I Assent Franz Manderson Acting Governor. 2nd August, 2018 A LAW TO FACILITATE THE PROVISION OF ADVANCE PASSENGER INFORMATION RELATING TO PASSENGERS AND CREW MEMBERS OF AN AIRCRAFT OR VESSEL; TO SHARE THE INFORMATION WITH OTHER STATES WITH A VIEW TO IDENTIFYING PERSONS WHO MAY POSE RISKS TO SECURITY; AND FOR INCIDENTAL AND CONNECTED PURPOSES ENACTED by the Legislature of the Cayman Islands. 1. (1)  This Law may be cited as the Advance Passenger Information Law, 2018. (2) This Law shall come into force on such date as may be appointed by Order made by the Cabinet and different dates may be appointed for different provisions of this Law and in relation to different matters. 2. In this Law - \u201cadvanced passenger information\u201d means the information or data concerning a crew member, passenger or any other person travelling in an aircraft or vessel as set out in Schedule 1; Short title and commencement Interpretation Schedule 1 The Advance Passenger Information Law, 2018 \u201cadvanced passenger information system or APIS\u201d means the automated electronic data interchange of API; and the screening of API by the competent authority, IMPACS and JRCC against a Watch List for any API hit; \u201caircraft\u201d includes an aeroplane or a helicopter or other means of airborne navigation by means of which persons can travel across international borders; \u201cAPI\u201d means advanced passenger information; \u201cAPI hit\u201d means a name present in the Watch List Systems; \u201cAPIS\u201d means advanced passenger information system; \u201ccaptain\u201d means the pilot of an aircraft designated by the operator , or in the case of general aviation, the owner or pilot designated by the owner, as being in command and charged with the safe conduct of the flight; \u201ccommercial aircraft\u201d means an aircraft which engages in transporting passengers or goods for monetary gain; \u201ccompetent authority\u201d means the Chief Immigration Officer pursuant to section 3 of the Immigration Law (2015 Revision) or the Chief Immigration Officer\u2019s designate who shall not be below the rank of Assistant Chief Immigration Officer under that Law; \u201cCONSLE\u201d means the Council for National Security and Law Enforcement in CARICOM; \u201ccrew member\u201d means - (a) in relation to aircraft, an individual charged with performing duties essential to the operation of an aircraft during flight; and (b) in relation to a vessel, any individual charged with performing duties essential to the operation of the vessel and the safety and well-being of its passengers or cargo; \u201cground stop\u201d means the instruction given by air traffic control to slow or halt the flow of aircraft departing from or inbound to an airport; (2015 Revision) The Advance Passenger Information Law, 2018 \u201cholding pattern\u201d means the flight path maintained by an aircraft awaiting permission to land; \u201cIATA\u201d means the International Air Transport Association founded in Havana, Cuba, on 19th April 1945; \u201cICAO\u201d means the International Civil Aviation Organisation which was formed as a result of the Convention on International Civil Aviation also known as the \u201cChicago Convention\u201d signed on 7th December, 1944; \u201cIMPACS\u201d means the Implementing Agency for Crime and Security established under the 2006 Agreement establishing the CARICOM Implementing Agency for Crime and Security; \u201cIMO\u201d means the International Maritime Organisation which was formerly the Inter-Governmental Maritime Consultative Organization established by a convention adopted in Geneva in 1948 for the purpose of effectively promoting maritime safety; \u201cINTERPOL\u201d means the International Crime Police Organisation; \u201cJRCC\u201d means the Joint Regional Communication Centre which is a sub-agency of IMPACS; \u201clocal agent\u201d means - (a) the owner of an aircraft or a vessel, if the owner is in the Islands; (b) any corporate body owning or operating, whether under charter or otherwise, the aircraft or vessel for the time being, where such corporate body maintains an office in the Islands; or (c) the agent in the Islands for the person or corporate body for the time being owning or operating the aircraft or vessel; \u201cmaster\u201d includes every person having command or charge of a vessel other than a pilot; \u201cpassenger\u201d means any person not being a bona fide crew member, travelling or seeking to travel on an aircraft or vessel; \u201cPNR\u201d or \u201cpassenger name record\u201d means the record created by air carriers or their authorised agents for each journey booked by or on behalf of any