This Bill therefore seeks to amend the Litter Act (1997 Revision) (\u201cthe principal Act\u201d) to- (a) increase penalties for various offences under the principal Act; (b) empower the Cabinet to make regulations creating an administrative penalty system in respect of offences; and (c) modernise some of the language of the principal Act. Clause 1 provides the short title of the legislation. Clause 1 also contains a commencement provision for the legislation. Clause 2 amends the principal Act to change the word \u201cLaw\u201d to \u201cAct\u201d. Clause 3 amends section 2 of the principal Act to correct the heading of section 2. Clause 4 amends section 3 of the principal Act to increase penalties for littering in public places. It is proposed that the fine will be increased from $500 to $5000 and the period of imprisonment will increase from 6 months to twelve months. Clause 5 amends section 4 of the principal Act to increase fines for littering premises. It is proposed that the fine will be increased from $500 to $5000 and the period of imprisonment will increase from 6 months to twelve months. Clause 6 amends section 5 of the principal Act to increase fines for causing another person to contravene sections 3 or 4 of the principal Act. It is proposed that the fine will be increased from $500 to $1000 and for a second offence from $1000 to $2500. The term of imprisonment for a subsequent offence will increase from six months to twelve months. Clause 7 repeals and replaces section 6 of the principal Act to increase fines for failure to comply with a notice given by an Environmental Health Officer to remove litter from premises. It is proposed that the fine will increase from $500 to $1000 and that there will be a further fine of two hundred and fifty dollars for every day during which the failure is continued after conviction. Clause 8 amends section 7 of the principal Act to increase fines for interfering with a person exercising authority under the principal Act. It is proposed that the fine will be increased from $500 to $5000. Clause 9 amends section 8 of the principal Act by repealing and replacing subsection (2) of that section in order to increase fines for refusing to comply with a notice to remove a derelict vehicle. Clause 10 repeals and replaces section 14 in order to modernise the language of that section. (2) A notice in writing may be served on a person either personally, by being sent by post to the person\u2019s last known business or private address, or it may be posted on a conspicuous position on the premises on which the litter has been left. and\n(ii) by deleting the words \u201csix months\u201d and substituting the words\n\u201ctwelve months\u201d.\n\nLitter (Amendment) Bill, 2026\nClause 7\n\nc\nIntroduced\nPage 9\n\n7.\nRepeal of section 6 and substitution - officer shall enforce removal of litter\n7.\nThe principal Act is amended by repealing section 6 and substituting the following\nsection\u2014\n\u201cOfficer shall enforce removal of litter\n6.(1) Without prejudice to any proceedings for an offence committed under section 4\nor under any other law, where litter is left or caused to be kept in or on any\npremises in such circumstances as to cause, contribute to or tend to the\ndefacement of the premises by such litter, an officer shall give notice, either\norally or in writing, to \u2014\n(a)\nthe person who left the litter or caused the litter to be left; or\n(b) the owner or occupier of the premises,\nrequiring the person \u2014\n(i)\nforthwith in the case of dead animals, carrion or other litter\nconsidered by the officer to be dangerous to health or life; and,\n(ii) in any other case, within such time as may be limited by the notice\nnot being less than three days,\nto remove the litter so as to restore the premises to a condition satisfactory to\nthe officer.\n(2) A notice in writing may be served on a person either personally, by being sent\nby post to the person\u2019s last known business or private address, or it may be\nposted on a conspicuous position on the premises on which the litter has been\nleft.\n(3) A person who fails to comply with the requirements of a notice under subsection\n(1) commits an offence and liable on summary conviction \u2014\n(a)\nto a fine of one thousand dollars; and\n(b) to a further fine of two hundred and fifty dollars for every day during which\nthe failure is continued after conviction,\nand an officer may, without prejudice to proceedings for an offence in respect\nof such failure, enter the premises and remove the litter so left or caused to be\nleft, and may recover summarily, as a civil debt, from the person in default the\nexpenses reasonably incurred in so doing.\u201d.\n8.\nAmendment of section 7 - power to enter premises\n8.\nThe principal Act is amended in section 7(3) as follows \u2014\n(a)\nby deleting the words \u201cis guilty of an offence\u201d and substituting the words\n\u201ccommits an offence\u201d; and\n\nClause 9\nLitter (Amendment) Bill, 2026\n\nPage 10\nIntroduced\nc\n\n(b) by deleting the words \u201cliable on conviction to a fine of five hundred\ndollars\u201d and substituting the words \u201cis liable on summary conviction to a\nfine of five thousand dollars\u201d.\n9.\nAmendment of section 8 - duty of officer to remove derelict vehicles\n9.\nThe principal Act is amended in section 8 by repealing subsection (2) and substituting\nthe following subsection\u2014\n\u201c(2) A person who fails to comply with a notice under subsection (1)\ncommits an offence and is liable on summary conviction to \u2014\n(a)\na fine of one thousand five hundred dollars; and\n(b) a further fine of two hundred and fifty dollars for every day\nduring which the failure is continued after conviction,\nand an officer shall, without prejudice to the officer\u2019s right to take\nproceedings for a fine in respect of such failure, remove the derelict\nvehicle so left or caused to be left, and the Crown may recover\nsummarily, as a civil debt, from the person in default the expenses\nreasonably incurred in so doing.\u201d.\n\nLitter (Amendment) Bill, 2026\nClause 10\n\nc\nIntroduced\nPage 11\n\n10.\nRepeal of section14 and substitution; insertion of section 14A - regulations;\nadministrative fines system\n10. The principal Act is amended by repealing section 14 and substituting the following\nsections \u2014\n\u201cRegulations\n14.
