[20th February, 1958]\n\nE it enacted by the Queen\u2019s most Excellent Majesty, by and\nwith the advice and consent of the Lords Spiritual and\nTemporal, and Commons, in this present Parliament\n\nassembled, and by the authority of the same, as follows:\u2014\n\n1. On such day as Her Majesty may by Order in Council Separation of\nappoint (in this Act referred to as the \u201cappointed day\u201d) the Turks and\n\nTurks and Caicos Islands shall cease to be part of the colony of cao ee\nJamaica. of Jamaica.\n\n2.\u2014(1) On the appointed day the Cayman Islands Act, 1863, Provisions as\nand the Order in Council made under the Turks and Caicos '\u00a9 government\n\nIslands Act, 1873, shall cease to have effect. of Cayman\n\n. . : .. Turks and\n(2) Her Majesty may by Order in Council make such provision Caicos Islands.\n\nas appears to Her expedient for the government on and after the 26 & 27 Vict.\nappointed day of the Cayman Islands and the Turks and Caicos c. 31.\nIslands as part of the West Indies (that is to say, the Federation 36 & 37 Vict.\nestablished under the British Caribbean Federation Act, 1956), \u00a9 \u00a9\n\nand any such Order may, in so far as may be consistent with the 4 & 5 Eliz. 2.\nprovisions of any Order in Council in force under section one % \u00ae:\n\nof that Act,\u2014\n\n(a) confer power to make laws for any of the said Islands on\nauthorities established under the Order, on the legislature\nof Jamaica, and on any other authority;\n\n1\n\nPower to\nauthorise\nmaking of\nemergency\nlaws.\n\nCu. 13 Cayman Islands and Turks and = 6 & 7 Ez. 2\nCaicos Islands Act, 1958\n\n(b) confer or provide for conferring on any court of Jamaica\noriginal or other jurisdiction over matters arising in any\nof the said Islands;\n\n(c) confer powers and impose duties on any authorities\nestablished under the Order or any other authorities of\nany of the said Islands or any authorities of Jamaica;\n\n(d) make or provide for the making of such incidental,\nconsequential or transitional provisions as may appear\nto Her Majesty to be necessary or expedient.\n\n(3) The cesser of the provisions mentioned in subsection (1)\nof this section shall not affect the continued operation of any\nother law in force in any of the said Islands immediately before\nthe appointed day; but an Order in Council under this section\nmay make or provide for the making of such modifications or\nadaptations in, and such repeals of, any such laws as may appear\nto Her Majesty to be necessary or expedient in consequence of\nthe passing of this Act.\n\n(4) An Order in Council under this section made before the\nappointed day may be so framed as to enable any authority upon\nwhom power is thereby conferred to make any provision or to\nadapt, modify or repeal any law to exercise that power before\nthat day with effect from that or a later day.\n\n(5) An Order in Council under this section may be revoked or\nvaried by a subsequent Order in Council.\n\n3.\u2014(1) Notwithstanding anything in section two of this Act or\nany Order in Council made under that section, Her Majesty may\nby Order in Council confer power on any authority to make, in\nrelation to periods of emergency, such laws for any of the said\nIslands, to have effect notwithstanding the provisions of any\nother law, as may appear to that authority to be necessary or\nexpedient for securing the public safety, the defence of that\nIsland or the maintenance of public order or for maintaining\nsupplies and services essential to the life of the community; but\nany power so conferred shall be exercisable only to the same\nextent and subject to the same restrictions as the power of the\nlegislature of the Island to make Jaws in similar circumstances.\n\n(2) In this section \u201c\u2018 period of emergency \u201d\u2019 means, in relation\nto any of the said Islands, a period beginning with a declaration\nmade by such authority and in such manner as may be prescribed\nby an Order in Council under this section that a public emergency\nexists in that Island and ending with a declaration so made that\na public emergency no longer exists therein.\n\n2\n\n6 & 7 Exiz. 2 Cayman Islands and Turks and Cu. 13\nCaicos Islands Act, 1958\n\n(3) An Order in Council under this section may be revoked or\nvaried by a subsequent Order in Council.\n\n4.
