In these rules \u2014 \u201cchild\u201d means a person who has not attained the age of eighteen years; \u201cBirths and Deaths Registration Law\u201d means the Births and Deaths Registration Act (2021 Revision); \u201cCommissioner\u201d means the Commissioner of Police appointed under the Police Act (2021 Revision); \u201cdeceased\u201d means the person upon whose body an autopsy is performed or touching whose death an inquest is held or the person whose death is reported to the Coroner, as the case may be; \u201chospital\u201d means any institution for the reception and treatment of persons suffering from illness or mental disorder, any maternity home, and any institution for the reception and treatment of persons during convalescence; \u201cinquest\u201d means an inquiry by a Coroner sitting with a jury; Rule 3 Coroners Rules (2021 Revision) \u201cLaw\u201d means the Coroners Act (2021 Revision); \u201clicensed premises\u201d has the meaning assigned by the Liquor Licensing Act (2019 Revision); \u201cmedical practitioner\u201d means a person registered as being authorised to practise medicine under the Health Practice Act (2021 Revision) and includes a pathologist; \u201cnotification in writing\u201d includes electronic communication; \u201cparental responsibility\u201d has the same meaning as in the Children Act (2012 Revision); \u201cpathologist\u201d means a medical practitioner who specialises in medical diagnosis and has training and experience in the performance of autopsies; \u201cPenal Code\u201d means the Penal Code (2019 Revision); \u201cPublic Holidays Law\u201d means the Public Holidays Act (2007 Revision); \u201cRegistrar\u201d means the Registrar-General of births and deaths appointed under the Births and Deaths Registration Act (2021 Revision); \u201cShipping Master\u201d has the meaning assigned by the Merchant Shipping Act, (2021 Revision); \u201cspecial autopsy\u201d means an autopsy consisting of analysis, test or otherwise of such parts or contents of the body or such other substances or things as ought, in the opinion of the Coroner, to be submitted to analyses, tests or other examinations; \u201cTraffic Law\u201d means the Traffic Act (2021 Revision); and \u201cwatersports\u201d includes swimming, scuba-diving, free-diving, snorkelling, paddle-boarding, surfing, wind-surfing, sailing, kayaking, parasailing, kitesurfing, water skiing, jet skiing, water-powered jet-packs, and recreational fishing.1\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_3\", \"num\": \"3.\", \"text\": \"Revocation and application 3. (1) Subject to paragraph (2), the Coroners Rules (1996 Revision) are hereby revoked. (2) These rules shall apply so far as is practicable to any inquest begun before, and not completed on or before, the date of the commencement of these rules and to any autopsy which, before that day, a Coroner has directed or requested a medical practitioner to perform. 4. Coroner to be available at all times 4. A Coroner shall at all times hold themselves ready to undertake any duties in connection with inquests and autopsies. Coroners Rules (2021 Revision) Rule 5 PART 2 - NOTIFICATION OF CERTAIN DEATHS 5. Persons under duty to notify the Clerk of the Court of deaths; notice to next of kin, etc. 5. (1) Upon the following persons becoming aware that a death has occurred to which section 4 of the Law applies, they shall notify the Clerk of the Court, acting on behalf of the Chief Magistrate, without delay \u2014 (a) in respect of a death having occurred in a hospital, a medical practitioner who attended upon the deceased; (b) in respect of a death having occurred in a prison, the Director of Prisons; (c) the Commissioner; (d) in respect of a death having occurred in any ship in Cayman Islands waters, the Shipping Master; and (e) in respect of bodies that are imported for burial in the Cayman Islands, undertakers. (2) Nothing in this rule shall prevent any person from notifying a Coroner of a death at any time when the Court Offices are closed; and in such a case, the person notifying a Coroner shall, on the next day that the Court Offices are open, notify the Clerk of the Court in writing of \u2014 (a) the death; (b) the Coroner who was notified; and (c) the date when the Coroner was notified. (3) As soon as reasonably practicable after any person has notified the Clerk of the Court of such a death, the Clerk of the Court shall take all reasonable steps to inform the deceased\u2019s next of kin. (4) As soon as practicable after a Coroner has been notified of any death, the Clerk of the Court shall open a file and the Coroner shall notify the Registrar. PART 3 \u2013 AUTOPSIES\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_6\", \"num\": \"6.\", \"text\": \"Delay in performing autopsy to be avoided 6. (1) Where a Coroner directs or requests that an autopsy shall be performed in accordance with section 15 of the Law, the autopsy shall be performed as soon after the death of the deceased as is reasonably practicable. (2) If at any time when the Court Offices are closed any person applies to a Coroner to direct or request that an autopsy be performed, then that person shall, on the next day that the Court Offices are open, notify the Clerk of the Court in writing of \u2014 Rule 7 Coroners Rules (2021 Revision) (a) that person\u2019s request; (b) the name of the Coroner who dealt with the application; and (c) the result of the application.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_7\", \"num\": \"7.\", \"text\": \"Medical practitioner performing autopsy 7. (1) In considering what medical practitioner shall be directed or requested by the Coroner to perform an autopsy, the Coroner shall have regard to the following considerations \u2014 (a) the autopsy should be performed, whenever practicable, by a pathologist with suitable qualifications and experience and having access to laboratory facilities; (b) if the Coroner is informed by the Commissioner that a person may be charged with the murder, manslaughter, abortion or infanticide of the deceased, the Coroner should consult the Commissioner regarding the medical practitioner who is to perform the autopsy; (c) if the deceased died in a hospital, the Coroner should not direct or request a medical practitioner on the staff of, or associated with, that hospital to perform an autopsy if \u2014 (i) that medical practitioner does not desire to perform the autopsy; (ii) the conduct of any member of the hospital staff is likely to be called in question; or (iii) any relative of the deceased asks the Coroner that the autopsy be not performed by such a medical practitioner, unless the obtaining of another medical practitioner with suitable qualifications and experience would cause the examination to be unduly delayed.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_8\", \"num\": \"8.\", \"text\": \"Coroner to notify persons of autopsy to be performed 8. (1) Where a Coroner directs or requests a medical practitioner to perform an autopsy, the Coroner shall notify the persons and bodies set out in paragraph (2) of the date, hour and place at which the autopsy will be performed, unless it is impracticable to notify any such persons or bodies or to do so would cause the examination to be unduly delayed. (2) The persons and bodies to be notified by the Coroner are as follows \u2014 (a) any relative of the deceased who has notified the Coroner of their desire to attend, or be represented at, the autopsy; (b) the deceased\u2019s regular medical practitioner (if known); (c) if the deceased died in a hospital, the hospital; Coroners Rules (2021 Revision) Rule 9 (d) if the death of the deceased may have been caused by any disease notice of which is required by or under any enactment to be given, the Chief Medical Officer; (e) any government department which has notified the Coroner of its desire to be represented at the examination; or (f) if the Commissioner has notified the Coroner of the Commissioner\u2019s desire to be represented at the examination, the Commissioner. (3) Any person or body mentioned in paragraph (2) shall be entitled to be represented at an autopsy by a medical practitioner, or if any such person is a medical practitioner, that person shall be entitled to attend the autopsy in person; but the Commissioner may be represented by a member of the Royal Cayman Islands Police Service. (4) Nothing in this rule shall be deemed to limit the discretion of the Coroner to notify any person of the date, hour and place at which an autopsy will be performed and to permit that person to attend the examination.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_9\", \"num\": \"9.\", \"text\": \"Person attending autopsy not to interfere 9. A person attending an autopsy by virtue of rule 8(3) or (4) shall not interfere with the performance of the autopsy.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_10\", \"num\": \"10.\", \"text\": \"Preservation of material from autopsy 10. (1) A medical practitioner shall make provision, so far as possible, for the preservation of material which, in that person\u2019s opinion, bears upon the cause of death or the identification of the deceased. (2) Where a medical practitioner preserves material under paragraph (1) that person shall notify the Coroner of that fact forthwith by notification in writing. (3) A notification under paragraph (2) shall \u2014 (a) identify the material being preserved; and (b) explain why the medical practitioner is of the opinion mentioned in paragraph (1). (4) A notification under paragraph (2) may \u2014 (a) specify the period for which the medical practitioner believes the material should be preserved; and (b) specify different periods for different material. (5) Where a Coroner receives a notification under paragraph (2) that Coroner shall notify the medical practitioner of the period for which that Coroner requires the material to be preserved, being such period as in the Coroner\u2019s opinion the material needs to be preserved for the purpose of fulfilling the Coroner\u2019s functions under the Law in relation to the deceased, and that Coroner may specify different periods for different material. Rule 11 Coroners Rules (2021 Revision) (6) Subject to paragraph (7), on making the notification under paragraph (5) or, if not then known, as soon as their whereabouts are known, the Coroner shall also notify \u2014 (a) one of the persons referred to in rule 26(2)(a); and (b) any other relative of the deceased who has notified the Coroner of their desire to attend, or be represented at the autopsy, that the material is being preserved, the period or periods for which it is required to be preserved under paragraph (5), and the options for dealing with the material on expiry of a period notified under that paragraph. (7) In the case of a child who has identified themselves as such to the Coroner, the Coroner may notify a person who has parental responsibility for the child instead of notifying the child. (8) The options referred to in paragraph (6) are \u2014 (a) disposal of the material by burial or other lawful disposal by the medical practitioner; (b) return of the material to a person referred to in that paragraph who requests that the material be returned to that person; or (c) retention of the material with the consent of a person referred to in paragraph (6) for medical research or other purposes. (9) If a period notified under paragraph (5) does not expire before the date on which the Coroner\u2019s functions cease under the Law it shall expire on the date such functions cease, and the Coroner shall notify the persons referred to in paragraphs (5) and (6) accordingly. (10) The medical practitioner shall, so far as possible, preserve material to which this rule applies until the expiry of the period notified to that person in relation to the material under paragraph (5).