Revocation Marine Conservation Directives (2003 Revision) Marine Conservation Directives (2003 Revision) (2003 Revision) Note: In exercise of the powers and functions conferred on the Marine Conservation Board by sections 3 and 4 of the Marine Conservation Law (2003 Revision) and by regulation 5(4) of the Marine Conservation (Marine Parks) Regulations (1996 Revision), the following directives putting into effect the decisions of the Board have been issued for the guidance of the Public. PART I-Introductory 1. These directives may be cited as the Marine Conservation Directives (2003 Revision). Citation PART II-Licensing of Spear Guns 2. In this Part- Definitions in this Part \u201cspecies\u201d means a group, having certain common and permanent characteristics which clearly distinguish it from other groups, the members of which are able to interbreed; and \u201cowner\u2019s licence\u201d has the meaning assigned by directive 4(2). 3. (1) The Board shall not issue any licence to any person who - Limitations upon issue (a) at the time of making application for a licence is less than eighteen years of age; or (b) does not possess Caymanian status. (2) In considering applications for licences from persons other than those disqualified under paragraph (1), the Board shall have regard to all the circumstances of the case, and in particular to whether the applicant has been convicted of any offence against the Law or any regulations thereunder, or of any offence involving violence or the threat of violence. 4. (1) The Board shall issue licences called owner\u2019s licences. Owner\u2019s licence (2) An owner\u2019s licence will license the holder to possess the one of spear gun stated therein and to take marine life with it. 5. (1) The Board, when granting an owner\u2019s licence, shall- User\u2019s licence: conditions (a) fix the maximum number of spear guns that may be possessed under the licence,  to a maximum of one; Marine Conservation Directives (2003 Revision) (b) limit the number of fish that may be taken in any one period of twenty-four hours beginning at midnight to a maximum of three fish; (c) prohibit the use of any spear gun in any replenishment, marine park, environmental zone, lagoon, sound or any body of water which does not exceed twenty feet in depth; (d) prohibit the use of any spear gun within two hundred yards of any dive or snorkel boat flying a dive flag indicating that there are divers in the water; (e) prohibit the use of any spear gun within one mile of  any designated grouper spawning area during the months of November to March inclusive; (f) affix an identification tag to the licensee\u2019s spear gun; and (g) require photographic identification of the licence holder and the spear gun. (2) Possession of a spear gun by an owner\u2019s licence holder in excess of the number permitted under paragraph 1(a) will not be possession licensed by the Board, and will constitute an offence under the Law. 6. Every licence issued by the Board is subject to the following conditions - General conditions (a) it will be for a period of one year, after which the licence holder must reapply to the Board; (b) it will not be transferable; (c) it will prohibit the licence holder from importing or causing to be imported into the Islands any spear gun or any component part for any spear gun; (d) it may be revoked by the Board acting in its absolute discretion; (e) it will prohibit the licence holder from selling, giving or lending the gun to any other person; (f) it will require the licence holder to keep the licence in the licence holder\u2019s presence when spear fishing; and (g) it will prohibit the licence holder from removing or tampering with the identification tag affixed to the spear gun. 7. (1) The Board may revoke a licence issued under this Part if it appears to the Board that- Revocation (a) any material particular on the application for the licence was false; (b) the licence holder is convicted of any offence under the Law or any regulations thereunder; (c)  the licence holder is convicted of any offence involving violence or the threat of violence; or Marine Conservation Directives (2003 Revision) (d) the licence holder contravenes any condition or restriction of the licence, whether or not the licence holder is prosecuted or convicted of any offence in relation to such contravention. (2) Any revocation of a licence will be notified to the licence holder and to the police by notice in writing and such notice will be expressed to terminate the licence fourteen days after service of the notice on the licence holder, and thereafter he will no longer be licensed by the Board. PART III-Licensing of Seine Nets 8. In this Part- Definitions in this Part \u201cseine net\u201d means a net which is buoyed at the top and weighted at the bottom, and which is manipulated to surround schools of fish. 9. Only persons with Caymanian status are eligible for a seine licence. Eligibility 10. (1) The use of seine nets in any area which is designated as a Marine Park Zone, Replenishment Zone or Environmental Zone is not permitted. Conditions (2) The use of seine nets in any part of Little Cayman is not permitted. (3) The use of seine nets in any designated grouper spawning area is not permitted. (4) Seine nets may be used only to take jacks and goggle eyes (carangidae family). The use of seine nets to take any other type of fish is not permitted. (5) Holders of seine net licences shall allow Government officers to collect catch data at all reasonable times. 