passenger The Advance Passenger Information Law, 2018 and containers in the air carrier\u2019s reservation system, departure control system or equivalent system; \u201cprivate aircraft\u201d means any aircraft which is not - (a) a commercial aircraft; or (b) an aircraft owned or leased by the Government; \u201crecreational sports fishing vessel\u201d means a sports fishing boat based in the Cayman Islands and registered in accordance with prescribed procedure referred to in the Immigration Law (2015 Revision); \u201ctechnical stop\u201d or \u201cstop for non-traffic purposes\u201d means an aircraft or vessel arriving for purposes of refuelling, repairs, emergency or a similar purpose other than taking on or discharging passengers, baggage, cargo or mail; \u201cvessel\u201d means any ship, boat, yacht, or other floating or submersible transportation  by  means  of  which  persons  and  goods  can  travel  across international borders and for the avoidance of doubt includes a cruise line, a cargo ship and a tug boat; \u201cWatch List\u201d means a list that is used to watch or track the current activity or movements of criminals; including terrorists and persons who have been found guilty of any offence involving stolen and lost travel documents, criminal deportees and other persons of interest to the intelligence community; and \u201cwheels up\u201d means the expect further clearance time, release time or point in time when the crew of an aircraft expects to be released from a holding pattern or exempted from a ground stop. 3. (1) This section applies to an aircraft or vessel which - (a) is expected to arrive in the Islands; or (b) is expected to depart from the Islands, but does not apply to a recreational sports fishing vessel. (2) The local agent of every aircraft or vessel to which this section applies shall provide to the competent authority and IMPACS, the relevant API and data relating to the flight or voyage as set out in Schedule 1. (3) A local agent who - (a) fails to provide the API in accordance with subsection (2); or (2015 Revision) Duty to provide advance passenger information Schedule 1 The Advance Passenger Information Law, 2018 (b) intentionally or recklessly - (i) provides an erroneous, faulty, misleading, incomplete or false API; or (ii) transmits the API in an incorrect format; commits an offence and is liable on summary conviction to a fine of ten thousand dollars or to imprisonment for a term of one year or to both. (4) Where the API provided is inaccurate and the local agent of  the aircraft or vessel satisfies the competent authority that the error was not made knowingly or recklessly, then notwithstanding any other provision of this Law, the local agent may not be charged for an offence pursuant to subsection (3). (5) In addition to any information provided pursuant to subsection (2) the competent authority may - (a) question any captain or master, crew member or passenger in relation to the aircraft or vessel; or (b) request any person within the category of persons mentioned in paragraph (a) to forthwith produce any document  within that person\u2019s possession or control in relation to the questions put to the person. (6) Any captain or master, member of crew or passenger who - (a) refuses to answer or knowingly gives a false answer to any question put to him by the competent authority; or (b) fails to comply with a request under subsection 5(b), commits an offence and is liable on summary conviction to a fine of five thousand dollars or to imprisonment for six months or to both. (7) An Assistant Chief Immigration Officer or an immigration officer in a position senior to an Assistant Chief Immigration Officer may waive the requirements of subsection (2) where the aircraft or vessel is - (a) a military or law enforcement aircraft or vessel; (b) on official Government business; or (c) on the business of a humanitarian organisation. 4. (1) API data shall be submitted to the competent authority in accordance with the timelines set out in Schedule 2. (2) Notwithstanding subsection (1) the competent authority may waive the requirement for the submission of API data in the case of an emergency. Timeframe The Advance Passenger Information Law, 2018 5. (1) The API provided under section 3(2) shall be verified by the competent authority during physical processing of any crew member or passenger at any port of entry or exit by comparing the API information to the information contained in the travel document presented by the crew member or the passenger. (2) The competent authority shall, if any discrepancy is found in the API, correct the data at the port of entry or departure and update the information in APIS after verifying the information from the travel document or other relevant documents of the crew member or passenger. 