\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_11\", \"num\": \"11.\", \"text\": \"Further provisions relating to preservation of materials from autopsy 11. (1) Where the Coroner \u2014 (a) is informed under section 11 of the Law that a person has been charged with an offence in relation to, or connected with, the death of the deceased; or (b) receives a request under rule 32 on the ground that a person may be charged with an offence in relation to the death of the deceased, that Coroner shall notify the Commissioner or, in the case of a notification under section 11, the Director of Public Prosecutions, of any period for which that Coroner requires material to be preserved under rule 10(5). Coroners Rules (2021 Revision) Rule 12 (2) A Coroner may from time to time vary a period notified under rule 10(5) and shall promptly notify both the medical practitioner and any person notified under rule 10(6) of the variation. (3) Where a period is varied under paragraph (2), rule 10(9) and (10) and paragraphs (1), (4), and (6) of this rule shall apply to the period so varied, as they apply to the period notified under rule 10(5). (4) Where, at any time during a period notified to that person under of rule 10(5), the medical practitioner believes that any of the material retained under that rule should be retained for a different period, that person shall notify the Coroner of that fact and the notification shall comply with rule 10(3). (5) Rule 10(5) applies to a notification under paragraph (4) as it applies to a notification under rule 10(2). (6) Where a medical practitioner has retained material under rule 10 and the period notified under rule 10(5) in relation to that material has expired, that medical practitioner shall record \u2014 (a) that the material has been disposed of by that medical practitioner or on that medical practitioner\u2019s behalf; (b) that the material has been delivered into the possession of a specified person; or (c) that that medical practitioner has retained the material on behalf of a specified person, and shall retain such a record for fifteen years.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_12\", \"num\": \"12.\", \"text\": \"Report on autopsy 12. (1) The person performing an autopsy shall submit a report of such autopsy to the Coroner in the form set out in the Schedule. (2) Unless authorised by the Coroner, the person performing an autopsy shall not supply a copy of that person\u2019s report to any person other than the Coroner. 13. Premises for autopsies 13. (1) No person shall carry out an autopsy in a dwelling house or in licensed premises. (2) Every autopsy shall be carried out in premises which are adequately equipped for the purpose of the autopsy. (3) Where a person dies in a hospital possessing premises so equipped, any autopsy of the body of that person shall, with the consent of the hospital, be carried out in those premises unless the Coroner otherwise decides. (4) For the purpose of this rule no premises shall be deemed to be adequately equipped for the purpose of autopsies unless they are supplied with running water, air-conditioning, lighting facilities and containers for the storing and preservation of material. Rule 14 Coroners Rules (2021 Revision) PART 4 - SPECIAL AUTOPSIES\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_14\", \"num\": \"14.\", \"text\": \"Coroner may order special autopsy 14. The Coroner may, pursuant to that Coroner\u2019s power to order an autopsy under section 15 of the Law order a special autopsy.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_15\", \"num\": \"15.\", \"text\": \"Preservation of material from special autopsy 15. (1) A person performing a special autopsy shall make provision, so far as possible, for the preservation of the material submitted to that person for examination. (2) Where a person performs a special autopsy that person shall send forthwith to the Coroner a notification in writing, identifying the material which that person is preserving in accordance with this rule. (3) A notification under paragraph (2) may specify the period for which the person believes the material should be preserved and may specify different periods for different material. (4) Where a Coroner receives a notification under paragraph (2) that Coroner shall notify the person making the special autopsy of the period for which the material is to be preserved, being such period as in the Coroner\u2019s opinion the material needs to be preserved for the purpose of fulfilling the Coroner\u2019s functions under the Law in relation to the deceased, and that Coroner may specify different periods for different material. (5) Subject to paragraph (6), on making the notification under paragraph (4) or, if not then known, as soon as their whereabouts are known, the Coroner shall also notify \u2014 (a) one of the persons referred to in rule 26(2)(a); and (b) any other relative of the deceased who has previously notified the Coroner of their desire to attend, or be represented at the autopsy, that the material is being preserved, the period or periods for which it is required to be preserved under paragraph (4), and the options for dealing with the material on expiry of a period notified under that paragraph. (6) In the case of a child who has identified themselves as such to the Coroner, the Coroner may notify a person who has parental responsibility for the child instead of notifying the child. (7) The options referred to in paragraph (5) are \u2014 (a) disposal of the material by burial or other lawful disposal by the person making the special autopsy; (b) return of the material to a person referred to in that paragraph who requests that the material be returned to that person; or Coroners Rules (2021 Revision) Rule 16 (c) retention of the material with the consent of a person referred to in paragraph (5) for medical research or other purposes. (8) If a period notified under paragraph (4) does not expire before the date on which the Coroner\u2019s functions cease under the Law it shall expire on the date the functions cease, and the Coroner shall notify the persons referred to in paragraphs (4) and (5) accordingly. (6) Where a person carrying out a special autopsy has retained material under rule 15 and the period notified under rule 15(4) in relation to the material has expired that person shall record \u2014 (a) that the material has been disposed of by that person or on that person\u2019s behalf; Rule 17 Coroners Rules (2021 Revision) (b) that the material has been delivered into the possession of a specified person; or (c) that that person has retained the material on behalf of a specified person, and shall retain such a record for fifteen years. 17. Report on special autopsies 17. Unless authorised by the Coroner, the person performing a special autopsy shall not supply a copy of that person\u2019s report to any person other than the Coroner. PART 5- BURIAL ORDERS AND REMOVAL OF BODIES FROM THE CAYMAN ISLANDS\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_18\", \"num\": \"18.\", \"text\": \"Issue of burial order 18. (1) The burial of the body of a deceased person shall not take place without either a certificate issued by the Registrar or an order for burial issued by the Coroner under section 32 of the Births and Deaths Registration Act (2021 Revision). (2) An order of a Coroner authorising the burial of a body shall not be issued unless the Coroner has held, or has decided to hold, an inquest touching the death; and if a Coroner has decided not to hold an inquest then that Coroner may issue an order for burial or the Registrar may issue a certificate.2\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_19\", \"num\": \"19.\", \"text\": \"Burial order where certificate for disposal of body issued 19. Where a Coroner is satisfied that a certificate for the disposal of a body has been issued by the Registrar, the Coroner shall not issue an order authorising the burial of that body unless the certificate has been surrendered to that Coroner; and in such a case that Coroner shall, on issuing the order, transmit the certificate to the Registrar and inform that Registrar of the issue of the order. 20. Removal of body from Islands 20. (1) Every person intending to remove the body of a deceased person out of the Cayman Islands shall give notice of that person\u2019s  intention in the relevant form set out in the Schedule, or in a form substantially to the like effect, to the Clerk of the Court, and when the deceased person died in the Cayman Islands and a certificate has been given by the Registrar under section 32 of the Births and Deaths Registration Act (2021 Revision) or a Coroner\u2019s order for burial has been issued, the certificate or order shall be delivered to the Clerk of the Court with the notice. (2) Upon receiving a notice under sub-paragraph (1) the Clerk of the Court shall forthwith notify a Coroner, and the Coroner so notified shall forthwith send or deliver \u2014 Coroners Rules (2021 Revision) Rule 21 (a) to the person who gave the notice, or the undertaker or other person designated by that person for the purpose, an acknowledgment of the receipt of the notice in the form set out in the Schedule, or in a form substantially to the like effect; and (b) to the Registrar, a notification that a notice of intention to remove the body out of the Cayman Islands has been received, and, if a certificate given by the Registrar under section 32 of the Births and Deaths Registration Act (2021 Revision) was sent to the Coroner under subsection (1), such certificate. (3) Any Coroner\u2019s order for burial sent to the Clerk of the Court under subparagraph (1) shall be retained by the Clerk of the Court. (4) Subject to sub-paragraph (5), the body shall not be removed out of the Cayman Islands before the expiration of a period of four clear days after the day on which notice of intention to remove the body was received by the Clerk of the Court. (5) Where the Coroner states in that Coroner\u2019s acknowledgment of receipt of the notice that after making due enquiry that Coroner is satisfied that no further enquiries by that Coroner are necessary concerning the death, the body may be removed out of the Cayman Islands at any time after the acknowledgment has been received by the person to whom it is addressed, notwithstanding that the period of four clear days has not expired. (6) Any notice, acknowledgment or notification required by rule 20 to be given, sent or delivered may be delivered by hand or by facsimile or electronically (but not by post) and, in any event, any such notice, acknowledgment or notification required by rule 20 to be given by the Coroner shall be displayed publicly in the Court House. PART 6 - INQUESTS\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_21\", \"num\": \"21.\", \"text\": \"Formality 21. Every inquest shall be opened, adjourned and closed in a formal manner.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_22\", \"num\": \"22.\", \"text\": \"Inquest in public 22. Every inquest shall be held in public but the Coroner may direct that the public be excluded from an inquest or any part of an inquest if that Coroner considers that it would be in the public interest or the interest of national security so to do.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_23\", \"num\": \"23.\", \"text\": \"Days on which inquest not to be held 23. (1) An inquest shall not be held on any public general holiday pursuant to the Public Holidays Act (2007 Revision) unless the Coroner thinks it is required on grounds of urgency that an inquest should be held on such a day. Rule 24 Coroners Rules (2021 Revision) (2) No inquest shall be held on a Sunday, or, notwithstanding paragraph (1), Christmas Day or Good Friday.