These Regulations may be cited as the Building Code (Amendment) Regulations, 2016 and shall come into force on 30th December, 2016. 2. The Building Code Regulations (2013 Revision), in these Regulations referred to as the \u201cprincipal Regulations\u201d, are amended by repealing regulation 2 and substituting the following regulation - \u201cDefinitions 2. In these regulations - \u201cadopted Code\u201d means a Code that applies in the Cayman Islands by virtue of regulation 3(a) to (h); and \u201cBuilding Official\u201d means the Director of Planning and anyone to whom the Director has delegated all or any part of the Director\u2019s authority under these Regulations.\u201d. 3. The principal Regulations are amended in regulation 3 as follows - (a) in the marginal note, by deleting the words \u201cStandard Building Code and other related Codes\u201d and substituting the words \u201cICC Codes to Cayman Islands\u201d; (b) in the introductory words before paragraph (a) \u2013 (i) by deleting the words \u201cthe Schedule\u201d and substituting the words \u201cSchedules 1 to 7\u201d; and (ii) by deleting the words \u201cSouthern Building Code Congress International Inc. of Birmingham in the State of Alabama\u201d Citation  and commencement Repeal and substitution of regulation 2 of the Building Code Regulations (2013 Revision) - definitions Amendment of regulation 3 -application of Standard Building Code and other related Codes and substituting the words \u201cInternational Code Council (ICC),\u201d; (c) in paragraph (a) by deleting the words \u201c1999 Edition of the Standard Building Code, as adopted by the Southern Building Code Congress International of Birmingham in the State of Alabama in the United States of America (hereinafter called the Standard Building Code)\u201d and substituting the words \u201c2009 International Building Code and the 2009 International Residential Code (hereinafter referred to as the Cayman Islands Building Code and the Cayman Islands Residential Code)\u201d; (d) in paragraph (b) - (i) by deleting the words \u201c1997 Edition of the Standard Plumbing Code, as adopted by the Southern Building Code Congress International of Birmingham in the State of Alabama in the United States of America (hereinafter in this Code referred to as the Standard Plumbing Code)\u201d and substituting the words \u201c2009 International Plumbing Code (to be known as the Cayman Islands Plumbing Code)\u201d; and (ii) by inserting after the word \u201cappurtenances\u201d the words \u201c, except where covered in the Cayman Islands Residential Code\u201d; (e) in paragraph (c) - (i) by deleting the words \u201c1999 Edition of the Standard Mechanical Code, as adopted by the Southern Building Code Congress International of Birmingham in the State of Alabama in the United States of America (hereinafter in this Code referred to as the Standard Mechanical Code)\u201d and substituting the words \u201c2009 International Mechanical Code (to be known as the Cayman Islands Mechanical Code)\u201d; (ii) by deleting the words \u201cenergy related\u201d and substituting the word \u201cmechanical\u201d; and (iii) by deleting the word \u201cand\u201d at the end of the paragraph; (f) in paragraph (d) - (i) by deleting the words \u201c1999 Edition of the Standard Gas Code, as adopted by the Southern Building Code Congress International of Birmingham in the State of Alabama in the United States of America (hereinafter in this Code referred to as the Standard Gas Code)\u201d and substituting the words \u201c2009 International Fuel and Gas Code (to be known as the Cayman Islands Fuel and Gas Code)\u201d; and (ii) by deleting the full stop and substituting a semi-colon; and (g) by inserting after paragraph (d) the following paragraphs - \u201c(e) the ICC-600 2008 relating to standards for Residential Construction in High-Wind Regions, specifically prescriptive methods to provide wind resistant designs and construction details for residential buildings sited in high wind regions, with wind climates of 100 to 150 mph., being a supplement to the Cayman Islands Residential Code; (f) the NFPA 70 National Electrical Code (NEC) 2014 ed. as amended, in relation to safe electrical design, installation, and inspection to protect people and property from electrical hazards; (g) the following American Society of Mechanical Engineers Safety Codes, as amended - (i) Safety Code for Elevators and. Escalators ASME A17.1\/CSA B44- 2007, including Table 3001.7 as amended by Schedule 7; (ii) Safety Code for Existing Elevators and Escalators (Includes Requirements for Electric and Hydraulic Elevators and Escalators) ASME A17.3-2008; and (iii) Safety Standard for Platform Lifts and Stairway Chairlifts ASME A18.1.- 2005; and (h) the 2009 International Fire Code, in relation to the protection of life and property from the hazards of fire, explosion or dangerous conditions in new and existing buildings, structures and premises.