(1) This Act may be cited as the Pharmacy Act, 2024. (2) This Act comes into force on such date as may be appointed by Order made by the Cabinet and different dates may be appointed for different provisions of this Act and in relation to different matters.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_2\", \"num\": \"2.\", \"text\": \"Interpretation 2. In this Act \u2014 \u201cadminister\u201d, in relation to a substance, means to apply, inject, insert or otherwise introduce the substance to the body of a human being or animal, in its existing state or after it has been dissolved, dispensed in, diluted or mixed with another substance; I Assent, Franz Manderson Acting Governor Date: 15th August, 2024 \u201canimal\u201d means a mammal, bird, reptile, amphibian or fish, but does not include a human being; \u201capproved form\u201d means a form approved by the registrar under section 37; \u201capproved medicine\u201d means a medicine \u2014 (a) approved by a corresponding authority of a country prescribed by the regulations; (b) approved by the Council under section 12; or (c) taken to be an approved medicine under section 13 or 14; \u201cassemble\u201d, in relation to a medicine, means \u2014 (a) to enclose the medicine, with or without other medicines, in a container that is labelled before the medicine is supplied; or (b) if the medicine is already enclosed in the container in which it is to be supplied, to label the container before it is supplied; \u201cauthorized dispenser\u201d means a person who is permitted to dispense a pharmacy medicine or prescription-only medicine under section 6(1); \u201ccertified pharmacy\u201d means a pharmacy that is a certified health care facility under section 5 of the Health Practice Act (2021 Revision); \u201cChief Medical Officer\u201d means the person appointed to the position of that title in the ministry responsible for health; \u201cChief Nursing Officer\u201d means the person appointed to the position of that title in the ministry responsible for health; \u201ccompound\u201d, in relation to a medicine, means to prepare, mix, alter or assemble multiple ingredients to make the medicine in order to dispense the medicine; \u201cconstable\u201d has the meaning assigned by section 2 of the Police Act (2021 Revision); \u201ccorresponding authority\u201d means the authority of another country that performs corresponding functions to those of the Council under this Act; \u201cCouncil\u201d means the Pharmacy Council established under section 21 of the Health Practice Act (2021 Revision); \u201cdispense\u201d, in relation to a medicine, means to supply the medicine, in the course of business or of providing professional services, to a person for the purpose of the medicine being self-administered by the person or administered to an animal; \u201cdispensing licence\u201d means a licence referred to in section 6 and issued under section 9; \u201cemergency use authorization\u201d means an authorization issued by the Cabinet under section 14; \u201cexceptional use authorization\u201d means an authorization issued by the Council under section 13; \u201cGovernment entity\u201d means any body of Government and includes a ministry, portfolio, statutory authority, company, board, department or office; \u201cimport\u201d means import into the Islands; \u201cinspector\u201d means a person appointed to be an inspector under section 32; \u201cinternet or mail-order pharmacy\u201d means a pharmacy that \u2014 (a) operates by way of online or mail-order sales; and (b) does not have a physical premises where in-person pharmacy services are provided; \u201clicence\u201d means a dispensing licence, a manufacturing licence, a product licence or a wholesale licence; \u201cmanufacturing licence\u201d means a licence referred to in section 4 and issued under section 9; \u201cmedicine\u201d means \u2014 (a) a substance or combination of substances \u2014 (i) presented as having properties of preventing or treating disease in human beings or animals; or (ii) that may be administered to human beings or animals with a view to restoring, correcting or modifying a physiological function by exerting a pharmacological, immunological or metabolic action, or making a medical diagnosis; or (b) a preparation developed from autologous or allogeneic biological materials; \u201cnarcotic\u201d means any of the following \u2014 (a) a drug included on the Yellow List of Narcotic Drugs Under International Control prepared by the International Narcotics Control Board; or (b) a controlled drug under the Misuse of Drugs Act (2017 Revision); \u201cnon-approved medicine\u201d means a medicine other than an approved medicine; \u201cpharmacist\u201d means a person who, under the Health Practice Act (2021 Revision) \u2014 (a) is registered to practice the profession of pharmacy; and (b) holds a practising licence to do so; \u201cpharmacy medicine\u201d means a medicine prescribed as a pharmacy medicine by the regulations; \u201cpoison\u201d means a substance prescribed to be a poison by the regulations; \u201cprescriber\u201d means \u2014 (a) a registered practitioner who is a medical doctor or dentist; (b) any other registered practitioner prescribed by the regulations; or (c) a veterinary surgeon; \u201cprescription\u201d means a verbal or written instruction (including an instruction issued electronically) authorizing the dispensing of a medicine; \u201cprescription-only medicine\u201d means medicine prescribed as a prescriptiononly medicine by the regulations; \u201cregistered practitioner\u201d has the meaning assigned by section 2 of the Health Practice Act (2021 Revision); \u201cregistrar\u201d has the meaning assigned by section 2 of the Health Practice Act (2021 Revision); \u201cscope of practice\u201d, in relation to a registered practitioner, means the practitioner\u2019s scope of practice under a code mentioned in section 35 of the Health Practice Act (2021 Revision); \u201cship\u2019s physician\u201d means a medical doctor employed to practise on board a commercial cruise ship or military vessel; \u201csupply\u201d includes sell; \u201cveterinary surgeon\u201d has the meaning assigned by section 2 of the Veterinary Act (1997 Revision); and \u201cwholesale licence\u201d means a licence referred to in section 5 and issued under section 9. PART 2 - LICENCES AND AUTHORIZATIONS Division 1 - Licence requirements\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_3\", \"num\": \"3.\", \"text\": \"Importing medicines 3. (1) A person may import an approved medicine as follows \u2014 (a) a pharmacist may import an approved medicine for the purpose of dispensing it; (b) a registered practitioner who is authorized to administer an approved medicine within the registered practitioner\u2019s scope of practice may import the medicine for the purpose of administering the medicine to the practitioner\u2019s patients in quantities that are appropriate for the size of the practitioner\u2019s practice; (c) under section 4(2)(a), the holder of a manufacturing licence for the manufacture of an approved medicine may import the ingredients (which may be medicines) specified in the licence for the purpose of manufacturing the medicine; (d) under section 5(2), the holder of a wholesale licence to sell an approved medicine by wholesale may import the medicine for the purpose of selling it; (e) under section 6(2), the holder of a dispensing licence to dispense an approved medicine may import the medicine for the purpose of dispensing it; (f) a person may import an approved medicine for self-administration if the following conditions are met \u2014 (i) the quantity of the medicine is not of commercial value; (ii) the medicine is contained in the original manufacturer\u2019s packaging or the container in which it was dispensed by a pharmacy and is labelled with a full description of the contents; and (g) the Chief Medical Officer or the Director of Agriculture may import an approved medicine. (2) A person who imports a medicine except as specified in this section commits an offence and is liable on conviction to a fine of ten thousand dollars or to imprisonment for a term of two years, or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_4\", \"num\": \"4.\", \"text\": \"Manufacturing licence 4. (1) Subject to subsection (3), a person shall not manufacture a medicine except in accordance with a manufacturing licence. (2) A manufacturing licence authorizes the holder of the licence to do any of the following in addition to manufacturing each medicine specified in the licence without an additional licence \u2014 (a) import the ingredients specified in the licence for the purpose of manufacturing the medicine; and (b) sell the medicine by wholesale. (3) A person specified in section 17(1) does not require a manufacturing licence to compound a medicine. (4) A person who contravenes subsection (1) commits an offence and is liable on conviction to a fine of twenty thousand dollars or to imprisonment for a term of five years, or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_5\", \"num\": \"5.\", \"text\": \"Wholesale licence 5. (1) Subject to subsection (3), a person shall not sell an approved medicine by wholesale except in accordance with a wholesale licence. (2) A wholesale licence authorizes the holder of the licence to import, for the purpose of selling by wholesale, each medicine or class of medicines permitted to be sold by wholesale under the licence without an additional licence. (3) The holder of a manufacturing licence may sell a medicine specified in the licence by wholesale without a wholesale licence. (4) A person who contravenes subsection (1) commits an offence and is liable on conviction to a fine of twenty thousand dollars or to imprisonment for a term of five years, or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_6\", \"num\": \"6.