This Law may be cited as the Conditional Release Law (2019 Revision).\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_2\", \"num\": \"2.\", \"text\": \"Interpretation 2. (1) In this Law \u2014 \u201cBoard\u201d means the Conditional Release Board established by section 4; \u201cchild\u201d means a person under the age of eighteen years; \u201cconditional release\u201d means release referred to in section 7; \u201celectronic monitoring\u201d means surveillance using an electronic device of any description attached to a person allowing \u2014 (a) the person\u2019s location to be monitored; and (b) the person\u2019s position and the electronic device\u2019s current status to be reported back to a central location; \u201cGovernor\u201d means the Governor acting in his discretion; \u201clicence\u201d means a licence referred to in section 12 or 14; \u201cSecretary\u201d means the Secretary of the Conditional Release Board, referred to in section 4(1); \u201cvictim\u201d, in relation to an offence, means \u2014 Conditional Release Law (2019 Revision) (a) the person to whom harm is done or who suffers continuing physical, financial or emotional loss as a result of the commission of the offence; and (b) where the person described in paragraph (a) is dead, ill or otherwise incapable of making a Victim Impact Statement, includes \u2014 (i) the spouse or any relative of that person; or (ii) anyone who has, in law or fact, the custody of that person or is responsible for the care or support of that person; or (iii) a dependant of that person; \u201cVictim Impact Report\u201d means a report by an expert providing a specialist opinion on the traumatic impact of the crime on the victim and any consequential needs of the victim; and \u201cVictim Impact Statement\u201d means a written or oral statement in which a victim of a crime makes representations.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_3\", \"num\": \"3.\", \"text\": \"Application 3. (1) This Law applies to all prisoners regardless of when they were convicted or sentenced, including prisoners who have no right of abode in the Islands or are liable to be deported. (2) In relation to prisoners who have no right of abode in the Islands or are liable to be deported, the Board shall liaise with the Department of Immigration and other relevant authorities to ensure the timely enforcement of relevant Laws in relation to any such persons. (3) This Law applies, with necessary modifications, to children held at the court\u2019s pleasure in the same way as it applies to other prisoners.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_4\", \"num\": \"4.\", \"text\": \"Establishment and procedure of Board 4. (1) There is hereby established the Conditional Release Board. (2) Subject to the other provisions of this section, the Board shall consist of a minimum of five members and a maximum of nine members, none of whom shall be civil servants, appointed by the Governor comprising at least two of the following \u2014 (a) a retired judge other than a public servant; (b) a retired magistrate other than a public servant; or (c) an attorney-at-law other than a public servant, and such of the following as the Governor considers appropriate \u2014 (d) a person with experience in criminal justice; (e) a mental health professional; (f) a minister of religion; and Conditional Release Law (2019 Revision) (g) a person or persons other than a person referred to in paragraphs (a), (b), (c), (d), (e) or (f). (3) The Governor shall designate two of the persons referred to in paragraph (a), (b) or (c) as Chairperson and Vice Chairperson respectively. (4) At a meeting of the Board \u2014 (a) the Chairperson shall preside; (b) if the Chairperson is unable to attend, the Vice Chairperson shall preside; or (c) if the Chairperson and the Vice Chairperson are unable to attend, the members of the Board shall appoint a temporary Chairperson from among themselves and that member shall preside. (5) Decisions of the Board shall be based on the votes of members present and voting and, where the Board is equally divided on any matter, the person presiding shall have a casting vote in addition to his deliberative vote. (6) The members shall serve for a term of three years and are eligible for reappointment. (7) If a vacancy occurs in the membership of the Board, the Governor may appoint a person to fill that vacancy and that person shall be from the same category of persons specified in subsection (2) as the member in relation to whom the vacancy occurs. (8) The Governor may, at the Governor\u2019s discretion, revoke the appointment of a member \u2014 (a) for inability to discharge the functions of his office (whether arising from infirmity of body or mind); (b) for misbehaviour; or (c) where that member has failed to attend three consecutive meetings of the Board. (9) At a meeting of the Board three members shall constitute a quorum. (10) Subject to the provisions of this Law, the members of the Board may regulate the conduct of the proceedings of the Board in such manner as they think fit and may constitute such committees as they consider necessary to enable them better perform their functions. (11) There shall be in the office of the Deputy Governor the office of Secretary to the Conditional Release Board who shall \u2014 (a) be in charge of the day-to-day administration of the affairs of the Board; (b) record the minutes of each meeting of the Board including particulars of the members in attendance and the decisions made by the Board; and Conditional Release Law (2019 Revision) (c) perform such other duties as may be determined under the Public Service Management Law (2018 Revision). (12) The Governor shall make his best efforts to ensure that he appoints persons who meet the requirements in subsection (2)(a), (b) and (c) but where he is not able to find suitable persons for any or all those positions, he may appoint for any or all those positions any other person who does not meet the legal aspect of those requirements.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_5\", \"num\": \"5.\", \"text\": \"Immunity of members of Board 5. No action for damages or other proceedings shall lie against a member of the Board or the Secretary for anything done or omitted in good faith by the member or Secretary while carrying out his functions or exercising his powers under this Law.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_6\", \"num\": \"6.\", \"text\": \"Functions of Board 6. (1) The functions of the Board shall be to make decisions and orders in relation to \u2014 (a) the release of prisoners on licence, except for prisoners sentenced to detention at the court\u2019s pleasure; (b) the conditions of a licence, including the variation and cancellation of conditions; (c) the suspension of a licence; (d) the revocation of a licence; (e) deferral of certain cases for consideration at a later date with specific requirements; and (f) any other matter related to the release on licence or revocation of the licence of a prisoner. (2) The Board may establish such committees as it considers necessary or expedient and consult with such other agencies as it thinks fit.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_7\", \"num\": \"7.