\u201d. 4. The principal Regulations are amended by inserting after regulation 3 the following regulation - \u201cApplication of Cayman Islands Building Code and Residential Code 3A  (1) The Cayman Islands Building Code applies to all buildings and structures in areas where it is adopted except those covered by the Cayman Islands Residential Code. (2) Those buildings and structures not covered in the Cayman Islands Building Code shall be regulated by the Cayman Islands Residential Code.\u201d. 5. The principal Regulations are amended in regulation 5 by repealing the marginal note and paragraph (1) and substituting the following - \u201cStandards for single family residences 5. (1) All single family residences shall be constructed to meet the structural requirements of the ICC-600 (2008) Standards for Residential Construction in High-Wind Regions.\u201d. Insertion of new regulation 3A - application of Cayman Islands Building Code and Residential Code Repeal and substitution of regulation 5(1) - regulations not to apply to certain buildings 6. The principal Regulations are amended by repealing regulations 6 to 9 and substituting the following regulation - \u201cAmendment s to adopted Codes 6. An amendment by the International Code Council, the National Fire Protection Association or the American Society of Mechanical Engineers to any of the adopted Codes shall take effect on publication in the Gazette.\u201d. 7. The principal Regulations are amended in regulation 12 - (a) by deleting the word \u201cAuthority\u201d wherever it appears and substituting the words \u201cBuilding Official\u201d; and (b) in paragraph (1) - (i) by inserting after the word \u201cbuilding\u201d the words \u201cor structure\u201d; and (ii) by inserting before the word \u201capply\u201d the words \u201cor adopted Codes\u201d. 8. The principal Regulations are amended by repealing regulation 13 and substituting the following regulation - \u201cWork done in contravention of Regulations or Codes 13.  (1) If any work to which the Regulations or adopted Codes apply is carried out in a dangerous or unsafe manner or in contravention of the Regulations or an adopted Code, the Building Official may, without prejudice to any right the Official may have to take proceedings under any other regulation, by notice, require the owner of the building or structure, in respect of which the work is being carried out, to do one or more of the following - (a) immediately cease such work; (b) restrain or remove any non-compliant work or unsafe conditions; (c) affect such remediation or alterations as are necessary to comply with the adopted Code and Regulations; (d) if life, health and or safety risks cannot be abated through the implementation of conditions (a) to (c), pull down or remove the non-compliant work; (e)  recover from the person who commissioned or carried out the work the expenses incurred in implementing any of conditions (b) to (d). (2) Subject to paragraph (3), a person who fails to comply Repeal and substitution of regulations 6 to 9 - the Register, etc. Amendment of regulation 12 - stop notices Repeal and substitution of regulation 13 - offending works with a notice served under paragraph (1) and any person who continues any work on the building to which the notice relates or on its mechanical, plumbing or building services system in contravention of such notice commits an offence and is liable on summary conviction to a fine of $5,000 or imprisonment for 6 months, or to both. (3) A person does not commit an offence under paragraph (2) by performing work as directed by the Building Official or the owner of the building or structure to remove non-compliant work or unsafe conditions. (4) If an offence by a person referred to in paragraph (2) continues for more than seven days, the Building Official may issue a second notice under paragraph (1) and any person who fails to comply with that notice or who continues work in contravention of it as described in paragraph (2), commits an offence and is liable to a fine of $5,000 or imprisonment for 6 months, or to both. 9. The principal Regulations are amended by inserting after regulation 13 the following regulations - Proceedings to correct or abate contravening work 13A. (1) If a person served with a notice under regulation 13(4) fails to comply with it promptly, the Building Official shall cause legal proceedings to be instituted - (a) to restrain, correct or abate any contravention of the Regulations or adopted Codes; or (b) to require the removal or termination of the unlawful occupancy of the building or structure to which the notice relates. (2) The Summary Court may, on application by the Building Official under this regulation - (a)  authorise the Department of Planning - (i) to restrain, correct or abate any contravention of the Regulations or adopted Codes by removal of the non-compliant work or unsafe