nat a private residence; and\n(ii) there are other occupants who reside at the private residence who\nintend to stay at the residence during the period of isolation with the\ncrew member,\nthe other occupants shall comply with the directions of the Medical Officer\nof Health with regard to isolation and any testing and health monitoring.\n(9) For the purpose of paragraph (3), \u201cdependant\u201d means, in relation to a person\nreferred to under paragraph (1) \u2014\n(a)\nthe spouse or civil partner of that person, or one of the following relations\nof that person, namely a child, step-child, adopted child, grandchild,\nparent, step-parent, grandparent, brother, sister, half-brother, half-sister,\n\nRegulation 5\nControl of Covid-19 (No.3) Regulations, 2021\n\nPage 12\nSL 67 of 2021\nc\n\nbeing, in each case, wholly or substantially dependent upon that person;\nand\n(b) except where the spouse, civil partner or relation referred to under\nsubparagraph (a) is \u2014\n(i)\na Caymanian or resident of the Islands; or\n(ii) a child of a Caymanian or resident of the Islands or a child under the\nguardianship or care of a Caymanian or resident of the Islands and\nwho is travelling with the Caymanian or resident of the Islands,\nas applicable, a spouse, civil partner or relation who, at least fourteen days\nprior to the proposed date of arrival in the Islands of the spouse, civil\npartner or relation, has completed an approved vaccine course.\n(10) A person who contravenes this regulation commits an offence and is liable on\nsummary conviction to a fine of ten thousand dollars or to imprisonment for a\nterm of two years, or to both.\n5.\nOffence of providing false medical certificate or false vaccination certificate\n5.\n(1) A person who, in the purported discharge of the requirement under regulation\n3(2)(b) or 4(2)(b)(ii), provides a customs and border control officer with a false\nor forged medical certificate commits an offence and is liable on summary\nconviction to a fine of ten thousand dollars or to imprisonment for a term of two\nyears, or to both.\n(2) A person who, in purported compliance with regulation 4(2)(b)(i), provides a\ncustoms and border control officer with a false or forged vaccination certificate\ncommits an offence and is liable on summary conviction to a fine of ten\nthousand dollars or to imprisonment for a term of two years, or to both.\n6.\nPower to exempt persons from compliance with regulations 3 or 4\n6.\n(1) Subject to paragraph (2), the Medical Officer of Health may exempt a person or\ncategory of persons from any of the requirements in regulations 3 or 4.\n(2) A person who is exempted under paragraph (1) \u2014\n(a)\nshall comply with the directions of the Medical Officer of Health with\nregard to isolation and any additional health monitoring for the purpose of\nthe prevention, control or suppression of the spread of the virus; and\n(b) who tests positive for the virus or shows respiratory symptoms or\nsymptoms of the virus shall be managed at a place and in such manner as\nspecified by the Medical Officer of Health,\nuntil the Medical Officer of Health determines that the person is not a health\nrisk to the public.\n(3) Where the Medical Officer of Health exempts a person or category of persons\nfrom any of the requirements in regulation 3 or 4, the Medical Officer of Health\n\nControl of Covid-19 (No.3) Regulations, 2021\nRegulation 7\n\nc\nSL 67 of 2021\nPage 13\n\nshall ensure that, not less than once in every three month period, the Cabinet is\nnotified of \u2014\n(a)\nthe number of exemptions granted during that three month period;\n(b) the nature of each exemption granted; and\n(c)\nthe person or category of persons to whom the exemption has been granted.\n(4) A person who contravenes paragraph (2) commits an offence and is liable on\nsummary conviction to a fine of ten thousand dollars or to imprisonment for a\nterm of two years, or to both.\n7.\nPowers, duties and functions of the Medical Officer of Health\n7.\n(1) In carrying out powers, duties and functions under these Regulations, the\nMedical Officer of Health has all the powers, duties and functions specified in\nPart VI of the Act and shall exercise any other relevant powers, duties and\nfunctions specified \u2014\n(a)\nunder regulation 12 of the Public Health (Communicable Diseases)\nRegulations (1997 Revision) which a medical officer would otherwise be\nrequired to exercise; and\n(b) under the Public Health (Quarantine) Regulations (2021 Revision) which\na quarantine officer would otherwise be required to exercise.