\", \"text\": \"Minimum periods of incarceration 7. (1) Prisoners shall be eligible for conditional release as follows \u2014 (a) prisoners sentenced to imprisonment for life shall be eligible to be considered for conditional release on licence after serving the minimum period of incarceration imposed under section 14(1); (b) prisoners serving a term of imprisonment exceeding one year, other than prisoners referred to in paragraph (a), are eligible to be considered for conditional release on licence after serving sixty per cent of the sentence imposed by a court; and (c) prisoners who are sentenced to a term of imprisonment not exceeding one year shall be released by the Director of Prisons after serving sixty per Conditional Release Law (2019 Revision) cent of the sentence imposed by a court, but may be held for a longer period in accordance with any remission they may have forfeited under the Prison Law, 1975 [Law 14 of 1975] or regulations made thereunder. (2) Where a prisoner who is serving a sentence is convicted of another offence and a consecutive sentence is imposed for the additional offence, the sentences shall, for purposes of subsection (1), be treated as one sentence and the conditional release date shall be adjusted accordingly. (3) The Director of Prisons shall refer terminally ill or incapacitated prisoners to the Advisory Committee on the Prerogative of Mercy but this does not limit any rights relating to conditional release.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_8\", \"num\": \"8.\", \"text\": \"Procedures for conditional release 8. (1) The Director of Prisons may, at least six months before a prisoner becomes eligible to be considered for conditional release, inform him in writing of that date and, if the prisoner wishes to be considered for release on licence, he is required to submit an application to the Director of Prisons at least four months before that date. (2) When a prisoner makes an application for conditional release on licence, the Director of Prisons may refer the application to the Board four months before the prisoner is eligible for consideration for conditional release on licence. (3) The Director of Prisons shall, at intervals of not more than one year from previous consideration by the Board, again refer each case to the Board for consideration of the prisoner for conditional release on licence if the prisoner to whom the case relates \u2014 (a) has not been released on licence; or (b) has had his licence revoked and is continuing to serve his sentence. (4) Notwithstanding subsection (3), if the Board so directs, a particular case shall be referred by the Director of Prisons to the Board at such shorter interval, not being less than three months, specified by the Board.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_9\", \"num\": \"9.\", \"text\": \"Factors to be considered by Board 9. In carrying out its functions under this Law, the Board shall consider the following factors \u2014 (a) whether it is no longer necessary for the protection of the public that a particular prisoner be imprisoned; (b) the risk of the prisoner reoffending; (c) whether the rehabilitation of the prisoner can be safely carried out in the community; and (d) whether the prisoner is capable of complying with the conditions of a licence. Conditional Release Law (2019 Revision)\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_10\", \"num\": \"10.\", \"text\": \"Reports and representations 10. (1) Where a case is referred under section 8(2), the Board shall consider the report of the Director of Prisons and the reports of all other relevant agencies and any other relevant evidence that the Board has been provided with. (2) The Board shall be provided with all relevant documents including the following if available \u2014 (a) the prisoner\u2019s application for conditional release on licence, or a referral by the Director of Prisons under section 8(2), or both; (b) a copy of the criminal court documents relating to the prisoner in relation to the nature and circumstances of the offence for which the sentence of imprisonment was imposed; (c) a report by the Director of Prisons in relation to the conduct and compliance with the re-entry plan of the prisoner while in the prison; (d) a record of the criminal convictions of the prisoner; (e) an assessment of risk, prepared by such experts as may be approved by the Board; (f) a report from the Director of the Department of Community Rehabilitation; (g) a copy of all written representations made by the prisoner, and, if a previous application was made to the Board, written representations made previously by the prisoner; (h) a Victim Impact Report in relation to the release of the prisoner; (i) a report from the Chief Immigration Officer, where the prisoner has no right of abode in the Islands; (j) reports from the Department of Counselling Services; and (k) mental health reports. (3) The Board shall give the prisoner who has applied for a conditional release licence an opportunity to make representations in person, or through a representative, or both. (4) A prisoner shall be provided with all the documents provided to the Board at least fourteen days prior to the hearing of the application for conditional release on licence unless the Board determines that disclosure would have an adverse effect on \u2014 (a) national security; or (b) the prevention of disorder and crime; or (c) the health and welfare of the prisoner or a third party, and it is necessary and proportionate to withhold it from the prisoner in all the circumstances. Conditional Release Law (2019 Revision) (5) A victim may himself or through a representative make oral representations before the Board.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_11\", \"num\": \"11.\", \"text\": \"Duties of the Director of Department of Community Rehabilitation 11. (1) The Director of the Department of Community Rehabilitation, or any person authorised by him \u2014 (a) shall interview a prisoner who is eligible for conditional release and who has submitted an application if the prisoner consents to an interview, and may interview the victim if a victim consents; (b) shall provide the Board with all necessary information to comply with the requirements of sections 9 and 10 and such report shall contain the following \u2014 (i) recommendations as to whether the prisoner is a suitable candidate for release on licence; (ii) assessment of the risk of the prisoner re-offending and the risk of the prisoner endangering the community; (iii) recommendations as to the suitability of the prisoner\u2019s proposed residence if released on licence and, if necessary, a proposed alternative residence; and (iv) recommendations on conditions of the licence, which may include rehabilitative programmes; (c) shall supervise a prisoner released on licence with a view to assisting the prisoner\u2019s rehabilitation and reintegration into the community as a lawabiding person; (d) shall, if necessary, submit to the Board a request to vary or cancel a condition of the licence along with a report setting out the grounds for such variation or cancellation; (e) shall, if necessary, submit to the Board a report of a prisoner\u2019s alleged breach of the conditions of a licence; and (f) shall perform any other duties required by this Law. (2) For the purpose of ensuring the effective supervision of prisoners released on licence, the Director of the Department of Community Rehabilitation shall \u2014 (a) assign officers to serve in such areas and for such matters as he thinks necessary; (b) direct and supervise the work of officers; (c) formulate and implement methods of \u2014 (i) record keeping; and (ii) reporting; Conditional Release Law (2019 Revision) (d) develop policies and procedures for dealing with prisoners released on licence; and (e) prepare and submit to the Board every quarter, a report regarding the prisoners under its supervision during the period covered by the report. (3) The Director of the Department of Community Rehabilitation or any person specifically or generally authorised in that behalf shall, as soon as practicable, inform any identified victim of crime \u2014 (a) of an application by the prisoner to the Board for conditional release; (b) of the decision of the Board on that application (to grant or not to grant conditional release) and the reasons for granting or not granting conditional release, if the reasons are relevant to the victim; (c) of the conditions of any licence that may be granted, if relevant to the victim; (d) of any decision to recall the prisoner and the reasons for the recall, if the reasons are relevant to the victim; or (e) of any decision not to recall the prisoner and the reasons for that decision, if the reasons are relevant to the victim. (4) The Cabinet may make regulations relating to the investigation and supervision of prisoners.