condition; or (ii) to remove or terminate the unlawful Insertion of new regulations 13A to 13C - proceedings to correct or abate contravening work, etc. occupancy of the building or structure in contravention of this regulation; and (b) order the recovery of expenses reasonably incurred under paragraph (2)(a) from the owner of the building or structure or the person who carried out the work. Penalty for contravention of the Regulations or an adopted Code 13B. Any person who erects, constructs, alters, repairs, removes, demolishes or utilizes a mechanical system, or causes the same to be done, in contravention of these Regulations or an adopted Code commits an offence and is liable on summary conviction to a fine of $5,000 or  imprisonment for 6 months, or to both. Proceedings by the Attorney-General 13C. The commencement of a prosecution under regulation 13 or 13B does not preclude the Attorney General from instituting legal proceedings - (a) to prevent unlawful construction or to restrain, correct or abate a contravention of the Regulations or an adopted Code; (b) to prevent illegal occupancy of a building, structure or premises; or (c) to stop an illegal act, conduct, business or utilization of any mechanical, plumbing, electrical or building system in, on or about any premises.\u201d. 10. The principal Regulations are amended in regulation 14 by deleting the word \u201cAuthority\u201d wherever it appears and substituting the words \u201cBuilding Official\u201d. 11. The principal Regulations are amended by inserting after regulation 14 the following regulation - \u201cIdentification 14A. The Building Official shall carry proper identification when inspecting buildings, structures or premises in the performance of the Official\u2019s duties under these regulations and produce it when requested to do so by the owner or occupier of the building, structure or premises.\u201d. 12. The principal Regulations are amended by repealing regulation 15 and substituting the following regulation - Amendment of regulation 14 - right of entry Insertion of new regulation 14A - identification Repeal and substitution of regulation15 - immunity \u201cImmunity\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_15\", \"num\": \"15.\", \"text\": \"Neither the Governor, nor the Building Official, nor any person charged with the enforcement of these Regulations or the adopted Codes is liable in damages for anything done or omitted to be done in the discharge of their respective functions and duties required by law, while acting in good faith and without malice.\u201d. 13. The principal Regulations are amended by repealing the Schedule and substituting for that Schedule Schedules 1 to 7 of this Law. Repeal and substitution of Schedule SCHEDULE 1 (Regulation 3) AMENDMENTS TO THE 2009 INTERNATIONAL BUILDING CODE Part 1 - Amendments Provision of the International Building Code affected Exception, adaptation or modification Chapter 1 Amend Section 101.1 Title Delete the words \u201cInternational Building Code of [NAME OF JURISDICTION]\u201d and substitute the words \u201cCayman Islands Building Code,\u201d. Amend Section 101.2 Scope In the Exception, delete the word \u201cInternational\u201d and substitute the words \u201cCayman Islands\u201d. Amend Section 101.4 Referenced Codes Delete the words \u201cthrough 101.4.6 and referenced elsewhere\u201d and substitute the words \u201cand 101.4.2 are for reference only and not adopted in the Cayman Islands. Other codes referenced\u201d. Delete Section 101.4.1 Gas Delete Section 101.4.2 Mechanical Delete Section 101.4.3 Plumbing Delete Section 101.4.4 Property Maintenance Renumber Section101.4.5 Fire Prevention Renumber as section 101.4.1. Renumber Section 101.4.6 Energy Renumber as section 101.4.2. Insert Section 101.5 Adopted Codes \u201c101.5 Adopted Codes. The other codes listed in Sections 101.5.1 through 101.5.4 and referenced elsewhere in this Code shall be considered part of the requirements of this Code to the prescribed extent of each such reference.\u201d Insert Section 101.5.1 Gas \u201c101.5.1 Gas. The International Fuel and Gas Code shall mean the Cayman Islands Fuel and Gas Code as amended and shall apply to the installation of gas piping from the point of delivery, gas appliances and related accessories as covered in this Code. These requirements apply to gas piping systems extending from the point of delivery to the inlet connections of appliances and the installation and operation of residential and commercial gas appliances and related accessories.\u201d Insert Section 101.5.2 Mechanical \u201c101.5.2 Mechanical. The International Mechanical Code shall mean the Cayman Islands Mechanical Code as amended and shall apply to the installation, alterations, repairs and replacement of mechanical systems, including equipment, appliances, fixtures, fittings and\/or appurtenances, including ventilating, heating, cooling, air-conditioning and refrigeration systems, incinerators and other mechanical systems.