This Act may be cited as the National Honours and Awards Act (2021 Revision).\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_2\", \"num\": \"2.\", \"text\": \"Interpretation1 2. In this Act \u2014 \u201caward\u201d means an award issued under this Act;2 \u201cCaymanian\u201d has the meaning assigned by the repealed Immigration Law (2015 Revision); \u201cChairperson\u201d means the Chairperson of the Council appointed under section 4(1); \u201cChancellor\u201d means the Premier of the Islands as defined by section 124 of the Cayman Islands Constitution Order 2009 [UKSI 2009\/1379]; \u201cConstitution\u201d means the Constitution of the Cayman Islands set out in Schedule 2 to the Cayman Islands Constitution Order 2009 [UKSI 2009\/1379]; \u201cCouncil\u201d means the Council for the Order established under section 4; \u201cOrder\u201d means the Order of the Cayman Islands established under section 3; \u201cpermanent resident\u201d has the meaning assigned by the repealed Immigration Law (2015 Revision); \u201cPremier\u201d means the Premier as defined in section 124 of the Cayman Islands Constitution Order 2009 [UKSI 2009\/1379]; \u201cSecretary\u201d means the Secretary to the Council appointed under section 4(3). National Honours and Awards Act (2021 Revision)\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_3\", \"num\": \"3.\", \"text\": \"Order of the Cayman Islands3 3. (1) There is established a society of honour to be known as the Order of the Cayman Islands which shall comprise the Chancellor and Principal Companion and three levels of membership as follows \u2014 (a) Companion; (b) Officer; and (c) Member. (2) The Premier shall, by virtue of that office, be the Chancellor of the Order and Principal Companion of the Order. (3) The Chancellor is charged with the administration of the Order.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_4\", \"num\": \"4.\", \"text\": \"Council of the Order4 4. (1) There is established a Council for the Order to be known as \u201cthe Council\u201d which shall be governed by the procedure in Schedule 1 and which is responsible for considering nominations for the various levels of the Order and shall consist of the following members \u2014 (a) the Chairperson who shall be the Chief Justice or the Chief Justice\u2019s designate; (b) two persons designated by the Chancellor; (c) one person designated by the Leader of the Opposition; and (d) one person designated by the Speaker of the Cayman Islands Parliament. (2) The members of the Council designated under subsection 1(b), (c) and (d) may \u2014 (a) serve for a period of five years; (b) be reappointed; and (c) resign their tenure. (3) The names of the persons designated pursuant to subsection (1) shall be published by the Cabinet Secretary by notice published in the Gazette. (4) A member of the Council may terminate membership from the Council by notifying the Cabinet Secretary in writing of the member\u2019s intention to terminate that membership and the notification shall include the date upon which the termination is to take effect. (5) The Chancellor may terminate a member of the Council by notifying the member in writing after consultation with the person who designated the member under subsection (2). (6) The notification under subsection (5) shall include the date upon which the termination from the Council is to take effect. National Honours and Awards Act (2021 Revision) 4A. Secretary of the Order5 4A. (1) The Cabinet Secretary shall, by virtue of that office, be the secretary of the Order and is responsible for \u2014 (a) maintaining a stock of insignia; (b) maintaining a register of the names of members of the Order; (c) organising investitures of the Order; (d) preparing the Warrants of Appointment; (e) maintaining the records of minutes of the meetings of the Council; and (f) providing administrative support to the Council of the Order. (2) Where the recipient of an award is promoted from one level to a higher level of award the insignia of the lower shall be returned to the Secretary of the Order.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_5\", \"num\": \"5.\", \"text\": \"Duties of the Council 5. The Council shall \u2014 (a) consider nominations of persons who are residents of the Cayman Islands together with recommendations and supporting material received by the Council for the awards; (b) compile separate lists in respect of each grade of award and where applicable in respect of each class in the grade of nominees to whom an award may be made; (c) submit to the Chancellor the list compiled under paragraph (b) with the recommendations respecting awards; (ca) make rules specifying the use of certificates and the wearing of medals and insignia;6 and (d) advise the Chancellor in respect of any matter concerning the Order that is referred to the Council by the Chancellor for consideration.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_6\", \"num\": \"6.\", \"text\": \"Eligibility7 6. (1) The following persons are eligible to be admitted to the Order in the category of membership stipulated \u2014 (a) a Caymanian or permanent resident of the Islands as an Ordinary member; and (b) a person other than a Caymanian or a permanent resident of the Islands as an Honorary member. (2) A citizen of the United Kingdom who lives and works in the United Kingdom or is resident in a foreign country is not eligible to be admitted to the Order. National Honours and Awards Act (2021 Revision) 6A. Nominations8 6A. (1) Any person or organisation may, in the time and manner prescribed, submit to the Secretary of the Order, for consideration by the Council, a nomination for admission at any level of the Order. (2) The person or organisation submitting a nomination under subsection (1) shall do so in the prescribed manner. 6B. Submission of nominees9 6B. The Council shall consider the nominations submitted under section 6A and following the Council\u2019s deliberation, the Secretary of the Order will submit the names of the successful nominees to the Chancellor\u2019s office. 6C. Nominations refused10 6C. Successful candidates shall be admitted to the various levels of the Order in keeping with the nominations of the Council but a candidate whose nomination is refused by the Council shall not be nominated to the Order.