\", \"text\": \"Dispensing licence 6. (1) A person shall not dispense a pharmacy medicine or a prescription-only medicine unless \u2014 (a) the person is a pharmacist or acting under the supervision of a pharmacist; or (b) the person does so in accordance with a dispensing licence. (2) A dispensing licence authorizes the holder of the licence to import, for the purpose of dispensing, each medicine or class of medicines permitted to be dispensed under the licence without an additional licence. (3) Section 26 contains additional requirements for dispensing prescription-only medicines. (4) A person who contravenes subsection (1) commits an offence and is liable on conviction to a fine of twenty thousand dollars or to imprisonment for a term of five years, or to both. Division 2 - Licence applications\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_7\", \"num\": \"7.\", \"text\": \"Application for licence 7. (1) A person may apply to the Council for a licence. (2) The application shall be \u2014 (a) made in the approved form; and (b) accompanied by the prescribed fee and any documents prescribed by the regulations.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_8\", \"num\": \"8.\", \"text\": \"Criteria for issuing licence 8. (1) The criteria for issuing a manufacturing licence are as follows \u2014 (a) that the premises and equipment to be used for manufacturing operations under the licence are suitable for purpose; (b) that the manufacturing operations are to be supervised by a person who holds the qualifications prescribed by the regulations; (c) that adequate records are to be kept of the operations and output; and (d) any other criteria prescribed by the regulations. (2) The criteria for issuing a wholesale licence are as follows \u2014 (a) that the premises and equipment to be used for storing and distributing medicines under the licence are suitable for purpose; (b) that a pharmacist is to supervise the storage and distribution of medicines; (c) that adequate records are to be kept of the storage and distribution of medicines; and (d) any other criteria prescribed by the regulations. (3) The criteria for issuing a dispensing licence are as follows \u2014 (a) that the premises and equipment to be used for storing and dispensing medicines under the licence are suitable for purpose; (b) that a registered practitioner acting within the registered practitioner\u2019s scope of practice is to supervise the storage and dispensing of medicines; (c) that adequate records are to be kept of the storage and dispensing of medicines; (d) that adequate arrangements are in place for providing appropriate information to patients to whom medicines are dispensed; (e) that a pharmacist, acting as a consultant, is to be available to advise the licence holder on dispensing medicines and to consult with patients when required; and (f) any other criteria prescribed by the regulations.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_9\", \"num\": \"9.\", \"text\": \"Decision on licence application 9. The Council shall assess an application under section 7 and \u2014 (a) issue the licence if satisfied that the applicant \u2014 (i) meets the criteria for the issue of the licence specified in section 8; and (ii) is otherwise a fit and proper person to hold the licence; or (b) refuse the application and give the applicant written notice of the refusal, including the reasons for it.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_10\", \"num\": \"10.\", \"text\": \"Duration and conditions of licence 10. (1) A licence may be issued for the period, not exceeding three years, specified in it and may be renewed. (2) A licence is subject to any conditions prescribed by the regulations and any additional conditions and limitations specified in it.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_11\", \"num\": \"11.\", \"text\": \"Variation, suspension and revocation of licence 11. (1) The Council may vary the conditions of a licence if \u2014 (a) the Council becomes aware of information that, had it been known when the licence was issued, would have resulted in different or additional conditions being imposed on the licence; or (b) the holder of the licence has breached a condition of the licence and the Council believes the variation is necessary to reduce the risk of a further breach. (2) Before deciding to vary the conditions of a licence, the Council shall \u2014 (a) give written notice to the holder of the licence \u2014 (i) of the reasons for, and particulars of, the proposed variation; and (ii) that the holder may make written submissions to the Council about the proposed variation within a reasonable period of at least twentyone days stated in the notice; and (b) have regard to any written submissions made by the holder within the stated period. (3) The Council may revoke a licence if \u2014 (a) the Council becomes aware of information that, had it been known when the application for the licence was made, would have resulted in the application being refused; or (b) the holder of the licence has breached a condition of the licence in such a serious manner that the Council believes the licence should be revoked. (4) Before deciding to revoke the licence, the Council \u2014 (a) shall give written notice to the holder of the licence \u2014 (i) of the reasons for the proposed revocation; and (ii) that the holder may make written submissions to the Council about the proposed revocation within a reasonable period of at least twentyone days stated in the notice; and (b) may suspend the licence during the period stated in the notice; and (c) shall have regard to any written submissions made by the holder within the stated period. (5) If the Council decides to vary, suspend or revoke a licence, the Council must give the holder written reasons for the decision. Division 3 - Medicine approval and authorization\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_12\", \"num\": \"12.\", \"text\": \"Medicine approval 12. The Council may approve a medicine for the purposes of this Act if the Council is satisfied that the medicine \u2014 (a) is safe and effective for the purpose for which it is intended to be administered; (b) is of good quality, according to the specification and method or proposed method of manufacture, and will be of good quality when sold and dispensed; and (c) meets any other criteria prescribed by the regulations.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_13\", \"num\": \"13.\", \"text\": \"Exceptional use authorization 13. (1) The Council may, on application by a prescriber, issue an exceptional use authorization for a non-approved medicine if the Council is satisfied that \u2014 (a) exceptional circumstances exist requiring the medicine to be made available; and (b) the medicine is safe and effective for the purpose for which it is intended to be administered. (2) The non-approved medicine is taken to be an approved medicine for the purposes of this Act for the duration of the exceptional use authorization. (3) The exceptional use authorization \u2014 (a) may be issued for the use of the medicine generally or be limited to the administration of the medicine to a specified patient or class of patients; and (b) is subject to the conditions and limitations specified in it.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_14\", \"num\": \"14.\", \"text\": \"Emergency use authorization 14. (1) The Cabinet may, by notice published in the Gazette, issue an emergency use authorization for a non-approved medicine. (2) The non-approved medicine is taken to be an approved medicine for the purposes of this Act for the duration of the emergency use authorization. (3) The emergency use authorization is subject to the conditions and limitations specified in it. PART 3 - DEALING WITH MEDICINES Division 1 - Medicines generally\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_15\", \"num\": \"15.\", \"text\": \"Dealing with non-approved medicine 15. (1) A person shall not \u2014 (a) import; (b) sell by wholesale; (c) dispense; (d) prescribe; (e) administer; or (f) manufacture, a non-approved medicine. (2) A person who contravenes subsection (1) commits an offence and is liable on conviction to a fine of twenty thousand dollars or to imprisonment for a term of five years, or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_16\", \"num\": \"16.\", \"text\": \"Supplying a medicine 16. (1) Subject to subsection (2), a person shall not supply a medicine by retail unless \u2014 (a) the person \u2014 (i) is a pharmacist, or is acting under the supervision of a pharmacist; and (ii) supplies the medicine from a certified pharmacy; or (b) the person does so in accordance with a dispensing licence. (2) Subsection (1) does not apply to the supply of a medicine in the following circumstances \u2014 (a) the supply is made from premises capable of being contained and locked so as to exclude the public; and (b) the medicine \u2014 (i) has been prepared for retail supply and placed in a container or package that has not been opened since the medicine was prepared; (ii) is supplied under the authority of the person holding a manufacturing or wholesale licence for the medicine; and (iii) is not a pharmacy medicine, prescription-only medicine or narcotic. (3) A person who contravenes subsection (1) commits an offence and is liable on conviction to a fine of twenty thousand dollars or to imprisonment for a term of five years, or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_17\", \"num\": \"17.\", \"text\": \"Compounding a medicine 17. (1) A person shall not compound a medicine unless the person is \u2014 (a) a pharmacist; (b) acting under the supervision of a pharmacist; (c) the holder of a dispensing licence who is authorized to compound the medicine under the licence; (d) a registered practitioner acting within the registered practitioner\u2019s scope of practice; or (e) a veterinary surgeon acting within the veterinary surgeon\u2019s scope of practice. (2) A person who contravenes subsection (1) commits an offence and is liable on conviction to a fine of twenty thousand dollars or to imprisonment for a term of five years, or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_18\", \"num\": \"18.