(1) These Regulations may be cited as the Fire Code, 1997. (1) To the extent that they are consistent with the Law and with the other laws of the Islands for the time being in force, and subject to the exceptions, adaptations and modifications set out in the Schedule to these Regulations, the provisions of the Eighth (1994) Edition of the Standard Fire Prevention Code, based on the former American Insurance Association National Fire Prevention Code first adopted in 1974 at the Southern Building Code Congress International in Birmingham in the State of Alabama in the United States of America (in these Regulations referred to as the \u201cStandard Fire Prevention Code\u201d) shall, in relation to the safety of life and property from fire and certain hazards, apply as part of the laws of the Islands \u2014 (2) The provisions of the Standard Fire Prevention Code shall be those set out in the copy thereof for the time being entered in Part III of the Register (in these Regulations referred to as \u201cthe Register\u201d) kept by the Director of Planning under the provisions of the Building Code. (3) It shall be the duty of the Director of Planning to enter in Part II of the Register referred to in subregulation (2) in addition to the documents required to be kept therein under the Building Code, a copy of each of the several documents (in this Code referred to as \u201cthe referenced standards\u201d) referred to in Chapter 3 and Appendix D104 (Reference Publications) of the Standard Fire Prevention Code.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_4\", \"num\": \"4.\", \"text\": \"Identification of standards and references thereto in Code 4. (1) The Director of Planning shall identify each of the documents entered in Part II of the Register under the provisions of subregulation 4(3) by marking on it the initial letters of the title of the relevant authority and the letters and numbers set out against the document in Chapter 3 and in Appendix D104 (Reference Publications) of the Standard Fire Prevention Code. (2) Whenever a reference is made in this Code to a group of letters and numbers identifying a document in Part II of the Register such reference shall be deemed a reference to the respective document as recorded in the Register at the relevant time and a reference in this Code to a Part, paragraph, section or other division of that document shall be construed accordingly. When the person or authority responsible for laying down any standard set out in any document for the time being entered in Part II of the Register under the provisions of subregulation 4 (3) amends that standard, the Governor may by order require the Director of Planning to make corresponding amendments (with any further amendments that the Governor may consider should be made) to the relevant document in such Register and the Director of Planning shall amend the Register accordingly. (1) Whoever contravenes any of these Regulations is guilty of an offence and liable on summary conviction to a fine not exceeding $6,000 and, if the offence is a continuing one, to a further fine not exceeding $60 for every day, or part of a day, during which the default continues after he is convicted. (2) In any case where a person is convicted of a continuing offence under subsection (1) \u2014 (a) the court may fix a reasonable period from the date of conviction for the defendant to comply with any directions given by the court; and (b) where the court has fixed such a period, the daily penalty is not recoverable in respect of any day before the period expires. Delete the definition \u201cAPPROVED\u201d and substitute the following- \u2018\u201cAPPROVED\u201d means approved by the Chief Fire Officer;\u2019. Amend the definition \u201cBUILDING CODE\u201d by deleting \u201cStandard\u201d. Delete the definition \u201cBUILDING OFFICIAL\u201d and substitute the following\u2018\u201c BUILDING OFFICIAL\u201d bears the meaning ascribed to that term in Chapter 2 of the Schedule to the Building Code;\u2019. SCHEDULE Fire Code, 1997 SL 3 of 1997 Provisions of the Standard Fire Prevention Code affected Exceptions, adaptations and modifications Delete the definition \u201c CHIEF OF FIRE DEPARTMENT\u201d. Delete the definition of \u201cCHIEF OF FIRE PREVENTION BUREAU\u201d and substitute the following- \u2018\u201cCHIEF