The Bill would also allow licences to be granted to registered non-profit organisations and reduce the number of, and define more precisely, the categories of licences issued under the Law. Clause 1 provides for the short title and commencement of the legislation. Clause 2 amends the definitions of \u201clicence\u201d and \u201cpermitted hours\u201d in section 2 of the Law in consequence of amendments made by clauses 7 and 8 of this Bill.  The clause also adds a new definition of \u201cmobile bar\u201d. Clause 3 inserts new section 4A into the Law, which provides for the Cabinet to give policy directions to the Board in the performance of its functions and requires the Board to give effect to such policy directions. Clause 4 amends section 7 by inserting a new subsection requiring the Board, before it issues a package licence and a retail licence in respect of the same premises, to be satisfied that there is a clear demarcation between the areas used within the premises for the dispensing of intoxicating liquor under each licence and that licensees are able to control each area. Clause 5 amends section 8 to allow the Board to grant licences to non-profit organisations that are registered under the Non-Profit Organisations Law, 2017. Clause 6 amends section 9 by deleting the requirements for licensed premises to have plainly marked and lighted exits and an adequate fire extinguishing system since section 9 already provides that the Board, before granting a licence, shall have regard to representations concerning the suitability of premises made by the Chief Fire Officer.  The clause also deletes the reference to representations made by the Chief Medical Officer; as these are no longer necessary since smoking is prohibited inside licensed premises. Clause 7 amends section 10(1) to delete wine and beer licences, reducing the number of categories of licence from eight to seven. The Liquor Licensing (Amendment) Bill, 2018 The clause amends the terms of retail licences, temporary licences and restaurant licences in section 10 as follows - A retail licence is restricted to the disposal of intoxicating liquor for consumption on the premises of a bar, mobile bar, night club, sea-going vessel or of an establishment at which tasting events of wine or other intoxicating liquors are held. A temporary licence is specified as having a maximum period of validity of ninety days. A restaurant licence is broadened to permit the disposal of liquor to any person if it is consumed on the premises and food is served on the premises. Clause 7 also amends section 10 to permit Cabinet to prescribe fees for an extension granted by the Chairman under section 11(3) or for permission given by the Board under section 11(6).  Finally, the clause amends section 10 to permit the Board to waive fees for a temporary or occasional licence for an event that is part of a national festival, like Pirate\u2019s Week. Clause 8 amends section 11 to empower the Board to permit licensed premises covered by a package licence to sell liquor on Sundays during such hours as the Board may determine.  The clause also makes minor amendments to subsections (1) and (8) in consequence of the elimination of wine and beer licences by clause 6. This Law may be cited as the Liquor Licensing (Amendment) Bill, 2018 and shall come into force on such date as the Cabinet may by Order appoint. 2. The Liquor Licensing Law (2016 Revision), in this Law referred to as \u201cthe principal Law\u201d, is amended in section 2 - (a) in the definition of \u201clicence\u201d - (i) by deleting the word \u201ceight\u201d and substituting the word \u201cseven\u201d; and (ii) by deleting the words \u201c10(2) to (8)\u201d and substituting the words \u201c10(2) to (7)\u201d; Short title and commencement Amendment of section 2 of the Liquor Licensing Law (2016 Revision) - definitions The Liquor Licensing (Amendment) Bill, 2018 (b) by inserting after the definition of \u201clicensing session\u201d the following definition - \u201c \u201cmobile bar\u201d means a bar for the disposal of intoxicating liquors to the public that can be moved from place to place and set up on premises or at a designated outdoor space covered the bar\u2019s licence or another licence;\u201d and (c) in the definition of \u201cpermitted hours\u201d by inserting after the words \u201c11(3)\u201d the words \u201cand includes the hours covered by an extension granted by the Chairman under section 11(3) or permission granted by the Board under section 11(6)\u201d; and 3. The principal Law is amended by inserting after section 4 the following section - \u201cPolicy directions 4A. The Cabinet may, after consultation with the Board, give such general directions as to the policy to be followed by the Board in the performance of its functions under this or any other Law as appear to Cabinet to be necessary in the public interest, and the Board shall give effect to any such directions.