\", \"text\": \"Altering a medicine 18. (1) A person shall not \u2014 (a) alter the composition of a medicine with the intention of supplying the medicine to another person; or (b) supply, or possess with the intention of supplying, a medicine with an altered composition. (2) A person who contravenes subsection (1) commits an offence and is liable on conviction to a fine of twenty thousand dollars or to imprisonment for a term of five years, or to both. (3) Subsection (1) is not contravened only because a medicine contains extraneous matter as a result of the process of manufacturing or compounding the medicine.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_19\", \"num\": \"19.\", \"text\": \"Labelling of medicine 19. (1) A person shall not supply, or possess with the intention of supplying, a medicine in a container that is labelled in a way that \u2014 (a) falsely describes the medicine; (b) is likely to be misleading in relation to the nature, efficacy or quality of the medicine; or (c) does not meet the requirements prescribed by the regulations for the labelling of the medicine. (2) A person who contravenes subsection (1) commits an offence and is liable on conviction to a fine of ten thousand dollars or to imprisonment for a term of two years, or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_20\", \"num\": \"20.\", \"text\": \"Information accompanying medicine 20. (1) A person shall not supply with a medicine, or possess with the intention of supplying with a medicine, written information (whether contained in a leaflet or otherwise) that \u2014 (a) falsely describes the medicine; (b) is likely to be misleading in relation to the nature, efficacy or quality of the medicine; or (c) does not meet the requirements prescribed by the regulations or specified in the Misuse of Drugs Act (2017 Revision) for information accompanying the medicine. (2) Subject to subsection (3), a person shall not supply a medicine unless the medicine is supplied with a patient information leaflet written in English. (3) The Chief Medical Officer may, on a case-by-case basis, issue an exemption from the requirement to supply a medicine with a patient information leaflet written in English if it is not reasonably practicable to comply with the requirement. (4) A person who contravenes subsection (1) or (2) commits an offence and is liable on conviction to a fine of ten thousand dollars or to imprisonment for a term of two years, or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_21\", \"num\": \"21.\", \"text\": \"Vending machines 21. (1) A person (\u201cperson A\u201d) shall not \u2014 (a) install a vending machine on premises occupied by person A for the purpose of supplying a pharmacy medicine, prescription-only medicine or narcotic; (b) dispense a pharmacy medicine, prescription-only medicine or narcotic using a vending machine; or (c) allow another person to install a vending machine on premises occupied by person A for the purpose of supplying a pharmacy medicine, prescription-only medicine or narcotic. (2) A person who contravenes subsection (1) commits an offence and is liable on conviction to a fine of ten thousand dollars or to imprisonment for a term of two years, or to both. (3) In this section, \u201cvending machine\u201d means a machine or device from which a product can be obtained, including by \u2014 (a) electronic funds transfer; or (b) inserting money, a token or something else.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_22\", \"num\": \"22.\", \"text\": \"Internet and mail order pharmacies 22. (1) A person shall not dispense a pharmacy medicine or prescription-only medicine from an internet or mail-order pharmacy. (2) A person who contravenes subsection (1) commits an offence and is liable on conviction to a fine of twenty thousand dollars or to imprisonment for a term of five years, or to both. Division 2 - Pharmacy medicines, prescription-only medicines and other restricted products\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_23\", \"num\": \"23.\", \"text\": \"Wholesale of pharmacy or prescription-only medicine 23. (1) The holder of a wholesale licence or a manufacturing licence shall not sell a pharmacy medicine or a prescription-only medicine by wholesale except to \u2014 (a) a pharmacist operating a certified pharmacy; (b) the holder of a dispensing licence; (c) in the case of a pharmacy medicine, a registered practitioner who is authorized to administer the medicine within the registered practitioner\u2019s scope of practice; (d) in the case of a prescription-only medicine, a prescriber who is authorized to administer the medicine within the prescriber\u2019s scope of practice; or (e) a Government entity that is authorized by law to use the medicine. (2) A person who contravenes subsection (1) commits an offence and is liable on conviction to a fine of twenty thousand dollars or to imprisonment for a term of five years, or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_24\", \"num\": \"24.\", \"text\": \"Prescribing medicine 24. (1) Subject to subsection (2), a person shall not issue a prescription unless \u2014 (a) the person is a prescriber acting within the prescriber\u2019s scope of practice; and (b) if the prescription is for a narcotic, the prescriber complies with the requirements prescribed by the regulations for prescribing narcotics. (2) A ship\u2019s physician who is not a registered practitioner may issue a prescription for the supply (not exceeding a seven-day supply or, if the medicine is packaged in units that each exceed a seven-day supply, a single unit), of a medicine other than a narcotic, but may not authorize a refill of the prescription. (2) A person who contravenes subsection (1) commits an offence and is liable on conviction to a fine of ten thousand dollars or to imprisonment for a term of two years, or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_26\", \"num\": \"26.\", \"text\": \"Dispensing a prescription-only medicine 26. (1) Subject to subsection (2), an authorized dispenser shall not dispense a prescription-only medicine unless \u2014 (a) the person does so in accordance with a prescription issued within \u2014 (i) twelve months before the date of dispensing the medicine; or (ii) if the regulations prescribe a different period, that period; and (b) if the medicine is a narcotic, the person complies with the requirements prescribed by the regulations for dispensing narcotics. (2) Notwithstanding subsection (1) \u2014 (a) a prescriber may dispense a prescription-only medicine to the prescriber\u2019s patients in accordance with a dispensing licence; (b) a veterinary surgeon may dispense a prescription-only medicine within the scope of the veterinary surgeon\u2019s practice; or (c) a pharmacist may dispense a supply of a prescription-only medicine without a prescription (\u201cemergency supply\u201d) if the following conditions are satisfied \u2014 (i) the medicine is not a narcotic; (ii) the medicine is essential to maintaining the patient\u2019s life or continuing therapy and, in the professional opinion of the pharmacist, interrupting the therapy would be detrimental to the patient\u2019s wellbeing; (iii) the request for the emergency supply has not been made immediately after a previous emergency supply of the medicine was given and used; (iv) the pharmacist makes a complete record of the particulars of the supply; and (v) the amount dispensed does not exceed a fourteen-day supply or, if the medicine is packaged in units that each exceed a fourteen-day supply, a single unit. (3) A person who contravenes subsection (1) commits an offence and is liable on conviction to a fine of ten thousand dollars or to imprisonment for a term of two years, or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_27\", \"num\": \"27.\", \"text\": \"Interchangeable and bio-equivalent generic medicines 27. (1) Subject to subsection (3), an authorized dispenser may substitute an interchangeable and bio-equivalent generic medicine for a product specified in a prescription if the authorized dispenser \u2014 (a) informs the patient; and (b) labels the container of the medicine with the name of the medicine dispensed rather than the brand name of the medicine prescribed. (2) A medicine is an interchangeable and bio-equivalent generic medicine in relation to a specified product if it \u2014 (a) is an approved medicine; and (b) has the same active ingredient, in the same strength and the same dosage, as the specified product. (3) An authorized dispenser shall not substitute an interchangeable and bioequivalent medicine if the substitution is prohibited by the regulations. (4) A person who contravenes subsection (1) or (3) commits an offence and is liable on conviction to a fine of five thousand dollars or to imprisonment for a term of one year, or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_28\", \"num\": \"28.\", \"text\": \"Dispensing samples 28. (1) A person shall not administer a prescription-only medicine to another person unless the person is \u2014 (a) the prescriber of the medicine; (b) acting in accordance with the written directions of the prescriber of the medicine; or (c) a registered practitioner acting within the registered practitioner\u2019s scope of practice. (2) A person who contravenes subsection (1) commits an offence and is liable on conviction to a fine of ten thousand dollars or to imprisonment for a term of two years, or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_30\", \"num\": \"30.\", \"text\": \"Possessing a prescription-only medicine 30. (1) A person shall not possess a prescription-only medicine unless the person \u2014 (a) has a prescription for the medicine in the person\u2019s name; (b) is acting under the directions of a person who holds a prescription for the medicine; (c) is an authorized dispenser; (d) is a registered practitioner who, acting within the registered practitioner\u2019s scope of practice, may dispense the medicine; (e) is a veterinary surgeon who, acting within the veterinary surgeon\u2019s scope of practice, may dispense the medicine; (f) is acting under the written directions of a prescriber; or (g) holds a manufacturing or wholesale licence for the medicine. (2) A person who contravenes subsection (1) commits an offence and is liable on conviction to a fine of five thousand dollars or to imprisonment for a term of one year, or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_31\", \"num\": \"31.