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_12\", \"num\": \"12.\", \"text\": \"Release of prisoners in general 12. (1) The Board may order the conditional release on licence of any prisoner, after the prisoner has served the period specified in section 7(1) and in doing so shall comply with sections 9 and 10. (2) A licence granted to a prisoner under this section may be made subject to such reasonable conditions, if any, as appear to the Board to be desirable and any such conditions may be varied from time to time or cancelled by the Board, after considering the report of the Director of the Department of Community Rehabilitation, or any person authorised by him, prepared in accordance with section 9. (3) A prisoner released on licence under this section shall comply with such conditions, if any, as may be specified in the licence. (4) A licence granted to a prisoner shall remain in force until the expiration of the term of his sentence, unless it is revoked earlier. Conditional Release Law (2019 Revision) 12A. Changes in material circumstances 12A. (1) The Board may where the Board has ordered the release on licence of a prisoner pursuant to section 12 and prior to the date of release of that prisoner the Board is notified that there is a material change in the circumstances relating to that prisoner, reconvene and hear the prisoner in respect of the material change and may \u2014 (a) set aside the order; or (b) vary the order. (2) For the purposes of subsection (1), a material change of circumstances may include, but is not limited to, additional information that was not previously available to the Board at the time of the Board\u2019s determination.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_13\", \"num\": \"13.\", \"text\": \"Electronic monitoring 13. (1) The Board may release a prisoner on licence subject to electronic monitoring for the whole or a part of the licence period to the extent considered necessary by the Board. (2) The Board shall cause the prisoner to be informed in writing of the conditions of electronic monitoring and the period during which he shall be subject to monitoring. (3) The Board shall not impose a condition of electronic monitoring unless \u2014 (a) it has been notified by the Ministry or Portfolio responsible for electronic monitoring that the necessary arrangements are available in the area in which the monitoring is to take place; and (b) it is satisfied that necessary provision can be made under those arrangements. (4) A prisoner who damages, destroys or tampers with any device used for or to facilitate electronic monitoring commits an offence and is liable on summary conviction to a fine of two thousand dollars or to imprisonment for a term of one year, or to both. (5) Any document or information provided by the person responsible for electronic monitoring relating to a prisoner who is under licence and being monitored electronically shall prima facie be admissible in proceedings in a court. Conditional Release Law (2019 Revision)\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_14\", \"num\": \"14.\", \"text\": \"Release of life prisoners 14. (1) Notwithstanding any other Law to the contrary, when sentencing a prisoner to a term of imprisonment for life, the court shall specify the period of incarceration the prisoner shall serve before the prisoner is eligible to be considered for conditional release on licence, the period being such as the court considers appropriate to satisfy requirements of retribution, deterrence and rehabilitation, but for murder, the period shall be thirty years before the prisoner is eligible for conditional release unless there are \u2014 (a) extenuating circumstances, exceptional in nature, in which case the court may impose a lower period of incarceration; or (b) aggravating circumstances, exceptional in nature, in which case the court may impose a longer period of incarceration. (1A) Notwithstanding subsection (1) and any other Law to the contrary, where any of the following circumstances are present \u2014 (a) the murder of two or more persons, where each murder involves any of the following \u2014 (i) a substantial degree of premeditation or planning; (ii) the abduction of a victim; or (iii) sexual or sadistic conduct; (b) the murder of a child where the murder also involves the abduction of the child or sexual or sadistic conduct; (c) a murder done for the purpose of advancing a political, religious, racial or ideological motivation; or (d) a murder by an offender previously convicted of murder, the court shall, when sentencing a prisoner to a term of imprisonment for life, specify the period of incarceration the prisoner shall serve before the prisoner is eligible to be considered for conditional release on licence, the period being such as the court considers appropriate to satisfy requirements of retribution, deterrence and rehabilitation, the period shall be whole life before the prisoner is eligible for conditional release unless there are extenuating circumstances, exceptional in nature, in which case the court may impose a lower period of incarceration (2) In making a decision under subsection (1)(a) or (b) or (1A) the court shall state the extenuating circumstances or the aggravating circumstances, as the case may be. (3) The Board may, after considering the factors referred to in sections 9 and 10 and in accordance with the procedures set out therein, order conditional release on licence of a prisoner sentenced to a term of imprisonment for life after the Conditional Release Law (2019 Revision) prisoner has served the period of imprisonment specified by the court under subsection (1). (4) Conditional release on licence granted to a prisoner sentenced to a term of imprisonment for life shall remain in force for life, reviewable by the Board every twelve months with a view to assessing whether the conditions need to be varied.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_15\", \"num\": \"15.