\u201d Insert Section 101.5.3 Plumbing \u201c101.5.3 Plumbing. The International Plumbing Code shall mean the Cayman Islands Plumbing Code as amended shall apply to the installation, alteration, repair and replacement of plumbing systems, including equipment, appliances, fixtures, fittings and appurtenances, and where connected to a water or sewage system and all aspects of a medical gas system.\u201d Insert Section 101.5.4 Residential \u201c101.5.4 Residential. Any reference to the International Residential Code shall mean the Cayman Islands Residential Code as amended. When uses are permitted to be constructed in accordance with the International Residential Code, such uses must comply with the provisions of the Cayman Islands Residential Code for that specific occupancy before exercising the option of using the International Residential Code.\u201d Insert Section 101.5.5 Electrical \u201c101.5.5 Electrical. Any reference to NFPA 70 or Appendix K shall mean the National Electrical Code as amended and adopted.\u201d Insert Section 101.5.6 Elevator Code \u201c101.5.6 Elevator Code. While the Elevator Code is the adopted standard, amendments based on extracts from the ASME A17.1, ASME A17.3, ASME A18.1, and Chapter 30 of the International Building Code shall also be referenced.\u201d Amend Section 102.2 Other laws Delete the words \u201clocal, state or federal law\u201d and substitute the words \u201cCayman Islands laws and regulations\u201d. Insert Section 102.4.1 Amendments \u201c102.4.1 Amendments. Whenever amendments have been adopted for a referenced code or standard, each reference to said code or standard shall be considered to reference the amendments as well.\u201d Amend Section 102.6 Existing Structures Delete the words \u201cInternational Property Maintenance Code\u201d and substitute the words \u201cCayman Islands Building Code\u201d. Replace Section 103.1 Creation of enforcement agency Delete section 103.1 and substitute the following section - \u201c103.1 Creation of enforcement agency. Any reference to the \u201cDepartment of Building Safety\u201d shall mean the Department of Planning, which shall have primary responsibility for enforcement of this Code, as specified under the duties and powers of the Building Official.  This code may be enforced by other code enforcement divisions in the Cayman Islands but authority shall be retained by the Director of Planning.\u201d Amend Section 103.2 Appointment Delete the words \u201cchief appointing authority of the jurisdiction\u201d and substitute the words \u201cBuilding Official presiding over the authority having jurisdiction.\u201d. Amend Section 103.3 Deputies Delete the words \u201cFor the maintenance of existing properties, see the International Property Maintenance Code.\u201d. Insert Section 104.1.1 Other interpretations \u201c104.1.1 Other interpretations. Any provision or local amendment marked in this Code as [F] shall be under the primary interpretation authority having jurisdiction. Any provision marked in the Fire Code or local amendment as [B], [FG], [M] or [P] shall be under the primary interpretation authority of the Building Official.\u201d Amend Section 104.7 Department Records Delete the words \u201cBuilding Official\u201d and substitute the words \u201cDepartment of Planning\u201d. Insert Section 104.12 Cooperation of other officials and officers \u201c104.12 Cooperation of other officials and officers. The Building Official may request, and shall receive, the assistance and cooperation of other officials of the jurisdiction so far as is required in the discharge of the duties required by this Code or other pertinent law.\u201d Delete Section 105.1.1 Annual Permit Delete Section 105.1.2 Annual Permit Records Amend Section 105.2 Work exempt from permits Insert the following after the word \u201creceptacles\u201d (under the heading Electrical) - \u201cSuch repairs shall not include the cutting away of any wall, partition or portion thereof, the removal or cutting of any structural beam or load-bearing support, or the removal or change of any required means of egress, or rearrangement of parts of a structure affecting the egress requirements.  Nor shall ordinary repairs include addition to, alteration of, replacement or relocation of any standpipe, water supply, sewer, drainage, drain leader, gas, soil, waste, vent or similar piping, electric wiring or mechanical or other work affecting public health or general safety.\u201d. Amend Section 105.3.2 Time limitation of Application Insert the following sentence after the word \u201cdemonstrated\u201d - \u201cThe Building Official may also grant an extension of time, for a period of 180 days, in any case where the extension is necessary due to the occurrence of a national disaster.