\", \"text\": \"Supply and labelling of poison 31. (1) The Council may, in accordance with the requirements of the regulations, certify a person to be a person who may possess a poison. (2) A person (\u201cperson A\u201d) shall not supply another person (\u201cperson B\u201d) with a poison unless \u2014 (a) person A is a pharmacist who supplies the poison from a certified pharmacy; and (b) person B is certified by the Council under subsection (1). (3) A person who contravenes subsection (2) commits an offence and is liable on conviction to a fine of ten thousand dollars or to imprisonment for a term of two years, or to both. (4) A person shall not supply a poison, or possess a poison with the intention of supplying it, unless the container of the poison is labelled as follows \u2014 (a) with the name of the poison; (b) with the word \u201cpoison\u201d; (c) with the name and address of the certified pharmacy from which the poison is supplied; (d) with an indication of the general or specific risk taken in its use, together with any safety precautions to be taken; and (e) in accordance with any other requirements prescribed by the regulations. (5) A person who contravenes subsection (4) commits an offence and is liable on conviction to a fine of five thousand dollars or to imprisonment for a term of one year, or to both. PART 4 - ENFORCEMENT\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_32\", \"num\": \"32.\", \"text\": \"Appointment of inspectors 32. (1) The registrar may, in writing, appoint a person to be an inspector. (2) An inspector shall assist the Council and has the functions and powers conferred on an inspector by this Act, subject to any restrictions specified in the inspector\u2019s instrument of appointment. (3) In exercising powers or performing functions, an inspector shall comply with the directions of the registrar. (4) The registrar shall issue each inspector with an identity card \u2014 (a) stating the inspector\u2019s name and the expiry date of the card; (b) showing a recent photograph of the inspector; and (c) signed by the Chief Medical Officer or a person designated by the Chief Medical Officer. (5) An inspector exercising a power or performing a function in relation to a person shall, if asked by the person, produce the inspector\u2019s identity card.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_33\", \"num\": \"33.\", \"text\": \"Powers of inspectors 33. (1) An inspector may exercise any of the powers specified in subsection (2) if the inspector reasonably believes it is necessary to do so for the administration or enforcement of this Act. (2) Subject to section 34, the inspector may do any of the following in relation to a place \u2014 (a) enter, inspect and search the place; (b) require a person at the place to give the inspector specified information (including documents) or assistance to access anything at the place; (c) inspect and take samples of anything found in the place that appears to the inspector to be \u2014 (i) a medicine; (ii) a container or package used or intended to be used to contain a medicine or a document used or intended to be used to provide information to accompany a medicine; or (iii) anything used in connection with the manufacture or assembly of a medicine, including an ingredient of the medicine; (d) seize anything the inspector reasonably believes \u2014 (i) is connected with the commission, or intended commission, of an offence under this Act; or (ii) provides evidence of the commission of an offence under this Act; and (e) make a record relating to the exercise of a power under this subsection (including, for example, by making a copy of a document, taking a photograph or making a video recording).\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_34\", \"num\": \"34.\", \"text\": \"Restrictions on powers of entry 34. (1) This section applies if an inspector intends to enter a place under section 33(2). (2) If the place is not a residence, the inspector shall, as far as practicable, give notice to the owner of the place of the inspector\u2019s intention to enter the place before doing so. (3) If the place is a residence, the inspector shall not enter the place unless \u2014 (a) the inspector has given written notice to the owner of the place of the inspector\u2019s intention to enter the place; and (b) the inspector \u2014 (i) is permitted by the owner (whether orally or in writing) to enter the place; or (ii) is authorized to enter the place under a warrant issued by a Magistrate. (4) A Magistrate may issue the warrant only if satisfied that the warrant is reasonably required in the circumstances for the enforcement of this Act. (5) The warrant may authorize the inspector, with the assistance of a constable, to use force to enter the place.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_35\", \"num\": \"35.\", \"text\": \"Dealing with seized items 35. (1) An inspector shall give a receipt to a person for anything the inspector seizes from the person under this Act. (2) The registrar has control of anything seized under this Act. (3) The registrar may retain anything seized that is relevant to the prosecution of an offence under this Act until the proceedings for the offence have ended.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_36\", \"num\": \"36.\", \"text\": \"Obstructing an inspector 36. (1) A person who obstructs an inspector who is exercising a power or performing a function under this Act, including by destroying any document or thing during the course of a search conducted under section 33(2), commits an offence and is liable on conviction to a fine of five thousand dollars or to imprisonment for a term of one year, or to both. (2) A person who fails to comply with a requirement given to the person by an inspector who is exercising a power or performing a function under this Act commits an offence and is liable on conviction to a fine of five thousand dollars or to imprisonment for a term of one year, or to both. PART 5 - MISCELLANEOUS\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_37\", \"num\": \"37.\", \"text\": \"Approved forms 37. The registrar may approve forms for use under this Act.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_38\", \"num\": \"38.\", \"text\": \"Protection from liability and indemnity 38. (1) Each of the following persons is not civilly or criminally liable for an act done or omitted to be done by the person in good faith in the exercise of a power or performance of a function under this Act \u2014 (a) the registrar; (b) an inspector; (c) a member of the Council; or (d) the Chief Medical Officer. (2) The Government shall indemnify each of the following persons against all claims, damages, costs, charges or expenses incurred for an act done or omitted to be done in good faith in the exercise of a power or performance of a function under this Act \u2014 (a) the registrar; (b) an inspector; (c) a member of the Council; or (d) the Chief Medical Officer.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_39\", \"num\": \"39.\", \"text\": \"Confidentiality of information 39. (1) A person commits an offence if \u2014 (a) the person obtains information in the course of performing a function connected with the administration of this Act or exercising a power under this Act; (b) the person recklessly or intentionally discloses the information to another person; and (c) the disclosure is not \u2014 (i) for a purpose connected with the administration of this Act, including a legal proceeding arising out of the operation of this Act; or (ii) to a person who is otherwise entitled to the information. (2) A person who contravenes subsection (1) commits an offence and is liable on conviction to a fine of ten thousand dollars or to imprisonment for a term of one year, or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_40\", \"num\": \"40.\", \"text\": \"Appeals 40. Where a person is aggrieved by a decision of the Council under this Act \u2014 (a) the person may appeal against the decision to the Health Appeals Tribunal established by section 4 of the Health Practice Act (2021 Revision); and (b) Schedule 2 to the Health Practice Act (2021 Revision) applies to the conduct of the appeal.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_41\", \"num\": \"41.\", \"text\": \"Regulations 41. (1) The Cabinet, on the advice of the Council, the Chief Medical Officer or the Chief Nursing Officer, may make regulations prescribing all matters that are required or permitted by this Act to be prescribed, or are necessary to be prescribed to give effect to the purposes of this Act. (2) Without limiting subsection (1), the Cabinet may make regulations \u2014 (a) controlling, regulating or prohibiting the manufacture, sale, supply, possession, export or import of any medicine; (b) regulating the issue of prescriptions; (c) regulating the storage and disposal of medicines; (d) prohibiting or regulating the advertising of medicines; (e) regulating the keeping of records relating to the supply of medicines; and (f) prescribing fees and providing for the waiver, refund and discount of fees. (3) Regulations made under this Act may \u2014 (a) make different provision in relation to different cases or circumstances; (b) apply in respect of particular persons or particular cases or particular classes of persons or particular classes of cases, and define a class by reference to any circumstances whatsoever; or (c) contain such transitional, consequential, incidental or supplementary provisions as appear to the Cabinet to be necessary or expedient for the purposes of the regulations. (4) Regulations made under this Act may create an offence punishable by a penalty not exceeding the maximum penalty prescribed under this Act. DISPENSING AND PRESCRIBING OF MEDICINES; AND FOR\nINCIDENTAL AND CONNECTED PURPOSES\u2000\nENACTED by the Legislature of the Cayman Islands.