\", \"text\": \"Revocation of licence for breach of condition 15. (1) If the Department of Community Rehabilitation has reasonable grounds to suspect that a prisoner released on licence has breached a condition of the licence, the Department may submit to the Board a report of the alleged breach. (2) On receipt of a report submitted in accordance with subsection (1), the Board shall review and determine whether the information presented in the report establishes a prima facie case that there has been a breach of a condition of the licence. (3) If on review of the information presented in the report under subsection (1), the Board is not satisfied that a prima facie case has been established, the conditional release on licence shall continue. (4) If after a review of the information presented in the report prepared pursuant to subsection (1) the Board is satisfied that a prima facie case has been established, the Board shall suspend the licence and cause the prisoner to be returned to prison. (5) The Secretary to the Conditional Release Board shall \u2014 (a) forward the suspended licence order to the Commissioner of Police; and (b) inform the prisoner of the licence conditions he is alleged to have breached. (6) A prisoner returned to prison under subsection (4) has the status of a prisoner on remand and his conditional release licence is automatically suspended. (7) On the return of a prisoner on a conditional release licence to prison under subsection (4), the Secretary to the Conditional Release Board shall \u2014 (a) provide the prisoner with all documentary evidence in relation to the allegations of breach of the licence conditions; and (b) inform the prisoner of his right \u2014 (i) to have an attorney-at-law or other representative act on his behalf; (ii) to present evidence; and (iii) make representations in his defence before the Board. Conditional Release Law (2019 Revision) (8) As soon as reasonably practicable but in any case within fourteen working days of the return to prison of a prisoner under subsection (4), the Board shall meet to hear and determine whether or not his licence should be revoked. (9) At the hearing referred to in subsection (8), the Board shall give the prisoner, his attorney-at-law or other representative an opportunity to make representations in his defence as to why the licence should not be revoked. (10) If the Board is satisfied that the evidence presented proves on a balance of probabilities that the prisoner has breached one or more of the conditions of the licence, the Board may within five working days \u2014 (a) revoke the licence; or (b) order the release of the prisoner subject to the variation of licence conditions, if necessary. (11) If a licence is revoked under this section, the prisoner \u2014 (a) has the status of a convicted prisoner and shall continue to serve the unexpired portion of his sentence but this does not preclude the prisoner from making a subsequent application for conditional release on licence \u2014 (i) after twelve months has elapsed from the date of revocation; or (ii) where the sentence is twelve months or less, at such time as the Board may determine; and (b) shall be liable to be detained in pursuance of his sentence and, if at large, shall be deemed to be unlawfully at large. (12) If the Board is not satisfied that the evidence proves on a balance of probabilities that the prisoner is in breach of the conditions of the licence, the Board shall release the prisoner on licence and the licence shall continue until it has expired or unless it is subsequently revoked or suspended in accordance with this Law, unless some matters of concern arise, in which case the Board may exercise its powers under section 6(1)(b) and 12(2) to vary the terms of the licence. (13) If a prisoner who is on a conditional release licence leaves the jurisdiction in breach of a condition, he shall be subject to the process outlined in relation to suspension and revocation of the licence.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_16\", \"num\": \"16.\", \"text\": \"Revocation of licence for commission of further offence 16. (1) The Board may revoke the licence of a prisoner who is convicted of an offence committed during the period of release on licence. (2) A prisoner on a conditional release licence who is arrested and charged in relation to another criminal charge and is not released on bail assumes the status of a remand prisoner and his conditional release licence is automatically Conditional Release Law (2019 Revision) suspended and the revocation of his licence shall then be considered under section 15(6) to (12). (3) Where a prisoner on conditional release is arrested and charged in relation to another criminal offence and is released on bail the Board may consider the suspension or revocation of his conditional release licence under the process provided for in section 15(1) to (12).\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_17\", \"num\": \"17.\", \"text\": \"Variation of licence on grounds of incapacity or medical deterioration 17. If a prisoner is released on licence and subsequently becomes incapacitated or the prisoner\u2019s medical condition has deteriorated, or both, the Board may vary the terms of the licence.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_18\", \"num\": \"18.\", \"text\": \"Emergency recall procedure 18. (1) Where the Board has reasonable grounds to suspect that a prisoner has committed, is about to, or is likely to, commit a serious offence, the Board shall immediately suspend the licence and recall the prisoner to prison. (2) Where a prisoner is recalled under subsection (1), the Board shall cause the Commissioner of Police to be informed of the suspension and the Commissioner shall cause that person to be detained in prison to await a hearing at which the need or otherwise of revoking the licence is to be considered. (3) As soon as reasonably practicable but in any case within three working days of the remand of a prisoner under subsection (2), the Board shall hold a hearing to determine whether or not the prisoner\u2019s licence should be revoked. (4) The hearing by the Board under this section shall be conducted in accordance with section 15(7) to (12).\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_19\", \"num\": \"19.\", \"text\": \"Reports on operations of Board 19. (1) The Board shall, within three months after the end of each financial year, forward to the Governor an annual report of the operation of the Board during that year. (2) Where an application under section 31A of the Prison Law, 1975 [Law 14 of 1975]  is refused, the prisoner may at any time apply to the Grand Court for a tariff to be set, in which case the Grand Court shall exercise the powers in subsection (1). (3) In exercising the powers referred to in subsection (1), the Grand Court may, where practicable, consult any serving Judge who decided the matter concerned, and may exercise such other powers as a Judge sentencing an accused in a case tried by him may have under any Law and the accused shall have such right to be heard as he would have had at the time of his original sentencing hearing. (4) At the sentencing hearing referred to in this section, evidence of the prisoner\u2019s behaviour in prison after original sentencing is not admissible. (5) A prisoner who is dissatisfied with a decision made under subsection (1) or (2) shall have a right of appeal in the same manner as a person being sentenced for the first time. (6) Where at the commencement of the Conditional Release Law, 2014 [Law 18 of 2014], a prisoner is serving a fixed term and the earliest date of release which would have been determined under section 29 of the Prisons Law, 1975 [Law 14 of 1975] is earlier than the earliest date on which he would have been eligible for release on licence under this Law, the prisoner shall be released on the earlier date and without conditions. and\n(b) the person\u2019s position and the electronic device\u2019s current status to be\nreported back to a central location;\n\u201cGovernor\u201d means the Governor acting in his discretion;\n\u201clicence\u201d means a licence referred to in section 12 or 14;\n\u201cSecretary\u201d means the Secretary of the Conditional Release Board, referred to\nin section 4(1);\n\u201cvictim\u201d, in relation to an offence, means \u2014\n\nSection 3\nConditional Release Law (2019 Revision)\n\nPage 6\nRevised as at 1st January, 2019\nc\n\n(a) the person to whom harm is done or who suffers continuing physical,\nfinancial or emotional loss as a result of the commission of the\noffence; and\n(b) where the person described in paragraph (a) is dead, ill or otherwise\nincapable of making a Victim Impact Statement, includes \u2014\n(i)\nthe spouse or any relative of that person; or\n(ii) anyone who has, in law or fact, the custody of that person or is\nresponsible for the care or support of that person; or\n(iii) a dependant of that person;\n\u201cVictim Impact Report\u201d means a report by an expert providing a specialist\nopinion on the traumatic impact of the crime on the victim and any\nconsequential needs of the victim; and\n\u201cVictim Impact Statement\u201d means a written or oral statement in which a\nvictim of a crime makes representations.