OF FIRE PREVENTION BUREAU\u201d means the Chief Fire Officer;\u2019. Delete the definition \u201cDEA\u201d. Delete the definition of \u201cFIRE OFFICIAL\u201d and substitute the following- \u2018\u201cFIRE OFFICIAL\u201d means the Chief Fire Officer and includes any officer duly authorised by him or lawfully acting on his behalf;\u2019. Delete the definition \u201cFIRE PREVENTION BUREAU\u201d and substitute the following- \u2018\u201cFIRE PREVENTION BUREAU\u201d means the Fire Brigade;\u2019. The definition \u201cFIREWORKS\u201d is amended by deleting the Fire Code, 1997 SCHEDULE SL 3 of 1997 Provisions of the Standard Fire Prevention Code affected Exceptions, adaptations and modifications paragraph headed \u201cCLASS C, COMMON\u201d. Insert in its appropriate alphabetical sequence the following new definition- \u2018\u201cFLAMMABLE\u201d bears the same meaning as the word \u201cinflammable\u201d;\u2019. Delete the definition \u201cHIGH RISE BUILDING\u201d. Delete the definition \u201cHOTEL\u201d and substitute the following\u2018\u201c HOTEL\u201d bears the meaning ascribed to that term in the Hotels Aid Law (1995 Revision);\u2019. The definition \u201cICC CONTAINER\u201d is amended by inserting the words \u201cof the United States of America\u201d after \u201cCommission\u201d. Insert, in its appropriate alphabetical sequence, the following new definition- \u2018\u201cLABELLED\u201d means, in relation to devices, equipment or materials, having affixed thereto a label, seal, symbol or other identifying mark of a testing laboratory, inspection agency or other organisation recognised by the Chief Fire Officer which is concerned with product evaluation and which maintains periodic inspection of production of the thing concerned and by the affixing of which label, seal, symbol or mark the manufacturer attests to compliance with the applicable generally recognised standards; and \u201cLABELED\u201d bears a similar meaning;\u2019. Delete the definition \u201cLISTED\u201d and substitute the following- \u2018\u201cLISTED\u201d, in relation to equipment or materials, means included in a list published by a testing laboratory, inspection agency or other organisation recognised by the Chief Fire Officer to be of a standard satisfactory to him which is concerned with the product evaluation and which maintains periodic inspection of production of equipment and materials and, if it is stated or implied in such list, either that the equipment or material meets recognised standards or has been tested and found suitable for use in a specified manner;\u2019. \u201cLOT\u201d bears the meaning ascribed to that word in the Registered Land Law (1995 Revision). \u201cROAD\u201d bears the meaning ascribed to that word in the Roads Law (Revised). CHAPTER 4 401.1.1 Insert \u201cby reason of fire\u201d after \u201cproperty\u201d. SCHEDULE Fire Code, 1997 SL 3 of 1997 Provisions of the Standard Fire Prevention Code affected Exceptions, adaptations and modifications 401.2.1 Delete \u201ca Certificate of Occupancy has been issued by the building official for that occupancy classification\u201d and substitute \u201cwhere required by law, a Certificate of Occupancy authorising occupancy of the relevant class has been issued under the Building Code in respect of the premises concerned\u201d. 401.2.2 Insert \u201cof Government\u201d immediately before \u201cdepartments\u201d where it first appears. 402.3 Delete. 402.4 Delete. 402.7 Delete. 402.10 Delete. 402.13 Delete. 402.14 Delete. 402.15.1 Substitute \u201cmaterials hazardous by reason of fire\u201d for \u201chazardous materials\u201d. CHAPTER 5 501.1.1 Amend by- (a) deleting the first sentence; and (b) deleting \u201ca permit or other proper authorisation\u201d, and substituting \u201cthe permission of the Chief Fire Officer\u201d. 501.3 Delete and substitute the following new section- \u201cIncinerator construction Commercial, industrial and apartment incinerators shall be- (a) constructed in accordance with the provisions of the building and mechanical codes and NFiPA 82; (b) equipped with an effective means for arresting sparks; and (c) maintained in compliance with NFiPA 82.