\nPART 1 - PRELIMINARY\n1.\nShort title and commencement\n1.\n(1) This Act may be cited as the Pharmacy Act, 2024.\n(2) This Act comes into force on such date as may be appointed by Order made by\nthe Cabinet and different dates may be appointed for different provisions of this\nAct and in relation to different matters.\n2.\nInterpretation\n2.\nIn this Act \u2014\n\u201cadminister\u201d, in relation to a substance, means to apply, inject, insert or\notherwise introduce the substance to the body of a human being or animal, in its\nexisting state or after it has been dissolved, dispensed in, diluted or mixed with\nanother bird, reptile, amphibian or fish, but does not include\na human being;\n\u201capproved form\u201d means a form approved by the registrar under section 37;\n\u201capproved medicine\u201d means a medicine \u2014\n(a)\napproved by a corresponding authority of a country prescribed by the\nregulations;\n(b) approved by the Council under section 12; or\n(c)\ntaken to be an approved medicine under section 13 or 14;\n\u201cassemble\u201d, in relation to a medicine, means \u2014\n(a)\nto enclose the medicine, with or without other medicines, in a container\nthat is labelled before the medicine is supplied; or\n(b) if the medicine is already enclosed in the container in which it is to be\nsupplied, to label the container before it is supplied;\n\u201cauthorized dispenser\u201d means a person who is permitted to dispense a\npharmacy medicine or prescription-only medicine under section 6(1);\n\u201ccertified pharmacy\u201d means a pharmacy that is a certified health care facility\nunder section 5 of the Health Practice Act (2021 Revision);\n\u201cChief Medical Officer\u201d means the person appointed to the position of that title\nin the ministry responsible for health;\n\u201cChief Nursing Officer\u201d means the person appointed to the position of that title\nin the ministry responsible for health;\n\u201ccompound\u201d, in relation to a medicine, means to prepare, mix, alter or assemble\nmultiple ingredients to make the medicine in order to dispense the medicine;\n\u201cconstable\u201d has the meaning assigned by section 2 of the Police Act (2021\nRevision);\n\u201ccorresponding authority\u201d means the authority of another country that\nperforms corresponding functions to those of the Council under this Act;\n\u201cCouncil\u201d means the Pharmacy Council established under section 21 of the\nHealth Practice Act (2021 Revision);\n\u201cdispense\u201d, in relation to a medicine, means to supply the medicine, in the\ncourse of business or of providing professional services, to a person for the\npurpose of the medicine being self-administered by the person or administered\nto an animal;\n\u201cdispensing licence\u201d means a licence referred to in section 6 and issued under\nsection 9;\n\u201cemergency use authorization\u201d means an authorization issued by the Cabinet\nunder section 14;\n\nPharmacy Act, 2024\nSection 2\n\nc\nAct 8 of 2024\nPage 7\n\n\u201cexceptional use authorization\u201d means an authorization issued by the Council\nunder section 13;\n\u201cGovernment entity\u201d means any body of Government and includes a ministry,\nportfolio, statutory authority, company, board, department or office;\n\u201cimport\u201d means import into the Islands;\n\u201cinspector\u201d means a person appointed to be an inspector under section 32;\n\u201cinternet or mail-order pharmacy\u201d means a pharmacy that \u2014\n(a)\noperates by way of online or mail-order sales; and\n(b) does not have a physical premises where in-person pharmacy services are\nprovided;\n\u201clicence\u201d means a dispensing licence, a manufacturing licence, a product\nlicence or a wholesale licence;\n\u201cmanufacturing licence\u201d means a licence referred to in section 4 and issued\nunder section 9;\n\u201cmedicine\u201d means \u2014\n(a) a substance or combination of substances \u2014\n(i)\npresented as having properties of preventing or treating disease in\nhuman beings or animals; or\n(ii) that may be administered to human beings or animals with a view to\nrestoring, correcting or modifying a physiological function by\nexerting a pharmacological, immunological or metabolic action, or\nmaking a medical diagnosis; or\n(b) a preparation developed from autologous or allogeneic biological\nmaterials;\n\u201cnarcotic\u201d means any of the following \u2014\n(a)\na drug included on the Yellow List of Narcotic Drugs Under International\nControl prepared by the International Narcotics Control Board; or\n(b) a controlled drug under the Misuse of Drugs Act (2017 Revision);\n\u201cnon-approved medicine\u201d means a medicine other than an approved medicine;\n\u201cpharmacist\u201d means a person who, under the Health Practice Act (2021\nRevision) \u2014\n(a)\nis registered to practice the profession of pharmacy; and\n(b) holds a practising licence to do so;\n\u201cpharmacy medicine\u201d means a medicine prescribed as a pharmacy medicine\nby the regulations;\n\u201cpoison\u201d means a substance prescribed to be a poison by the regulations;\n\u201cprescriber\u201d means \u2014\n\nSection 3\nPharmacy Act, 2024\n\nPage 8\nAct 8 of 2024\nc\n\n(a)\na registered practitioner who is a medical doctor or dentist;\n(b) any other registered practitioner prescribed by the regulations; or\n(c)\na veterinary surgeon;\n\u201cprescription\u201d means a verbal or written instruction (including an instruction\nissued electronically) authorizing the dispensing of a medicine;\n\u201cprescription-only medicine\u201d means medicine prescribed as a prescriptiononly medicine by the regulations;\n\u201cregistered practitioner\u201d has the meaning assigned by section 2 of the Health\nPractice Act (2021 Revision);\n\u201cregistrar\u201d has the meaning assigned by section 2 of the Health Practice Act\n(2021 Revision);\n\u201cscope of practice\u201d, in relation to a registered practitioner, means the\npractitioner\u2019s scope of practice under a code mentioned in section 35 of the\nHealth Practice Act (2021 Revision);\n\u201cship\u2019s physician\u201d means a medical doctor employed to practise on board a\ncommercial cruise ship or military vessel;\n\u201csupply\u201d includes sell;\n\u201cveterinary surgeon\u201d has the meaning assigned by section 2 of the Veterinary\nAct (1997 Revision); and\n\u201cwholesale licence\u201d means a licence referred to in section 5 and issued under\nsection 9.\n\nPART 2 - LICENCES AND AUTHORIZATIONS\nDivision 1 - Licence requirements\n3.\nImporting medicines\n3.\n(1) A person may import an approved medicine as follows \u2014\n(a)\na pharmacist may import an approved medicine for the purpose of\ndispensing it;\n(b) a registered practitioner who is authorized to administer an approved\nmedicine within the registered practitioner\u2019s scope of practice may import\nthe medicine for the purpose of administering the medicine to the\npractitioner\u2019s patients in quantities that are appropriate for the size of the\npractitioner\u2019s practice;\n(c)\nunder section 4(2)(a), the holder of a manufacturing licence for the\nmanufacture of an approved medicine may import the ingredients (which\n\nPharmacy Act, 2024\nSection 4\n\nc\nAct 8 of 2024\nPage 9\n\nmay be medicines) specified in the licence for the purpose of\nmanufacturing the medicine;\n(d) under section 5(2), the holder of a wholesale licence to sell an approved\nmedicine by wholesale may import the medicine for the purpose of selling\nit;\n(e)\nunder section 6(2), the holder of a dispensing licence to dispense an\napproved medicine may import the medicine for the purpose of dispensing\nit;\n(f)\na person may import an approved medicine for self-administration if the\nfollowing conditions are met \u2014\n(i)\nthe quantity of the medicine is not of commercial value;\n(ii) the medicine is contained in the original manufacturer\u2019s packaging\nor the container in which it was dispensed by a pharmacy and is\nlabelled with a full description of the contents; and\n(g) the Chief Medical Officer or the Director of Agriculture may import an\napproved medicine.\n(2) A person who imports a medicine except as specified in this section commits an\noffence and is liable on conviction to a fine of ten thousand dollars or to\nimprisonment for a term of two years, or to both.\n4.\nManufacturing licence\n4.\n(1) Subject to subsection (3), a person shall not manufacture a medicine except in\naccordance with a manufacturing licence.\n(2) A manufacturing licence authorizes the holder of the licence to do any of the\nfollowing in addition to manufacturing each medicine specified in the licence\nwithout an additional licence \u2014\n(a)\nimport the ingredients specified in the licence for the purpose of\nmanufacturing the medicine; and\n(b) sell the medicine by wholesale.\n(3) A person specified in section 17(1) does not require a manufacturing licence to\ncompound a medicine.\n(4) A person who contravenes subsection (1) commits an offence and is liable on\nconviction to a fine of twenty thousand dollars or to imprisonment for a term of\nfive years, or to both.\n5.\nWholesale licence\n5.\n(1) Subject to subsection (3), a person shall not sell an approved medicine by\nwholesale except in accordance with a wholesale licence.\n\nSection 6\nPharmacy Act, 2024\n\nPage 10\nAct 8 of 2024\nc\n\n(2) A wholesale licence authorizes the holder of the licence to import, for the\npurpose of selling by wholesale, each medicine or class of medicines permitted\nto be sold by wholesale under the licence without an additional licence.\n(3) The holder of a manufacturing licence may sell a medicine specified in the\nlicence by wholesale without a wholesale licence.\n(4) A person who contravenes subsection (1) commits an offence and is liable on\nconviction to a fine of twenty thousand dollars or to imprisonment for a term of\nfive years, or to both.\n6.\nDispensing licence\n6.