11. (1) The Board may revoke a licence issued under this Part at any time if it appears to the Board, in its sole discretion, that- Revocation (a) any material particular on the application form was false; (b) the licensee is convicted of any offence under the Law; or (c) the licensee contravenes any condition or restriction of the licence, whether or not the licensee is prosecuted or convicted of any offence related to such contravention. (2) Any revocation of a license will be notified to the licence holder and to the police in writing, and such notice will be expressed to terminate the licence fourteen days after the service of the notice on the licence holder, and thereafter he will no longer be licensed by the Board. Marine Conservation Directives (2003 Revision) PART IV-Commercial Vessels in the Bloody Bay-Jackson Point Marine Park, Little Cayman\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_12\", \"num\": \"12.\", \"text\": \"In this Part- Definitions in this Part \u201ccommercial vessel\u201d means a vessel which is for hire for the carriage of passengers or which is carrying passengers as part of a charter or other commercial venture; \u201cLaw\u201d\u2019 means the Law and regulations made thereunder; \u201clicence\u201d means a licence granted by the Board under directive 14 or 15; \u201clive-aboard vessel\u201d means a commercial vessel equipped with berths and cooking and sanitary facilities and used for the overnight accommodation of passengers; \u201cPark\u201d means the Bloody Bay-Jackson Point Marine Park, Little Cayman, designated as such in the Second Schedule to the Marine Conservation (Marine Parks) Regulations (1996 Revision); and 1996 Revision \u201cwatersports operator\u201d means a person holding a current trade and business licence issued under section 12 of the Trade and Business Licensing Law (2003 Revision) for the trade or business of watersports or water-related recreational activities however so described in the licence. 2003 Revision\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_13\", \"num\": \"13.\", \"text\": \"No commercial vessel will be allowed in the Park without a licence from the Board. Restriction on entry\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_14\", \"num\": \"14.\", \"text\": \"Licences will be granted to all watersports operators who have entered the Park with commercial vessels operators at any time in the six months immediately preceding the 1st December, 1994 provided an application was made to the Board on or before 1st May, 1995. Licence for existing operators\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_15\", \"num\": \"15.\", \"text\": \"Licences will be granted on application to other persons who- Licence for others (a) are watersports operators; and (b) do not employ any person on commercial vessels who has been convicted within a period of two years immediately preceding the date of the application for a licence of any offence under the Law.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_16\", \"num\": \"16.\", \"text\": \"Licences will be granted subject to the following conditions - Licence conditions Marine Conservation Directives (2003 Revision) (a) no commercial vessel exceeding one hundred and ten feet in overall length shall enter the Park or be used to discharge divers or snorkellers in the Park; and (b) a licensee shall not permit- (i) a total of more than four commercial vessels from its operation to discharge divers or snorkellers in the Park during any one day; or (ii) a total of more than fourteen commercial vessels from its operation to discharge divers or snorkellers in the Park in any week, and for the purpose of this condition a week is deemed to start on a Sunday. (3) A licensee shall not permit any of its commercial vessels to enter the Park unless there are fewer than nineteen commercial vessels in the Park at the time. Licensees must liaise between themselves to agree a schedule and ensure that this limit is not exceeded. (4) The maximum number of divers and snorkellers on any one vessel shall be twenty. (5) No commercial