(1) These Regulations may be cited as the Caymanian Protection (Amendment) Regulations, 2026. The principal Regulations are amended in regulation 4(6) by deleting the words \u201con conviction\u201d and substituting the words \u201con summary conviction\u201d. 5. Insertion of regulation 8A - exemption from requirement to leave Islands on cessation of employment within first two years of grant of work permit 5. The principal Regulations are amended by inserting after regulation 8 the following regulation \u2014 \u201cExemption from requirement to leave Islands on cessation of employment within first two years of grant of work permit 8A.(1) Further to section 64 of the Act, where a person who is the holder of a work permit ceases to be employed with the person\u2019s employer based on a claim of the existence of a circumstance specified in paragraph (2), the person may apply to the Director of WORC in accordance with paragraph (3) to be exempted from the requirement under that section to leave the Islands for a period of not less than one year. (2) For the purposes of paragraph (1), the circumstances are as follows \u2014 (a) the person was required to work overtime regularly \u2014 (i) without compensation; or (ii) without an agreement that provided that no overtime would be paid for extra hours of work or without compensation, and that was approved by and registered with a Labour Tribunal established under section 74 of the Labour Act (2021 Revision); (b) the person was required to do work of a nature outside of the person\u2019s job description on a regular basis, without compensation; (c) the person was discriminated against on any of the grounds set out in section 80(1) of the Labour Act (2021 Revision); (d) the person was the victim of retaliation by the person\u2019s employer in response to a complaint or concern made to or about the employer; Caymanian Protection (Amendment) Regulations, 2026 Regulation 5 SL 16 of 2026 (e) the person was the victim of harassment, including sexual harassment, physical harassment, verbal harassment, and bullying; (f) the position has become redundant; or (g) any other circumstance which, in the opinion of the Director of WORC, justifies the person being exempted from the requirement under section 64 of the Act to leave the Islands for a period of not less than one year. (3) An application under paragraph (1) shall be \u2014 (a) made within three working days after the person ceases to be employed with the person\u2019s employer; (b) in writing; and (c) accompanied by \u2014 (i) proof of the relevant circumstance identified in the application; and (ii) in the case of a circumstance under paragraph (2)(a) to (e), and paragraph (2)(g) as applicable, proof that the person lodged a complaint with the Department of Labour and Pensions, the Royal Cayman Islands Police Service, the Gender Equality Tribunal or any other government agency with investigative powers, regarding the relevant circumstance identified in the application. (4) The Director of WORC shall notify the person under paragraph (1) in writing of the determination made in respect of the person\u2019s application within thirty working days after receiving a complete application.\u201d. Regulation 6 Caymanian Protection (Amendment) Regulations, 2026 SL 16 of 2026\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_6\", \"num\": \"6.\", \"text\": \"Repeal and substitution of regulation 9 - employer to notify of cessation of employment 6. The principal Regulations are amended by repealing regulation 9 and substituting the following regulation \u2014 \u201cEmployer to notify of cessation of employment\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_9\", \"num\": \"9.\", \"text\": \"(1) Where a person whose employment in the Islands is authorised under a work permit, the grant of which is conditional on that person remaining in the employment of a particular employer, and the person ceases to be employed by that employer \u2014 (a) the work permit ceases to be valid; and (b) within seven days after the person\u2019s employment with the employer ceases, the employer shall give written notice of the termination of the employment to the Director of WORC. (2) An employer who fails to comply with paragraph (1)(b) commits an offence and is liable on summary conviction to a fine of twenty thousand dollars or to imprisonment for a term of two years, or to both.