\n(1) A person shall not dispense a pharmacy medicine or a prescription-only\nmedicine unless \u2014\n(a)\nthe person is a pharmacist or acting under the supervision of a pharmacist;\nor\n(b) the person does so in accordance with a dispensing licence.\n\n(2) A dispensing licence authorizes the holder of the licence to import, for the\npurpose of dispensing, each medicine or class of medicines permitted to be\ndispensed under the licence without an additional licence.\n(3) Section 26 contains additional requirements for dispensing prescription-only\nmedicines.\n(4) A person who contravenes subsection (1) commits an offence and is liable on\nconviction to a fine of twenty thousand dollars or to imprisonment for a term of\nfive years, or to both.\nDivision 2 - Licence applications\n7.\nApplication for licence\n7.\n(1) A person may apply to the Council for a licence.\n(2) The application shall be \u2014\n(a)\nmade in the approved form; and\n(b) accompanied by the prescribed fee and any documents prescribed by the\nregulations.\n8.\nCriteria for issuing licence\n8.\n(1) The criteria for issuing a manufacturing licence are as follows \u2014\n(a)\nthat the premises and equipment to be used for manufacturing operations\nunder the licence are suitable for purpose;\n\nPharmacy Act, 2024\nSection 9\n\nc\nAct 8 of 2024\nPage 11\n\n(b) that the manufacturing operations are to be supervised by a person who\nholds the qualifications prescribed by the regulations;\n(c)\nthat adequate records are to be kept of the operations and output; and\n(d) any other criteria prescribed by the regulations.\n(2) The criteria for issuing a wholesale licence are as follows \u2014\n(a)\nthat the premises and equipment to be used for storing and distributing\nmedicines under the licence are suitable for purpose;\n(b) that a pharmacist is to supervise the storage and distribution of medicines;\n(c)\nthat adequate records are to be kept of the storage and distribution of\nmedicines; and\n(d) any other criteria prescribed by the regulations.\n(3) The criteria for issuing a dispensing licence are as follows \u2014\n(a)\nthat the premises and equipment to be used for storing and dispensing\nmedicines under the licence are suitable for purpose;\n(b) that a registered practitioner acting within the registered practitioner\u2019s\nscope of practice is to supervise the storage and dispensing of medicines;\n(c)\nthat adequate records are to be kept of the storage and dispensing of\nmedicines;\n(d) that adequate arrangements are in place for providing appropriate\ninformation to patients to whom medicines are dispensed;\n(e)\nthat a pharmacist, acting as a consultant, is to be available to advise the\nlicence holder on dispensing medicines and to consult with patients when\nrequired; and\n(f)\nany other criteria prescribed by the regulations.\n9.\nDecision on licence application\n9.\nThe Council shall assess an application under section 7 and \u2014\n(a)\nissue the licence if satisfied that the applicant \u2014\n(i)\nmeets the criteria for the issue of the licence specified in section 8;\nand\n(ii) is otherwise a fit and proper person to hold the licence; or\n(b) refuse the application and give the applicant written notice of the refusal,\nincluding the reasons for it.\n10.\nDuration and conditions of licence\n10. (1) A licence may be issued for the period, not exceeding three years, specified in\nit and may be renewed.\n\nSection 11\nPharmacy Act, 2024\n\nPage 12\nAct 8 of 2024\nc\n\n(2) A licence is subject to any conditions prescribed by the regulations and any\nadditional conditions and limitations specified in it.\n11.\nVariation, suspension and revocation of licence\n11. (1) The Council may vary the conditions of a licence if \u2014\n(a)\nthe Council becomes aware of information that, had it been known when\nthe licence was issued, would have resulted in different or additional\nconditions being imposed on the licence; or\n(b) the holder of the licence has breached a condition of the licence and the\nCouncil believes the variation is necessary to reduce the risk of a further\nbreach.\n(2) Before deciding to vary the conditions of a licence, the Council shall \u2014\n(a)\ngive written notice to the holder of the licence \u2014\n(i)\nof the reasons for, and particulars of, the proposed variation; and\n(ii) that the holder may make written submissions to the Council about\nthe proposed variation within a reasonable period of at least twentyone days stated in the notice; and\n(b) have regard to any written submissions made by the holder within the\nstated period.\n(3) The Council may revoke a licence if \u2014\n(a)\nthe Council becomes aware of information that, had it been known when\nthe application for the licence was made, would have resulted in the\napplication being refused; or\n(b) the holder of the licence has breached a condition of the licence in such a\nserious manner that the Council believes the licence should be revoked.\n(4) Before deciding to revoke the licence, the Council \u2014\n(a)\nshall give written notice to the holder of the licence \u2014\n(i)\nof the reasons for the proposed revocation; and\n(ii) that the holder may make written submissions to the Council about\nthe proposed revocation within a reasonable period of at least twentyone days stated in the notice; and\n(b) may suspend the licence during the period stated in the notice; and\n(c)\nshall have regard to any written submissions made by the holder within the\nstated period.\n(5) If the Council decides to vary, suspend or revoke a licence, the Council must\ngive the holder written reasons for the decision.\n\nPharmacy Act, 2024\nSection 12\n\nc\nAct 8 of 2024\nPage 13\n\nDivision 3 - Medicine approval and authorization\n12.\nMedicine approval\n12. The Council may approve a medicine for the purposes of this Act if the Council is\nsatisfied that the medicine \u2014\n(a)\nis safe and effective for the purpose for which it is intended to be\nadministered;\n(b) is of good quality, according to the specification and method or proposed\nmethod of manufacture, and will be of good quality when sold and\ndispensed; and\n(c)\nmeets any other criteria prescribed by the regulations.\n13.\nExceptional use authorization\n13. (1) The Council may, on application by a prescriber, issue an exceptional use\nauthorization for a non-approved medicine if the Council is satisfied that \u2014\n(a)\nexceptional circumstances exist requiring the medicine to be made\navailable; and\n(b) the medicine is safe and effective for the purpose for which it is intended\nto be administered.\n(2) The non-approved medicine is taken to be an approved medicine for the\npurposes of this Act for the duration of the exceptional use authorization.\n(3) The exceptional use authorization \u2014\n(a)\nmay be issued for the use of the medicine generally or be limited to the\nadministration of the medicine to a specified patient or class of patients;\nand\n(b) is subject to the conditions and limitations specified in it.\n14.\nEmergency use authorization\n14. (1) The Cabinet may, by notice published in the Gazette, issue an emergency use\nauthorization for a non-approved medicine.\n(2) The non-approved medicine is taken to be an approved medicine for the\npurposes of this Act for the duration of the emergency use authorization.\n(3) The emergency use authorization is subject to the conditions and limitations\nspecified in it.\n\nSection 15\nPharmacy Act, 2024\n\nPage 14\nAct 8 of 2024\nc\n\nPART 3 - DEALING WITH MEDICINES\nDivision 1 - Medicines generally\n15.\nDealing with non-approved medicine\n15. (1) A person shall not \u2014\n(a)\nimport;\n(b) sell by wholesale;\n(c)\ndispense;\n(d) prescribe;\n(e)\nadminister; or\n(f)\nmanufacture,\na non-approved medicine.\n(2) A person who contravenes subsection (1) commits an offence and is liable on\nconviction to a fine of twenty thousand dollars or to imprisonment for a term of\nfive years, or to both.\n16.\nSupplying a medicine\n16. (1) Subject to subsection (2), a person shall not supply a medicine by retail\nunless \u2014\n(a)\nthe person \u2014\n(i)\nis a pharmacist, or is acting under the supervision of a pharmacist;\nand\n(ii) supplies the medicine from a certified pharmacy; or\n(b) the person does so in accordance with a dispensing licence.\n(2) Subsection (1) does not apply to the supply of a medicine in the following\ncircumstances \u2014\n(a)\nthe supply is made from premises capable of being contained and locked\nso as to exclude the public; and\n(b) the medicine \u2014\n(i)\nhas been prepared for retail supply and placed in a container or\npackage that has not been opened since the medicine was prepared;\n(ii) is supplied under the authority of the person holding a manufacturing\nor wholesale licence for the medicine; and\n(iii) is not a pharmacy medicine, prescription-only medicine or narcotic.\n\nPharmacy Act, 2024\nSection 17\n\nc\nAct 8 of 2024\nPage 15\n\n(3) A person who contravenes subsection (1) commits an offence and is liable on\nconviction to a fine of twenty thousand dollars or to imprisonment for a term of\nfive years, or to both.\n17.\nCompounding a medicine\n17. (1) A person shall not compound a medicine unless the person is \u2014\n(a)\na pharmacist;\n(b) acting under the supervision of a pharmacist;\n(c)\nthe holder of a dispensing licence who is authorized to compound the\nmedicine under the licence;\n(d) a registered practitioner acting within the registered practitioner\u2019s scope of\npractice; or\n(e)\na veterinary surgeon acting within the veterinary surgeon\u2019s scope of\npractice.\n(2) A person who contravenes subsection (1) commits an offence and is liable on\nconviction to a fine of twenty thousand dollars or to imprisonment for a term of\nfive years, or to both.\n18.\nAltering a medicine\n18. (1) A person shall not \u2014\n(a)\nalter the composition of a medicine with the intention of supplying the\nmedicine to another person; or\n(b) supply, or possess with the intention of supplying, a medicine with an\naltered composition.\n(2) A person who contravenes subsection (1) commits an offence and is liable on\nconviction to a fine of twenty thousand dollars or to imprisonment for a term of\nfive years, or to both.