\u201d. 4. Section 7 of the principal Law is amended by inserting after subsection (5) the following subsection - \u201c(5A) A Board must be satisfied, before granting a new package licence or retail licence which relates to the same premises, that - (a) there is a clear demarcation between the areas used within the premises for the dispensing of intoxicating liquor under each licence; and (b) licensees are able to control each area.\u201d. 5. Section 8 of the principal Law is amended - (a) in subsection (1) - (i) in paragraph (b), by inserting after the word \u201cLaw\u201d the words \u201c(2018 Revision) or is registered as a non-profit organisation under the Non-Profit Organisations Law, 2017\u201d; and (ii) in paragraph (c), by inserting after the word \u201ccompany\u201d the words \u201cor a non-profit organisation\u201d; and (b) in subsection (1A) - Insertion of new section 4A - policy directions Amendment of section 7 - nature of a licence Amendment of section 8 - qualifications of a licensee The Liquor Licensing (Amendment) Bill, 2018 (i) by inserting after the word \u201ccompany\u201d the words \u201cor a nonprofit organisation\u201d; and (ii) in paragraph (a) by inserting after the word \u201cLaw\u201d the words \u201c(2018 Revision) or under the Non-Profit Organisations Law, 2017\u201d. 6. Section 9 of the principal Law is amended - (a) in subsection (1) - (i) by deleting paragraphs (a) and (b); and (ii) by renumbering paragraphs (c), (d) and (e) as paragraphs (a), (b) and (c); and (b) in subsection (4) by deleting the words \u201cthe Chief Medical Officer,\u201d. 7. Section 10 of the principal Law is amended - (a) in subsection (1) - (i) by deleting the word \u201ceight\u201d and substituting the word \u201cseven\u201d; and (ii) by deleting paragraph (g) and renumbering paragraph (h) as paragraph (g); (b) by repealing subsection (4) and substituting the following subsection - \u201c(4) A retail licence - (a) permits the disposal of intoxicating liquor for consumption on the premises of - (i) a bar or mobile bar; (ii) a night club; (iii) a sea-going vessel; or (iv) a retail establishment at which tasting events of samples of intoxicating spirits are held; but (b) does not permit disposal to another licensee for the purpose of disposal by that licensee under the terms of his licence.\u201d; (c) in subsection (6) by deleting the word \u201ctemporarily\u201d and substituting the words \u201cfor a period not exceeding ninety days\u201d; (d) by deleting subsection (7) and substituting the following subsection - \u201c(7) A restaurant licence permits the disposal of intoxicating liquor to any person at a restaurant, or other premises affixed to the land, at which food is served for consumption on the premises.\u201d; Amendment of section 9 - requirements for licensed premises Amendment of section 10 - categories of licenses The Liquor Licensing (Amendment) Bill, 2018 (e) by deleting subsection (8) and substituting the following subsection - \u201c(8) The Cabinet may from time to time prescribe the fees for a licence, an extension granted by the Chairman under section 11(3) or permission granted by the Board under section 11(6).\u201d; (f) in subsection (9) by deleting the words \u201cThe fees for a licence may be prescribed from time to time, and shall\u201d and substituting the words \u201cThe prescribed licence fees shall, subject to subsection (9A),\u201d; and (g) by inserting after subsection (9) the following subsection - \u201c(9A) A Board may waive, in whole or in part, the fees required to be paid for a temporary or occasional licence for the disposal of intoxicating liquor at an event that is part of a national festival of the Islands.