Clause 1 contains the short title and commencement provisions. Clause 2 amends the principal Law to make it gender neutral. Clause 3 amends section 2 of the principal Law by introducing new definitions for terms used in the legislation. Clause 4 amends section 4 of the principal Law by repealing and replacing subsection (3) to change the composition of the Builders Board established under that section so that the voting members appointed by the Cabinet three of which must have sufficient experience and knowledge in the construction and development industries. The amendment also changes the qualification requirements for appointment to the Builders Board so that such members must comprise at least a person registered by a prescribed recognised body as a professional in engineering, a person licensed as an electrician or master electrician under the Electricity Regulations (2011 Revision), a person licensed in the Islands as an plumber or master plumber under the Water Authority Regulations (2018 Revision) and a person qualified to practice law in the Islands under the Legal Practitioners Law (2015 Revision) also appointed by the Cabinet. The Director of Planning is also a member of the Board and serving by virtue of the office. Clause 5 amends section 6 of the principal Law to change the categories of registration for business entities to register as contractors. Clause 6 amends section 13 of the principal Law to change the time at which a licence expires to twenty-four months after the date of its issue. Clause 7 amends section 15 of the principal Law to provide for the removal of the name of a business entity from the register or suspend the licence of a business entity if the business entity fails to comply with the Code of Ethics and Professional Conduct. Clause 7 also amends section 15  of the principal Law to provide that the revocation of a licence or the removal of the name of a business entity from the register must not be construed as a deletion of the historical particulars of the business entity but the register shall be an accurate representation of registered business entities and business entities that hold a valid licence. Clause 8 provides for the repeal of Part IV of the principal Law which deals with the registration of qualified persons. Objects and Reasons The Builders (Amendment) Bill, 2019 K - V01 Introduced Clause 9 amends of section 27 of the principal Law to remove the reference to section 20(8) of the principal Law. Clause 10 amends sections 30 of the principal Law to change the reference to \u201cqualified individual\u201d to \u201cqualified person\u201d. Clause 11 amends section 40 of the principal Law to change the reference to \u201cqualified individual\u201d to \u201cqualified person\u201d. Clause 12 amends section 41 of the principal Law to change the references to \u201cqualified individual\u201d to \u201cqualified person\u201d. Clause 13 contains savings and transitional provisions regarding the members of the Builders Board and qualified individuals. The principal Law is amended in section 6 as follows \u2014 The Builders (Amendment) Bill, 2019 Clause 4 K - V01 Introduced (a) in subsection (2), by deleting the words \u201cpersons who are qualified\u201d and substituting the words \u201cqualified persons in accordance with regulations made under this Law\u201d; (b) by repealing subsection (4) and substituting the following subsections \u2014 \u201c(4) A business entity may be registered as a contractor in the category of \u2014 (a) general contractor- high rise; (b) general contractor; (c) building contractor; (d) small works contractor; (e) civil engineering contractor; (f) electrical contractor; (g) elevator and conveyance contractor; (h) fuel gas contractor; (i) fire protection contractor; (j) mechanical contractor; (k) plumbing contractor; or (l) (other specified) \u2013 contractor, and the Board may determine from time to time, the category of work that shall comprise any of the categories specified in paragraphs (a) to (l) or the respective sub-trades and may, in addition but without recategorising a business entity, permit a business entity to undertake work of a kind that belongs to another category of registration and such permission may relate to a particular project or class of projects, or both. (4A) A business entity that desires to register as an (other specified) - contractor may apply to the Board for registration at the business entity\u2019s discretion, provided that, if the business entity is so registered, this Law shall govern the business entity but such registration shall not be required except where the (other specified) - contractor is required to consult with Department of Planning in the discharge of their duties.