6. (1) Nothing in section 3 applies to an aircraft or vessel which makes a technical stop or lands, berths, anchors, or otherwise arrives or stops at any port for non-traffic purposes if the arrival is - (a) required by any statutory or other requirement relating to navigation; (b) compelled by any emergency, accident, unfavourable weather conditions, or other necessity; or (c) authorised by the competent authority. (2) Where an aircraft or vessel arrives or stops for any of the reasons outlined in subsection (1) the captain or master shall - (a) forthwith report to the competent authority; (b) not without the consent of the competent authority, permit any crew members or passenger to disembark from the aircraft or vessel; and (c) comply with any directions given by the competent authority in respect of any crew member, or passenger carried on the aircraft or vessel. (3) Subject to any authorisation granted by the competent authority, neither a crew member nor a passenger on an aircraft or vessel shall without the consent of that authority disembark from the aircraft or vessel, and any such person shall comply with any direction given by the competent authority. (4) A captain or master who fails to comply with or contravenes this section commits an offence and is liable on summary conviction to a fine of ten thousand dollars or to imprisonment for a term of one year or to both. (5) Notwithstanding subsection (4), the disembarkation of a crew member or a passenger from an aircraft or vessel shall not constitute an offence, if the disembarkation is necessary for reasons of health, safety or the preservation of life. Powers of the competent authority to verify Vessel or aircraft arriving for non-traffic purposes or making a technical stop The Advance Passenger Information Law, 2018 (6) In the circumstances set out at subsection (5) or in similar emergency circumstances the competent authority shall take into consideration the circumstances of the emergency and that the pilot or master may not have been in a position to transmit the API and in such circumstances the competent authority shall not consider the non-compliance of the pilot or master to be a contravention of this section. 7. (1) The competent authority shall - (a) co-ordinate with IMPACS on all matters relating to the APIS; (b) if requested, allow a crew member or a passenger from an aircraft or vessel access to the crew member\u2019s or the passenger\u2019s personal identifiable information maintained in the APIS to ensure its correctness; but no crew member or passenger shall have access to any information provided by IMPACS or JRCC through the screening of API by IMPACS and JRCC against a Watch List for any API hit; (c) determine, after consultation with IMPACS, the admissibility or otherwise of any crew member or passenger into the Islands; (d) withhold clearance for the departure of an aircraft whose captain has not provided the API required pursuant to section 3, pending submission of the API; and (e) assess the sufficiency of API information provided for each journey of an aircraft or vessel and review API transmissions to assess error rates. (2) Notwithstanding section 7(a) and (c), any decision with respect to the admissibility or inadmissibility of a crew member or a passenger from an aircraft or vessel into the Islands shall be made solely by the competent authority. (3) A pilot or master in control of an aircraft or a vessel or a local agent, respectively may, at the discretion of the authority, be required to provide a manifest and any other passenger or crew data which may be requested by the competent authority and if such a request is made, the pilot, master or local agent shall satisfy the request. 8. (1) IMPACS shall use the APIS to conduct screening against Watch Lists of crew members and passengers on aircraft and vessels that enter into, depart from and travel within the regional space in order to provide information to assist participating countries. (2) IMPACS may share the information contained within APIS with INTERPOL and any other national, regional or international intelligence, law Powers and duties of the competent authority Use and sharing of API with regional and international security agencies The Advance Passenger Information Law, 2018 enforcement or security agencies or centres approved by CONSLE to further national, regional or international security. (3) API shall only be used for the purposes mentioned in this Law. 9. (1) The API collected under this Law for entry screening purposes shall be retained for a period not exceeding three years from the date of travel of  the crew member or the passenger. (2) Nothing contained in subsection (1) applies to the data copied from the APIS into any other security database system to which a different data retention schedule applies. 