\n(2) Subject to paragraph (1)(b), the Public Health (Quarantine) Regulations (2021\nRevision) shall apply for the purposes of these Regulations with any necessary\nmodifications.\n(3) Where a person is found to have presented a false or forged vaccination\ncertificate under these Regulations, the person, shall, from a date and for such\nperiod as may be determined by the Medical Officer of Health, for the purpose\nof surveillance by the Medical Officer of Health, remain at a place or facility of\nquarantine or isolation specified by the Medical Officer of Health and be subject\nto such directions as are provided by the Medical Officer of Health.\n8.\nPolice powers\n8.\n(1) A police officer may require a person to answer any questions to enable the\npolice officer to ascertain who the person is and whether the person is complying\nwith these Regulations, and where the person does not satisfy the police officer\nthat the person is complying with these Regulations, the police officer may \u2014\n(a)\ndetain the person and inform the Medical Officer of Health or a person\ndesignated by the Medical Officer of Health of the fact that a person has\nbeen so detained; and\n(b) convey the person to a place or facility of quarantine or isolation, if so\ndirected by the Medical Officer of Health.\n(2) The powers in paragraph (1) may be exercised where a person is at any place.\n\nRegulation 9\nControl of Covid-19 (No.3) Regulations, 2021\n\nPage 14\nSL 67 of 2021\nc\n\n(3) For the purposes of exercising the powers in paragraph (1), a police officer may\nenter any place or facility of quarantine or isolation, including a private\nresidence specified as such under these Regulations, or a multi-dwelling\npremises in which such a private residence is located.\n(4) A police officer may use reasonable force, if necessary, in the exercise of the\npolice officer\u2019s powers under this regulation.\n9.\nPayment for place or facility of quarantine or isolation\n9.\n(1) Subject to paragraph (2), a person who is required to stay in a place or facility\nof quarantine or isolation which is operated by Government is liable to pay for\nany costs associated with the person\u2019s accommodation in such a place or facility.\n(2) The following persons who provide evidence that they reside in the Islands and\nwho are required to stay in a place or facility of quarantine or isolation which is\noperated by Government are not required to pay the costs of accommodation at\nthat place or facility \u2014\n(a)\na person who provides evidence that the person is a returning student;\n(b) a person who provides evidence that the person\u2019s travel was for the\npurposes of government business;\n(c)\na person who provides evidence that the purpose of the person\u2019s travel was\nto represent the Islands in a sporting event as part of a national team;\n(d) a person who provides a medical certificate signed by a medical\npractitioner that the person travelled overseas in order to obtain medical\nservices;\n(e)\na person who is a parent, guardian or caregiver who provides evidence that\nthe person travelled overseas for the purposes of taking the person\u2019s child,\nor a child in the person\u2019s care to \u2014\n(i)\nan overseas educational institution; or\n(ii) represent the Islands in a sporting event as part of a national team;\nand\n(f)\na person who provides evidence that the person had responsibility to take\na child or an adult overseas to obtain medical services.\n(3) For the purposes of this regulation \u2014\n\u201cchild\u201d means \u2014\n(a)\na person under the age of eighteen; and\n(b) a person between the age of eighteen and twenty-four years who is\nreceiving instruction at an educational establishment or undergoing\ntraining for a trade, profession or vocation, whether or not while in gainful\nemployment; and\n\u201cparent\u201d includes a step-parent and a foster parent.\n\nControl of Covid-19 (No.3) Regulations, 2021\nRegulation 10\n\nc\nSL 67 of 2021\nPage 15\n\n10.\nMedical certificate or vaccination certificate may be submitted by electronic\nmeans\n10. (1) For the purposes of these Regulations, where a person is required to submit a\nmedical certificate or a vaccination certificate, the certificate may be recorded\nin electronic form and submitted by electronic means.\n(2) For the purposes of this regulation, \u201celectronic\u201d has the meaning assigned by\nsection 2 of the Electronic Transactions Act (2003 Revision).\n11.\nRepeal of the Control of Covid-19 (No. 2) Regulations, 2021\n11. The Control of Covid-19 (No. 2) Regulations, 2021 are repealed.\n12.\nExpiry\n12.