\u201d. 8. Section 11 of the principal Law is amended - (a) in subsection (1), by deleting the words \u201can hotel licensee, a restaurant licensee or a wine and beer licensee\u201d and substituting the words \u201ca hotel or restaurant licensee\u201d; (b) in subsection (6) - (i) by inserting after the words \u201cretail licence\u201d the words \u201cor a package licence\u201d; and (ii) by deleting the words \u201c, and such permission shall be endorsed upon the licence\u201d; (c) by inserting after subsection (6) the following subsection - \u201c(6A) Hours covered by permission granted by the Board under subsection (6) shall be endorsed upon the licence and are deemed to be permitted hours for the purposes of this Law.\u201d; and Amendment of section 11 - hours for sale of alcoholic liquor The Liquor Licensing (Amendment) Bill, 2018 (d) in subsection (8) by deleting the words \u201c, a restaurant licence or a wine and beer licence\u201d and substituting the words \u201cor a restaurant licence\u201d. The clause also makes minor amendments to subsections\n(1) and (8) in consequence of the elimination of wine and beer licences by clause\n6.\n\nThe Liquor Licensing (Amendment) Bill, 2018\n\n4\nTHE LIQUOR LICENSING (AMENDMENT) BILL, 2018\n\nARRANGEMENT OF CLAUSES\n\n1.\nShort title and commencement\n2.\nAmendment of section 2 of the Liquor Licensing Law (2016 Revision) -\n\ndefinitions\n3.\nInsertion of new section 4A - policy directions\n4.\nAmendment of section 7 - nature of a licence\n5.\nAmendment of section 8 - qualifications of a licensee\n6.\nAmendment of section 9 - requirements for licensed premises\n7.\nAmendment of section 10 - categories of licenses\n8.\nAmendment of section 11 - hours for sale of alcoholic liquor\n\nThe Liquor Licensing (Amendment) Bill, 2018\n\n5\nCAYMAN ISLANDS\n\nA BILL TO AMEND THE LIQUOR LICENSING LAW (2016 REVISION)\nTO BROADEN THE BOARD\u2019S POWER TO PERMIT SUNDAY\nOPENING OF LICENSED PREMISES; TO PROVIDE FOR CABINET TO\nGIVE POLICY DIRECTIONS TO THE BOARD IN THE\nPERFORMANCE OF ITS FUNCTIONS TO REDUCE THE NUMBER OF\nCATEGORIES OF LICENCES AND AMEND THE DEFINITIONS OF\nRETAIL, TEMPORARY AND RESTAURANT LICENCES; TO PERMIT\nLICENCES TO BE GRANTED TO REGISTERED NON-PROFIT\nORGANISATIONS; TO ALLOW THE BOARD TO WAIVE FEES FOR\nCERTAIN TEMPORARY OR OCCASIONAL LICENCES; TO\nAUTHORISE CABINET TO SET ADDITIONAL FEES BY\nREGULATION; AND FOR INCIDENTAL AND CONNECTED MATTERS\n\nENACTED by the Legislature of the Cayman Islands.\n1.\nThis Law may be cited as the Liquor Licensing (Amendment) Bill, 2018 and\nshall come into force on such date as the Cabinet may by Order appoint.\n2.\nThe Liquor Licensing Law (2016 Revision), in this Law referred to as \u201cthe\nprincipal Law\u201d, is amended in section 2 -\n(a) in the definition of \u201clicence\u201d -\n(i)\nby deleting the word \u201ceight\u201d and substituting the word\n\u201cseven\u201d; and\n(ii) by deleting the words \u201c10(2) to (8)\u201d and substituting the\nwords \u201c10(2) to (7)\u201d;\nShort title and\ncommencement\nAmendment of section 2\nof the Liquor Licensing\nLaw (2016 Revision) -\ndefinitions\n\nThe Liquor Licensing (Amendment) Bill, 2018\n\n6\n(b) by inserting after the definition of \u201clicensing session\u201d the\nfollowing definition -\n\u201c \u201cmobile bar\u201d means a bar for the disposal of intoxicating\nliquors to the public that can be moved from place to place\nand set up on premises or at a designated outdoor space\ncovered the bar\u2019s licence or another licence;\u201d and\n(c) in the definition of \u201cpermitted hours\u201d by inserting after the words\n\u201c11(3)\u201d the words \u201cand includes the hours covered by an\nextension granted by the Chairman under section 11(3) or\npermission granted by the Board under section 11(6)\u201d; and\n\n3.\nThe principal Law is amended by inserting after section 4 the following\nsection -\n\u201cPolicy\ndirections\n4A. The Cabinet may, after consultation with the Board, give\nsuch general directions as to the policy to be followed by the\nBoard in the performance of its functions under this or any\nother Law as appear to Cabinet to be necessary in the public\ninterest, and the Board shall give effect to any such directions.\u201d.\n\n4.