The Cayman Islands (Constitution) (Amendment) Order 2020 (UKSI 2020:1283)\", \"parties\": [], \"longTitle\": null}, \"docKind\": null}, \"bill\": null, \"judgment\": null}}","akn_full_text":"1\nEXPLANATORY MEMORANDUM TO\nTHE CAYMAN ISLANDS CONSTITUTION (AMENDMENT) ORDER 2020\n2020 No. 1283\n1.\nIntroduction\n1.1\nThis explanatory memorandum has been prepared by the Foreign, Commonwealth and\nDevelopment Office and is laid before Parliament by Command of Her Majesty.\n2.\nPurpose of the instrument\n2.1\nThis Order makes several amendments to the Constitution of the Cayman Islands, in\nline with the commitments and strategy of the constitutional framework in the 2012\nWhite Paper on the Overseas Territories available at\nhttps:\/\/www.gov.uk\/government\/publications\/the-overseas-territories-securitysuccess-and-sustainability). It follows proposals from the Cayman Islands\nGovernment and agreement reached between the United Kingdom Government and a\nCayman Islands delegation in negotiations in December 2018. However, agreement to\nthe removal of the Governor\u2019s legislative reserved power was withdrawn following its\nuse at the point the Governor assented to the Civil Partnership Act on 4 September\n2020.\n3.\nMatters of special interest to Parliament\nMatters of special interest to the Joint Committee on Statutory Instruments\n3.1\nNone.\nMatters relevant to Standing Orders Nos. 83P and 83T of the Standing Orders of the House\nof Commons relating to Public Business (English Votes for English Laws)\n3.2\nAs the instrument is required to be laid before Parliament, but is not subject to any\nfurther parliamentary procedure there are no matters relevant to Standing Orders Nos.\n83P and 83T of the Standing Orders of the House of Commons relating to Public\nBusiness.\n4.\nExtent and Territorial Application\n4.1\nThe territorial extent of this instrument is the Cayman Islands.\n4.2\nThe territorial application of this instrument is the Cayman Islands.\n5.\nEuropean Convention on Human Rights\n5.1\nAs the instrument is not subject to parliamentary procedure, no statement is required.\n6.\nLegislative Context\n6.1\nThis instrument is made under the sections 5 and 7 of the West Indies Act 1962 (c. 19)\nand amends the Cayman Islands Constitution Order 2009 (S.I. 2009\/1373, as amended\nby the Cayman Islands Constitution (Amendment) Order 2016 (S.I. 2016\/780).\nCertified copy from legislation.gov.uk Publishing\n\n2\n7.\nPolicy background\nWhat is being done and why?\n7.1\nThe United Kingdom Government\u2019s policy on the constitutional arrangements with\nthe Overseas Territory is set out in the 2012 White Paper: \u201cThe Overseas Territories:\nSecurity, Success and Sustainability\u201d. The current fundamental structure of the\nconstitutional relationships provides that powers are devolved to the elected\nGovernments of the Overseas Territories to the maximum extent possible consistent\nwith the United Kingdom needing to retain those powers necessary to discharge its\nsovereign responsibilities. The 2012 White Paper made clear the United Kingdom\nGovernment\u2019s commitment to ensure the constitutional arrangements with the\nOverseas Territories work effectively to promote the best interests of the Territories\nand of the United Kingdom, and to ensure a dialogue is sustained with all those\nTerritories that wish to engage.\n7.2\nIn October 2018, the Cayman Islands Government made a number of proposals to the\nUnited Kingdom Government on amending the 2009 Cayman Islands Constitution\nlargely based on precedents in other Overseas Territories\u2019 constitutions. Negotiations\ntook place in December 2018 and this instrument reflects the agreement reached\nbetween the United Kingdom Government and Cayman Islands delegation during\nthose negotiations. However, agreement to the removal of the Governor\u2019s legislative\nreserved power was withdrawn following its use at the point the Governor assented to\nthe Civil Partnership Act on 4 September 2020.\n7.3\nThe instrument makes several amendments to the Constitution of the Cayman Islands,\nto update and clarify the processes of Government. In particular, the instrument\nchanges the name of the Legislative Assembly to Parliament. It abolishes Her\nMajesty\u2019s power of disallowance of locally-enacted legislation, but introduces instead\nsome pre-legislative controls. It makes clearer that the Cayman Islands Cabinet has\nautonomous capacity with respect to domestic affairs. It removes the Governor\u2019s\nexemption from a duty to consult the Cabinet, but defines certain exceptions to this. It\nalso provides for Parliamentary Secretaries and a Police Service Commission. It\nprovides an obligation for the Secretary of State for Foreign Affairs to notify the\nPremier of proposed Acts of the United Kingdom Parliament that would extend\ndirectly to the Cayman Islands or Orders in Council extending any provisions of an\nAct of the United Kingdom Parliament to the Cayman Islands.\n8.\nEuropean Union (Withdrawal) Act\/Withdrawal of the United Kingdom from the\nEuropean Union\n8.1\nThis instrument does not relate to withdrawal from the European Union \/ trigger the\nstatement requirements under the European Union (Withdrawal) Act.\n9.\nConsolidation\n9.1\nThis instrument does not involve consolidation.\n10.\nConsultation outcome\n10.1\nThis instrument follows negotiations during December 2018 between the United\nKingdom Government and a delegation from the Cayman Islands comprising\nmembers of the Cayman Islands Government, the Cayman Islands Opposition and\nofficials. A draft of this instrument was subsequently debated in the Cayman Islands\nCertified copy from legislation.gov.uk Publishing\n\n3\nLegislative Assembly on 6 December 2019. The Premier of the Cayman Islands\ncommunicated consent to the draft instrument on 10 December 2019 along with\ndetails of the public consultation that had taken place.