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_24\", \"num\": \"24.\", \"text\": \"Coroner to notify persons of inquest arrangements 24. The Clerk of the Court shall give notification of the date, hour and place of an inquest to \u2014 (a) the spouse, civil partner or a near relative or personal representative of the deceased whose name and address are known to the Coroner; and (b) any other person who \u2014 (i) in the opinion of the Coroner is within rule 26(2); (ii) has asked the Clerk of the Court to notify that person of the aforesaid particulars of the inquest; and (iii) has supplied the Clerk of the Court with a telephone or fax number, email address or postal address for the purpose of notifying that person.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_25\", \"num\": \"25.\", \"text\": \"Attendance of witnesses 25. (2) Each of the following persons shall have the rights conferred by paragraph (1) \u2014 (a) a parent, child, spouse, civil partner and any personal representative of the deceased; (b) any beneficiary under a policy of insurance issued on the life of the deceased; (c) the insurer who issued such a policy of insurance; (d) any person whose act or omission or that of that person\u2019s  agent or servant may in the opinion of the Coroner have caused, or contributed to, the death of the deceased; (e) the Commissioner; and Coroners Rules (2021 Revision) Rule 27 (f) any other person who, in the opinion of the Coroner, is a properly interested person. (3) The Commissioner, unless interested otherwise than in that capacity, shall only be entitled to examine a witness by an attorney-at-law. (4) The Coroner shall disallow any question which in that Coroner\u2019s opinion is not relevant or is otherwise not a proper question. (5) Any person who is, or who contends that that person is, within paragraph (2) and who wishes to examine any witness at an inquest shall notify the Clerk of the Court no later than two days prior to the inquest; and such person shall in the notice state whether that person wishes to appear in person or by an attorneyat-law and, if by an attorney-at-law, that person shall state the name of the attorney-at-law or of the attorney\u2019s firm.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_27\", \"num\": \"27.\", \"text\": \"Appearance of attorney-at-law at inquest 27. (2) The notice under paragraph (1) shall contain the following details \u2014 (a) the name of the attorney-at-law; (b) their business address and email address, and their  telephone and fax number; (c) the name of the person on whose behalf that person is appearing; and (d) the case number of the inquest.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_28\", \"num\": \"28.\", \"text\": \"Examination of witnesses 28. (3) The offences within this paragraph are murder, manslaughter, infanticide or abortion contrary to the Penal Code (2019 Revision), suicide or sections 75, 79, 80 or 83 of the Traffic Act (2021 Revision).\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_33\", \"num\": \"33.\", \"text\": \"Request by Director of Public Prosecutions for adjournment or stay3 33. (1) If the Director of Public Prosecutions requests a Coroner to adjourn an inquest on the ground that a person may be charged with an offence (whether or not involving the death of a person other than deceased) committed in circumstances connected with the death of the deceased, the Coroner shall adjourn the inquest for twenty-eight days or for such longer period as that Coroner may think fit. (2) At any time before the date fixed for the holding of the adjourned inquest, the Director of Public Prosecutions may ask the Coroner for a further adjournment and the Coroner may comply with that request. (3) If the Director of Public Prosecutions decides to institute criminal proceedings against any person for causing the death of any person upon whose body an inquest is in the course of being held, that Director of Public Prosecutions shall immediately notify the Coroner who shall stay the inquest pending the outcome of the criminal proceedings and the Coroner \u2014 (a) shall cause the statements taken up to that time and any exhibits produced before that Coroner to be made available to the Director of Public Prosecutions; and (b) may, if that Coroner thinks fit, discharge any jury that has been summoned. (4) Where any such criminal proceedings have been concluded the Director of Public Prosecutions shall forthwith inform the Clerk of the Court of the result of the criminal proceedings who shall thereafter inform the Coroner. Coroners Rules (2021 Revision) Rule 34 (5) If at the conclusion of such criminal proceedings any person is convicted of an offence by which the death of the person upon whom the inquest was being held was brought about, the Coroner shall make in the record all details of the conviction and shall close the inquest; and the Coroner shall forthwith send to the Registrar a certificate under the Coroner\u2019s hand stating the result of the relevant criminal proceedings and the particulars which are required to be registered concerning a death under section 30 of the Births and Deaths Registration Act (2021 Revision). (6) If at the conclusion of such criminal proceedings no person is convicted of an offence by which the death of the person upon whom the inquest was being held was brought about, the Coroner shall require the Director of Public Prosecutions to supply all the materials in the possession of the office of the Director of Public Prosecutions and of the Royal Cayman Islands Police Service concerning the cause and circumstances of the death and thereafter resume the inquest.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_34\", \"num\": \"34.\", \"text\": \"Coroner to adjourn in certain other cases 34. (1) If during the course of an inquest evidence is given from which it appears to the Coroner that the death of the deceased is likely to be due to murder, manslaughter, infanticide or abortion contrary to the Penal Code (2019 Revision), suicide, or sections 75, 79, 80 or 83 of the Traffic Act (2021 Revision) and that a person might be charged with such an offence, then the Coroner, unless that Coroner has previously been notified by the Director of Public Prosecutions that an adjournment is unnecessary, shall adjourn the inquest for fourteen days or for such longer period as that Coroner may think fit and send to the Director of Public Prosecutions particulars of that evidence. (2) At any time before the date fixed for the holding of the adjourned inquest, the Director of Public Prosecutions may ask the Coroner for a further adjournment and the Coroner may comply with the Director of Public Prosecutions\u2019 request.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_35\", \"num\": \"35.\", \"text\": \"Coroner to furnish certificate after adjournment or stay 35. If a Coroner adjourns or stays an inquest in compliance with rule 33 that Coroner shall send to the Registrar a certificate under that Coroner\u2019shand stating, so far as they have been ascertained at the date of the certificate, the particulars which are required to be registered concerning a death under section 30 of the Births and Deaths Registration Act (2021 Revision) within five days from the date on which the inquest is adjourned.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_36\", \"num\": \"36.\", \"text\": \"Coroner\u2019s interim certificate of the fact of death 36. When an inquest has been adjourned for any reason and rule 35 does not apply, the Coroner shall on application supply to any person who, in the opinion of the Coroner, is a properly interested person an interim certificate of the fact of death in the form set out in the Schedule. Rule 37 Coroners Rules (2021 Revision) 37. Coroner to notify persons as to resumption of, and alteration of arrangements for, adjourned or stayed inquest 37. (1) If an inquest which has been adjourned or stayed in pursuance of rule 33 will not be resumed, the Coroner shall notify the persons within paragraph (4). (2) If an inquest which has been adjourned or stayed is to be resumed, the Coroner shall give reasonable notice of the date, hour and place at which the inquest will be resumed to the persons within paragraph (4). (3) Where a Coroner has fixed a date, hour and place for the holding of an inquest adjourned for any reason, that Coroner may, at any time before the date so fixed, alter the date, hour or place fixed and shall then give reasonable notice to the persons within paragraph (4). (4) The persons to whom this paragraph refers are the members of the jury, the witnesses, the Commissioner, any person notified under rule 24 or 30, and any other person appearing in person or represented at the inquest.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_38\", \"num\": \"38.\", \"text\": \"Recognisance of witness or juror becoming void 38. (1) The proceedings and evidence at an inquest shall be directed solely to ascertaining the following matters \u2014 (a)  the name and description of the deceased; (b)  when the deceased came to that person\u2019s death; (c)  where the deceased came to that person\u2019s death; (d)  the cause and manner of death; and (e)  the particulars required by the Births and Deaths Registration Act (2021 Revision) to be registered concerning the death; (2) Neither the Coroner nor the jury shall express any opinion on any other matters. Coroners Rules (2021 Revision) Rule 41\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_41\", \"num\": \"41.\", \"text\": \"Evidence 41. (1) The Commissioner shall ensure that all the materials in the possession of the Royal Cayman Islands Police Service concerning the cause and circumstances of the death are supplied to the Coroner; and if any such materials have been passed to the Director of Public Prosecutions then the Director of Public Prosecutions shall arrange for those materials to be provided to the Coroner. (2) Subject to paragraphs (3) to (5), the Coroner may admit at an inquest documentary evidence relevant to the purposes of the inquest from any living person which in the Coroner\u2019s opinion is unlikely to be disputed, unless a person who in the opinion of the Coroner is within rule 26(2) objects to the documentary evidence being admitted. (3) Documentary evidence so objected to may be admitted if in the opinion of the Coroner the maker of the document is unable to give oral evidence within a reasonable period. (4) Subject to paragraph (5), before admitting such documentary evidence the Coroner shall at the beginning of the inquest announce publicly \u2014 (a) that the documentary evidence may be admitted; (b) the full name of the maker of the document to be admitted in evidence, and a brief account of such document; (c) that any person who, in the opinion of the Coroner, is within rule 26(2) may object to the admission of any such documentary evidence; and (d) that any person who, in the opinion of the Coroner, is within rule 26(2) is entitled to see a copy of any such documentary evidence if that person so wishes. (5) If during the course of an inquest it appears that there is available at the inquest documentary evidence which, in the opinion of the Coroner, is relevant to the purposes of the inquest but the maker of the document is not present and, in the opinion of the Coroner, the content of the documentary evidence is unlikely to be disputed, the Coroner shall at the earliest opportunity during the course of the inquest comply with the provisions of paragraph (4). (6) A Coroner may admit, as evidence at an inquest, any document made by a deceased person if that Coroner is of the opinion that the contents of the document are relevant to the purposes of the inquest. (7) A written statement by any person is admissible as evidence to the same extent as oral evidence if the statement complies with section 10(1) and (2) of the Law. (8) Any documentary evidence admitted under this rule shall, unless the Coroner otherwise directs, be read aloud at the inquest and, if the Coroner so directs, an account shall be given orally of so much of any statement not read aloud. Rule 42 Coroners Rules (2021 Revision) (9) If a witness is not in the jurisdiction and that person\u2019s sworn written statement is, or may be disputed and \u2014 (a) that person is unable or unwilling to travel to the Cayman Islands; or (b) the Coroner is satisfied that it is not reasonably practicable for that person to travel to the Cayman Islands, to testify at the inquest, then the Coroner may permit that person to testify by live videolink.