\nSection 7 of the principal Law is amended by inserting after subsection (5)\nthe following subsection -\n\u201c(5A)\nA Board must be satisfied, before granting a new package\nlicence or retail licence which relates to the same premises, that -\n(a) there is a clear demarcation between the areas used within the\npremises for the dispensing of intoxicating liquor under each\nlicence; and\n(b) licensees are able to control each area.\u201d.\n5.\nSection 8 of the principal Law is amended -\n(a) in subsection (1) -\n(i)\nin paragraph (b), by inserting after the word \u201cLaw\u201d the\nwords \u201c(2018 Revision) or is registered as a non-profit\norganisation under the Non-Profit Organisations Law,\n2017\u201d; and\n(ii) in paragraph (c), by inserting after the word \u201ccompany\u201d the\nwords \u201cor a non-profit organisation\u201d; and\n(b) in subsection (1A) -\nInsertion of new section\n4A - policy directions\nAmendment of section 7\n- nature of a licence\nAmendment of section 8\n- qualifications of a\nlicensee\n\nThe Liquor Licensing (Amendment) Bill, 2018\n\n7\n(i)\nby inserting after the word \u201ccompany\u201d the words \u201cor a nonprofit organisation\u201d; and\n(ii) in paragraph (a) by inserting after the word \u201cLaw\u201d the words\n\u201c(2018 Revision) or under the Non-Profit Organisations\nLaw, 2017\u201d.\n6.\nSection 9 of the principal Law is amended -\n(a) in subsection (1) -\n(i)\nby deleting paragraphs (a) and (b); and\n(ii) by renumbering paragraphs (c), (d) and (e) as paragraphs\n(a), (b) and (c); and\n(b) in subsection (4) by deleting the words \u201cthe Chief Medical\nOfficer,\u201d.\n7.\nSection 10 of the principal Law is amended -\n(a) in subsection (1) -\n(i)\nby deleting the word \u201ceight\u201d and substituting the word\n\u201cseven\u201d; and\n(ii) by deleting paragraph (g) and renumbering paragraph (h) as\nparagraph (g);\n(b) by repealing subsection (4) and substituting the following\nsubsection -\n\u201c(4) A retail licence -\n(a) permits the disposal of intoxicating liquor for\nconsumption on the premises of -\n(i)\na bar or mobile bar;\n(ii) a night club;\n(iii) a sea-going vessel; or\n(iv) a retail establishment at which tasting\nevents of samples of intoxicating spirits are\nheld; but\n(b) does not permit disposal to another licensee for the\npurpose of disposal by that licensee under the terms of\nhis licence.\u201d;\n(c) in subsection (6) by deleting the word \u201ctemporarily\u201d and\nsubstituting the words \u201cfor a period not exceeding ninety days\u201d;\n(d) by deleting subsection (7) and substituting the following\nsubsection -\n\u201c(7) A restaurant licence permits the disposal of\nintoxicating liquor to any person at a restaurant, or other\npremises affixed to the land, at which food is served for\nconsumption on the premises.\u201d;\nAmendment of section 9\n- requirements for\nlicensed premises\nAmendment of section\n10 - categories of\nlicenses\n\nThe Liquor Licensing (Amendment) Bill, 2018\n\n8\n(e) by deleting subsection (8) and substituting the following\nsubsection -\n\u201c(8) The Cabinet may from time to time prescribe the\nfees for a licence, an extension granted by the Chairman\nunder section 11(3) or permission granted by the Board\nunder section 11(6).\u201d;\n(f)\n in subsection (9) by deleting the words \u201cThe fees for a licence\nmay be prescribed from time to time, and shall\u201d and substituting\nthe words \u201cThe prescribed licence fees shall, subject to\nsubsection (9A),\u201d; and\n(g) by inserting after subsection (9) the following subsection -\n\u201c(9A)\nA Board may waive, in whole or in part, the\nfees required to be paid for a temporary or occasional\nlicence for the disposal of intoxicating liquor at an event\nthat is part of a national festival of the Islands.\u201d.\n8.\nSection 11 of the principal Law is amended -\n(a) in subsection (1), by deleting the words \u201can hotel licensee, a\nrestaurant licensee or a wine and beer licensee\u201d and substituting\nthe words \u201ca hotel or restaurant licensee\u201d;\n(b) in subsection (6) -\n(i)\nby inserting after the words \u201cretail licence\u201d the words \u201cor a\npackage licence\u201d; and\n(ii) by deleting the words \u201c, and such permission shall be\nendorsed upon the licence\u201d;\n(c) by inserting after subsection (6) the following subsection -\n\u201c(6A)\nHours covered by permission granted by the\nBoard under subsection (6) shall be endorsed upon the licence\nand are deemed to be permitted hours for the purposes of this\nLaw.\u201d;