\u201d Amend   Section 105.5 Expiration Insert the following sentence after the word \u201cdemonstrated\u201d - \u201cThe Building Official may also grant an extension of time, for a period of 180 days, in any case where the extension is necessary due to the occurrence of a national disaster.\u201d Amend Section 105.7 Placement of Permit Delete the words \u201cor copy\u201d. Insert Section 105.7.1 Responsibility \u201c105.7.1 Responsibility. It shall be the duty of every person who performs work for the installation or repair of building, structure, electrical, gas, mechanical or plumbing systems, to which this Code is applicable, to comply with this Code.\u201d Amend Section 107.1 General Delete the words \u201cwhere required by the statutes of the jurisdiction in which the project is to be constructed\u201d and substitute the words \u201cin accordance with the requirements of this Code and the Cayman Islands Residential Code and where required by the laws and regulations governing the Cayman Islands or as required by the Building Official.\u201d. Amend Section 107.2.1 Information on Construction Documents Insert the words \u201cdrawn to scale,\u201d immediately before the word \u201cdimensioned\u201d. Replace Section 107.2.2 Fire protection system shop drawings Delete section 107.2.2 and substitute the following - \u201c107.2.2 Fire protection system shop drawings. Shop drawings, calculations and manufacturers\u2019 specifications for the fire protection system(s) shall be submitted to the authority having jurisdiction, to indicate conformity with this Code and the construction documents and shall be approved by that authority prior to the start of system installation. Shop drawings shall contain all information as required by the referenced installation standards in Chapter 9. All fire alarm and fire sprinkler systems shall require the engineer or contractor on record to submit to the authority having jurisdiction the form \u2018letter of acceptance\u2019 upon completion and installation of such systems.\u201d Insert Section 107.2.6 Manufacturer\u2019s installation instructions \u201c107.2.6 Manufacturers\u2019 installation instructions. Manufacturers\u2019 installation instructions, as required by this Code, shall be available on the job site at the time of inspection.\u201d Delete Section 107.3.2 Previous Approvals Amend Section 109.1 Payment of Fees Insert before the full stop the words \u201c, in accordance with the Development and Planning Law (2015 Revision) and Development and Planning Regulations (2015 Revision) Fee Schedules\u201d. Amend Section 109.2 Schedule of Permit Fees Delete the words \u201capplicable governing authority\u201d and substitute the words \u201cDevelopment and Planning Law (2015 Revision) and Development and Planning Regulations (2015 Revision) Fee Schedules\u201d. Delete Section 109.3 Building Permit Valuations Amend Section 109.4 Work commencing before permit issuance Delete the words \u201cshall be subject to a fee established by the Building Official that shall be in addition to the required permit fees\u201d and substitute the words \u201ccommits an offence under the Development and Planning Law (2015 Revision) or the Development and Planning Regulations (2015 Revision) and shall be subject to a fine and or after-the-fact fees as required by law\u201d. Delete Section 109.6 Refunds Insert Section 109.6 Administrative Hold \u201c109.6 Administrative Hold. Any administrative discrepancy including but not limited to, delinquency in payments, returned checks, failure to pay for re-inspection, investigation or registration fees, and failure to keep any registration, insurance or bond up-todate, may result in a hold being placed on the issuance of permits and performance of inspections of existing permits until the administrative discrepancy is corrected. Repeal and substitution of Schedule\n\nSCHEDULE 1 - Amendments to the 2009 International Building Code\nSCHEDULE 2 - Amendments to the 2009 International Mechanical Code\nSCHEDULE 3 - Amendments to the 2009 International Plumbing Code\nSCHEDULE 4 - Amendments to the 2009 International Fuel and Gas Code\nSCHEDULE 5 - Amendments to the 2009 International Residential Code\nSCHEDULE 6 - Amendments to the 2014 National Electrical Code\nSCHEDULE 7 - Required Periodic Inspection and Test Intervals for Elevators\n\nand Escalators\n\nBuilding Code (Amendment) Regulations, 2016\n\n3\nCAYMAN ISLANDS\n\nTHE DEVELOPMENT AND PLANNING LAW\n(2015 REVISION)\n\nTHE BUILDING CODE (AMENDMENT) REGULATIONS, 2016\n\nIn exercise of the powers conferred by section 42 of the Development and\nPlanning Law (2015 Revision), the Cabinet makes the following Regulations -\n1.\nThese Regulations may be cited as the Building Code (Amendment)\nRegulations, 2016 and shall come into force on 30th December, 2016.\n2.\nThe Building Code Regulations (2013 Revision), in these Regulations\nreferred to as the \u201cprincipal Regulations\u201d, are amended by repealing regulation 2\nand substituting the following regulation -\n\u201cDefinitions\n2.