\u201d. 7. Insertion of regulation 15A - financial standing requirements for the purposes of certain provisions of the Act 7. The principal Regulations are amended by inserting after regulation 15 the following regulation \u2014 \u201cFinancial standing requirements for the purposes of certain provisions of the Act 15A. For the purposes of sections 20(3), 28(8)(d), 38(3)(g), 40(2A)(a), 40(3)(b)(iv) and 58(3)(d) of the Act, the financial standing requirements in respect of persons with dependants are as follows \u2014 (a) in respect of a person with one dependant, a monthly income of at least five thousand dollars; and (b) in respect of a person with more than one dependant \u2014 (i) a monthly income of at least five thousand dollars; and (ii) an additional amount of at least one thousand dollars in monthly income per additional dependant.\u201d. Caymanian Protection (Amendment) Regulations, 2026 Regulation 8 SL 16 of 2026 8. Insertion of regulation 16A - prescribed particulars for declarations to be provided under the Act 8. The principal Regulations are amended by inserting after regulation 16 the following regulation \u2014 \u201cPrescribed particulars for declarations to be provided under the Act 16A. The prescribed particulars to be contained in the declarations referred to in sections 28(6A), 37(12), 38(10), 40(1D), 47(12) and section 50(10) of the Act are set out in Schedule 5.\u201d. 9. Repeal of regulation 17 - prescribed fees 9. prescribed particulars to be contained in declarations ....................... 12\n\nCaymanian Protection (Amendment) Regulations, 2026\nRegulation 1\n\nc\nSL 16 of 2026\nPage 5\n\nCAYMAN ISLANDS\n\nCaymanian Protection Act\n(2022 Revision)\nCAYMANIAN PROTECTION (AMENDMENT)\nREGULATIONS, 2026\n(SL 16 of 2026)\nIn exercise of the powers conferred by section 72 of the Caymanian Protection Act (2022\nRevision), the Cabinet makes the following Regulations \u2014\n1.\nCitation and commencement\n1.\n(1) These Regulations may be cited as the Caymanian Protection (Amendment)\nRegulations, 2026.\n(2) These Regulations come into force immediately after the Immigration\n(Transition) (Amendment and Validation) Act, 2026 comes into force.\n2.\nAmendment of regulation 1 of the Immigration Regulations (2025 Revision) -\ncitation\n2.\nThe Immigration Regulations (2025 Revision), in these Regulations referred to as the\n\u201cprincipal Regulations\u201d, are amended in regulation 1 by deleting the word\n\u201cImmigration\u201d and substituting the words \u201cCaymanian Protection\u201d.\n\nRegulation 3\nCaymanian Protection (Amendment) Regulations, 2026\n\nPage 6\nSL 16 of 2026\nc\n\n3.\nAmendment of regulation 2 - definitions\n3.\nThe principal Regulations are amended in regulation 2 by inserting after the definition\nof the words \u201cfine arts\u201d, the following definition \u2014\n\u201c \u201cGender Equality Tribunal\u201d means the Gender Equality Tribunal\nestablished under section 23 of the Gender Equality Act, 2011;\u201d.\n4.\nAmendment of regulation 4 - applications for work permits\n4.\nThe principal Regulations are amended in regulation 4(6) by deleting the words \u201con\nconviction\u201d and substituting the words \u201con summary conviction\u201d.\n5.\nInsertion of regulation 8A - exemption from requirement to leave Islands on\ncessation of employment within first two years of grant of work permit\n5.\nThe principal Regulations are amended by inserting after regulation 8 the following\nregulation \u2014\n\u201cExemption from requirement to leave Islands on cessation of\nemployment within first two years of grant of work permit\n8A.(1)\nFurther to section 64 of the Act, where a person who is the holder of\na work permit ceases to be employed with the person\u2019s employer\nbased on a claim of the existence of a circumstance specified in\nparagraph (2), the person may apply to the Director of WORC in\naccordance with paragraph (3) to be exempted from the requirement\nunder that section to leave the Islands for a period of not less than\none year.\n(2) For the purposes of paragraph (1), the circumstances are as\nfollows \u2014\n(a)\nthe person was required to work overtime regularly \u2014\n(i)\nwithout compensation; or\n(ii) without an agreement that provided that no overtime\nwould be paid for extra hours of work or without\ncompensation, and that was approved by and registered\nwith a Labour Tribunal established under section 74 of the\nLabour Act (2021 Revision);\n(b) the person was required to do work of a nature outside of the\nperson\u2019s job description on a regular basis, without\ncompensation;\n(c)\nthe person was discriminated against on any of the grounds set\nout in section 80(1) of the Labour Act (2021 Revision);\n(d) the person was the victim of retaliation by the person\u2019s\nemployer in response to a complaint or concern made to or\nabout the employer;\n\nCaymanian Protection (Amendment) Regulations, 2026\nRegulation 5\n\nc\nSL 16 of 2026\nPage 7\n\n(e)\nthe person was the victim of harassment, including sexual\nharassment, physical harassment, verbal harassment, and\nbullying;\n(f)\nthe position has become redundant; or\n(g) any other circumstance which, in the opinion of the Director of\nWORC, justifies the person being exempted from the\nrequirement under section 64 of the Act to leave the Islands for\na period of not less than one year.