\u201d; (c) by repealing subsection (5) and substituting the following subsections \u2014 \u201c(5) A contractor registered by the Board in one of the categories specified in subsection (4) may also be registered as a contractor in another category if considered by the Board to be so qualified. (5A) An individual seeking to engage in owner-contracting may apply to the Board for an exemption from the registration requirements Clause 6 The Builders (Amendment) Bill, 2019 K - V01 Introduced under this Law, and such an exemption may be limited to a single house or duplex once every seven years, but the time limitation shall not apply \u2014 (a) to additions, ancillary buildings, conversions between single houses and duplexes and renovation of existing buildings; or (b) as determined by the Board in special circumstances. (5B) A labour broker shall not be registered under the registration categories. (5C) A business entity that enters into a contract with a labour broker or another business entity for the supply of labour to conduct work on a project shall ensure that the labour broker or other business entity is in compliance with the Trade and Business Law (2018 Revision) prior to entering into the contract and over the duration of the contract. (5D) A contractor registered by the Board in one of the categories specified in subsection (4) or a person engaging in ownercontracting may sub-contract work to a business entity from another category but shall be responsible for the resultant construction. (5E) Registration under this Law shall not have the effect of dispensing with the necessity of compliance or obtaining permission where such permission or compliance is required under any other Law.\u201d; and (d) by inserting after subsection (11) the following subsection \u2014 \u201c(12) In this section \u201cpermission\u201d includes registration, licence, authorisation and permit.\u201d.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_6\", \"num\": \"6.\", \"text\": \"Amendment of section 13 - issuance and expiry of registration as a business entity 6. The amendment also\nchanges the qualification requirements for appointment to the Builders Board so that such\nmembers must comprise at least a person registered by a prescribed recognised body as a\nprofessional in engineering, a person licensed as an electrician or master electrician under\nthe Electricity Regulations (2011 Revision), a person licensed in the Islands as an\nplumber or master plumber under the Water Authority Regulations (2018 Revision) and a\nperson qualified to practice law in the Islands under the Legal Practitioners Law (2015\nRevision) also appointed by the Cabinet. The Director of Planning is also a member of\nthe Board and serving by virtue of the office.\nClause 5 amends section 6 of the principal Law to change the categories of registration\nfor business entities to register as contractors.\nClause 6 amends section 13 of the principal Law to change the time at which a licence\nexpires to twenty-four months after the date of its issue.\nClause 7 amends section 15 of the principal Law to provide for the removal of the name\nof a business entity from the register or suspend the licence of a business entity if the\nbusiness entity fails to comply with the Code of Ethics and Professional Conduct. and\n(b) in sections 7(1), 10(2)(a), (b), (c) and (d), 16(3) and (6), 19(3) and (5),\n20(3), 24(6)(b) and (7)(a), 25(2), 26(7)(b), and 41(1) and (2) and\nparagraph 3(1) of the Schedule, by deleting the word \u201che\u201d wherever it\nappears in those provisions and substituting the words \u201che or she\u201d.\n3.\nAmendment of section 2 - definintions\n3.\nThe principal Law is amended in section 2 as follows \u2014\n(a)\nby deleting the definitions of \u201cbuilding contractor\u201d, \u201cgeneral contractor\u201d,\n\u201cqualified individual\u201d, \u201cregistered\u201d, \u201csub-trade\u201d and \u201ctrades contractor\u201d;\nand\n(b) by inserting the following definitions in the appropriate alphabetical\nsequence \u2014\n\u201c \u201cbuilding contractor\u201d means a business entity which \u2014\n(a)\nconstructs any building or structure where the highest\noccupied floor is three storeys or less, other than a\nmedical facility; or\n(b) repairs or renovates any building of any size where such\nwork does not affect the structural integrity of the\nbuilding;\n\u201celectrical contractor\u201d includes a business entity that constructs,\ninstalls, alters, maintains and repairs any electrical system or\ninstallation, system component, equipment or appliance;\n\u201celevator and conveyance contractor\u201d includes a business entity\nthat constructs, installs, alters, maintains and repairs any elevator,\nescalator, dumbwaiter, moving walk, or material lift;\n\u201cfire protection contractor\u201d includes a business entity that\nconstructs, installs, alters, maintains or repairs any fire protection\nsystem or any related system components, equipment or devices;\n\u201cfuel gas contractor\u201d includes a business entity that constructs,\ninstalls, alters, maintains or repairs any fuel gas system, piping\nsystem, appliance or equipment;\n\u201cgeneral contractor\u201d means a business entity which \u2014\n(a)\nperforms any type or description of construction, other\nthan civil engineering construction, to construct any\nbuilding where the highest occupied floor is less than\nseven storeys; or\n\nThe Builders (Amendment) Bill, 2019\nClause 3\n\nc\nK - V01 Introduced\nPage 9\n\n(b) repairs or renovates any building of any size where such\nwork does not affect the structural integrity of the\nbuilding;\n\u201cgeneral contractor - high rise\u201d means a business entity which\nperforms any type or description of construction, other