\nIn these regulations -\n\u201cadopted Code\u201d means a Code that applies in the Cayman\nIslands by virtue of regulation 3(a) to (h); and\n\u201cBuilding Official\u201d means the Director of Planning and anyone\nto whom the Director has delegated all or any part of the\nDirector\u2019s authority under these Regulations.\u201d.\n\n3.\nThe principal Regulations are amended in regulation 3 as follows -\n(a) in the marginal note, by deleting the words \u201cStandard Building\nCode and other related Codes\u201d and substituting the words \u201cICC\nCodes to Cayman Islands\u201d;\n(b) in the introductory words before paragraph (a) \u2013\n(i)\nby deleting the words \u201cthe Schedule\u201d and substituting the\nwords \u201cSchedules 1 to 7\u201d; and\n(ii) by deleting the words \u201cSouthern Building Code Congress\nInternational Inc. of Birmingham in the State of Alabama\u201d\nCitation  and\ncommencement\nRepeal and substitution\nof regulation 2 of the\nBuilding Code\nRegulations (2013\nRevision) - definitions\nAmendment of regulation\n3 -application of\nStandard Building Code\nand other related Codes\n\nBuilding Code (Amendment) Regulations, 2016\n\n4\nand substituting the words \u201cInternational Code Council\n(ICC),\u201d;\n(c) in paragraph (a) by deleting the words \u201c1999 Edition of the\nStandard Building Code, as adopted by the Southern Building\nCode Congress International of Birmingham in the State of\nAlabama in the United States of America (hereinafter called the\nStandard Building Code)\u201d and substituting the words \u201c2009\nInternational Building Code and the 2009 International\nResidential Code (hereinafter referred to as the Cayman Islands\nBuilding Code and the Cayman Islands Residential Code)\u201d;\n(d) in paragraph (b) -\n(i)\nby deleting the words \u201c1997 Edition of the Standard\nPlumbing Code, as adopted by the Southern Building Code\nCongress International of Birmingham in the State of\nAlabama in the United States of America (hereinafter in this\nCode referred to as the Standard Plumbing Code)\u201d and\nsubstituting the words \u201c2009 International Plumbing Code\n(to be known as the Cayman Islands Plumbing Code)\u201d; and\n(ii) by inserting after the word \u201cappurtenances\u201d the words \u201c,\nexcept where covered in the Cayman Islands Residential\nCode\u201d;\n(e) in paragraph (c) -\n(i)\nby deleting the words \u201c1999 Edition of the Standard\nMechanical Code, as adopted by the Southern Building\nCode Congress International of Birmingham in the State of\nAlabama in the United States of America (hereinafter in this\nCode referred to as the Standard Mechanical Code)\u201d and\nsubstituting the words \u201c2009 International Mechanical Code\n(to be known as the Cayman Islands Mechanical Code)\u201d;\n(ii) by deleting the words \u201cenergy related\u201d and substituting the\nword \u201cmechanical\u201d; and\n(iii) by deleting the word \u201cand\u201d at the end of the paragraph;\n(f)\nin paragraph (d) -\n(i)\nby deleting the words \u201c1999 Edition of the Standard Gas\nCode, as adopted by the Southern Building Code Congress\nInternational of Birmingham in the State of Alabama in the\nUnited States of America (hereinafter in this Code referred\nto as the Standard Gas Code)\u201d and substituting the words\n\u201c2009 International Fuel and Gas Code (to be known as the\nCayman Islands Fuel and Gas Code)\u201d; and\n(ii) by deleting the full stop and substituting a semi-colon; and\n(g) by inserting after paragraph (d) the following paragraphs -\n\nBuilding Code (Amendment) Regulations, 2016\n\n5\n\u201c(e) the ICC-600 2008 relating to standards for Residential\nConstruction\nin\nHigh-Wind\nRegions,\nspecifically\nprescriptive methods to provide wind resistant designs and\nconstruction details for residential buildings sited in high\nwind regions, with wind climates of 100 to 150 mph., being\na supplement to the Cayman Islands Residential Code;\n(f)\nthe NFPA 70 National Electrical Code (NEC) 2014 ed. as\namended, in relation to safe electrical design, installation,\nand inspection to protect people and property from electrical\nhazards;\n(g) the following American Society of Mechanical Engineers\nSafety Codes, as amended -\n(i)\nSafety Code for Elevators and. Escalators ASME\nA17.1\/CSA B44- 2007, including Table 3001.7 as\namended by Schedule 7;\n(ii) Safety Code for Existing Elevators and Escalators\n(Includes Requirements for Electric and Hydraulic\nElevators and Escalators) ASME A17.3-2008; and\n(iii) Safety Standard for Platform Lifts and Stairway\nChairlifts ASME A18.1.- 2005; and\n(h) the 2009 International Fire Code, in relation to the\nprotection of life and property from the hazards of fire,\nexplosion or dangerous conditions in new and existing\nbuildings, structures and premises.\u201d.\n4.