vessel shall anchor in the Park. (6) Commercial vessels other than live-aboard vessels shall not use any of the moorings in the Park for a continuous period exceeding two hours and shall not return to the same mooring within one hour of leaving. Live-aboard vessels shall not use any of the moorings in the Park for a continuous period exceeding four hours, between 8 a.m. and 5 p.m. on any one day and shall not return to the same mooring within two hours of leaving. (7) There shall be a divemaster on board every commercial vessel who shall ensure that every diver and snorkeller is aware of the provisions of the Law before he or she enters the waters of the Park. (8) A licensee shall not, without the prior consent of the Board, engage any new employee on any commercial vessel used for carrying passengers to the Park who has been convicted, on or after the 1st January, 1993, of any offence under the Law. This prohibition does not extend to the employment of such a person in an emergency provided he or she is employed for the duration of the emergency only and the circumstances are reported to the Board within the following two working days. (9) Every licensee shall keep a weekly log of all trips to the Park specifying the date, the vessel, the number of divers and snorkellers and the times Marine Conservation Directives (2003 Revision) spent at each site visited. A copy of the log shall be delivered to the Sister Islands Marine Enforcement Officer or, in his absence, the District Officer of Little Cayman within seven days of the end of the month to which the log relates. (10) Any dispute arising from these conditions shall be referred to the Sister Islands Marine Enforcement Officer or, in his absence, to the District Officer of Little Cayman whose decision shall be final, subject only to an appeal to the Board. The decision of the Officer shall remain effective pending the outcome of any appeal. (11) Any breach of these conditions shall entitle the Board to suspend or revoke the licence. (12) Any person whose licence has been revoked shall not be entitled to apply for a new licence within a period of six months or, in the case of a second or subsequent revocation, within a period of five years from the date of revocation. (13) These conditions may be amended, from time to time, by the Board. or\n(b) does not possess Caymanian status.\n(2) In considering applications for licences from persons other than those\ndisqualified under paragraph (1), the Board shall have regard to all the\ncircumstances of the case, and in particular to whether the applicant has been\nconvicted of any offence against the Law or any regulations thereunder, or of any\noffence involving violence or the threat of violence.\n4.\n(1) The Board shall issue licences called owner\u2019s licences.\nOwner\u2019s licence\n(2) An owner\u2019s licence will license the holder to possess the one of spear\ngun stated therein and to take marine life with it.\n5.\n(1) The Board, when granting an owner\u2019s licence, shall-\nUser\u2019s licence:\nconditions\n(a) fix the maximum number of spear guns that may be possessed\nunder the licence,  to a maximum of one;\n\n5\n\nMarine Conservation Directives (2003 Revision)\n\n(b) limit the number of fish that may be taken in any one period of\ntwenty-four hours beginning at midnight to a maximum of three\nfish;\n(c) prohibit the use of any spear gun in any replenishment, marine\npark, environmental zone, lagoon, sound or any body of water\nwhich does not exceed twenty feet in depth;\n(d) prohibit the use of any spear gun within two hundred yards of\nany dive or snorkel boat flying a dive flag indicating that there\nare divers in the water;\n(e) prohibit the use of any spear gun within one mile of  any\ndesignated grouper spawning area during the months of\nNovember to March inclusive;\n(f)\naffix an identification tag to the licensee\u2019s spear gun; and\n(g) require photographic identification of the licence holder and the\nspear gun.\n(2) Possession of a spear gun by an owner\u2019s licence holder in excess of the\nnumber permitted under paragraph 1(a) will not be possession licensed by the\nBoard, and will constitute an offence under the Law.\n6.\nEvery licence issued by the Board is subject to the following conditions -\nGeneral conditions\n(a) it will be for a period of one year, after which the licence holder\nmust reapply to the Board;\n(b) it will not be transferable;\n(c) it will prohibit the licence holder from importing or causing to be\nimported into the Islands any spear gun or any component part\nfor any spear gun;\n(d) it may be revoked by the Board acting in its absolute discretion;\n(e) it will prohibit the licence holder from selling, giving or lending\nthe gun to any other person;\n(f)\nit will require the licence holder to keep the licence in the licence\nholder\u2019s presence when spear fishing; and\n(g) it will prohibit the licence holder from removing or tampering\nwith the identification tag affixed to the spear gun.