\n3.\nApplication\n3.\n(1) This Law applies to all prisoners regardless of when they were convicted or\nsentenced, including prisoners who have no right of abode in the Islands or are\nliable to be deported.\n(2) In relation to prisoners who have no right of abode in the Islands or are liable\nto be deported, the Board shall liaise with the Department of Immigration and\nother relevant authorities to ensure the timely enforcement of relevant Laws in\nrelation to any such persons.\n(3) This Law applies, with necessary modifications, to children held at the court\u2019s\npleasure in the same way as it applies to other prisoners.\n4.\nEstablishment and procedure of Board\n4.\n(1) There is hereby established the Conditional Release Board.\n(2) Subject to the other provisions of this section, the Board shall consist of a\nminimum of five members and a maximum of nine members, none of whom\nshall be civil servants, appointed by the Governor comprising at least two of\nthe following \u2014\n(a) a retired judge other than a public servant;\n(b) a retired magistrate other than a public servant; or\n(c) an attorney-at-law other than a public servant, and such of the following\nas the Governor considers appropriate \u2014\n(d) a person with experience in criminal justice;\n(e) a mental health professional;\n(f)\na minister of religion; and\n\nConditional Release Law (2019 Revision)\nSection 4\n\nc\nRevised as at 1st January, 2019\nPage 7\n\n(g) a person or persons other than a person referred to in paragraphs (a), (b),\n(c), (d), (e) or (f).\n(3) The Governor shall designate two of the persons referred to in paragraph (a),\n(b) or (c) as Chairperson and Vice Chairperson respectively.\n(4) At a meeting of the Board \u2014\n(a) the Chairperson shall preside;\n(b) if the Chairperson is unable to attend, the Vice Chairperson shall preside;\nor\n(c) if the Chairperson and the Vice Chairperson are unable to attend, the\nmembers of the Board shall appoint a temporary Chairperson from\namong themselves and that member shall preside.\n(5) Decisions of the Board shall be based on the votes of members present and\nvoting and, where the Board is equally divided on any matter, the person\npresiding shall have a casting vote in addition to his deliberative vote.\n(6) The members shall serve for a term of three years and are eligible for reappointment.\n(7) If a vacancy occurs in the membership of the Board, the Governor may\nappoint a person to fill that vacancy and that person shall be from the same\ncategory of persons specified in subsection (2) as the member in relation to\nwhom the vacancy occurs.\n(8) The Governor may, at the Governor\u2019s discretion, revoke the appointment of a\nmember \u2014\n(a) for inability to discharge the functions of his office (whether arising from\ninfirmity of body or mind);\n(b) for misbehaviour; or\n(c) where that member has failed to attend three consecutive meetings of the\nBoard.\n(9) At a meeting of the Board three members shall constitute a quorum.\n(10) Subject to the provisions of this Law, the members of the Board may regulate\nthe conduct of the proceedings of the Board in such manner as they think fit\nand may constitute such committees as they consider necessary to enable them\nbetter perform their functions.\n(11) There shall be in the office of the Deputy Governor the office of Secretary to\nthe Conditional Release Board who shall \u2014\n(a) be in charge of the day-to-day administration of the affairs of the Board;\n(b) record the minutes of each meeting of the Board including particulars of\nthe members in attendance and the decisions made by the Board; and\n\nSection 5\nConditional Release Law (2019 Revision)\n\nPage 8\nRevised as at 1st January, 2019\nc\n\n(c) perform such other duties as may be determined under the Public Service\nManagement Law (2018 Revision).\n(12) The Governor shall make his best efforts to ensure that he appoints persons\nwho meet the requirements in subsection (2)(a), (b) and (c) but where he is not\nable to find suitable persons for any or all those positions, he may appoint for\nany or all those positions any other person who does not meet the legal aspect\nof those requirements.\n5.\nImmunity of members of Board\n5.\nNo action for damages or other proceedings shall lie against a member of the Board\nor the Secretary for anything done or omitted in good faith by the member or\nSecretary while carrying out his functions or exercising his powers under this Law.\n6.\nFunctions of Board\n6.\n(1) The functions of the Board shall be to make decisions and orders in\nrelation to \u2014\n(a) the release of prisoners on licence, except for prisoners sentenced to\ndetention at the court\u2019s pleasure;\n(b) the conditions of a licence, including the variation and cancellation of\nconditions;\n(c) the suspension of a licence;\n(d) the revocation of a licence;\n(e) deferral of certain cases for consideration at a later date with specific\nrequirements; and\n(f)\nany other matter related to the release on licence or revocation of the\nlicence of a prisoner.\n(2) The Board may establish such committees as it considers necessary or\nexpedient and consult with such other agencies as it thinks fit.\n7.\nMinimum periods of incarceration\n7.\n(1) Prisoners shall be eligible for conditional release as follows \u2014\n(a) prisoners sentenced to imprisonment for life shall be eligible to be\nconsidered for conditional release on licence after serving the minimum\nperiod of incarceration imposed under section 14(1);\n(b) prisoners serving a term of imprisonment exceeding one year, other than\nprisoners referred to in paragraph (a), are eligible to be considered for\nconditional release on licence after serving sixty per cent of the sentence\nimposed by a court; and\n(c) prisoners who are sentenced to a term of imprisonment not exceeding one\nyear shall be released by the Director of Prisons after serving sixty per\n\nConditional Release Law (2019 Revision)\nSection 8\n\nc\nRevised as at 1st January, 2019\nPage 9\n\ncent of the sentence imposed by a court, but may be held for a longer\nperiod in accordance with any remission they may have forfeited under\nthe Prison Law, 1975 [Law 14 of 1975] or regulations made thereunder.\n(2) Where a prisoner who is serving a sentence is convicted of another offence\nand a consecutive sentence is imposed for the additional offence, the sentences\nshall, for purposes of subsection (1), be treated as one sentence and the\nconditional release date shall be adjusted accordingly.\n(3) The Director of Prisons shall refer terminally ill or incapacitated prisoners to\nthe Advisory Committee on the Prerogative of Mercy but this does not limit\nany rights relating to conditional release.\n8.\nProcedures for conditional release\n8.