\u201d. 501.4.1 Amend as follows- (a) by inserting after the word \u201cincinerators\u201d the words \u201cto which Fire Code, 1997 SCHEDULE SL 3 of 1997 Provisions of the Standard Fire Prevention Code affected Exceptions, adaptations and modifications 501.3 applies\u201d; and (b) by deleting the word \u201cmountainous\u201d and the comma preceding it. 501.5 Delete. 503.2.1 Delete \u201cto any public fire station or company\u201d, and substitute \u201cthe Brigade or any official emergency communication system\u201d. conferred upon him by section 15 of\nthe Fire Brigade Law (1995 Revision), makes the following Regulations \u2014\n1.\nCitation and commencement\n1.\n(1) These Regulations may be cited as the Fire Code, 1997.\n(2) These Regulations shall come into force on such day the Governor may by\norder appoint and different days may be appointed for different provisions or\nfor different purposes.\n(3) An order under subregulation (2) may make such transitional adaptations of\nthe provisions of these Regulations then in force or brought into force by the\norder as appear to the Governor to be necessary or expedient in consequence\nof the partial operation of the Regulations.\n2.\nInterpretation\n2.\nIn these Regulations, unless the context otherwise requires \u2014\n\u201cLaw\u201d means the Fire Brigade Law (1995 Revision); and\n\u201csection\u201d means section of the Law.\n\nSection 3\nFire Code, 1997\n\nPage 6\nSL 3 of 1997\nc\n\n3.\nApplication of Standard Fire Prevention Code\n3.\n(1) To the extent that they are consistent with the Law and with the other laws of\nthe Islands for the time being in force, and subject to the exceptions,\nadaptations and modifications set out in the Schedule to these Regulations, the\nprovisions of the Eighth (1994) Edition of the Standard Fire Prevention Code,\nbased on the former American Insurance Association National Fire Prevention\nCode first adopted in 1974 at the Southern Building Code Congress\nInternational in Birmingham in the State of Alabama in the United States of\nAmerica (in these Regulations referred to as the \u201cStandard Fire Prevention\nCode\u201d) shall, in relation to the safety of life and property from fire and certain\nhazards, apply as part of the laws of the Islands \u2014\n(2) The provisions of the Standard Fire Prevention Code shall be those set out in\nthe copy thereof for the time being entered in Part III of the Register (in these\nRegulations referred to as \u201cthe Register\u201d) kept by the Director of Planning\nunder the provisions of the Building Code. (3) It shall be the duty of the\nDirector of Planning to enter in Part II of the Register referred to in\nsubregulation (2) in addition to the documents required to be kept therein\nunder the Building Code, a copy of each of the several documents (in this\nCode referred to as \u201cthe referenced standards\u201d) referred to in Chapter 3 and\nAppendix\nD104\n(Reference\nPublications)\nof\nthe\nStandard\nFire\nPrevention Code.\n4.\nIdentification of standards and references thereto in Code\n4.\n(1) The Director of Planning shall identify each of the documents entered in Part\nII of the Register under the provisions of subregulation 4(3) by marking on it\nthe initial letters of the title of the relevant authority and the letters and\nnumbers set out against the document in Chapter 3 and in Appendix D104\n(Reference Publications) of the Standard Fire Prevention Code.\n(2) Whenever a reference is made in this Code to a group of letters and numbers\nidentifying a document in Part II of the Register such reference shall be\ndeemed a reference to the respective document as recorded in the Register at\nthe relevant time and a reference in this Code to a Part, paragraph, section or\nother division of that document shall be construed accordingly.\n\nFire Code, 1997\nSection 5\n\nc\nSL 3 of 1997\nPage 7\n\n5.\nAmendment of standards\n5.\nWhen the person or authority responsible for laying down any standard set out in\nany document for the time being entered in Part II of the Register under the\nprovisions of subregulation 4 (3) amends that standard, the Governor may by order\nrequire the Director of Planning to make corresponding amendments (with any\nfurther amendments that the Governor may consider should be made) to the relevant\ndocument in such Register and the Director of Planning shall amend the Register\naccordingly. Any such amendment, unless the Order made by the Governor\nprovides otherwise, shall take effect from the time of its being entered in Part II of\nthe Register.