\n(3) An application under paragraph (1) shall be \u2014\n(a)\nmade within three working days after the person ceases to be\nemployed with the person\u2019s employer;\n(b) in writing; and\n(c)\naccompanied by \u2014\n(i)\nproof of the relevant circumstance identified in the\napplication; and\n(ii) in the case of a circumstance under paragraph (2)(a) to (e),\nand paragraph (2)(g) as applicable, proof that the person\nlodged a complaint with the Department of Labour and\nPensions, the Royal Cayman Islands Police Service, the\nGender Equality Tribunal or any other government agency\nwith investigative powers, regarding the relevant\ncircumstance identified in the application.\n(4) The Director of WORC shall notify the person under paragraph (1)\nin writing of the determination made in respect of the person\u2019s\napplication within thirty working days after receiving a complete\napplication.\u201d.\n\nRegulation 6\nCaymanian Protection (Amendment) Regulations, 2026\n\nPage 8\nSL 16 of 2026\nc\n\n6.\nRepeal and substitution of regulation 9 - employer to notify of cessation of\nemployment\n6.\nThe principal Regulations are amended by repealing regulation 9 and substituting the\nfollowing regulation \u2014\n\u201cEmployer to notify of cessation of employment\n9.\n(1) Where a person whose employment in the Islands is authorised under\na work permit, the grant of which is conditional on that person\nremaining in the employment of a particular employer, and the\nperson ceases to be employed by that employer \u2014\n(a)\nthe work permit ceases to be valid; and\n(b) within seven days after the person\u2019s employment with the\nemployer ceases, the employer shall give written notice of the\ntermination of the employment to the Director of WORC.\n(2) An employer who fails to comply with paragraph (1)(b) commits an\noffence and is liable on summary conviction to a fine of twenty\nthousand dollars or to imprisonment for a term of two years, or to\nboth.\u201d.\n7.\nInsertion of regulation 15A - financial standing requirements for the\npurposes of certain provisions of the Act\n7.\nThe principal Regulations are amended by inserting after regulation 15 the following\nregulation \u2014\n\u201cFinancial standing requirements for the purposes of certain\nprovisions of the Act\n15A. For the purposes of sections 20(3), 28(8)(d), 38(3)(g), 40(2A)(a),\n40(3)(b)(iv) and 58(3)(d) of the Act, the financial standing requirements\nin respect of persons with dependants are as follows \u2014\n(a) in respect of a person with one dependant, a monthly income of\nat least five thousand dollars; and\n(b) in respect of a person with more than one dependant \u2014\n(i)\na monthly income of at least five thousand dollars; and\n(ii) an additional amount of at least one thousand dollars in\nmonthly income per additional dependant.\u201d.\n\nCaymanian Protection (Amendment) Regulations, 2026\nRegulation 8\n\nc\nSL 16 of 2026\nPage 9\n\n8.\nInsertion of regulation 16A - prescribed particulars for declarations to be\nprovided under the Act\n8.\nThe principal Regulations are amended by inserting after regulation 16 the following\nregulation \u2014\n\u201cPrescribed particulars for declarations to be provided under the\nAct\n16A. The prescribed particulars to be contained in the declarations referred to in\nsections 28(6A), 37(12), 38(10), 40(1D), 47(12) and section 50(10) of the\nAct are set out in Schedule 5.\u201d.\n9.\nRepeal of regulation 17 - prescribed fees\n9.\nThe principal Regulations are amended by repealing regulation 17.\n10.\nRepeal of regulation 27 - waiver of fees\n10. The principal Regulations are amended by repealing regulation 27.\n11.\nRepeal of Schedule 1 - fees\n11. The principal Regulations are amended by repealing Schedule 1.\n\nRegulation 12\nCaymanian Protection (Amendment) Regulations, 2026\n\nPage 10\nSL 16 of 2026\nc\n\n12.\nAmendment of Schedule 4 - forms\n12. The principal Regulations are amended in Schedule 4 as follows \u2014\n(a)\nby repealing Form 2 and substituting the following forms \u2014\n\u201cFORM 1A\nCAYMANIAN PROTECTION ACT\n(2022 Revision)\n(section 37(16))\nRESIDENCY AND EMPLOYMENT RIGHTS CERTIFICATE\n\n(for the spouse or civil partner of a permanent resident)\n\nTHIS IS TO CERTIFY THAT \u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026.\u2026.., of\n\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026.has with effect from this day been granted the right to reside in the\nCayman Islands for a period of fifteen years from the date hereof as the spouse or civil\npartner of a permanent resident.