than civil\nengineering construction;\n\u201clabour broker\u201d means a person that supplies labour to another\nperson to conduct work on a construction project;\n\u201cmechanical contractor\u201d includes a business entity that constructs,\ninstalls, alters, maintains or repairs any mechanical system, system\ncomponent, equipment or appliance;\n\u201c(other specified) - contractor\u201d means a business entity that\ncarries on sub-trade work within one of the categories listed in\nsection 6(4)(a) to (e) including roofing or pool construction or such\nother work as may be determined by the Board;\n\u201cowner-contracting\u201d means acting as a contractor by a Caymanian\nfor the purpose of building his or her home;\n\u201cplumbing contractor\u201d includes a business entity that constructs,\ninstalls, alters, maintains and repairs any plumbing and sanitary\nsystem, system component, equipment or device;\n\u201cqualified person\u201d means a person who possess the necessary\nknowledge and skill to carry out work in a category;\n\u201cregistered\u201d, in relation to a business entity, means registered\nunder section 6 to undertake work in relation to which the\nregistration relates and includes temporary registration;\n\u201csmall works contractor\u201d means a business entity which \u2014\n(a)\nconstructs an ancillary or accessory structure not\nexceeding one storey in height ;\n(b) constructs a fence and a retaining wall that is not over six\nfeet in height, unless supporting a surcharge;\n(c)\nconstructs decks, sidewalks and driveways and similar\nlow horizontal structures;\n(d) installs building accessories; or\n(e)\nrepairs or renovates buildings where such work does not\naffect the structural integrity of the building, not\nexceeding three thousand square feet in floor area per\nproject; and\n\u201csub-trade\u201d means specific elements of a trade performed by a\nbusiness entity.\u201d.\n\nClause 4\nThe Builders (Amendment) Bill, 2019\n\nPage 10\nK - V01 Introduced\nc\n\n4.\nAmendment of section 4 - Builders Board\n4.\nThe principal Law is amended in section 4 as follows \u2014\n(a)\nin subsection (1), by deleting the words \u201cqualified individuals\u201d and\nsubstituting the words \u201cqualified persons\u201d;\n(b) by repealing subsection (3) and substituting the following subsection \u2014\n\u201c(3) The Board shall consist of \u2014\n(a)\nnine voting members appointed by the Cabinet three of which\nshall possess sufficient experience and knowledge in the\nconstruction and development industries, and such members\nshall comprise at least one of each of the following \u2014\n(i)\na person registered by a prescribed recognised body as a\nprofessional in engineering;\n(ii) a person licensed as an electrician or master electrician\nunder the Electricity Regulations (2011 Revision); and\n(iii) a person licensed in the Islands as a plumber or master\nplumber under the Water Authority Regulations (2018\nRevision);\n(b) a person qualified to practice law in the Islands under the\nLegal Practitioners Law (2015 Revision) appointed by the\nCabinet; and\n(c)\nthe Director of Planning who shall serve by virtue of the\noffice.\u201d;\n(c)\nin subsection (8) \u2014\n(i)\nby deleting the words \u201cQualified Individuals\u201d and substituting the\nwords \u201cQualified Persons\u201d; and\n(ii) by deleting the words \u201cqualified individuals\u201d and substituting the\nwords \u201cqualified persons\u201d; and\n(d) by inserting after subsection (8) the following subsection \u2014\n\u201c(8A) The Board shall issue and maintain a Code of Ethics and\nProfessional Conduct that shall govern the conduct of registered\nbusiness entities and qualified persons and which shall be\nadministered by the Board or a committee appointed by the\nBoard for that purpose.\u201d.\n5.\nAmendment of section 6 - criteria for registration of a business entity as a\ncontractor\n5.\nThe principal Law is amended in section 6 as follows \u2014\n\nThe Builders (Amendment) Bill, 2019\nClause 4\n\nc\nK - V01 Introduced\nPage 11\n\n(a)\nin subsection (2), by deleting the words \u201cpersons who are qualified\u201d and\nsubstituting the words \u201cqualified persons in accordance with regulations\nmade under this Law\u201d;\n(b) by repealing subsection (4) and substituting the following subsections \u2014\n\u201c(4) A business entity may be registered as a contractor in the category\nof \u2014\n(a)\ngeneral contractor- high rise;\n(b) general contractor;\n(c)\nbuilding contractor;\n(d) small works contractor;\n(e)\ncivil engineering contractor;\n(f)\nelectrical contractor;\n(g) elevator and conveyance contractor;\n(h) fuel gas contractor;\n(i)\nfire protection contractor;\n(j)\nmechanical contractor;\n(k) plumbing contractor; or\n(l)\n(other specified) \u2013 contractor,\nand the Board may determine from time to time, the category of\nwork that shall comprise any of the categories specified in\nparagraphs (a) to (l) or the respective sub-trades and may, in\naddition but without recategorising a business entity, permit a\nbusiness entity to undertake work of a kind that belongs to another\ncategory of registration and such permission may relate to a\nparticular project or class of projects, or both.