\n(1) The Director of Prisons may, at least six months before a prisoner becomes\neligible to be considered for conditional release, inform him in writing of that\ndate and, if the prisoner wishes to be considered for release on licence, he is\nrequired to submit an application to the Director of Prisons at least four\nmonths before that date.\n(2) When a prisoner makes an application for conditional release on licence, the\nDirector of Prisons may refer the application to the Board four months before\nthe prisoner is eligible for consideration for conditional release on licence.\n(3) The Director of Prisons shall, at intervals of not more than one year from\nprevious consideration by the Board, again refer each case to the Board for\nconsideration of the prisoner for conditional release on licence if the prisoner\nto whom the case relates \u2014\n(a) has not been released on licence; or\n(b) has had his licence revoked and is continuing to serve his sentence.\n(4) Notwithstanding subsection (3), if the Board so directs, a particular case shall\nbe referred by the Director of Prisons to the Board at such shorter interval, not\nbeing less than three months, specified by the Board.\n9.\nFactors to be considered by Board\n9.\nIn carrying out its functions under this Law, the Board shall consider the following\nfactors \u2014\n(a) whether it is no longer necessary for the protection of the public that a\nparticular prisoner be imprisoned;\n(b) the risk of the prisoner reoffending;\n(c) whether the rehabilitation of the prisoner can be safely carried out in the\ncommunity; and\n(d) whether the prisoner is capable of complying with the conditions of a\nlicence.\n\nSection 10\nConditional Release Law (2019 Revision)\n\nPage 10\nRevised as at 1st January, 2019\nc\n\n10.\nReports and representations\n10. (1) Where a case is referred under section 8(2), the Board shall consider the report\nof the Director of Prisons and the reports of all other relevant agencies and any\nother relevant evidence that the Board has been provided with.\n(2) The Board shall be provided with all relevant documents including the\nfollowing if available \u2014\n(a) the prisoner\u2019s application for conditional release on licence, or a referral\nby the Director of Prisons under section 8(2), or both;\n(b) a copy of the criminal court documents relating to the prisoner in relation\nto the nature and circumstances of the offence for which the sentence of\nimprisonment was imposed;\n(c) a report by the Director of Prisons in relation to the conduct and\ncompliance with the re-entry plan of the prisoner while in the prison;\n(d) a record of the criminal convictions of the prisoner;\n(e) an assessment of risk, prepared by such experts as may be approved by\nthe Board;\n(f)\na report from the Director of the Department of Community\nRehabilitation;\n(g) a copy of all written representations made by the prisoner, and, if a\nprevious application was made to the Board, written representations\nmade previously by the prisoner;\n(h) a Victim Impact Report in relation to the release of the prisoner;\n(i)\na report from the Chief Immigration Officer, where the prisoner has no\nright of abode in the Islands;\n(j)\nreports from the Department of Counselling Services; and\n(k) mental health reports.\n(3) The Board shall give the prisoner who has applied for a conditional release\nlicence an opportunity to make representations in person, or through a\nrepresentative, or both.\n(4) A prisoner shall be provided with all the documents provided to the Board at\nleast fourteen days prior to the hearing of the application for conditional\nrelease on licence unless the Board determines that disclosure would have an\nadverse effect on \u2014\n(a) national security; or\n(b) the prevention of disorder and crime; or\n(c) the health and welfare of the prisoner or a third party,\nand it is necessary and proportionate to withhold it from the prisoner in all the\ncircumstances.\n\nConditional Release Law (2019 Revision)\nSection 11\n\nc\nRevised as at 1st January, 2019\nPage 11\n\n(5) A victim may himself or through a representative make oral representations\nbefore the Board.\n11.\nDuties of the Director of Department of Community Rehabilitation\n11. (1) The Director of the Department of Community Rehabilitation, or any person\nauthorised by him \u2014\n(a) shall interview a prisoner who is eligible for conditional release and who\nhas submitted an application if the prisoner consents to an interview, and\nmay interview the victim if a victim consents;\n(b) shall provide the Board with all necessary information to comply with\nthe requirements of sections 9 and 10 and such report shall contain the\nfollowing \u2014\n(i)\nrecommendations as to whether the prisoner is a suitable candidate\nfor release on licence;\n(ii) assessment of the risk of the prisoner re-offending and the risk of\nthe prisoner endangering the community;\n(iii) recommendations as to the suitability of the prisoner\u2019s proposed\nresidence if released on licence and, if necessary, a proposed\nalternative residence; and\n(iv) recommendations on conditions of the licence, which may include\nrehabilitative programmes;\n(c) shall supervise a prisoner released on licence with a view to assisting the\nprisoner\u2019s rehabilitation and reintegration into the community as a lawabiding person;\n(d) shall, if necessary, submit to the Board a request to vary or cancel a\ncondition of the licence along with a report setting out the grounds for\nsuch variation or cancellation;\n(e) shall, if necessary, submit to the Board a report of a prisoner\u2019s alleged\nbreach of the conditions of a licence; and\n(f)\nshall perform any other duties required by this Law.\n(2) For the purpose of ensuring the effective supervision of prisoners released on\nlicence, the Director of the Department of Community Rehabilitation shall \u2014\n(a) assign officers to serve in such areas and for such matters as he thinks\nnecessary;\n(b) direct and supervise the work of officers;\n(c) formulate and implement methods of \u2014\n(i)\nrecord keeping; and\n(ii) reporting;\n\nSection 12\nConditional Release Law (2019 Revision)\n\nPage 12\nRevised as at 1st January, 2019\nc\n\n(d) develop policies and procedures for dealing with prisoners released on\nlicence; and\n(e) prepare and submit to the Board every quarter, a report regarding the\nprisoners under its supervision during the period covered by the report.\n(3) The Director of the Department of Community Rehabilitation or any person\nspecifically or generally authorised in that behalf shall, as soon as practicable,\ninform any identified victim of crime \u2014\n(a) of an application by the prisoner to the Board for conditional release;\n(b) of the decision of the Board on that application (to grant or not to grant\nconditional release) and the reasons for granting or not granting\nconditional release, if the reasons are relevant to the victim;\n(c) of the conditions of any licence that may be granted, if relevant to the\nvictim;\n(d) of any decision to recall the prisoner and the reasons for the recall, if the\nreasons are relevant to the victim; or\n(e) of any decision not to recall the prisoner and the reasons for that\ndecision, if the reasons are relevant to the victim.\n(4) The Cabinet may make regulations relating to the investigation and\nsupervision of prisoners.\n12.\nRelease of prisoners in general\n12. (1) The Board may order the conditional release on licence of any prisoner, after\nthe prisoner has served the period specified in section 7(1) and in doing so\nshall comply with sections 9 and 10.