\n7.\n(1) The Board may revoke a licence issued under this Part if it appears to\nthe Board that-\nRevocation\n(a) any material particular on the application for the licence was\nfalse;\n(b) the licence holder is convicted of any offence under the Law or\nany regulations thereunder;\n(c)  the licence holder is convicted of any offence involving violence\nor the threat of violence; or\n\n6\n\nMarine Conservation Directives (2003 Revision)\n\n(d) the licence holder contravenes any condition or restriction of the\nlicence, whether or not the licence holder is prosecuted or\nconvicted of any offence in relation to such contravention.\n(2) Any revocation of a licence will be notified to the licence holder and to\nthe police by notice in writing and such notice will be expressed to terminate the\nlicence fourteen days after service of the notice on the licence holder, and\nthereafter he will no longer be licensed by the Board.\nPART III-Licensing of Seine Nets\n8.\nIn this Part-\nDefinitions in this Part\n\u201cseine net\u201d means a net which is buoyed at the top and weighted at the bottom,\nand which is manipulated to surround schools of fish.\n9.\nOnly persons with Caymanian status are eligible for a seine licence.\nEligibility\n10. (1) The use of seine nets in any area which is designated as a Marine Park\nZone, Replenishment Zone or Environmental Zone is not permitted.\nConditions\n(2) The use of seine nets in any part of Little Cayman is not permitted.\n(3) The use of seine nets in any designated grouper spawning area is not\npermitted.\n(4) Seine nets may be used only to take jacks and goggle eyes (carangidae\nfamily). The use of seine nets to take any other type of fish is not permitted.\n(5) Holders of seine net licences shall allow Government officers to\ncollect catch data at all reasonable times.\n11. (1) The Board may revoke a licence issued under this Part at any time if it\nappears to the Board, in its sole discretion, that-\nRevocation\n(a) any material particular on the application form was false;\n(b) the licensee is convicted of any offence under the Law; or\n(c) the licensee contravenes any condition or restriction of the\nlicence, whether or not the licensee is prosecuted or convicted of\nany offence related to such contravention.\n(2) Any revocation of a license will be notified to the licence holder and to\nthe police in writing, and such notice will be expressed to terminate the licence\nfourteen days after the service of the notice on the licence holder, and thereafter\nhe will no longer be licensed by the Board.\n\n7\n\nMarine Conservation Directives (2003 Revision)\n\nPART IV-Commercial Vessels in the Bloody Bay-Jackson Point Marine\nPark, Little Cayman\n12. In this Part-\nDefinitions in this Part\n\u201ccommercial vessel\u201d means a vessel which is for hire for the carriage of\npassengers or which is carrying passengers as part of a charter or other\ncommercial venture;\n\u201cLaw\u201d\u2019 means the Law and regulations made thereunder;\n\u201clicence\u201d means a licence granted by the Board under directive 14 or 15;\n\u201clive-aboard vessel\u201d means a commercial vessel equipped with berths and\ncooking and sanitary facilities and used for the overnight accommodation of\npassengers;\n\u201cPark\u201d means the Bloody Bay-Jackson Point Marine Park, Little Cayman,\ndesignated as such in the Second Schedule to the Marine Conservation (Marine\nParks) Regulations (1996 Revision); and\n1996 Revision\n\u201cwatersports operator\u201d means a person holding a current trade and business\nlicence issued under section 12 of the Trade and Business Licensing Law (2003\nRevision) for the trade or business of watersports or water-related recreational\nactivities however so described in the licence.\n2003 Revision\n13. No commercial vessel will be allowed in the Park without a licence from the\nBoard.\nRestriction on entry\n14. Licences will be granted to all watersports operators who have entered the\nPark with commercial vessels operators at any time in the six months immediately\npreceding the 1st December, 1994 provided an application was made to the Board\non or before 1st May, 1995.\nLicence for existing\noperators\n15. Licences will be granted on application to other persons who-\nLicence for others\n(a) are watersports operators; and\n(b) do not employ any person on commercial vessels who has been\nconvicted within a period of two years immediately preceding the\ndate of the application for a licence of any offence under the\nLaw.