\n(4A) A business entity that desires to register as an (other specified) -\ncontractor may apply to the Board for registration at the business\nentity\u2019s discretion, provided that, if the business entity is so\nregistered, this Law shall govern the business entity but such\nregistration shall not be required except where the (other specified)\n- contractor is required to consult with Department of Planning in\nthe discharge of their duties.\u201d;\n(c)\nby repealing subsection (5) and substituting the following subsections \u2014\n\u201c(5) A contractor registered by the Board in one of the categories\nspecified in subsection (4) may also be registered as a contractor in\nanother category if considered by the Board to be so qualified.\n(5A) An individual seeking to engage in owner-contracting may apply to\nthe Board for an exemption from the registration requirements\n\nClause 6\nThe Builders (Amendment) Bill, 2019\n\nPage 12\nK - V01 Introduced\nc\n\nunder this Law, and such an exemption may be limited to a single\nhouse or duplex once every seven years, but the time limitation\nshall not apply \u2014\n(a)\nto additions, ancillary buildings, conversions between single\nhouses and duplexes and renovation of existing buildings; or\n(b) as determined by the Board in special circumstances.\n(5B) A labour broker shall not be registered under the registration\ncategories.\n(5C) A business entity that enters into a contract with a labour broker or\nanother business entity for the supply of labour to conduct work on\na project shall ensure that the labour broker or other business entity\nis in compliance with the Trade and Business Law (2018 Revision)\nprior to entering into the contract and over the duration of the\ncontract.\n(5D) A contractor registered by the Board in one of the categories\nspecified in subsection (4) or a person engaging in ownercontracting may sub-contract work to a business entity from another\ncategory but shall be responsible for the resultant construction.\n(5E) Registration under this Law shall not have the effect of dispensing\nwith the necessity of compliance or obtaining permission where\nsuch permission or compliance is required under any other Law.\u201d;\nand\n(d) by inserting after subsection (11) the following subsection \u2014\n\u201c(12) In this section \u201cpermission\u201d includes registration, licence,\nauthorisation and permit.\u201d.\n6.\nAmendment of section 13 - issuance and expiry of registration as a\nbusiness entity\n6.\nThe principal Law is amended in section 13(5) by deleting the word \u201ctwelve\u201d and\nsubstituting the word \u201ctwenty-four\u201d.\n7.\nAmendment of section 15 - removal, suspension, etc., of business entities\nfrom register\n7.\nThe principal Law is amended in section 15 as follows \u2014\n(a)\nin subsection (1) \u2014\n(i)\nin paragraph (f), by deleting after the semi-colon the word \u201cor\u201d; and\n(ii) by inserting after paragraph (f) the following paragraph \u2014\n\u201c(fa) the business entity fails to comply with the Code of Ethics and\nProfessional\nConduct\nissued\nand\nmaintained\nunder\nsection 4(8A); or\u201d; and\n\nThe Builders (Amendment) Bill, 2019\nClause 9\n\nc\nK - V01 Introduced\nPage 13\n\n(b) by inserting after subsection (10) the following subsection \u2014\n\u201c(11) The revocation of a licence or the removal of the name of a\nbusiness entity from the register under this section shall not be\nconstrued as a deletion of the historical particulars of the business\nentity but the register shall be an accurate representation of\nregistered business entities and business entities that hold a valid\nlicence.\u201d.8.\n8.\nRepeal of Part IV - registration of qualified individuals\n8.\nThe principal Law is amended in section 27(4) by deleting the words \u201cand 20(8)\u201d.\n9.\nAmendment of section 27 - powers of court in relation to non-compliance\nnotices\n9.\nThe principal Law is amended in section 27(4) by deleting the words \u201cand 20(8)\u201d.\n10.\nAmendment of section 30 - right of the public to complain\n10. The principal Law is amended in section 30(1) by deleting the words \u201c, a qualified\nindividual or both,\u201d and substituting the words \u201cor qualified person, or both,\u201d.\n11.\nAmendment of section 40 - regulations\n11. The principal Law is amended in section 40(2) as follows \u2014\n(a)\nin paragraph (f) by deleting the words \u201cqualified individuals\u201d and\nsubstituting the words \u201cqualified persons\u201d;\n(b) in paragraph (g) by deleting the words \u201cunder section 20(5)\u201d; and\n(c)\nby inserting after paragraph (g) the following paragraph \u2014\n\u201c(ga) a Code of Ethics and Professional Conduct;\u201d.\n12.\nAmendment of section 41 - transitional\n12. The principal Law is amended in section 41 as follows \u2014\n(a)\nin subsection (1) \u2014\n(i)\nby deleting words \u201cqualified individual\u201d and substituting the words\n\u201cqualified person\u201d; and\n(ii) by deleting the word \u201cindividual\u201d wherever it appears and\nsubstituting the word \u201cperson\u201d; and\n(b) in subsection (2) by deleting the words \u201cqualified individual\u201d and\nsubstituting the words \u201cqualified person\u201d.\n13.\nSavings and transitional provisions\n13.