\n6.\nEvidence of Register\n6.\nEvery document entered in the Register under this Code and every duplicate\nthereof, or extract therefrom, certified under the hand of the Director of Planning\nshall, respectively, be evidence of the content of such Code, document, or extract, as\nthe case may be.\n7.\nGeneral penalty\n7.\n(1) Whoever contravenes any of these Regulations is guilty of an offence and\nliable on summary conviction to a fine not exceeding $6,000 and, if the\noffence is a continuing one, to a further fine not exceeding $60 for every day,\nor part of a day, during which the default continues after he is convicted.\n(2) In any case where a person is convicted of a continuing offence under\nsubsection (1) \u2014\n(a)\nthe court may fix a reasonable period from the date of conviction for the\ndefendant to comply with any directions given by the court; and\n(b) where the court has fixed such a period, the daily penalty is not\nrecoverable in respect of any day before the period expires.\n\nFire Code, and\nproperty\u201d.\n105\nDelete.\nCHAPTER 2\n\nSection 202\nDelete the definitions \u201cAPARTMENT\u201d and \u201cAPARTMENT HOUSE\u201d\nand substitute the following- \u2018\u201cAPARTMENT\u201d and \u201cAPARTMENT\nHOUSE\u201d bear the meaning ascribed to the term \u201cApartment\u201d in the\nDevelopment and Planning Regulations (1995 Revision);\u2019.\n\nDelete the definition \u201cAPPLICABLE GOVERNING BODY\u201d\nand substitute the following-\n\u2018\u201cAPPLICABLE GOVERNING BODY\u201d includes the\nMinister, Department, entity, or person authorised to\nadminister or enforce the Provision of this Code\nconcerned;\u2019.\nDelete the definition \u201cAPPROVED\u201d and substitute the\nfollowing-\n\u2018\u201cAPPROVED\u201d means approved by the Chief Fire Officer;\u2019.\nAmend the definition \u201cBUILDING CODE\u201d by deleting\n\u201cStandard\u201d.\nDelete the definition \u201cBUILDING OFFICIAL\u201d and substitute\nthe following\u2018\u201c\nBUILDING OFFICIAL\u201d bears the meaning ascribed to\nthat term in Chapter 2 of the Schedule to the Building\nCode;\u2019.\n\nSCHEDULE\nFire Code, 1997\n\nPage 10\nSL 3 of 1997\nc\n\nProvisions of\nthe Standard\nFire Prevention\nCode affected\nExceptions, adaptations and modifications\nDelete the definition \u201c CHIEF OF FIRE DEPARTMENT\u201d.\nDelete the definition of \u201cCHIEF OF FIRE PREVENTION\nBUREAU\u201d and substitute the following-\n\u2018\u201cCHIEF OF FIRE PREVENTION BUREAU\u201d means the\nChief Fire Officer;\u2019.\nDelete the definition Law (1997\nRevision);\u2019.\n\u2018\u201cFIRE COMPANY\u201d means any two or more members of\nthe Brigade acting in concert;\u2019.\nDelete the definition \u201cFIRE DEPARTMENT\u201d and substitute\nthe following\u2018\u201c\nFIRE DEPARTMENT\u201d means the Fire Brigade;\u2019.\nInsert in its appropriate alphabetical sequence the following\nnew definition-\n\u2018\u201cFIRE DEPARTMENT CONNECTION\u201d means a hose\nconnection at grade or street level for use by the Fire\nBrigade only for the purpose of supplying water to\nstandpipes or sprinkler systems;\u2019.\nDelete the definition of \u201cFIRE HAZARD\u201d.\nDelete the definition of \u201cFIRE OFFICIAL\u201d and substitute the\nfollowing-\n\u2018\u201cFIRE OFFICIAL\u201d means the Chief Fire Officer and\nincludes any officer duly authorised by him or lawfully\nacting on his behalf;\u2019.\nDelete the definition \u201cFIRE PREVENTION BUREAU\u201d and\nsubstitute the following-\n\u2018\u201cFIRE PREVENTION BUREAU\u201d means the Fire\nBrigade;\u2019.\nThe definition \u201cFIREWORKS\u201d is amended by deleting the\n\nFire Code, 1997\nSCHEDULE\n\nc\nSL 3 of 1997\nPage 11\n\nProvisions of\nthe Standard\nFire Prevention\nCode affected\nExceptions, adaptations and modifications\nparagraph headed \u201cCLASS C, COMMON\u201d.\nInsert in its appropriate alphabetical sequence the following\nnew definition-\n\u2018\u201cFLAMMABLE\u201d bears the same meaning as the word\n\u201cinflammable\u201d;\u2019.\nDelete the definition \u201cHIGH RISE BUILDING\u201d.\nDelete the definition \u201cHOTEL\u201d and substitute the following\u2018\u201c\nHOTEL\u201d bears the meaning ascribed to that term in the\nHotels Aid Law (1995 Revision);\u2019.