\n(3) Subsection (1) is not contravened only because a medicine contains extraneous\nmatter as a result of the process of manufacturing or compounding the medicine.\n19.\nLabelling of medicine\n19. (1) A person shall not supply, or possess with the intention of supplying, a medicine\nin a container that is labelled in a way that \u2014\n(a)\nfalsely describes the medicine;\n(b) is likely to be misleading in relation to the nature, efficacy or quality of the\nmedicine; or\n(c)\ndoes not meet the requirements prescribed by the regulations for the\nlabelling of the medicine.\n\nSection 20\nPharmacy Act, 2024\n\nPage 16\nAct 8 of 2024\nc\n\n(2) A person who contravenes subsection (1) commits an offence and is liable on\nconviction to a fine of ten thousand dollars or to imprisonment for a term of two\nyears, or to both.\n20.\nInformation accompanying medicine\n20. (1) A person shall not supply with a medicine, or possess with the intention of\nsupplying with a medicine, written information (whether contained in a leaflet\nor otherwise) that \u2014\n(a)\nfalsely describes the medicine;\n(b) is likely to be misleading in relation to the nature, efficacy or quality of the\nmedicine; or\n(c)\ndoes not meet the requirements prescribed by the regulations or specified\nin the Misuse of Drugs Act (2017 Revision) for information accompanying\nthe medicine.\n(2) Subject to subsection (3), a person shall not supply a medicine unless the\nmedicine is supplied with a patient information leaflet written in English.\n(3) The Chief Medical Officer may, on a case-by-case basis, issue an exemption\nfrom the requirement to supply a medicine with a patient information leaflet\nwritten in English if it is not reasonably practicable to comply with the\nrequirement.\n(4) A person who contravenes subsection (1) or (2) commits an offence and is liable\non conviction to a fine of ten thousand dollars or to imprisonment for a term of\ntwo years, or to both.\n21.\nVending machines\n21. (1) A person (\u201cperson A\u201d) shall not \u2014\n(a)\ninstall a vending machine on premises occupied by person A for the\npurpose of supplying a pharmacy medicine, prescription-only medicine or\nnarcotic;\n(b) dispense a pharmacy medicine, prescription-only medicine or narcotic\nusing a vending machine; or\n(c)\nallow another person to install a vending machine on premises occupied\nby person A for the purpose of supplying a pharmacy medicine,\nprescription-only medicine or narcotic.\n(2) A person who contravenes subsection (1) commits an offence and is liable on\nconviction to a fine of ten thousand dollars or to imprisonment for a term of two\nyears, or to both.\n(3) In this section, \u201cvending machine\u201d means a machine or device from which a\nproduct can be obtained, including by \u2014\n(a) electronic funds transfer; or\n\nPharmacy Act, 2024\nSection 22\n\nc\nAct 8 of 2024\nPage 17\n\n(b) inserting money, a token or something else.\n22.\nInternet and mail order pharmacies\n22. (1) A person shall not dispense a pharmacy medicine or prescription-only medicine\nfrom an internet or mail-order pharmacy.\n(2) A person who contravenes subsection (1) commits an offence and is liable on\nconviction to a fine of twenty thousand dollars or to imprisonment for a term of\nfive years, or to both.\nDivision 2 - Pharmacy medicines, prescription-only medicines and\nother restricted products\n23.\nWholesale of pharmacy or prescription-only medicine\n23. (1) The holder of a wholesale licence or a manufacturing licence shall not sell a\npharmacy medicine or a prescription-only medicine by wholesale except to \u2014\n(a)\na pharmacist operating a certified pharmacy;\n(b) the holder of a dispensing licence;\n(c)\nin the case of a pharmacy medicine, a registered practitioner who is\nauthorized to administer the medicine within the registered practitioner\u2019s\nscope of practice;\n(d) in the case of a prescription-only medicine, a prescriber who is authorized\nto administer the medicine within the prescriber\u2019s scope of practice; or\n(e)\na Government entity that is authorized by law to use the medicine.\n(2) A person who contravenes subsection (1) commits an offence and is liable on\nconviction to a fine of twenty thousand dollars or to imprisonment for a term of\nfive years, or to both.\n24.\nPrescribing medicine\n24. (1) Subject to subsection (2), a person shall not issue a prescription unless \u2014\n(a)\nthe person is a prescriber acting within the prescriber\u2019s scope of practice;\nand\n(b) if the prescription is for a narcotic, the prescriber complies with the\nrequirements prescribed by the regulations for prescribing narcotics.\n(2) A ship\u2019s physician who is not a registered practitioner may issue a prescription\nfor the supply (not exceeding a seven-day supply or, if the medicine is packaged\nin units that each exceed a seven-day supply, a single unit), of a medicine other\nthan a narcotic, but may not authorize a refill of the prescription.\n\nSection 25\nPharmacy Act, 2024\n\nPage 18\nAct 8 of 2024\nc\n\n(3) A person who contravenes subsection (1) or (2) commits an offence and is liable\non conviction to a fine of twenty thousand dollars or to imprisonment for a term\nof five years, or to both.\n25.\nAltering a prescription\n25. (1) A person shall not alter a prescription unless the person is \u2014\n(a)\nthe prescriber who issued the prescription;\n(b) a pharmacist acting under the instruction of the prescriber who issued the\nprescription; or\n(c)\na pharmacist acting within the pharmacist\u2019s scope of practice.\n(2) A person who contravenes subsection (1) commits an offence and is liable on\nconviction to a fine of ten thousand dollars or to imprisonment for a term of two\nyears, or to both.\n26.\nDispensing a prescription-only medicine\n26. (1) Subject to subsection (2), an authorized dispenser shall not dispense a\nprescription-only medicine unless \u2014\n(a)\nthe person does so in accordance with a prescription issued within \u2014\n(i)\ntwelve months before the date of dispensing the medicine; or\n(ii) if the regulations prescribe a different period, that period; and\n(b) if the medicine is a narcotic, the person complies with the requirements\nprescribed by the regulations for dispensing narcotics.\n(2) Notwithstanding subsection (1) \u2014\n(a)\na prescriber may dispense a prescription-only medicine to the prescriber\u2019s\npatients in accordance with a dispensing licence;\n(b) a veterinary surgeon may dispense a prescription-only medicine within the\nscope of the veterinary surgeon\u2019s practice; or\n(c)\na pharmacist may dispense a supply of a prescription-only medicine\nwithout a prescription (\u201cemergency supply\u201d) if the following conditions\nare satisfied \u2014\n(i)\nthe medicine is not a narcotic;\n(ii) the medicine is essential to maintaining the patient\u2019s life or\ncontinuing therapy and, in the professional opinion of the pharmacist,\ninterrupting the therapy would be detrimental to the patient\u2019s wellbeing;\n(iii) the request for the emergency supply has not been made immediately\nafter a previous emergency supply of the medicine was given and\nused;\n\nPharmacy Act, 2024\nSection 27\n\nc\nAct 8 of 2024\nPage 19\n\n(iv) the pharmacist makes a complete record of the particulars of the\nsupply; and\n(v) the amount dispensed does not exceed a fourteen-day supply or, if\nthe medicine is packaged in units that each exceed a fourteen-day\nsupply, a single unit.\n(3) A person who contravenes subsection (1) commits an offence and is liable on\nconviction to a fine of ten thousand dollars or to imprisonment for a term of two\nyears, or to both.\n27.\nInterchangeable and bio-equivalent generic medicines\n27. (1) Subject to subsection (3), an authorized dispenser may substitute an\ninterchangeable and bio-equivalent generic medicine for a product specified in\na prescription if the authorized dispenser \u2014\n(a)\ninforms the patient; and\n(b) labels the container of the medicine with the name of the medicine\ndispensed rather than the brand name of the medicine prescribed.\n(2) A medicine is an interchangeable and bio-equivalent generic medicine in\nrelation to a specified product if it \u2014\n(a)\nis an approved medicine; and\n(b) has the same active ingredient, in the same strength and the same dosage,\nas the specified product.\n(3) An authorized dispenser shall not substitute an interchangeable and bioequivalent medicine if the substitution is prohibited by the regulations.\n(4) A person who contravenes subsection (1) or (3) commits an offence and is liable\non conviction to a fine of five thousand dollars or to imprisonment for a term of\none year, or to both.\n28.\nDispensing samples\n28. (1) An authorized dispenser shall not dispense a prescription-only medicine by way\nof a sample except in accordance with the regulations.\n(2) A person who contravenes subsection (1) commits an offence and is liable on\nconviction to a fine of five thousand dollars or to imprisonment for a term of\none year, or to both.\n29.\nAdministering a prescription-only medicine\n29. (1) A person shall not administer a prescription-only medicine to another person\nunless the person is \u2014\n(a)\nthe prescriber of the medicine;\n\nSection 30\nPharmacy Act, 2024\n\nPage 20\nAct 8 of 2024\nc\n\n(b) acting in accordance with the written directions of the prescriber of the\nmedicine; or\n(c)\na registered practitioner acting within the registered practitioner\u2019s scope of\npractice.\n(2) A person who contravenes subsection (1) commits an offence and is liable on\nconviction to a fine of ten thousand dollars or to imprisonment for a term of two\nyears, or to both.\n30.\nPossessing a prescription-only medicine\n30. (1) A person shall not possess a prescription-only medicine unless the person \u2014\n(a)\nhas a prescription for the medicine in the person\u2019s name;\n(b) is acting under the directions of a person who holds a prescription for the\nmedicine;\n(c)\nis an authorized dispenser;\n(d) is a registered practitioner who, acting within the registered practitioner\u2019s\nscope of practice, may dispense the medicine;\n(e)\nis a veterinary surgeon who, acting within the veterinary surgeon\u2019s scope\nof practice, may dispense the medicine;\n(f)\nis acting under the written directions of a prescriber; or\n(g) holds a manufacturing or wholesale licence for the medicine.