These Regulations may be cited as the Control of Covid-19 (Vaccination) Regulations, 2021.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_2\", \"num\": \"2.\", \"text\": \"Definitions 2. In these Regulations \u2014 \u201cDepartment\u201d means the department responsible for public health; \u201celectronic\u201d means having electrical, magnetic, optical, electromagnetic or similar capabilities, whether digital, analogue or otherwise; \u201chealth care facility\u201d means premises at which health services are provided by a registered practitioner; \u201chealth services\u201d include clinical examination, nursing care, dental care, the provision of blood and blood products, diagnostic procedures, the provision of medical and surgical services, provision of pharmaceuticals, advice or counselling and any such other service as is provided by a registered practitioner under the Health Practice Act (2021 Revision); Regulation 3 SL 59 of 2021 \u201cmanager\u201d, in relation to a health care facility or a medical tourism facility, includes the owner; \u201cmedical tourism facility\u201d means a health care facility designated by the Cabinet under section 7A(2) of the Health Practice Act (2021 Revision); \u201cregistered practitioner\u201d means any person qualified to practise any of the professions specified in the Health Practice Act (2021 Revision) and registered under the Health Practice Act (2021 Revision); \u201csupply\u201d, in relation to vaccinations, includes the process of administering the vaccinations; and \u201cvirus\u201d means the virus known as SARS-CoV-2 which causes the disease known as Covid-19.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_3\", \"num\": \"3.\", \"text\": \"Conditions for the supply of vaccinations for the virus 3. (1) For the purpose of the control of the virus and the vaccination of persons in the Islands, a registered practitioner, a manager of a health care facility or a manager of a medical tourism facility who intends to supply vaccinations for the virus shall \u2014 (a) prior to supplying vaccinations for the virus, register with the Department for that purpose; (b) ensure that only vaccinations which are approved by the Chief Medical Officer are supplied; (c) ensure that the vaccinations under subparagraph (b) are supplied in the manner approved by the Chief Medical Officer; (d) in accordance with paragraph (2), submit a report to the Medical Officer of Health, which contains the following information \u2014 (i) the number of vaccines administered; (ii) in relation to each person who received the vaccine \u2014 (A) the person\u2019s full name; (B) the person\u2019s date of birth; (C) the person\u2019s sex; (D) whether the person has any comorbidities; (E) the date of the first vaccination of the person; (F) the vaccine name and batch number; and (G) whether the person experienced any adverse event associated with the vaccination; and (iii) any other relevant information which the Medical Officer of Health may request; and Regulation 4 SL 59 of 2021 (e) ensure that a person who is administered the vaccine is provided with proof of vaccination against the virus \u2014 (i) in the form of a certificate, which shall be in a form approved by the Medical Officer of Health; or (ii) by recording the vaccination in the person\u2019s immunisation record card. (2) The report referred to in paragraph (1)(d) shall be submitted to the Medical Officer of Health \u2014 (a) on a weekly basis or, where otherwise required by the Medical Officer of Health, at such intervals as the Medical Officer of Health may specify; (b) by electronic means; and (c) in a form approved by the Medical Officer of Health. (3) A registered practitioner, a manager of a health care facility or a manager of a medical tourism facility who contravenes this regulation commits an offence and is liable on conviction to a fine of ten thousand dollars and to imprisonment for two years. 4. Expiry 4. These Regulations cease to have effect at the end of the period of one year beginning on the day on which they come into force or at such other date as may be specified by Cabinet by notice published in the Gazette.