\nThe definition \u201cICC CONTAINER\u201d is amended by inserting\nthe words \u201cof the United States of America\u201d after\n\u201cCommission\u201d.\nInsert, in its appropriate alphabetical sequence, the following\nnew definition-\n\u2018\u201cLABELLED\u201d means, in relation to devices, equipment or\nmaterials, having affixed thereto a label, seal, symbol or\nother identifying mark of a testing laboratory, inspection\nagency or other organisation recognised by the Chief Fire\nOfficer which is concerned with product evaluation and\nwhich maintains periodic inspection of production of the\nthing concerned and by the affixing of which label, seal,\nsymbol or mark the manufacturer attests to compliance with\nthe applicable generally recognised standards; and\n\u201cLABELED\u201d bears a similar meaning;\u2019.\nDelete the definition \u201cLISTED\u201d and substitute the following-\n\u2018\u201cLISTED\u201d, in relation to equipment or materials, means\nincluded in a list published by a testing laboratory,\ninspection agency or other organisation recognised by the\nChief Fire Officer to be of a standard satisfactory to him\nwhich is concerned with the product evaluation and which\nmaintains periodic inspection of production of equipment\nand materials and, if it is stated or implied in such list, either\nthat the equipment or material meets recognised standards or has\nbeen tested and found suitable for use in a specified\nmanner;\u2019.\n\u201cLOT\u201d bears the meaning ascribed to that word in the\nRegistered Land Law (1995 Revision).\n\u201cROAD\u201d bears the meaning ascribed to that word in the Roads\nLaw (Revised).\nCHAPTER 4\n\n401.1.1\nInsert \u201cby reason of fire\u201d after \u201cproperty\u201d.\n\nSCHEDULE\nFire Code, 1997\n\nPage 12\nSL 3 of 1997\nc\n\nProvisions of\nthe Standard\nFire Prevention\nCode affected\nExceptions, adaptations and modifications\n401.2.1\nDelete \u201ca Certificate of Occupancy has been issued by the building\nofficial for that occupancy classification\u201d and substitute \u201cwhere\nrequired by law, a Certificate of Occupancy authorising occupancy\nof the relevant class has been issued under the Building Code in\nrespect of the premises concerned\u201d.\n401.2.2\nInsert \u201cof Government\u201d immediately before \u201cdepartments\u201d where it\nfirst appears.\n402.3\nDelete.\n402.4\nDelete.\n402.7\nDelete.\n402.10\nDelete.\n402.13\nDelete.\n402.14\nDelete.\n402.15.1\nSubstitute \u201cmaterials hazardous by reason of fire\u201d for \u201chazardous\nmaterials\u201d.\nTable 402.15.2\nSubstitute \u201c500\u201d for \u201c1000\u201d where it thrice appears in the column\nheaded \u201cSolid (lb)\u201d.\n402.16\nSubstitute \u201cstorage\u201d for \u201cstock\u201d.\n402.17\nDelete.\n402.22\nDelete.\n402.23\nDelete.\n402.24\nDelete.\n402.26\nSubstitute \u201c16\u201d for \u201c12\u201d.\n402.27\nDelete.\n402.31\nDelete.\n402.33\nDelete.\nCHAPTER 5\n\n501.1.1\nAmend by-\n(a) deleting the first sentence; and\n(b) deleting \u201ca permit or other proper authorisation\u201d, and\nsubstituting \u201cthe permission of the Chief Fire Officer\u201d.\n501.3\nDelete and substitute the following new section-\n\u201cIncinerator construction\nCommercial, industrial and apartment incinerators shall be-\n(a) constructed in accordance with the provisions of the building\nand mechanical codes and NFiPA 82;\n(b) equipped with an effective means for arresting sparks; and\n(c) maintained in compliance with NFiPA 82.\u201d.\n501.4.1\nAmend as follows-\n(a) by inserting after the word \u201cincinerators\u201d the words \u201cto which\n\nFire Code, 1997\nSCHEDULE\n\nc\nSL 3 of 1997\nPage 13\n\nProvisions of\nthe Standard\nFire Prevention\nCode affected\nExceptions, adaptations and modifications\n501.3 applies\u201d; and\n(b) by deleting the word \u201cmountainous\u201d and the comma preceding\nit.\n501.5\nDelete.\n503.2.1\nDelete \u201cto any public fire station or company\u201d, and substitute \u201cthe\nBrigade or any official emergency less in height of other than Group 1 Restrained, the\ninterior finish may be Class B for unsprinklered buildings and Class C for sprinklered buildings.\n\u00b2 Class C interior finish materials may be Standpipe systems shall be provided with Fire Department\nconnection at accessible locations adjacent to usable stairs.