\n(2) A person who contravenes subsection (1) commits an offence and is liable on\nconviction to a fine of five thousand dollars or to imprisonment for a term of\none year, or to both.\n31.\nSupply and labelling of poison\n31. (1) The Council may, in accordance with the requirements of the regulations, certify\na person to be a person who may possess a poison.\n(2) A person (\u201cperson A\u201d) shall not supply another person (\u201cperson B\u201d) with a\npoison unless \u2014\n(a)\nperson A is a pharmacist who supplies the poison from a certified\npharmacy; and\n(b) person B is certified by the Council under subsection (1).\n(3) A person who contravenes subsection (2) commits an offence and is liable on\nconviction to a fine of ten thousand dollars or to imprisonment for a term of two\nyears, or to both.\n(4) A person shall not supply a poison, or possess a poison with the intention of\nsupplying it, unless the container of the poison is labelled as follows \u2014\n(a)\nwith the name of the poison;\n\nPharmacy Act, 2024\nSection 32\n\nc\nAct 8 of 2024\nPage 21\n\n(b) with the word \u201cpoison\u201d;\n(c)\nwith the name and address of the certified pharmacy from which the poison\nis supplied;\n(d) with an indication of the general or specific risk taken in its use, together\nwith any safety precautions to be taken; and\n(e)\nin accordance with any other requirements prescribed by the regulations.\n(5) A person who contravenes subsection (4) commits an offence and is liable on\nconviction to a fine of five thousand dollars or to imprisonment for a term of\none year, or to both.\nPART 4 - ENFORCEMENT\n32.\nAppointment of inspectors\n32. (1) The registrar may, in writing, appoint a person to be an inspector.\n(2) An inspector shall assist the Council and has the functions and powers conferred\non an inspector by this Act, subject to any restrictions specified in the inspector\u2019s\ninstrument of appointment.\n(3) In exercising powers or performing functions, an inspector shall comply with\nthe directions of the registrar.\n(4) The registrar shall issue each inspector with an identity card \u2014\n(a)\nstating the inspector\u2019s name and the expiry date of the card;\n(b) showing a recent photograph of the inspector; and\n(c)\nsigned by the Chief Medical Officer or a person designated by the Chief\nMedical Officer.\n(5) An inspector exercising a power or performing a function in relation to a person\nshall, if asked by the person, produce the inspector\u2019s identity card.\n33.\nPowers of inspectors\n33. (1) An inspector may exercise any of the powers specified in subsection (2) if the\ninspector reasonably believes it is necessary to do so for the administration or\nenforcement of this Act.\n(2) Subject to section 34, the inspector may do any of the following in relation to a\nplace \u2014\n(a)\nenter, inspect and search the place;\n(b) require a person at the place to give the inspector specified information\n(including documents) or assistance to access anything at the place;\n(c)\ninspect and take samples of anything found in the place that appears to the\ninspector to be \u2014\n\nSection 34\nPharmacy Act, 2024\n\nPage 22\nAct 8 of 2024\nc\n\n(i)\na medicine;\n(ii) a container or package used or intended to be used to contain a\nmedicine or a document used or intended to be used to provide\ninformation to accompany a medicine; or\n(iii) anything used in connection with the manufacture or assembly of a\nmedicine, including an ingredient of the medicine;\n(d) seize anything the inspector reasonably believes \u2014\n(i)\nis connected with the commission, or intended commission, of an\noffence under this Act; or\n(ii) provides evidence of the commission of an offence under this Act;\nand\n(e)\nmake a record relating to the exercise of a power under this subsection\n(including, for example, by making a copy of a document, taking a\nphotograph or making a video recording).\n\n34.\nRestrictions on powers of entry\n34. (1) This section applies if an inspector intends to enter a place under section 33(2).\n(2) If the place is not a residence, the inspector shall, as far as practicable, give\nnotice to the owner of the place of the inspector\u2019s intention to enter the place\nbefore doing so.\n(3) If the place is a residence, the inspector shall not enter the place unless \u2014\n(a)\nthe inspector has given written notice to the owner of the place of the\ninspector\u2019s intention to enter the place; and\n(b) the inspector \u2014\n(i)\nis permitted by the owner (whether orally or in writing) to enter the\nplace; or\n(ii) is authorized to enter the place under a warrant issued by a\nMagistrate.\n(4) A Magistrate may issue the warrant only if satisfied that the warrant is\nreasonably required in the circumstances for the enforcement of this Act.\n(5) The warrant may authorize the inspector, with the assistance of a constable, to\nuse force to enter the place.\n35.\nDealing with seized items\n35. (1) An inspector shall give a receipt to a person for anything the inspector seizes\nfrom the person under this Act.\n(2) The registrar has control of anything seized under this Act.\n\nPharmacy Act, 2024\nSection 36\n\nc\nAct 8 of 2024\nPage 23\n\n(3) The registrar may retain anything seized that is relevant to the prosecution of an\noffence under this Act until the proceedings for the offence have ended.\n36.\nObstructing an inspector\n36. (1) A person who obstructs an inspector who is exercising a power or performing a\nfunction under this Act, including by destroying any document or thing during\nthe course of a search conducted under section 33(2), commits an offence and\nis liable on conviction to a fine of five thousand dollars or to imprisonment for\na term of one year, or to both.\n(2) A person who fails to comply with a requirement given to the person by an\ninspector who is exercising a power or performing a function under this Act\ncommits an offence and is liable on conviction to a fine of five thousand dollars\nor to imprisonment for a term of one year, or to both.\nPART 5 - MISCELLANEOUS\n37.\nApproved forms\n37. The registrar may approve forms for use under this Act.\n38.\nProtection from liability and indemnity\n38. (1) Each of the following persons is not civilly or criminally liable for an act done\nor omitted to be done by the person in good faith in the exercise of a power or\nperformance of a function under this Act \u2014\n(a)\nthe registrar;\n(b) an inspector;\n(c)\na member of the Council; or\n(d) the Chief Medical Officer.\n(2) The Government shall indemnify each of the following persons against all\nclaims, damages, costs, charges or expenses incurred for an act done or omitted\nto be done in good faith in the exercise of a power or performance of a function\nunder this Act \u2014\n(a)\nthe registrar;\n(b) an inspector;\n(c)\na member of the Council; or\n(d) the Chief Medical Officer.\n39.\nConfidentiality of information\n39. (1) A person commits an offence if \u2014\n\nSection 40\nPharmacy Act, 2024\n\nPage 24\nAct 8 of 2024\nc\n\n(a)\nthe person obtains information in the course of performing a function\nconnected with the administration of this Act or exercising a power under\nthis Act;\n(b) the person recklessly or intentionally discloses the information to another\nperson; and\n(c)\nthe disclosure is not \u2014\n(i)\nfor a purpose connected with the administration of this Act, including\na legal proceeding arising out of the operation of this Act; or\n(ii) to a person who is otherwise entitled to the information.\n(2) A person who contravenes subsection (1) commits an offence and is liable on\nconviction to a fine of ten thousand dollars or to imprisonment for a term of one\nyear, or to both.\n40.\nAppeals\n40. Where a person is aggrieved by a decision of the Council under this Act \u2014\n(a)\nthe person may appeal against the decision to the Health Appeals Tribunal\nestablished by section 4 of the Health Practice Act (2021 Revision); and\n(b) Schedule 2 to the Health Practice Act (2021 Revision) applies to the\nconduct of the appeal.\n41.\nRegulations\n41. (1) The Cabinet, on the advice of the Council, the Chief Medical Officer or the\nChief Nursing Officer, may make regulations prescribing all matters that are\nrequired or permitted by this Act to be prescribed, or are necessary to be\nprescribed to give effect to the purposes of this Act.\n(2) Without limiting subsection (1), the Cabinet may make regulations \u2014\n(a)\ncontrolling, regulating or prohibiting the manufacture, sale, supply,\npossession, export or import of any medicine;\n(b) regulating the issue of prescriptions;\n(c)\nregulating the storage and disposal of medicines;\n(d) prohibiting or regulating the advertising of medicines;\n(e)\nregulating the keeping of records relating to the supply of medicines; and\n(f)\nprescribing fees and providing for the waiver, refund and discount of fees.\n(3) Regulations made under this Act may \u2014\n(a)\nmake different provision in relation to different cases or circumstances;\n(b) apply in respect of particular persons or particular cases or particular\nclasses of persons or particular classes of cases, and define a class by\nreference to any circumstances whatsoever; or\n\nPharmacy Act, 2024\nSection 42\n\nc\nAct 8 of 2024\nPage 25\n\n(c)\ncontain such transitional, consequential, incidental or supplementary\nprovisions as appear to the Cabinet to be necessary or expedient for the\npurposes of the regulations.\n(4) Regulations made under this Act may create an offence punishable by a penalty\nnot exceeding the maximum penalty prescribed under this Act.\nPART 6 - REPEALS\n42.\nRepeals\n42. The following are repealed \u2014\n(a)\nthe Pharmacy Act, 1979; and\n(b) the Pharmacy Act, 1991.\nPassed by the Parliament the 23rd day of July, 2024.\nHon.