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_42\", \"num\": \"42.\", \"text\": \"Exhibits 42. All exhibits produced in evidence at an inquest shall be marked with consecutive numbers and shall be preserved until the final disposal of the inquest and of any other proceedings arising out of the inquest.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_43\", \"num\": \"43.\", \"text\": \"Notes of evidence; record of testimony of witness 43. (1) The Coroner shall take notes, or cause notes to be taken or recorded on the Coroner\u2019s behalf, of the evidence at every inquest. (2) A witness who has given oral testimony shall, before that person is discharged, be given the opportunity to review the record of his testimony and where that person has confirmed to the Coroner that the record has correctly recorded his testimony that person and the Coroner shall sign a copy of that person\u2019s record. (3) If the witness has given that person\u2019s oral testimony by live video-link then the Coroner and the witness may sign different copies of the same record of that person\u2019s testimony. (4) In a case under paragraph 3 the witness shall send the copy of the record of his testimony as signed by that person to the Clerk of the Court. Upon receipt of the same the Coroner shall countersign the record of the witness\u2019 testimony and that countersigned copy shall be the official record of that person\u2019s testimony.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_44\", \"num\": \"44.\", \"text\": \"No address as to facts 44. No person shall be allowed to address the Coroner or the jury as to the facts.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_45\", \"num\": \"45.\", \"text\": \"Summing-up and direction to jury 45. The Coroner shall sum up the evidence to the jury and direct them as to the law before they consider their verdict and shall draw their attention to rules 40(2) and 44.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_46\", \"num\": \"46.\", \"text\": \"Verdict and inquisition5 46. (1) No verdict shall be framed in such a way as to appear to determine any question of \u2014 (a) criminal liability on the part of a named person; or (b) civil liability. Coroners Rules (2021 Revision) Rule 46A (2) The verdict of the jury shall be that of the majority thereof. (3) The verdict of the jury shall, subject to the evidence available, state \u2014 (a) the name and description of the deceased; (b) the physical cause of death; and (c) whether the death was occasioned \u2014 (i) by natural causes; (ii) by misadventure; (iii)  by suicide; (iv)   by unlawful killing; (v)  by lawful killing; or (vi)  by stillbirth. (4) Where the available evidence is insufficient to enable the jury to reach a conclusion then the verdict shall be, to that extent, an open one. (5) An inquisition \u2014 (a) shall be in the form set out in form C12 of these Rules; and (b) shall set out, so far as such particulars have been proved \u2014 (i) the identity of the deceased (if known); and (ii)  when and where the deceased came by that person\u2019s death; and (iii)  the cause and manner of that person\u2019s death. 46A. Death by watersports or the operation of motor vehicles6 46A. If, after the delivery of the verdict and inquisition, the Coroner is of the opinion that the circumstances relating to when or where the deceased came by that person\u2019s death or the cause and manner of that person\u2019s death concern the undertaking of watersports or the operation of motor vehicles, that Coroner shall notify the Registrar and shall provide to the Registrar any documents or information concerning the inquest as the Registrar may reasonably require. 47. Prevention of similar fatalities 47. A Coroner who believes that action should be taken to prevent the recurrence of fatalities similar to that in respect of which the inquest is being held may announce at the inquest that that Coroner is reporting the matter in writing to the person or authority who may have power to take such action and that Coroner may report the matter accordingly. Rule 48 Coroners Rules (2021 Revision) PART 7 - SUMMONING OF JURORS AND EXCUSAL FROM JURY SERVICE 48. Method of summoning 48. (1) Subject to the provisions of these rules, jurors shall be summoned by notice in the form set out in the Schedule. (2) The summons will be delivered by hand to a juror at that person\u2019s address as shown in the electoral register or at such other address as the juror shall notify the Clerk of the Court.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_49\", \"num\": \"49.\", \"text\": \"Notice to accompany summons 49. A written summons sent or delivered to any person under rule 48 shall be accompanied by a notice informing that person \u2014 (a) of the effect of section 6 of the Law and rules 51 and 52; and (b) that that person may make representations to the Clerk of the Court with a view to obtaining the withdrawal of the summons, if for any reason that person is not qualified for jury service, or wishes or is entitled to be excused.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_50\", \"num\": \"50.\", \"text\": \"Withdrawal or alteration of summons 50. If it appears to the Clerk of the Court, at any time before the day on which any person summoned under section 6 of the Law is to attend, that that person\u2019s attendance is unnecessary, or can be dispensed with, the Clerk of the Court may withdraw or alter the summons by notice served in the same way as a summons.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_51\", \"num\": \"51.\", \"text\": \"Excusal for previous jury service 51. (1) If a person summoned under section 6 of the Law shows to the satisfaction of the Clerk of the Court or of the Coroner that \u2014 (a) that person has served on a Coroner\u2019s jury or a Grand Court jury within the last six preceding sessions of the Grand Court; or (b) the Grand Court or a Coroner has excused that person from jury service for a period which has not terminated, the Clerk of the Court or the Coroner shall excuse that person from attending, or further attending, in pursuance of the summons.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_52\", \"num\": \"52.\", \"text\": \"Certificate of attendance 52. Coroners Rules (2021 Revision) Rule 53\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_53\", \"num\": \"53.\", \"text\": \"Excusal from certain persons and discretionary excusal 53. (1) If any person summoned under section 6 of the Law shows to the satisfaction of the Clerk of the Court that there is good reason why that person should be excused from attending in pursuance of the summons, the Clerk of the Court may excuse that person from so attending. (2) Without prejudice to paragraph (1), the Coroner before whom a person is summoned to attend under section 6 of the Law may excuse that person from so attending. 54. Discharge of summons in case of doubt as to capacity to act effectively as a juror 54. Where it appears to the Clerk of the Court, in the case of a person attending in pursuance of a summons under section 6 of the Law, that on account of physical disability or insufficient understanding of English there is doubt as to that person\u2019s capacity to act effectively as a juror, the person may be brought before the Coroner, who shall determine whether or not that person should act as a juror and, if not, that Coroner shall discharge the summons. PART 8 - RECORDS, DOCUMENTS, EXHIBITS AND FORMS\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_55\", \"num\": \"55.\", \"text\": \"Register of deaths 55. 2020\nPage 7\n\nCAYMAN ISLANDS\n\nCoroners Act\n(2021 Revision)\nCORONERS RULES\n(2021 Revision)\n\nPART 1 - GENERAL\n1.\nCitation\n1.\nThese rules may be cited as the Coroners Rules (2021 Revision).\n2.\nInterpretation\n2.\nIn these rules \u2014\n\u201cchild\u201d means a person who has not attained the age of eighteen years;\n\u201cBirths and Deaths Registration Law\u201d means the Births and Deaths\nRegistration Act (2021 Revision);\n\u201cCommissioner\u201d means the Commissioner of Police appointed under the Police\nAct (2021 Revision);\n\u201cdeceased\u201d means the person upon whose body an autopsy is performed or\ntouching whose death an inquest is held or the person whose death is reported\nto the Coroner, as the case may be;\n\u201chospital\u201d means any institution for the reception and treatment of persons\nsuffering from illness or mental disorder, any maternity home, and any\ninstitution for the reception and treatment of persons during convalescence;\n\u201cinquest\u201d means an inquiry by a Coroner sitting with a jury;\n\nRule 3\nCoroners Rules (2021 Revision)\n\nPage 8\nRevised as at 31st December, 2020\nc\n\n\u201cLaw\u201d means the Coroners Act (2021 Revision);\n\u201clicensed premises\u201d has the meaning assigned by the Liquor Licensing Act\n(2019 Revision);\n\u201cmedical practitioner\u201d means a person registered as being authorised to\npractise medicine under the Health Practice Act (2021 Revision) and includes a\npathologist;\n\u201cnotification in writing\u201d includes electronic communication;\n\u201cparental responsibility\u201d has the same meaning as in the Children Act (2012\nRevision);\n\u201cpathologist\u201d means a medical practitioner who specialises in medical\ndiagnosis and has training and experience in the performance of autopsies;\n\u201cPenal Code\u201d means the Penal Code (2019 Revision);\n\u201cPublic Holidays Law\u201d means the Public Holidays Act (2007 Revision);\n\u201cRegistrar\u201d means the Registrar-General of births and deaths appointed under\nthe Births and Deaths Registration Act (2021 Revision);\n\u201cShipping Master\u201d has the meaning assigned by the Merchant Shipping Act,\n(2021 Revision);\n\u201cspecial autopsy\u201d means an autopsy consisting of analysis, test or otherwise of\nsuch parts or contents of the body or such other substances or things as ought,\nin the opinion of the Coroner, to be submitted to analyses, tests or other\nexaminations;\n\u201cTraffic Law\u201d means the Traffic Act (2021 Revision); and\n\u201cwatersports\u201d includes swimming, scuba-diving, free-diving, snorkelling,\npaddle-boarding, surfing, wind-surfing, sailing, kayaking, parasailing, kitesurfing, water skiing, jet skiing, water-powered jet-packs, and recreational\nfishing.1\n3.\nRevocation and application\n3.\n(1) Subject to paragraph (2), the Coroners Rules (1996 Revision) are hereby\nrevoked.\n(2) These rules shall apply so far as is practicable to any inquest begun before, and\nnot completed on or before, the date of the commencement of these rules and to\nany autopsy which, before that day, a Coroner has directed or requested a\nmedical practitioner to perform.\n4.\nCoroner to be available at all times\n4.\nA Coroner shall at all times hold themselves ready to undertake any duties in\nconnection with inquests and autopsies.