10. The Cabinet may make regulations - (a) to provide for procedures for the gathering of information and for the collaboration and sharing of information with the agencies mentioned in this Law; and (b) for carrying into effect the purposes and provisions of this Law. 11. (1) The Cabinet may by Order published in the Gazette amend Schedule 1 or 2 in consultation with CONSLE with respect to API. (2) An Order made under subsection (1) is subject to negative resolution. (a) arriving to the Islands, no later than sixty minutes prior to departure from the last port of call; and (b) departing from the Islands, in three intervals of - (i) seventy minutes prior to departure; (ii) fifty-five minutes prior to departure; and (iii) no later than fifteen minutes after wheels up. (2) In the case of a privately owned aircraft - (a) arriving to the Islands, no later than sixty minutes prior to departure from the last port of call; and (b) departing from the Islands, no later than sixty minutes prior to departure. The Advance Passenger Information Law, 2018 (3) In the case of a vessel arriving, no later than forty minutes prior to the departure from the last port of call. (4) In the case of a vessel arriving from a destination outside the regional space, no later than twenty-four hours prior to the arrival. (5) In the case of a vessel arriving from a destination within the regional space, no later than one hour prior to the arrival of the vessel from the last port of call. (6) In the event of any changes to the flight or vessel header data or data relating to an individual on board, an updated API file is required prior to departure of the aircraft or vessel. Amendment of the Schedules\n\nThe Advance Passenger Information Law, 2018\n\n3\nCAYMAN ISLANDS\n\nLaw 4 of 2018.\n\nI Assent\n\nFranz Manderson\n\nActing Governor.\n\n 2nd August, 2018\n\nA LAW TO FACILITATE THE PROVISION OF ADVANCE\nPASSENGER INFORMATION RELATING TO PASSENGERS AND\nCREW MEMBERS OF AN AIRCRAFT OR VESSEL; TO SHARE THE\nINFORMATION WITH OTHER STATES WITH A VIEW TO\nIDENTIFYING PERSONS WHO MAY POSE RISKS TO SECURITY; AND\nFOR INCIDENTAL AND CONNECTED PURPOSES\n\nENACTED by the Legislature of the Cayman Islands.\n1.\n(1)  This Law may be cited as the Advance Passenger Information Law,\n2018.\n(2) This Law shall come into force on such date as may be appointed by\nOrder made by the Cabinet and different dates may be appointed for different\nprovisions of this Law and in relation to different matters.\n2.\nIn this Law -\n\u201cadvanced passenger information\u201d means the information or data concerning a\ncrew member, passenger or any other person travelling in an aircraft or vessel as\nset out in Schedule 1;\nShort title and\ncommencement\nInterpretation\nSchedule 1\n\nThe Advance Passenger Information Law, 2018\n\n4\n\u201cadvanced passenger information system or APIS\u201d means the automated\nelectronic data interchange of API; and the screening of API by the competent\nauthority, IMPACS and JRCC against a Watch List for any API hit;\n\u201caircraft\u201d includes an aeroplane or a helicopter or other means of airborne\nnavigation by means of which persons can travel across international borders;\n\u201cAPI\u201d means advanced passenger information;\n\u201cAPI hit\u201d means a name present in the Watch List Systems;\n\u201cAPIS\u201d means advanced passenger information system;\n\u201ccaptain\u201d means the pilot of an aircraft designated by the operator , or in the case\nof general aviation, the owner or pilot designated by the owner, as being in\ncommand and charged with the safe conduct of the flight;\n\u201ccommercial aircraft\u201d means an aircraft which engages in transporting passengers\nor goods for monetary gain;\n\u201ccompetent authority\u201d means the Chief Immigration Officer pursuant to section 3\nof the Immigration Law (2015 Revision) or the Chief Immigration Officer\u2019s\ndesignate who shall not be below the rank of Assistant Chief Immigration Officer\nunder that Law;\n\u201cCONSLE\u201d means the Council for National Security and Law Enforcement in\nCARICOM;\n\u201ccrew member\u201d means -\n(a)\nin relation to aircraft, an individual charged with performing\nduties essential to the operation of an aircraft during flight; and\n(b) in relation to a vessel, any individual