\nThe principal Regulations are amended by inserting after regulation 3 the\nfollowing regulation -\n\u201cApplication\nof\nCayman\nIslands\nBuilding\nCode\nand\nResidential\nCode\n3A  (1) The Cayman Islands Building Code applies to all\nbuildings and structures in areas where it is adopted except those\ncovered by the Cayman Islands Residential Code.\n(2) Those buildings and structures not covered in the\nCayman Islands Building Code shall be regulated by the Cayman\nIslands Residential Code.\u201d.\n\n5.\nThe principal Regulations are amended in regulation 5 by repealing the\nmarginal note and paragraph (1) and substituting the following -\n\u201cStandards\nfor\nsingle\nfamily\nresidences\n5.\n (1) All single family residences shall be constructed to\nmeet the structural requirements of the ICC-600 (2008) Standards\nfor Residential Construction in High-Wind Regions.\u201d.\nInsertion of new\nregulation 3A -\napplication of Cayman\nIslands Building Code\nand Residential Code\nRepeal and substitution\nof regulation 5(1) -\nregulations not to apply\nto certain buildings\n\nBuilding Code (Amendment) Regulations, 2016\n\n6\n\n6.\nThe principal Regulations are amended by repealing regulations 6 to 9 and\nsubstituting the following regulation -\n\u201cAmendment\ns to adopted\nCodes\n6.\nAn amendment by the International Code Council, the\nNational Fire Protection Association or the American Society of\nMechanical Engineers to any of the adopted Codes shall take\neffect on publication in the Gazette.\u201d.\n7.\nThe principal Regulations are amended in regulation 12 -\n(a) by deleting the word \u201cAuthority\u201d wherever it appears and\nsubstituting the words \u201cBuilding Official\u201d; and\n(b) in paragraph (1) -\n(i)\nby inserting after the word \u201cbuilding\u201d the words \u201cor\nstructure\u201d; and\n(ii) by inserting before the word \u201capply\u201d the words \u201cor adopted\nCodes\u201d.\n8.\nThe principal Regulations are amended by repealing regulation 13 and\nsubstituting the following regulation -\n\u201cWork done in\ncontravention of\nRegulations\nor\nCodes\n13.  (1) If any work to which the Regulations or adopted Codes\napply is carried out in a dangerous or unsafe manner or in\ncontravention of the Regulations or an adopted Code, the Building\nOfficial may, without prejudice to any right the Official may have\nto take proceedings under any other regulation, by notice, require\nthe owner of the building or structure, in respect of which the work\nis being carried out, to do one or more of the following -\n(a) immediately cease such work;\n(b) restrain or remove any non-compliant work or\nunsafe conditions;\n(c) affect such remediation or alterations as are\nnecessary to comply with the adopted Code and\nRegulations;\n(d) if life, health and or safety risks cannot be abated\nthrough the implementation of conditions (a) to\n(c), pull down or remove the non-compliant work;\n(e)  recover from the person who commissioned or\ncarried out the work the expenses incurred in\nimplementing any of conditions (b) to (d).\n(2) Subject to paragraph (3), a person who fails to comply\nRepeal and substitution\nof regulations 6 to 9 - the\nRegister, etc.\nAmendment of regulation\n12 - stop notices\nRepeal and substitution\nof regulation 13 -\noffending works\n\nBuilding Code (Amendment) Regulations, 2016\n\n7\nwith a notice served under paragraph (1) and any person who\ncontinues any work on the building to which the notice relates or\non its mechanical, plumbing or building services system in\ncontravention of such notice commits an offence and is liable on\nsummary conviction to a fine of $5,000 or imprisonment for 6\nmonths, or to both.\n(3) A person does not commit an offence under paragraph\n(2) by performing work as directed by the Building Official or the\nowner of the building or structure to remove non-compliant work\nor unsafe conditions.\n(4) If an offence by a person referred to in paragraph (2)\ncontinues for more than seven days, the Building Official may\nissue a second notice under paragraph (1) and any person who\nfails to comply with that notice or who continues work in\ncontravention of it as described in paragraph (2), commits an\noffence and is liable to a fine of $5,000 or imprisonment for 6\nmonths, or to both.\n\n9.\nThe principal Regulations are amended by inserting after regulation 13 the\nfollowing regulations -\nProceedings\nto\ncorrect or abate\ncontravening work\n\n13A. (1) If a person served with a notice under regulation 13(4)\nfails to comply with it promptly, the Building Official shall cause\nlegal proceedings to be instituted -\n(a) to restrain, correct or abate any contravention of\nthe Regulations or adopted Codes; or\n(b) to require the removal or termination of the\nunlawful occupancy of the building or structure\nto which the notice relates.