\n\nCoroners Rules (2021 Revision)\nRule 5\n\nc\nRevised as at 31st December, 2020\nPage 9\n\nPART 2 - NOTIFICATION OF CERTAIN DEATHS\n5.\nPersons under duty to notify the Clerk of the Court of deaths; notice to next\nof kin, etc.\n5.\n(1) Upon the following persons becoming aware that a death has occurred to which\nsection 4 of the Law applies, they shall notify the Clerk of the Court, acting on\nbehalf of the Chief Magistrate, without delay \u2014\n(a) in respect of a death having occurred in a hospital, a medical practitioner\nwho attended upon the deceased;\n(b) in respect of a death having occurred in a prison, the Director of Prisons;\n(c) the Commissioner;\n(d) in respect of a death having occurred in any ship in Cayman Islands waters,\nthe Shipping Master; and\n(e) in respect of bodies that are imported for burial in the Cayman Islands,\nundertakers.\n(2) Nothing in this rule shall prevent any person from notifying a Coroner of a death\nat any time when the Court Offices are closed; and in such a case, the person\nnotifying a Coroner shall, on the next day that the Court Offices are open, notify\nthe Clerk of the Court in writing of \u2014\n(a) the death;\n(b) the Coroner who was notified; and\n(c) the date when the Coroner was notified.\n(3) As soon as reasonably practicable after any person has notified the Clerk of the\nCourt of such a death, the Clerk of the Court shall take all reasonable steps to\ninform the deceased\u2019s next of kin.\n(4) As soon as practicable after a Coroner has been notified of any death, the Clerk\nof the Court shall open a file and the Coroner shall notify the Registrar.\nPART 3 \u2013 AUTOPSIES\n6.\nDelay in performing autopsy to be avoided\n6.\n(1) Where a Coroner directs or requests that an autopsy shall be performed in\naccordance with section 15 of the Law, the autopsy shall be performed as soon\nafter the death of the deceased as is reasonably practicable.\n(2) If at any time when the Court Offices are closed any person applies to a Coroner\nto direct or request that an autopsy be performed, then that person shall, on the\nnext day that the Court Offices are open, notify the Clerk of the Court in writing\nof \u2014\n\nRule 7\nCoroners Rules (2021 Revision)\n\nPage 10\nRevised as at 31st December, 2020\nc\n\n(a) that person\u2019s request;\n(b) the name of the Coroner who dealt with the application; and\n(c) the result of the application.\n7.\nMedical practitioner performing autopsy\n7.\n(1) In considering what medical practitioner shall be directed or requested by the\nCoroner to perform an autopsy, the Coroner shall have regard to the following\nconsiderations \u2014\n(a) the autopsy should be performed, whenever practicable, by a pathologist\nwith suitable qualifications and experience and having access to laboratory\nfacilities;\n(b) if the Coroner is informed by the Commissioner that a person may be\ncharged with the murder, manslaughter, abortion or infanticide of the\ndeceased, the Coroner should consult the Commissioner regarding the\nmedical practitioner who is to perform the autopsy;\n(c) if the deceased died in a hospital, the Coroner should not direct or request\na medical practitioner on the staff of, or associated with, that hospital to\nperform an autopsy if \u2014\n(i)\nthat medical practitioner does not desire to perform the autopsy;\n(ii) the conduct of any member of the hospital staff is likely to be called\nin question; or\n(iii) any relative of the deceased asks the Coroner that the autopsy be not\nperformed by such a medical practitioner,\nunless the obtaining of another medical practitioner with suitable qualifications\nand experience would cause the examination to be unduly delayed.\n8.\nCoroner to notify persons of autopsy to be performed\n8.\n(1) Where a Coroner directs or requests a medical practitioner to perform an\nautopsy, the Coroner shall notify the persons and bodies set out in paragraph (2)\nof the date, hour and place at which the autopsy will be performed, unless it is\nimpracticable to notify any such persons or bodies or to do so would cause the\nexamination to be unduly delayed.\n(2) The persons and bodies to be notified by the Coroner are as follows \u2014\n(a) any relative of the deceased who has notified the Coroner of their desire to\nattend, or be represented at, the autopsy;\n(b) the deceased\u2019s regular medical practitioner (if known);\n(c) if the deceased died in a hospital, the hospital;\n\nCoroners Rules (2021 Revision)\nRule 9\n\nc\nRevised as at 31st December, 2020\nPage 11\n\n(d) if the death of the deceased may have been caused by any disease notice\nof which is required by or under any enactment to be given, the Chief\nMedical Officer;\n(e) any government department which has notified the Coroner of its desire to\nbe represented at the examination; or\n(f)\nif the Commissioner has notified the Coroner of the Commissioner\u2019s desire\nto be represented at the examination, the Commissioner.\n(3) Any person or body mentioned in paragraph (2) shall be entitled to be\nrepresented at an autopsy by a medical practitioner, or if any such person is a\nmedical practitioner, that person shall be entitled to attend the autopsy in person;\nbut the Commissioner may be represented by a member of the Royal Cayman\nIslands Police Service.\n(4) Nothing in this rule shall be deemed to limit the discretion of the Coroner to\nnotify any person of the date, hour and place at which an autopsy will be\nperformed and to permit that person to attend the examination.\n9.\nPerson attending autopsy not to interfere\n9.\nA person attending an autopsy by virtue of rule 8(3) or (4) shall not interfere with the\nperformance of the autopsy.\n10.\nPreservation of material from autopsy\n10. (1) A medical practitioner shall make provision, so far as possible, for the\npreservation of material which, in that person\u2019s opinion, bears upon the cause\nof death or the identification of the deceased.\n(2) Where a medical practitioner preserves material under paragraph (1) that person\nshall notify the Coroner of that fact forthwith by notification in writing.\n(3) A notification under paragraph (2) shall \u2014\n(a) identify the material being preserved; and\n(b) explain why the medical practitioner is of the opinion mentioned in\nparagraph (1).\n(4) A notification under paragraph (2) may \u2014\n(a) specify the period for which the medical practitioner believes the material\nshould be preserved; and\n(b) specify different periods for different material.\n(5) Where a Coroner receives a notification under paragraph (2) that Coroner shall\nnotify the medical practitioner of the period for which that Coroner requires the\nmaterial to be preserved, being such period as in the Coroner\u2019s opinion the\nmaterial needs to be preserved for the purpose of fulfilling the Coroner\u2019s\nfunctions under the Law in relation to the deceased, and that Coroner may\nspecify different periods for different material.\n\nRule 11\nCoroners Rules (2021 Revision)\n\nPage 12\nRevised as at 31st December, 2020\nc\n\n(6) Subject to paragraph (7), on making the notification under paragraph (5) or, if\nnot then known, as soon as their whereabouts are known, the Coroner shall also\nnotify \u2014\n(a) one of the persons referred to in rule 26(2)(a); and\n(b) any other relative of the deceased who has notified the Coroner of their\ndesire to attend, or be represented at the autopsy,\nthat the material is being preserved, the period or periods for which it is required\nto be preserved under paragraph (5), and the options for dealing with the\nmaterial on expiry of a period notified under that paragraph.\n(7) In the case of a child who has identified themselves as such to the Coroner, the\nCoroner may notify a person who has parental responsibility for the child\ninstead of notifying the child.\n(8) The options referred to in paragraph (6) are \u2014\n(a) disposal of the material by burial or other lawful disposal by the medical\npractitioner;\n(b) return of the material to a person referred to in that paragraph who requests\nthat the material be returned to that person; or\n(c) retention of the material with the consent of a person referred to in\nparagraph (6) for medical research or other purposes.\n(9) If a period notified under paragraph (5) does not expire before the date on which\nthe Coroner\u2019s functions cease under the Law it shall expire on the date such\nfunctions cease, and the Coroner shall notify the persons referred to in\nparagraphs (5) and (6) accordingly.\n(10) The medical practitioner shall, so far as possible, preserve material to which this\nrule applies until the expiry of the period notified to that person in relation to\nthe material under paragraph (5).\n11.\nFurther provisions relating to preservation of materials from autopsy\n11. (1) Where the Coroner \u2014\n(a) is informed under section 11 of the Law that a person has been charged\nwith an offence in relation to, or connected with, the death of the deceased;\nor\n(b) receives a request under rule 32 on the ground that a person may be\ncharged with an offence in relation to the death of the deceased,\nthat Coroner shall notify the Commissioner or, in the case of a notification under\nsection 11, the Director of Public Prosecutions, of any period for which that\nCoroner requires material to be preserved under rule 10(5).\n\nCoroners Rules (2021 Revision)\nRule 12\n\nc\nRevised as at 31st December, 2020\nPage 13\n\n(2) A Coroner may from time to time vary a period notified under rule 10(5) and\nshall promptly notify both the medical practitioner and any person notified\nunder rule 10(6) of the variation.\n(3) Where a period is varied under paragraph (2), rule 10(9) and (10) and\nparagraphs (1), (4), and (6) of this rule shall apply to the period so varied, as\nthey apply to the period notified under rule 10(5).\n(4) Where, at any time during a period notified to that person under of rule 10(5),\nthe medical practitioner believes that any of the material retained under that rule\nshould be retained for a different period, that person shall notify the Coroner of\nthat fact and the notification shall comply with rule 10(3).\n(5) Rule 10(5) applies to a notification under paragraph (4) as it applies to a\nnotification under rule 10(2).\n(6) Where a medical practitioner has retained material under rule 10 and the period\nnotified under rule 10(5) in relation to that material has expired, that medical\npractitioner shall record \u2014\n(a) that the material has been disposed of by that medical practitioner or on\nthat medical practitioner\u2019s behalf;\n(b) that the material has been delivered into the possession of a specified\nperson; or\n(c) that that medical practitioner has retained the material on behalf of a\nspecified person, and shall retain such a record for fifteen years.\n12.\nReport on autopsy\n12. (1) The person performing an autopsy shall submit a report of such autopsy to the\nCoroner in the form set out in the Schedule.\n(2) Unless authorised by the Coroner, the person performing an autopsy shall not\nsupply a copy of that person\u2019s report to any person other than the Coroner.\n13.\nPremises for autopsies\n13. (1) No person shall carry out an autopsy in a dwelling house or in licensed premises.\n(2) Every autopsy shall be carried out in premises which are adequately equipped\nfor the purpose of the autopsy.\n(3) Where a person dies in a hospital possessing premises so equipped, any autopsy\nof the body of that person shall, with the consent of the hospital, be carried out\nin those premises unless the Coroner otherwise decides.\n(4) For the purpose of this rule no premises shall be deemed to be adequately\nequipped for the purpose of autopsies unless they are supplied with running\nwater, air-conditioning, lighting facilities and containers for the storing and\npreservation of material.