\n(2) A licence granted to a prisoner under this section may be made subject to such\nreasonable conditions, if any, as appear to the Board to be desirable and any\nsuch conditions may be varied from time to time or cancelled by the Board,\nafter considering the report of the Director of the Department of Community\nRehabilitation, or any person authorised by him, prepared in accordance with\nsection 9.\n(3) A prisoner released on licence under this section shall comply with such\nconditions, if any, as may be specified in the licence.\n(4) A licence granted to a prisoner shall remain in force until the expiration of the\nterm of his sentence, unless it is revoked earlier.\n\nConditional Release Law (2019 Revision)\nSection 12A\n\nc\nRevised as at 1st January, 2019\nPage 13\n\n12A. Changes in material circumstances\n12A. (1) The Board may where the Board has ordered the release on licence of a\nprisoner pursuant to section 12 and prior to the date of release of that prisoner\nthe Board is notified that there is a material change in the circumstances\nrelating to that prisoner, reconvene and hear the prisoner in respect of the\nmaterial change and may \u2014\n(a) set aside the order; or\n(b) vary the order.\n(2) For the purposes of subsection (1), a material change of circumstances may\ninclude, but is not limited to, additional information that was not previously\navailable to the Board at the time of the Board\u2019s determination.\n13.\nElectronic monitoring\n13. (1) The Board may release a prisoner on licence subject to electronic monitoring\nfor the whole or a part of the licence period to the extent considered necessary\nby the Board.\n(2) The Board shall cause the prisoner to be informed in writing of the conditions\nof electronic monitoring and the period during which he shall be subject to\nmonitoring.\n(3) The Board shall not impose a condition of electronic monitoring unless \u2014\n(a) it has been notified by the Ministry or Portfolio responsible for electronic\nmonitoring that the necessary arrangements are available in the area in\nwhich the monitoring is to take place; and\n(b) it is satisfied that necessary provision can be made under those\narrangements.\n(4) A prisoner who damages, destroys or tampers with any device used for or to\nfacilitate electronic monitoring commits an offence and is liable on summary\nconviction to a fine of two thousand dollars or to imprisonment for a term of\none year, or to both.\n(5) Any document or information provided by the person responsible for\nelectronic monitoring relating to a prisoner who is under licence and being\nmonitored electronically shall prima facie be admissible in proceedings in a\ncourt.\n\nSection 14\nConditional Release Law (2019 Revision)\n\nPage 14\nRevised as at 1st January, 2019\nc\n\n14.\nRelease of life prisoners\n14. (1) Notwithstanding any other Law to the contrary, when sentencing a prisoner to\na term of imprisonment for life, the court shall specify the period of\nincarceration the prisoner shall serve before the prisoner is eligible to be\nconsidered for conditional release on licence, the period being such as the\ncourt considers appropriate to satisfy requirements of retribution, deterrence\nand rehabilitation, but for murder, the period shall be thirty years before the\nprisoner is eligible for conditional release unless there are \u2014\n(a) extenuating circumstances, exceptional in nature, in which case the court\nmay impose a lower period of incarceration; or\n(b) aggravating circumstances, exceptional in nature, in which case the court\nmay impose a longer period of incarceration.\n(1A) Notwithstanding subsection (1) and any other Law to the contrary, where any\nof the following circumstances are present \u2014\n(a) the murder of two or more persons, where each murder involves any of\nthe following \u2014\n(i)\na substantial degree of premeditation or planning;\n(ii) the abduction of a victim; or\n(iii) sexual or sadistic conduct;\n(b) the murder of a child where the murder also involves the abduction of the\nchild or sexual or sadistic conduct;\n(c) a murder done for the purpose of advancing a political, religious, racial\nor ideological motivation; or\n(d) a murder by an offender previously convicted of murder,\nthe court shall, when sentencing a prisoner to a term of imprisonment for life,\nspecify the period of incarceration the prisoner shall serve before the prisoner\nis eligible to be considered for conditional release on licence, the period being\nsuch as the court considers appropriate to satisfy requirements of retribution,\ndeterrence and rehabilitation, the period shall be whole life before the prisoner\nis eligible for conditional release unless there are extenuating circumstances,\nexceptional in nature, in which case the court may impose a lower period of\nincarceration\n(2) In making a decision under subsection (1)(a) or (b) or (1A) the court shall state\nthe extenuating circumstances or the aggravating circumstances, as the case\nmay be.\n(3) The Board may, after considering the factors referred to in sections 9 and 10\nand in accordance with the procedures set out therein, order conditional release\non licence of a prisoner sentenced to a term of imprisonment for life after the\n\nConditional Release Law (2019 Revision)\nSection 15\n\nc\nRevised as at 1st January, 2019\nPage 15\n\nprisoner has served the period of imprisonment specified by the court under\nsubsection (1).\n(4) Conditional release on licence granted to a prisoner sentenced to a term of\nimprisonment for life shall remain in force for life, reviewable by the Board\nevery twelve months with a view to assessing whether the conditions need to\nbe varied.\n15.\nRevocation of licence for breach of condition\n15. (1) If the Department of Community Rehabilitation has reasonable grounds to\nsuspect that a prisoner released on licence has breached a condition of the\nlicence, the Department may submit to the Board a report of the alleged\nbreach.\n(2) On receipt of a report submitted in accordance with subsection (1), the Board\nshall review and determine whether the information presented in the report\nestablishes a prima facie case that there has been a breach of a condition of the\nlicence.\n(3) If on review of the information presented in the report under subsection (1),\nthe Board is not satisfied that a prima facie case has been established, the\nconditional release on licence shall continue.\n(4) If after a review of the information presented in the report prepared pursuant to\nsubsection (1) the Board is satisfied that a prima facie case has been\nestablished, the Board shall suspend the licence and cause the prisoner to be\nreturned to prison.\n(5) The Secretary to the Conditional Release Board shall \u2014\n(a) forward the suspended licence order to the Commissioner of Police; and\n(b) inform the prisoner of the licence conditions he is alleged to have\nbreached.\n(6) A prisoner returned to prison under subsection (4) has the status of a prisoner\non remand and his conditional release licence is automatically suspended.\n(7) On the return of a prisoner on a conditional release licence to prison under\nsubsection (4), the Secretary to the Conditional Release Board shall \u2014\n(a) provide the prisoner with all documentary evidence in relation to the\nallegations of breach of the licence conditions; and\n(b) inform the prisoner of his right \u2014\n(i)\nto have an attorney-at-law or other representative act on his behalf;\n(ii) to present evidence; and\n(iii) make representations in his defence before the Board.