charged with performing\nduties essential to the operation of the vessel and the safety and\nwell-being of its passengers or cargo;\n\u201cground stop\u201d means the instruction given by air traffic control to slow or halt the\nflow of aircraft departing from or inbound to an airport;\n\n(2015 Revision)\n\nThe Advance Passenger Information Law, 2018\n\n5\n\u201cholding pattern\u201d means the flight path maintained by an aircraft awaiting\npermission to land;\n\u201cIATA\u201d means the International Air Transport Association founded in Havana,\nCuba, on 19th April 1945;\n\u201cICAO\u201d means the International Civil Aviation Organisation which was formed\nas a result of the Convention on International Civil Aviation also known as the\n\u201cChicago Convention\u201d signed on 7th December, 1944;\n\u201cIMPACS\u201d means the Implementing Agency for Crime and Security established\nunder the 2006 Agreement establishing the CARICOM Implementing Agency for\nCrime and Security;\n\u201cIMO\u201d means the International Maritime Organisation which was formerly the\nInter-Governmental Maritime Consultative Organization established by a\nconvention adopted in Geneva in 1948 for the purpose of effectively promoting\nmaritime safety;\n\u201cINTERPOL\u201d means the International Crime Police Organisation;\n\u201cJRCC\u201d means the Joint Regional Communication Centre which is a sub-agency\nof IMPACS;\n\u201clocal agent\u201d means -\n(a)\nthe owner of an aircraft or a vessel, if the owner is in the Islands;\n(b) any corporate body owning or operating, whether under charter\nor otherwise, the aircraft or vessel for the time being, where such\ncorporate body maintains an office in the Islands; or\n(c)\nthe agent in the Islands for the person or corporate body for the\ntime being owning or operating the aircraft or vessel;\n\u201cmaster\u201d includes every person having command or charge of a vessel other than\na pilot;\n\u201cpassenger\u201d means any person not being a bona fide crew member, travelling or\nseeking to travel on an aircraft or vessel;\n\u201cPNR\u201d or \u201cpassenger name record\u201d means the record created by air carriers or\ntheir authorised agents for each journey booked by or on behalf of any passenger\n\nThe Advance Passenger Information Law, 2018\n\n6\nand containers in the air carrier\u2019s reservation system, departure control system or\nequivalent system;\n\u201cprivate aircraft\u201d means any aircraft which is not -\n(a)\na commercial aircraft; or\n(b) an aircraft owned or leased by the Government;\n\u201crecreational sports fishing vessel\u201d means a sports fishing boat based in the\nCayman Islands and registered in accordance with prescribed procedure referred\nto in the Immigration Law (2015 Revision);\n\u201ctechnical stop\u201d or \u201cstop for non-traffic purposes\u201d means an aircraft or vessel\narriving for purposes of refuelling, repairs, emergency or a similar purpose other\nthan taking on or discharging passengers, baggage, cargo or mail;\n\u201cvessel\u201d means any ship, boat, yacht, or other floating or submersible\ntransportation  by  means  of  which  persons  and  goods  can  travel  across\ninternational borders and for the avoidance of doubt includes a cruise line, a\ncargo ship and a tug boat;\n\u201cWatch List\u201d means a list that is used to watch or track the current activity or\nmovements of criminals; including terrorists and persons who have been found\nguilty of any offence involving stolen and lost travel documents, criminal\ndeportees and other persons of interest to the intelligence community; and\n\u201cwheels up\u201d means the expect further clearance time, release time or point in time\nwhen the crew of an aircraft expects to be released from a holding pattern or\nexempted from a ground stop.\n3.\n(1) This section applies to an aircraft or vessel which -\n(a)\nis expected to arrive in the Islands; or\n(b) is expected to depart from the Islands,\nbut does not apply to a recreational sports fishing vessel.\n(2) The local agent of every aircraft or vessel to which this section applies\nshall provide to the competent authority and IMPACS, the relevant API and data\nrelating to the flight or voyage as set out in Schedule 1.\n(3) A local agent who -\n(a)\nfails to provide the API in accordance with subsection (2); or\n\n(2015 Revision)\nDuty to provide advance\npassenger information\n\nSchedule 1\n\nThe Advance Passenger Information Law, 2018\n\n7\n(b) intentionally or recklessly -\n(i)\nprovides an erroneous, faulty, misleading, incomplete or\nfalse API; or\n(ii) transmits the API in an incorrect format;\ncommits an offence and is liable on summary conviction to a fine of ten thousand\ndollars or to imprisonment for a term of one year or to both.