\n\nRule 14\nCoroners Rules (2021 Revision)\n\nPage 14\nRevised as at 31st December, 2020\nc\n\nPART 4 - SPECIAL AUTOPSIES\n14.\nCoroner may order special autopsy\n14. The Coroner may, pursuant to that Coroner\u2019s power to order an autopsy under\nsection 15 of the Law order a special autopsy.\n15.\nPreservation of material from special autopsy\n15. (1) A person performing a special autopsy shall make provision, so far as possible,\nfor the preservation of the material submitted to that person for examination.\n(2) Where a person performs a special autopsy that person shall send forthwith to\nthe Coroner a notification in writing, identifying the material which that person\nis preserving in accordance with this rule.\n(3) A notification under paragraph (2) may specify the period for which the person\nbelieves the material should be preserved and may specify different periods for\ndifferent material.\n(4) Where a Coroner receives a notification under paragraph (2) that Coroner shall\nnotify the person making the special autopsy of the period for which the material\nis to be preserved, being such period as in the Coroner\u2019s opinion the material\nneeds to be preserved for the purpose of fulfilling the Coroner\u2019s functions under\nthe Law in relation to the deceased, and that Coroner may specify different\nperiods for different material.\n(5) Subject to paragraph (6), on making the notification under paragraph (4) or, if\nnot then known, as soon as their whereabouts are known, the Coroner shall also\nnotify \u2014\n(a) one of the persons referred to in rule 26(2)(a); and\n(b) any other relative of the deceased who has previously notified the Coroner\nof their desire to attend, or be represented at the autopsy,\nthat the material is being preserved, the period or periods for which it is required\nto be preserved under paragraph (4), and the options for dealing with the\nmaterial on expiry of a period notified under that paragraph.\n(6) In the case of a child who has identified themselves as such to the Coroner, the\nCoroner may notify a person who has parental responsibility for the child\ninstead of notifying the child.\n(7) The options referred to in paragraph (5) are \u2014\n(a) disposal of the material by burial or other lawful disposal by the person\nmaking the special autopsy;\n(b) return of the material to a person referred to in that paragraph who requests\nthat the material be returned to that person; or\n\nCoroners Rules (2021 Revision)\nRule 16\n\nc\nRevised as at 31st December, 2020\nPage 15\n\n(c) retention of the material with the consent of a person referred to in\nparagraph (5) for medical research or other purposes.\n(8) If a period notified under paragraph (4) does not expire before the date on which\nthe Coroner\u2019s functions cease under the Law it shall expire on the date the\nfunctions cease, and the Coroner shall notify the persons referred to in\nparagraphs (4) and (5) accordingly.\n(9) The person making the special autopsy shall, so far as possible, preserve\nmaterial to which this rule applies until the expiry of the period notified to that\nperson in relation to it under paragraph (4).\n16.\nFurther provisions relating to preservation of materials from special\nautopsies\n16. (1) Where the Coroner \u2014\n(a) is informed under section 11 of the Law that a person has been charged\nwith an offence in relation to, or connected with, the death of the deceased\nor,\n(b) receives a request under rule 32 on the ground that a person may be\ncharged with an offence in relation to the death of the deceased,\nthe Coroner shall notify the Commissioner or, in the case of a notification under\nsection 11, the Director of Public Prosecutions, of any period for which that\nCoroner requires the material to be preserved under rule 15(4).\n(2) A Coroner may from time to time vary a period notified under rule 15(4) and\nshall promptly notify the person making the special examination and any person\nnotified under rule 15(5) of the variation.\n(3) Where a period is varied under this paragraph, rule 15(8) and paragraphs (1),\n(2), (4) and (6) of this rule shall apply to the period so varied as they apply to\nthe period notified under rule 15(4).\n(4) Where, at any time during a period notified to that person under rule 15(4), the\nperson carrying out the special autopsy believes that any of the material retained\nunder that rule should be retained for a different period that person shall notify\nthe Coroner of that fact.\n(5) Rule 15(4) applies to a notification under paragraph (4) as it applies to a\nnotification under rule 15(2).\n(6) Where a person carrying out a special autopsy has retained material under rule\n15 and the period notified under rule 15(4) in relation to the material has expired\nthat person shall record \u2014\n(a) that the material has been disposed of by that person or on that person\u2019s\nbehalf;\n\nRule 17\nCoroners Rules (2021 Revision)\n\nPage 16\nRevised as at 31st December, 2020\nc\n\n(b) that the material has been delivered into the possession of a specified\nperson; or\n(c) that that person has retained the material on behalf of a specified person,\nand shall retain such a record for fifteen years.\n17.\nReport on special autopsies\n17. Unless authorised by the Coroner, the person performing a special autopsy shall not\nsupply a copy of that person\u2019s report to any person other than the Coroner.\nPART 5- BURIAL ORDERS AND REMOVAL OF BODIES FROM\nTHE CAYMAN ISLANDS\n18.\nIssue of burial order\n18. (1) The burial of the body of a deceased person shall not take place without either\na certificate issued by the Registrar or an order for burial issued by the Coroner\nunder section 32 of the Births and Deaths Registration Act (2021 Revision).\n(2) An order of a Coroner authorising the burial of a body shall not be issued unless\nthe Coroner has held, or has decided to hold, an inquest touching the death; and\nif a Coroner has decided not to hold an inquest then that Coroner may issue an\norder for burial or the Registrar may issue a certificate.2\n19.\nBurial order where certificate for disposal of body issued\n19. Where a Coroner is satisfied that a certificate for the disposal of a body has been\nissued by the Registrar, the Coroner shall not issue an order authorising the burial of\nthat body unless the certificate has been surrendered to that Coroner; and in such a\ncase that Coroner shall, on issuing the order, transmit the certificate to the Registrar\nand inform that Registrar of the issue of the order.\n20.\nRemoval of body from Islands\n20. (1) Every person intending to remove the body of a deceased person out of the\nCayman Islands shall give notice of that person\u2019s  intention in the relevant form\nset out in the Schedule, or in a form substantially to the like effect, to the Clerk\nof the Court, and when the deceased person died in the Cayman Islands and a\ncertificate has been given by the Registrar under section 32 of the Births and\nDeaths Registration Act (2021 Revision) or a Coroner\u2019s order for burial has been\nissued, the certificate or order shall be delivered to the Clerk of the Court with\nthe notice.\n(2) Upon receiving a notice under sub-paragraph (1) the Clerk of the Court shall\nforthwith notify a Coroner, and the Coroner so notified shall forthwith send or\ndeliver \u2014\n\nCoroners Rules (2021 Revision)\nRule 21\n\nc\nRevised as at 31st December, 2020\nPage 17\n\n(a) to the person who gave the notice, or the undertaker or other person\ndesignated by that person for the purpose, an acknowledgment of the\nreceipt of the notice in the form set out in the Schedule, or in a form\nsubstantially to the like effect; and\n(b) to the Registrar, a notification that a notice of intention to remove the body\nout of the Cayman Islands has been received, and, if a certificate given by\nthe Registrar under section 32 of the Births and Deaths Registration Act\n(2021 Revision) was sent to the Coroner under subsection (1), such\ncertificate.\n(3) Any Coroner\u2019s order for burial sent to the Clerk of the Court under subparagraph (1) shall be retained by the Clerk of the Court.\n(4) Subject to sub-paragraph (5), the body shall not be removed out of the Cayman\nIslands before the expiration of a period of four clear days after the day on which\nnotice of intention to remove the body was received by the Clerk of the Court.\n(5) Where the Coroner states in that Coroner\u2019s acknowledgment of receipt of the\nnotice that after making due enquiry that Coroner is satisfied that no further\nenquiries by that Coroner are necessary concerning the death, the body may be\nremoved out of the Cayman Islands at any time after the acknowledgment has\nbeen received by the person to whom it is addressed, notwithstanding that the\nperiod of four clear days has not expired.\n(6) Any notice, acknowledgment or notification required by rule 20 to be given,\nsent or delivered may be delivered by hand or by facsimile or electronically (but\nnot by post) and, in any event, any such notice, acknowledgment or notification\nrequired by rule 20 to be given by the Coroner shall be displayed publicly in the\nCourt House.\nPART 6 - INQUESTS\n21.\nFormality\n21. Every inquest shall be opened, adjourned and closed in a formal manner.\n22.\nInquest in public\n22. Every inquest shall be held in public but the Coroner may direct that the public be\nexcluded from an inquest or any part of an inquest if that Coroner considers that it\nwould be in the public interest or the interest of national security so to do.\n23.\nDays on which inquest not to be held\n23. (1) An inquest shall not be held on any public general holiday pursuant to the Public\nHolidays Act (2007 Revision) unless the Coroner thinks it is required on grounds\nof urgency that an inquest should be held on such a day.\n\nRule 24\nCoroners Rules (2021 Revision)\n\nPage 18\nRevised as at 31st December, 2020\nc\n\n(2) No inquest shall be held on a Sunday, or, notwithstanding paragraph (1),\nChristmas Day or Good Friday.\n24.\nCoroner to notify persons of inquest arrangements\n24. The Clerk of the Court shall give notification of the date, hour and place of an inquest\nto \u2014\n(a) the spouse, civil partner or a near relative or personal representative of the\ndeceased whose name and address are known to the Coroner; and\n(b) any other person who \u2014\n(i)\nin the opinion of the Coroner is within rule 26(2);\n(ii) has asked the Clerk of the Court to notify that person of the aforesaid\nparticulars of the inquest; and\n(iii) has supplied the Clerk of the Court with a telephone or fax number,\nemail address or postal address for the purpose of notifying that\nperson.\n25.\nAttendance of witnesses\n25. (1) The Coroner shall summon all persons that Coroner believes may be able to\ntestify in furtherance of the inquest.\n(2) The form of a summons shall be in the form set out in the Schedule.\n(3) The Coroner may require any witness so summoned to bring with that person\nany document or other thing in that person\u2019s possession or control.\n26.\nEntitlement to examine witnesses\n26. (1) Subject to paragraphs (3) and (4), without prejudice to any enactment with\nregard to the examination of witnesses at an inquest, any person who satisfies\nthe Coroner that that person is within paragraph (2) shall be entitled to examine\nany witness at an inquest either in person or by an attorney-at-law.