\n(2) The Summary Court may, on application by the\nBuilding Official under this regulation -\n(a)  authorise the Department of Planning -\n(i)\nto\nrestrain,\ncorrect\nor\nabate\nany\ncontravention of the Regulations or adopted\nCodes by removal of the non-compliant\nwork or unsafe condition; or\n(ii) to remove or terminate the unlawful\nInsertion of new\nregulations 13A to 13C -\nproceedings to correct or\nabate contravening work,\netc.\n\nBuilding Code (Amendment) Regulations, 2016\n\n8\noccupancy of the building or structure in\ncontravention of this regulation; and\n(b) order the recovery of expenses reasonably\nincurred under paragraph (2)(a) from the owner\nof the building or structure or the person who\ncarried out the work.\nPenalty\nfor\ncontravention\nof\nthe Regulations or\nan adopted Code\n13B. Any person who erects, constructs, alters, repairs, removes,\ndemolishes or utilizes a mechanical system, or causes the same to\nbe done, in contravention of these Regulations or an adopted\nCode commits an offence and is liable on summary conviction to\na fine of $5,000 or  imprisonment for 6 months, or to both.\nProceedings by the\nAttorney-General\n13C. The commencement of a prosecution under regulation 13 or\n13B does not preclude the Attorney General from instituting legal\nproceedings -\n(a) to prevent unlawful construction or to restrain,\ncorrect or abate a contravention of the\nRegulations or an adopted Code;\n(b) to prevent illegal occupancy of a building,\nstructure or premises; or\n(c) to stop an illegal act, conduct, business or\nutilization\nof\nany\nmechanical,\nplumbing,\nelectrical or building system in, on or about any\npremises.\u201d.\n10. The principal Regulations are amended in regulation 14 by deleting the\nword \u201cAuthority\u201d wherever it appears and substituting the words \u201cBuilding\nOfficial\u201d.\n11. The principal Regulations are amended by inserting after regulation 14 the\nfollowing regulation -\n\u201cIdentification\n14A. The Building Official shall carry proper identification\nwhen inspecting buildings, structures or premises in the\nperformance of the Official\u2019s duties under these regulations\nand produce it when requested to do so by the owner or\noccupier of the building, structure or premises.\u201d.\n\n12. These\nrequirements apply to gas piping systems extending from the point of\ndelivery to the inlet connections of appliances and the installation and\noperation of residential and commercial gas appliances and related\naccessories.\u201d\nInsert Section\n101.5.2 Mechanical\n\u201c101.5.2 Mechanical. The International Mechanical Code shall\nmean the Cayman Islands Mechanical Code as amended and shall\napply to the installation, alterations, repairs and replacement of\nmechanical systems, including equipment, appliances, fixtures,\nfittings and\/or appurtenances, including ventilating, heating, cooling,\nair-conditioning and refrigeration systems, incinerators and other\nmechanical systems.\u201d\nInsert Section\n101.5.3 Plumbing\n\u201c101.5.3 Plumbing. The International Plumbing Code shall mean\nthe Cayman Islands Plumbing Code as amended shall apply to the\ninstallation, alteration, repair and replacement of plumbing systems,\nincluding equipment, appliances, fixtures, fittings and appurtenances,\nand where connected to a water or sewage system and all aspects of a\nmedical gas system.\u201d\nInsert Section\n101.5.4 Residential\n\u201c101.5.4 Residential. Any reference to the International Residential\nCode shall mean the Cayman Islands Residential Code as amended.\nWhen uses are permitted to be constructed in accordance with the\nInternational Residential Code, such uses must comply with the\nprovisions of the Cayman Islands Residential Code for that specific\noccupancy before exercising the option of using the International\nResidential Code.\u201d\nInsert Section\n101.5.5 Electrical\n\u201c101.5.5 Electrical. Any reference to NFPA 70 or Appendix K shall\nmean the National Electrical Code as amended and adopted.\u201d\nInsert Section\n101.5.6 Elevator\nCode\n\u201c101.5.6 Elevator Code. While the Elevator Code is the adopted\nstandard, amendments based on extracts from the ASME A17.1,\nASME A17.3, ASME A18.1, and Chapter 30 of the International\nBuilding Code shall also be referenced.\u201d\nAmend Section\n102.2 Other laws\nDelete the words \u201clocal, state or federal law\u201d and substitute the words\n\u201cCayman Islands laws and regulations\u201d.\n\nBuilding Code (Amendment) Regulations, 2016\n\n12\nInsert Section\n102.4.1\nAmendments\n\u201c102.4.1 Amendments. All fire alarm and fire\n\nBuilding Code (Amendment) Regulations, 2016\n\n14\nsprinkler systems shall require the engineer or contractor on\nrecord to submit to the authority having jurisdiction the form\n\u2018letter of acceptance\u2019 upon completion and installation of such\nsystems.\u201d\nInsert Section\n107.2.6\nManufacturer\u2019s\ninstallation\ninstructions\n\u201c107.2.6 Manufacturers\u2019 installation instructions.