\n(4) Where the API provided is inaccurate and the local agent of  the\naircraft or vessel satisfies the competent authority that the error was not made\nknowingly or recklessly, then notwithstanding any other provision of this Law,\nthe local agent may not be charged for an offence pursuant to subsection (3).\n(5) In addition to any information provided pursuant to subsection (2) the\ncompetent authority may -\n(a)\nquestion any captain or master, crew member or passenger in\nrelation to the aircraft or vessel; or\n(b) request any person within the category of persons mentioned in\nparagraph (a) to forthwith produce any document  within that\nperson\u2019s possession or control in relation to the questions put to\nthe person.\n(6) Any captain or master, member of crew or passenger who -\n(a)\nrefuses to answer or knowingly gives a false answer to any\nquestion put to him by the competent authority; or\n(b) fails to comply with a request under subsection 5(b),\ncommits an offence and is liable on summary conviction to a fine of five\nthousand dollars or to imprisonment for six months or to both.\n(7) An Assistant Chief Immigration Officer or an immigration officer in a\nposition senior to an Assistant Chief Immigration Officer may waive the\nrequirements of subsection (2) where the aircraft or vessel is -\n(a)\na military or law enforcement aircraft or vessel;\n(b) on official Government business; or\n(c)\non the business of a humanitarian organisation.\n4.\n(1) API data shall be submitted to the competent authority in accordance\nwith the timelines set out in Schedule 2.\n(2) Notwithstanding subsection (1) the competent authority may waive the\nrequirement for the submission of API data in the case of an emergency.\n Timeframe\n\nThe Advance Passenger Information Law, 2018\n\n8\n5.\n(1) The API provided under section 3(2) shall be verified by the\ncompetent authority during physical processing of any crew member or passenger\nat any port of entry or exit by comparing the API information to the information\ncontained in the travel document presented by the crew member or the passenger.\n(2) The competent authority shall, if any discrepancy is found in the API,\ncorrect the data at the port of entry or departure and update the information in\nAPIS after verifying the information from the travel document or other relevant\ndocuments of the crew member or passenger.\n6.\n(1) Nothing in section 3 applies to an aircraft or vessel which makes a\ntechnical stop or lands, berths, anchors, or otherwise arrives or stops at any port\nfor non-traffic purposes if the arrival is -\n(a)\nrequired by any statutory or other requirement relating to\nnavigation;\n(b) compelled by any emergency, accident, unfavourable weather\nconditions, or other necessity; or\n(c)\nauthorised by the competent authority.\n(2) Where an aircraft or vessel arrives or stops for any of the reasons\noutlined in subsection (1) the captain or master shall -\n(a)\nforthwith report to the competent authority;\n(b) not without the consent of the competent authority, permit any\ncrew members or passenger to disembark from the aircraft or\nvessel; and\n(c)\ncomply with any directions given by the competent authority in\nrespect of any crew member, or passenger carried on the aircraft\nor vessel.\n(3) Subject to any authorisation granted by the competent authority,\nneither a crew member nor a passenger on an aircraft or vessel shall without the\nconsent of that authority disembark from the aircraft or vessel, and any such\nperson shall comply with any direction given by the competent authority.\n(4) A captain or master who fails to comply with or contravenes this\nsection commits an offence and is liable on summary conviction to a fine of ten\nthousand dollars or to imprisonment for a term of one year or to both.\n(5) Notwithstanding subsection (4), the disembarkation of a crew member\nor a passenger from an aircraft or vessel shall not constitute an offence, if the\ndisembarkation is necessary for reasons of health, safety or the preservation of\nlife.\nPowers of the competent\nauthority to verify\nVessel or aircraft\narriving for non-traffic\npurposes or making a\ntechnical stop\n\nThe Advance Passenger Information Law, 2018\n\n9\n(6) In the circumstances set out at subsection (5) or in similar emergency\ncircumstances the competent authority shall take into consideration the\ncircumstances of the emergency and that the pilot or master may not have been in\na position to transmit the API and in such circumstances the competent authority\nshall not consider the non-compliance of the pilot or master to be a contravention\nof this section.