\n(2) Each of the following persons shall have the rights conferred by\nparagraph (1) \u2014\n(a) a parent, child, spouse, civil partner and any personal representative of the\ndeceased;\n(b) any beneficiary under a policy of insurance issued on the life of the\ndeceased;\n(c) the insurer who issued such a policy of insurance;\n(d) any person whose act or omission or that of that person\u2019s  agent or servant\nmay in the opinion of the Coroner have caused, or contributed to, the death\nof the deceased;\n(e) the Commissioner; and\n\nCoroners Rules (2021 Revision)\nRule 27\n\nc\nRevised as at 31st December, 2020\nPage 19\n\n(f)\nany other person who, in the opinion of the Coroner, is a properly\ninterested person.\n(3) The Commissioner, unless interested otherwise than in that capacity, shall only\nbe entitled to examine a witness by an attorney-at-law.\n(4) The Coroner shall disallow any question which in that Coroner\u2019s opinion is not\nrelevant or is otherwise not a proper question.\n(5) Any person who is, or who contends that that person is, within paragraph (2)\nand who wishes to examine any witness at an inquest shall notify the Clerk of\nthe Court no later than two days prior to the inquest; and such person shall in\nthe notice state whether that person wishes to appear in person or by an attorneyat-law and, if by an attorney-at-law, that person shall state the name of the\nattorney-at-law or of the attorney\u2019s firm.\n27.\nAppearance of attorney-at-law at inquest\n27. (1) Each attorney-at-law appearing on behalf of any person specified in rule 26(2)\nis required to file a written notice of appearance on or before the time of the\nattorney-at-law\u2019s first appearance at the inquest or not later than ten days after\nappointment or retainer, whichever is sooner.\n(2) The notice under paragraph (1) shall contain the following details \u2014\n(a) the name of the attorney-at-law;\n(b) their business address and email address, and their  telephone and fax\nnumber;\n(c) the name of the person on whose behalf that person is appearing; and\n(d) the case number of the inquest.\n28.\nExamination of witnesses\n28. Unless the Coroner otherwise determines, a witness at an inquest shall be examined\nfirst by the Coroner and, if the witness is represented at the inquest, lastly by that\nperson\u2019s representative.\n29.\nSelf-incrimination\n29. (1) A witness at an inquest shall not be obliged to answer any question tending to\nincriminate themselves.\n(2) Where it appears to the Coroner that a witness has been asked such a question,\nthe Coroner shall inform the witness that that person may refuse to answer.\n30.\nNotice to person whose conduct is likely to be called in question\n30. Any person whose conduct is likely, in the opinion of the Coroner, to be called in\nquestion at an inquest shall, if not summoned to give evidence at the inquest, be given\nreasonable notice of the date, hour and place at which the inquest will be held.\n\nRule 31\nCoroners Rules (2021 Revision)\n\nPage 20\nRevised as at 31st December, 2020\nc\n\n31.\nAdjournment where person whose conduct is called in question is not\npresent\n31. If the conduct of any person is called in question at an inquest on grounds which the\nCoroner thinks substantial and which relate to any matter referred to in rule 40 and if\nthat person is not present at the inquest and has not been duly summoned to attend or\notherwise given notice of the holding of the inquest, the inquest shall be adjourned to\nenable that person to be present, if that person so desires.\n32.\nRequest by the Commissioner for adjournment\n32. (1) The Commissioner may request a Coroner to adjourn an inquest on the ground\nthat a person may be charged with an offence within paragraph (3), and in such\na case the Coroner shall adjourn the inquest for twenty-eight days or for such\nlonger period as that person may think fit.\n(2) At any time before the date fixed for the holding of the adjourned inquest, the\nCommissioner may ask the Coroner for a further adjournment and the Coroner\nmay comply with the Commissioner\u2019s request.\n(3) The offences within this paragraph are murder, manslaughter, infanticide or\nabortion contrary to the Penal Code (2019 Revision), suicide or sections 75, 79,\n80 or 83 of the Traffic Act (2021 Revision).\n33.\nRequest by Director of Public Prosecutions for adjournment or stay3\n33. (1) If the Director of Public Prosecutions requests a Coroner to adjourn an inquest\non the ground that a person may be charged with an offence (whether or not\ninvolving the death of a person other than deceased) committed in circumstances\nconnected with the death of the deceased, the Coroner shall adjourn the inquest\nfor twenty-eight days or for such longer period as that Coroner may think fit.\n(2) At any time before the date fixed for the holding of the adjourned inquest, the\nDirector of Public Prosecutions may ask the Coroner for a further adjournment\nand the Coroner may comply with that request.\n(3) If the Director of Public Prosecutions decides to institute criminal proceedings\nagainst any person for causing the death of any person upon whose body an\ninquest is in the course of being held, that Director of Public Prosecutions shall\nimmediately notify the Coroner who shall stay the inquest pending the outcome\nof the criminal proceedings and the Coroner \u2014\n(a) shall cause the statements taken up to that time and any exhibits produced\nbefore that Coroner to be made available to the Director of Public\nProsecutions; and\n(b) may, if that Coroner thinks fit, discharge any jury that has been summoned.\n(4) Where any such criminal proceedings have been concluded the Director of\nPublic Prosecutions shall forthwith inform the Clerk of the Court of the result\nof the criminal proceedings who shall thereafter inform the Coroner.\n\nCoroners Rules (2021 Revision)\nRule 34\n\nc\nRevised as at 31st December, 2020\nPage 21\n\n(5) If at the conclusion of such criminal proceedings any person is convicted of an\noffence by which the death of the person upon whom the inquest was being held\nwas brought about, the Coroner shall make in the record all details of the\nconviction and shall close the inquest; and the Coroner shall forthwith send to\nthe Registrar a certificate under the Coroner\u2019s hand stating the result of the\nrelevant criminal proceedings and the particulars which are required to be\nregistered concerning a death under section 30 of the Births and Deaths\nRegistration Act (2021 Revision).\n(6) If at the conclusion of such criminal proceedings no person is convicted of an\noffence by which the death of the person upon whom the inquest was being held\nwas brought about, the Coroner shall require the Director of Public Prosecutions\nto supply all the materials in the possession of the office of the Director of Public\nProsecutions and of the Royal Cayman Islands Police Service concerning the\ncause and circumstances of the death and thereafter resume the inquest.\n34.\nCoroner to adjourn in certain other cases\n34. (1) If during the course of an inquest evidence is given from which it appears to the\nCoroner that the death of the deceased is likely to be due to murder,\nmanslaughter, infanticide or abortion contrary to the Penal Code (2019\nRevision), suicide, or sections 75, 79, 80 or 83 of the Traffic Act (2021 Revision)\nand that a person might be charged with such an offence, then the Coroner,\nunless that Coroner has previously been notified by the Director of Public\nProsecutions that an adjournment is unnecessary, shall adjourn the inquest for\nfourteen days or for such longer period as that Coroner may think fit and send\nto the Director of Public Prosecutions particulars of that evidence.\n(2) At any time before the date fixed for the holding of the adjourned inquest, the\nDirector of Public Prosecutions may ask the Coroner for a further adjournment\nand the Coroner may comply with the Director of Public Prosecutions\u2019 request.\n35.\nCoroner to furnish certificate after adjournment or stay\n35. If a Coroner adjourns or stays an inquest in compliance with rule 33 that Coroner\nshall send to the Registrar a certificate under that Coroner\u2019shand stating, so far as they\nhave been ascertained at the date of the certificate, the particulars which are required\nto be registered concerning a death under section 30 of the Births and Deaths\nRegistration Act (2021 Revision) within five days from the date on which the inquest\nis adjourned.\n36.\nCoroner\u2019s interim certificate of the fact of death\n36. When an inquest has been adjourned for any reason and rule 35 does not apply, the\nCoroner shall on application supply to any person who, in the opinion of the Coroner,\nis a properly interested person an interim certificate of the fact of death in the form\nset out in the Schedule.\n\nRule 37\nCoroners Rules (2021 Revision)\n\nPage 22\nRevised as at 31st December, 2020\nc\n\n37.\nCoroner to notify persons as to resumption of, and alteration of\narrangements for, adjourned or stayed inquest\n37. (1) If an inquest which has been adjourned or stayed in pursuance of rule 33 will\nnot be resumed, the Coroner shall notify the persons within paragraph (4).\n(2) If an inquest which has been adjourned or stayed is to be resumed, the Coroner\nshall give reasonable notice of the date, hour and place at which the inquest will\nbe resumed to the persons within paragraph (4).\n(3) Where a Coroner has fixed a date, hour and place for the holding of an inquest\nadjourned for any reason, that Coroner may, at any time before the date so fixed,\nalter the date, hour or place fixed and shall then give reasonable notice to the\npersons within paragraph (4).\n(4) The persons to whom this paragraph refers are the members of the jury, the\nwitnesses, the Commissioner, any person notified under rule 24 or 30, and any\nother person appearing in person or represented at the inquest.\n38.\nRecognisance of witness or juror becoming void\n38. Where any witness or juror who has been bound over to attend at an adjourned or\nstayed inquest, whether without further notice or conditionally on receiving further\nnotice, is notified by the Coroner that that person\u2019s attendance at the adjourned or\nstayed inquest is not required or that the inquest will not be resumed, the recognisance\nentered into by that person shall be void.\n39.\nCoroner to notify the Clerk of the Court of adjournment or stay in certain\ncases\n39. Where a person charged with an offence specified in rule 34(1) is committed for trial\nto the Grand Court, the Coroner who has adjourned or stayed an inquest in pursuance\nof rule 33 shall inform the Clerk of the Court of such adjournment or stay.\n40.\nMatters to be ascertained at inquest4\n40. (1) The proceedings and evidence at an inquest shall be directed solely to\nascertaining the following matters \u2014\n(a)  the name and description of the deceased;\n(b)  when the deceased came to that person\u2019s death;\n(c)  where the deceased came to that person\u2019s death;\n(d)  the cause and manner of death; and\n(e)  the particulars required by the Births and Deaths Registration Act (2021\nRevision) to be registered concerning the death;\n (2) Neither the Coroner nor the jury shall express any opinion on any other matters.\n\nCoroners Rules (2021 Revision)\nRule 41\n\nc\nRevised as at 31st December, 2020\nPage 23\n\n41.\nEvidence\n41. (1) The Commissioner shall ensure that all the materials in the possession of the\nRoyal Cayman Islands Police Service concerning the cause and circumstances\nof the death are supplied to the Coroner; and if any such materials have been\npassed to the Director of Public Prosecutions then the Director of Public\nProsecutions shall arrange for those materials to be provided to the Coroner.\n(2) Subject to paragraphs (3) to (5), the Coroner may admit at an inquest\ndocumentary evidence relevant to the purposes of the inquest from any living\nperson which in the Coroner\u2019s opinion is unlikely to be disputed, unless a person\nwho in the opinion of the Coroner is within rule 26(2) objects to the\ndocumentary evidence being admitted.