\n\nSection 16\nConditional Release Law (2019 Revision)\n\nPage 16\nRevised as at 1st January, 2019\nc\n\n(8) As soon as reasonably practicable but in any case within fourteen working\ndays of the return to prison of a prisoner under subsection (4), the Board shall\nmeet to hear and determine whether or not his licence should be revoked.\n(9) At the hearing referred to in subsection (8), the Board shall give the prisoner,\nhis attorney-at-law or other representative an opportunity to make\nrepresentations in his defence as to why the licence should not be revoked.\n(10) If the Board is satisfied that the evidence presented proves on a balance of\nprobabilities that the prisoner has breached one or more of the conditions of\nthe licence, the Board may within five working days \u2014\n(a) revoke the licence; or\n(b) order the release of the prisoner subject to the variation of licence\nconditions, if necessary.\n(11) If a licence is revoked under this section, the prisoner \u2014\n(a) has the status of a convicted prisoner and shall continue to serve the\nunexpired portion of his sentence but this does not preclude the prisoner\nfrom making a subsequent application for conditional release on\nlicence \u2014\n(i)\nafter twelve months has elapsed from the date of revocation; or\n(ii) where the sentence is twelve months or less, at such time as the\nBoard may determine; and\n(b) shall be liable to be detained in pursuance of his sentence and, if at large,\nshall be deemed to be unlawfully at large.\n(12) If the Board is not satisfied that the evidence proves on a balance of\nprobabilities that the prisoner is in breach of the conditions of the licence, the\nBoard shall release the prisoner on licence and the licence shall continue until\nit has expired or unless it is subsequently revoked or suspended in accordance\nwith this Law, unless some matters of concern arise, in which case the Board\nmay exercise its powers under section 6(1)(b) and 12(2) to vary the terms of\nthe licence.\n(13) If a prisoner who is on a conditional release licence leaves the jurisdiction in\nbreach of a condition, he shall be subject to the process outlined in relation to\nsuspension and revocation of the licence.\n16.\nRevocation of licence for commission of further offence\n16. (1) The Board may revoke the licence of a prisoner who is convicted of an offence\ncommitted during the period of release on licence.\n(2) A prisoner on a conditional release licence who is arrested and charged in\nrelation to another criminal charge and is not released on bail assumes the\nstatus of a remand prisoner and his conditional release licence is automatically\n\nConditional Release Law (2019 Revision)\nSection 17\n\nc\nRevised as at 1st January, 2019\nPage 17\n\nsuspended and the revocation of his licence shall then be considered under\nsection 15(6) to (12).\n(3) Where a prisoner on conditional release is arrested and charged in relation to\nanother criminal offence and is released on bail the Board may consider the\nsuspension or revocation of his conditional release licence under the process\nprovided for in section 15(1) to (12).\n17.\nVariation of licence on grounds of incapacity or medical deterioration\n17. If a prisoner is released on licence and subsequently becomes incapacitated or the\nprisoner\u2019s medical condition has deteriorated, or both, the Board may vary the terms\nof the licence.\n18.\nEmergency recall procedure\n18. (1) Where the Board has reasonable grounds to suspect that a prisoner has\ncommitted, is about to, or is likely to, commit a serious offence, the Board\nshall immediately suspend the licence and recall the prisoner to prison.\n(2) Where a prisoner is recalled under subsection (1), the Board shall cause the\nCommissioner of Police to be informed of the suspension and the\nCommissioner shall cause that person to be detained in prison to await a\nhearing at which the need or otherwise of revoking the licence is to be\nconsidered.\n(3) As soon as reasonably practicable but in any case within three working days of\nthe remand of a prisoner under subsection (2), the Board shall hold a hearing\nto determine whether or not the prisoner\u2019s licence should be revoked.\n(4) The hearing by the Board under this section shall be conducted in accordance\nwith section 15(7) to (12).\n19.\nReports on operations of Board\n19. (1) The Board shall, within three months after the end of each financial year,\nforward to the Governor an annual report of the operation of the Board during\nthat year.\n(2) The Governor shall as soon as possible after receiving the annual report, cause\ncopies of the annual report to be laid before the Legislative Assembly by the\nMinister responsible for prisons.\n20.\nExpenses of Board\n20. Members of the Board other than full-time public servants shall receive such\nremuneration or allowance as may be prescribed by the Governor.\n\nSection 21\nConditional Release Law (2019 Revision)\n\nPage 18\nRevised as at 1st January, 2019\nc\n\n21.\nRegulations\n21. The Cabinet may make regulations prescribing all matters that are required or\npermitted by this Law to be prescribed, or are necessary or convenient to be\nprescribed for giving effect to the purposes of this Law.\n22.\nJudicial review of Board decisions\n22. A prisoner who is dissatisfied with a decision of the Board may seek leave from the\nGrand Court to apply for judicial review of the decision and the Grand Court shall\nin that regard exercise all the powers vested in it in relation to judicial review.\n23.\nTransitional provisions\n23. (1) Within twenty-four months after the entry into force of the Conditional\nRelease Law, 2014 [Law 18 of 2014], the Director of Public Prosecutions shall\nsend to the Grand Court the case records of all prisoners serving life sentences,\nexcluding those whose applications for release on licence are pending under\nsection 31A of the Prison Law, 1975 [Law 14 of 1975], and the Grand Court\nshall, in exercise of the powers contained in section 14, pronounce in open\ncourt a period of incarceration for each prisoner, and in so doing shall exercise\nthe powers specified in section 14 as if it were sentencing an accused who has\nbeen convicted.\n(2) Where an application under section 31A of the Prison Law, 1975 [Law 14 of\n1975]  is refused, the prisoner may at any time apply to the Grand Court for a\ntariff to be set, in which case the Grand Court shall exercise the powers in\nsubsection (1).\n(3) In exercising the powers referred to in subsection (1), the Grand Court may,\nwhere practicable, consult any serving Judge who decided the matter\nconcerned, and may exercise such other powers as a Judge sentencing an\naccused in a case tried by him may have under any Law and the accused shall\nhave such right to be heard as he would have had at the time of his original\nsentencing hearing.\n(4) At the sentencing hearing referred to in this section, evidence of the prisoner\u2019s\nbehaviour in prison after original sentencing is not admissible.\n(5) A prisoner who is dissatisfied with a decision made under subsection (1) or (2)\nshall have a right of appeal in the same manner as a person being sentenced for\nthe first time.\n(6) Where at the commencement of the Conditional Release Law, 2014 [Law 18\nof 2014], a prisoner is serving a fixed term and the earliest date of release\nwhich would have been determined under section 29 of the Prisons Law, 1975\n[Law 14 of 1975] is earlier than the earliest date on which he would have been\neligible for release on licence under this Law, the prisoner shall be released on\nthe earlier date and without conditions.\n\nConditional Release Law (2019 Revision)\nSection 24\n\nc\nRevised as at 1st January, 2019\nPage 19\n\n24.\nRepeal\n24.