\n16. Licences will be granted subject to the following conditions -\nLicence conditions\n\n8\n\nMarine Conservation Directives (2003 Revision)\n\n(a) no commercial vessel exceeding one hundred and ten feet in\noverall length shall enter the Park or be used to discharge divers\nor snorkellers in the Park; and\n(b) a licensee shall not permit-\n\n(i) a total of more than four commercial vessels from its\noperation to discharge divers or snorkellers in the Park\nduring any one day; or\n\n(ii) a total of more than fourteen commercial vessels from its\noperation to discharge divers or snorkellers in the Park in\nany week, and for the purpose of this condition a week is\ndeemed to start on a Sunday.\n(3) A licensee shall not permit any of its commercial vessels to enter the\nPark unless there are fewer than nineteen commercial vessels in the Park at the\ntime. Licensees must liaise between themselves to agree a schedule and ensure\nthat this limit is not exceeded.\n(4) The maximum number of divers and snorkellers on any one vessel\nshall be twenty.\n(5) No commercial vessel shall anchor in the Park.\n(6) Commercial vessels other than live-aboard vessels shall not use any of\nthe moorings in the Park for a continuous period exceeding two hours and shall\nnot return to the same mooring within one hour of leaving. Live-aboard vessels\nshall not use any of the moorings in the Park for a continuous period exceeding\nfour hours, between 8 a.m. and 5 p.m. on any one day and shall not return to the\nsame mooring within two hours of leaving.\n(7) There shall be a divemaster on board every commercial vessel who\nshall ensure that every diver and snorkeller is aware of the provisions of the Law\nbefore he or she enters the waters of the Park.\n(8) A licensee shall not, without the prior consent of the Board, engage\nany new employee on any commercial vessel used for carrying passengers to the\nPark who has been convicted, on or after the 1st January, 1993, of any offence\nunder the Law. This prohibition does not extend to the employment of such a\nperson in an emergency provided he or she is employed for the duration of the\nemergency only and the circumstances are reported to the Board within the\nfollowing two working days.\n(9) Every licensee shall keep a weekly log of all trips to the Park\nspecifying the date, the vessel, the number of divers and snorkellers and the times\n\n9\n\nMarine Conservation Directives (2003 Revision)\n\nspent at each site visited. A copy of the log shall be delivered to the Sister Islands\nMarine Enforcement Officer or, in his absence, the District Officer of Little\nCayman within seven days of the end of the month to which the log relates.\n(10) Any dispute arising from these conditions shall be referred to the Sister\nIslands Marine Enforcement Officer or, in his absence, to the District Officer of\nLittle Cayman whose decision shall be final, subject only to an appeal to the\nBoard. The decision of the Officer shall remain effective pending the outcome of\nany appeal.\n(11) Any breach of these conditions shall entitle the Board to suspend or\nrevoke the licence.\n(12) Any person whose licence has been revoked shall not be entitled to\napply for a new licence within a period of six months or, in the case of a second\nor subsequent revocation, within a period of five years from the date of\nrevocation.\n(13) These conditions may be amended, from time to time, by the Board.\nThe Board shall give written notice of any amendments to the licensee at the\naddress specified in the licence.\n17. Whoever enters the Park with a commercial vessel without a licence is\nguilty an offence under section 25 and liable on summary conviction to a fine of\nfive hundred thousand dollars and to imprisonment for six months.\nPenalty\nPart V-Licensing of Fish Pots\n18. Only persons possessing Caymanian status over the age of eighteen are\neligible for the grant of a licence to use a fish pot, and the Board shall not grant a\nlicence to any person to use more that two fish pots.\nLicence for use of fish\npots\n19. The Board shall grant a licence to use a fish pot subject to the following\nconditions-\nLicence conditions\n(a) the fish pot shall have no more than one entry funnel;\n(b) the fish pot shall not exceed two feet in height by four feet in\nwidth by four feet in length;\n(c) the minimum mesh size of the fish pot shall be a vertically\noriented two and one-quarter inch mesh opening on all sides of\nthe fish pot;\n(d) the trap door of the fish pot shall be not less than eight and onehalf inches height by eleven inches in width and shall be hinged\n\n10\n\nMarine Conservation Directives (2003 Revision)\n\nat the bottom and secured only by corrosible wire or by\ndecomposable cord;\n(e) the fish pot shall bear a tag issued by the Board;\n(f)\nthe licence shall be for a period of one year; and\n(g) the licence shall not be transferable.\n20.