\n(3) Documentary evidence so objected to may be admitted if in the opinion of the\nCoroner the maker of the document is unable to give oral evidence within a\nreasonable period.\n(4) Subject to paragraph (5), before admitting such documentary evidence the\nCoroner shall at the beginning of the inquest announce publicly \u2014\n(a) that the documentary evidence may be admitted;\n(b) the full name of the maker of the document to be admitted in evidence, and\na brief account of such document;\n(c) that any person who, in the opinion of the Coroner, is within rule 26(2)\nmay object to the admission of any such documentary evidence; and\n(d) that any person who, in the opinion of the Coroner, is within rule 26(2) is\nentitled to see a copy of any such documentary evidence if that person so\nwishes.\n(5) If during the course of an inquest it appears that there is available at the inquest\ndocumentary evidence which, in the opinion of the Coroner, is relevant to the\npurposes of the inquest but the maker of the document is not present and, in the\nopinion of the Coroner, the content of the documentary evidence is unlikely to\nbe disputed, the Coroner shall at the earliest opportunity during the course of\nthe inquest comply with the provisions of paragraph (4).\n(6) A Coroner may admit, as evidence at an inquest, any document made by a\ndeceased person if that Coroner is of the opinion that the contents of the\ndocument are relevant to the purposes of the inquest.\n(7) A written statement by any person is admissible as evidence to the same extent\nas oral evidence if the statement complies with section 10(1) and (2) of the Law.\n(8) Any documentary evidence admitted under this rule shall, unless the Coroner\notherwise directs, be read aloud at the inquest and, if the Coroner so directs, an\naccount shall be given orally of so much of any statement not read aloud.\n\nRule 42\nCoroners Rules (2021 Revision)\n\nPage 24\nRevised as at 31st December, 2020\nc\n\n(9) If a witness is not in the jurisdiction and that person\u2019s sworn written statement\nis, or may be disputed and \u2014\n(a) that person is unable or unwilling to travel to the Cayman Islands; or\n(b) the Coroner is satisfied that it is not reasonably practicable for that person\nto travel to the Cayman Islands,\nto testify at the inquest, then the Coroner may permit that person to testify by\nlive videolink.\n42.\nExhibits\n42. All exhibits produced in evidence at an inquest shall be marked with consecutive\nnumbers and shall be preserved until the final disposal of the inquest and of any other\nproceedings arising out of the inquest.\n43.\nNotes of evidence; record of testimony of witness\n43. (1) The Coroner shall take notes, or cause notes to be taken or recorded on the\nCoroner\u2019s behalf, of the evidence at every inquest.\n(2) A witness who has given oral testimony shall, before that person is discharged,\nbe given the opportunity to review the record of his testimony and where that\nperson has confirmed to the Coroner that the record has correctly recorded his\ntestimony that person and the Coroner shall sign a copy of that person\u2019s record.\n(3) If the witness has given that person\u2019s oral testimony by live video-link then the\nCoroner and the witness may sign different copies of the same record of that\nperson\u2019s testimony.\n(4) In a case under paragraph 3 the witness shall send the copy of the record of his\ntestimony as signed by that person to the Clerk of the Court. Upon receipt of the\nsame the Coroner shall countersign the record of the witness\u2019 testimony and that\ncountersigned copy shall be the official record of that person\u2019s testimony.\n44.\nNo address as to facts\n44. No person shall be allowed to address the Coroner or the jury as to the facts.\n45.\nSumming-up and direction to jury\n45. The Coroner shall sum up the evidence to the jury and direct them as to the law before\nthey consider their verdict and shall draw their attention to rules 40(2) and 44.\n46.\nVerdict and inquisition5\n46. (1) No verdict shall be framed in such a way as to appear to determine any question\nof \u2014\n(a) criminal liability on the part of a named person; or\n(b) civil liability.\n\nCoroners Rules (2021 Revision)\nRule 46A\n\nc\nRevised as at 31st December, 2020\nPage 25\n\n(2) The verdict of the jury shall be that of the majority thereof.\n(3) The verdict of the jury shall, subject to the evidence available, state \u2014\n(a) the name and description of the deceased;\n(b) the physical cause of death; and\n(c) whether the death was occasioned \u2014\n(i)\nby natural causes;\n(ii) by misadventure;\n(iii)  by suicide;\n(iv)   by unlawful killing;\n(v)  by lawful killing; or\n(vi)  by stillbirth.\n (4) Where the available evidence is insufficient to enable the jury to reach a\nconclusion then the verdict shall be, to that extent, an open one.\n(5) An inquisition \u2014\n(a) shall be in the form set out in form C12 of these Rules; and\n(b) shall set out, so far as such particulars have been proved \u2014\n(i)\nthe identity of the deceased (if known); and\n(ii)  when and where the deceased came by that person\u2019s death; and\n(iii)  the cause and manner of that person\u2019s death.\n46A. Death by watersports or the operation of motor vehicles6\n46A. If, after the delivery of the verdict and inquisition, the Coroner is of the opinion that\nthe circumstances relating to when or where the deceased came by that person\u2019s death\nor the cause and manner of that person\u2019s death concern the undertaking of watersports\nor the operation of motor vehicles, that Coroner shall notify the Registrar and shall\nprovide to the Registrar any documents or information concerning the inquest as the\nRegistrar may reasonably require.\n47.\nPrevention of similar fatalities\n47. A Coroner who believes that action should be taken to prevent the recurrence of\nfatalities similar to that in respect of which the inquest is being held may announce at\nthe inquest that that Coroner is reporting the matter in writing to the person or\nauthority who may have power to take such action and that Coroner may report the\nmatter accordingly.\n\nRule 48\nCoroners Rules (2021 Revision)\n\nPage 26\nRevised as at 31st December, 2020\nc\n\nPART 7 - SUMMONING OF JURORS AND EXCUSAL FROM\nJURY SERVICE\n48.\nMethod of summoning\n48. (1) Subject to the provisions of these rules, jurors shall be summoned by notice in\nthe form set out in the Schedule.\n(2) The summons will be delivered by hand to a juror at that person\u2019s address as\nshown in the electoral register or at such other address as the juror shall notify\nthe Clerk of the Court.\n49.\nNotice to accompany summons\n49. A written summons sent or delivered to any person under rule 48 shall be\naccompanied by a notice informing that person \u2014\n(a) of the effect of section 6 of the Law and rules 51 and 52; and\n(b) that that person may make representations to the Clerk of the Court with a\nview to obtaining the withdrawal of the summons, if for any reason that\nperson is not qualified for jury service, or wishes or is entitled to be\nexcused.\n50.\nWithdrawal or alteration of summons\n50. If it appears to the Clerk of the Court, at any time before the day on which any person\nsummoned under section 6 of the Law is to attend, that that person\u2019s attendance is\nunnecessary, or can be dispensed with, the Clerk of the Court may withdraw or alter\nthe summons by notice served in the same way as a summons.\n51.\nExcusal for previous jury service\n51. (1) If a person summoned under section 6 of the Law shows to the satisfaction of\nthe Clerk of the Court or of the Coroner that \u2014\n(a) that person has served on a Coroner\u2019s jury or a Grand Court jury within\nthe last six preceding sessions of the Grand Court; or\n(b) the Grand Court or a Coroner has excused that person from jury service\nfor a period which has not terminated,\nthe Clerk of the Court or the Coroner shall excuse that person from attending,\nor further attending, in pursuance of the summons.\n52.\nCertificate of attendance\n52. A person duly attending to serve on a jury in compliance with a summons under\nsection 6 of the Law shall be entitled on application in writing to the Clerk of the\nCourt to a certificate recording that that person has so attended in the form set out in\nthe Schedule.\n\nCoroners Rules (2021 Revision)\nRule 53\n\nc\nRevised as at 31st December, 2020\nPage 27\n\n53.\nExcusal from certain persons and discretionary excusal\n53. (1) If any person summoned under section 6 of the Law shows to the satisfaction of\nthe Clerk of the Court that there is good reason why that person should be\nexcused from attending in pursuance of the summons, the Clerk of the Court\nmay excuse that person from so attending.\n(2) Without prejudice to paragraph (1), the Coroner before whom a person is\nsummoned to attend under section 6 of the Law may excuse that person from so\nattending.\n54.\nDischarge of summons in case of doubt as to capacity to act effectively as a\njuror\n54. Where it appears to the Clerk of the Court, in the case of a person attending in\npursuance of a summons under section 6 of the Law, that on account of physical\ndisability or insufficient understanding of English there is doubt as to that person\u2019s\ncapacity to act effectively as a juror, the person may be brought before the Coroner,\nwho shall determine whether or not that person should act as a juror and, if not, that\nCoroner shall discharge the summons.\nPART 8 - RECORDS, DOCUMENTS, EXHIBITS AND FORMS\n55.\nRegister of deaths\n55. The Clerk of the Court shall keep an indexed register of all deaths reported to the\nCoroner which shall be in the relevant format and contain the particulars specified in\nthe Schedule.\n56.\nRetention and delivery or disposal of exhibits\n56. (1) Every exhibit at an inquest shall, unless a court otherwise directs, be retained by\nthe Clerk of the Court until the Coroner is satisfied that the exhibit is not likely\nto be, or will no longer be, required for the purposes of any other legal\nproceedings.\n(2) Where the Coroner decides under paragraph (1) that an exhibit is not required\nto be retained and a request for its delivery has been made by a person appearing\nto the Coroner to be entitled to the possession thereof, the exhibit shall be\ndelivered to that person, or, if no such request has been made, be destroyed or\notherwise disposed of as the Coroner thinks fit.\n57.\nRetention and delivery of documents\n57. (1) Any document, other than an exhibit at an inquest, in the possession of the Clerk\nof the Court in connection with an inquest or autopsy shall, unless a court\notherwise directs, be retained by the Clerk of the Court for at least fifteen years.\n\nRule 58\nCoroners Rules (2021 Revision)\n\nPage 28\nRevised as at 31st December, 2020\nc\n\n(2) Notwithstanding paragraph (1), the Clerk of the Court may deliver any such\ndocument to any person who, in the opinion of the Coroner, is a proper person\nto have possession of it.\n58.\nInspection of, or supply of copies of, documents etc.\n58. (1) The Clerk of the Court shall, on application and on payment of the prescribed\nfee if any, supply to any person who, in the opinion of the Coroner, is a properly\ninterested person a copy of any report of an autopsy or of any notes of evidence,\nor of any document put in evidence at an inquest.\n(2) The Clerk of the Court may, on application and without charge, permit any\nperson who, in the opinion of the Coroner, is a properly interested person, to\ninspect such report, notification, notes of evidence, or document.\n59.\nForms\n59.