\n7.\n(1) The competent authority shall -\n(a)\nco-ordinate with IMPACS on all matters relating to the APIS;\n(b) if requested, allow a crew member or a passenger from an aircraft\nor vessel access to the crew member\u2019s or the passenger\u2019s\npersonal identifiable information maintained in the APIS to\nensure its correctness; but no crew member or passenger shall\nhave access to any information provided by IMPACS or JRCC\nthrough the screening of API by IMPACS and JRCC against a\nWatch List for any API hit;\n(c)\ndetermine, after consultation with IMPACS, the admissibility or\notherwise of any crew member or passenger into the Islands;\n(d) withhold clearance for the departure of an aircraft whose captain\nhas not provided the API required pursuant to section 3, pending\nsubmission of the API; and\n(e)\nassess the sufficiency of API information provided for each\njourney of an aircraft or vessel and review API transmissions to\nassess error rates.\n(2) Notwithstanding section 7(a) and (c), any decision with respect to the\nadmissibility or inadmissibility of a crew member or a passenger from an aircraft\nor vessel into the Islands shall be made solely by the competent authority.\n(3) A pilot or master in control of an aircraft or a vessel or a local agent,\nrespectively may, at the discretion of the authority, be required to provide a\nmanifest and any other passenger or crew data which may be requested by the\ncompetent authority and if such a request is made, the pilot, master or local agent\nshall satisfy the request.\n8.\n(1) IMPACS shall use the APIS to conduct screening against Watch Lists\nof crew members and passengers on aircraft and vessels that enter into, depart\nfrom and travel within the regional space in order to provide information to assist\nparticipating countries.\n(2) IMPACS may share the information contained within APIS with\nINTERPOL and any other national, regional or international intelligence, law\nPowers and duties of the\ncompetent authority\nUse and sharing of API\nwith regional and\ninternational security\nagencies\n\nThe Advance Passenger Information Law, 2018\n\n10\nenforcement or security agencies or centres approved by CONSLE to further\nnational, regional or international security.\n(3) API shall only be used for the purposes mentioned in this Law.\n9.\n(1) The API collected under this Law for entry screening purposes shall be\nretained for a period not exceeding three years from the date of travel of  the crew\nmember or the passenger.\n(2) Nothing contained in subsection (1) applies to the data copied from the\nAPIS into any other security database system to which a different data retention\nschedule applies.\n10. The Cabinet may make regulations -\n(a)\nto provide for procedures for the gathering of information and for\nthe collaboration and sharing of information with the agencies\nmentioned in this Law; and\n(b) for carrying into effect the purposes and provisions of this Law.\n11. (1) The Cabinet may by Order published in the Gazette amend Schedule 1\nor 2 in consultation with CONSLE with respect to API.\n(2) An Order made under subsection (1) is subject to negative Reporting Party Facsimile Number\n(iv) Reporting Party Electronic Mail Address\nSCHEDULE 2\n(Section 4)\nTIMEFRAME\n(1) In the case of commercial aircraft -\n(a)\narriving to the Islands, no later than sixty minutes prior to\ndeparture from the last port of call; and\n(b) departing from the Islands, in three intervals of -\n(i)\nseventy minutes prior to departure;\n(ii) fifty-five minutes prior to departure; and\n(iii) no later than fifteen minutes after wheels up.\n(2) In the case of a privately owned aircraft -\n(a)\narriving to the Islands, no later than sixty minutes prior to\ndeparture from the last port of call; and\n(b) departing from the Islands, no later than sixty minutes prior to\ndeparture.\n\nThe Advance Passenger Information Law, 2018\n\n15\n(3) In the case of a vessel arriving, no later than forty minutes prior to the\ndeparture from the last port of call.\n(4) In the case of a vessel arriving from a destination outside the regional space,\nno later than twenty-four hours prior to the arrival.\n(5) In the case of a vessel arriving from a destination within the regional space,\nno later than one hour prior to the arrival of the vessel from the last port of\ncall.\n(6) In the event of any changes to the flight or vessel header data or data\nrelating to an individual on board, an updated API file is required prior to\ndeparture of the aircraft or