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_7\", \"num\": \"7.\", \"text\": \"Warrant of Appointment11 7. Each person admitted to the Order shall receive a Warrant of Appointment signed by the Chancellor and sealed with the seal of the Order. 7A. Quotas12 7A. The annual quotas of awards to be appointed by the Council is as follows \u2014 (a) Companion - two; (b) Officer - three; and (c) Member - five. 7B. Special appointments13 7B. (1) The Chancellor may make appointments to the Order independent of the Council. (2) The annual quota of awards to be appointed by the Chancellor is as follows \u2014 (a) Companion - one; (b) Officer - one; and (c) Member - one. 7C. Investiture14 7C. The Chancellor of the Order shall designate the dates for investiture ceremonies to take place. (1) A recipient of an award shall, in recognition of the award conferred on that person, be entitled to \u2014 (a) receive and use the prescribed certificate; (b) have the prescribed letters placed after that recipent\u2019s name on occasions when the use of such letters is customary; and (c) receive and to wear as a decoration the prescribed medal or insignia. (2) A recipient of an award shall comply with the rules made by the Council regarding the use of certificates and the wearing of medals and insignia.15 8A. Motto16 8A. The Motto of the Order is \u201cDETERMINATION CONQUERS ALL\u201d. 8B. Precedence of the Order and when wearing insignia prohibited17 8B. (1) The Order of the Cayman Islands shall take precedence immediately after all UK Orders and Decorations but before the Certificate and Badge of Honour and UK Campaign, Commemorative or Long Service Medals. (2) A Caymanian who is a serving member of the United Kingdom Armed Forces, or Police Force shall not wear the medal whilst in uniform. 8C. Refusal18 8C. A person nominated under this Act may refuse to accept that honour or award without being required to provide a reason for doing so and shall not by any person be compelled to provide any such reason. 8D. Termination of membership19 8D. (1) The Chancellor may, after consultation with the Council of the Order, terminate the appointment of a member who is deemed unanimously by the Chancellor and the Council of the Order to be unsuitable to remain a member of the Order. (2) A person who has accepted an award under this Act may terminate the person\u2019s membership of the Order by notifying the Secretary of the Order, in writing, and returning the award to the Secretary of the Order.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_9\", \"num\": \"9.\", \"text\": \"Preservation of rights to honour and award 9. (1) Nothing in this Act prohibits Her Majesty, the Governor or the Cabinet from honouring or awarding any resident of the Islands or other person. (2) An award granted under this Act shall not supersede any award granted by Her Majesty. The Cabinet may make regulations prescribing all matters that are required or permitted under this Act to be prescribed, or are necessary or convenient to be prescribed for giving effect to the purposes of this Act and may after consultation with the Council, by regulation, amend a Schedule. 10A. Validation21 10A. An award purporting to have been issued under this Act at any time before the coming into force of the National Honours and Awards (Amendment) Act, 2018 [Law 21 of 2018] is deemed for all purposes to have been validly issued. National Honours and Awards Act (2021 Revision) SCHEDULE 122 SCHEDULE 122 (section 4(1)) PROCEDURE OF THE COUNCIL 1. The Council shall meet at such times as may be convenient or expedient for the transaction of business and at such places as it may deem fit. 2. The Chairperson shall preside at meetings of the Council and, in the case of that Chairperson\u2019s absence from any meeting, the members present shall elect one from amongst their number to preside at that meeting. 3. The quorum for meetings of the Council shall be three members of the Council. 4. The decisions of the Council shall be by a simple majority of votes of the members present and voting, except that, in the case of an equality of votes, the chairperson of the meeting shall, in addition, have a casting vote. 5. Repealed by section 11(b)(ii) of the National Honours and Awards (Amendment) Act, 2018 [Law 21 of 2018]. 6. Subject to the provisions of this Schedule, the Council shall have power to regulate its own proceedings, and may delegate to any member or sub-committee of its members the power and authority to carry out on behalf of the Council such duties as the Council may determine. SCHEDULE 223 National Honours and Awards Act (2021 Revision) SCHEDULE 223 (section 4A(1)) DESCRIPTION OF INSIGNIA, THE RIBBON AND SEAL 1. Miniature Badge \u2014 (a) Members of the Order may wear the insignia of their particular level in miniature form with other miniature medals, to which they are entitled, or appropriate occasions after 6pm. (b) On such occasions when miniatures are worn, Companions of the Order should also wear their full size neck badge. 2. Insignia of the Order \u2014 The Badge of the Order, a stylised five petalled flower with the arms of the Cayman Islands, within a circlet in the centre. The badge is ensigned with a device which may be described as follows \u2014 Between two wild Banana Orchids or a Cross Azure all issuant from a coronet; or \u2014 (i) Companions shall wear a blue enamelled badge of the Order suspended from a ribbon worn around their neck, or in the case of ladies, worn on a bow on the left shoulder; (ii) Officers shall wear a blue enamelled badge of the Order on a ribbon suspended from the left lapel of their jacket, or in the case of ladies, worn on a bow on the left shoulder; (iii) Members shall wear the badge of the Order in gold on a ribbon suspended from the left lapel of their jacket, or in the case of ladies, worn on a bow on the left shoulder. 3. Ribbon of the Order \u2014 The ribbon of the Order is Royal Blue with thin white borders with a broad white stripe in the centre. 4. Seal of the Order \u2014 The Seal of the Order shall consist of the badge of the Order within a circlet bearing the Motto. Validation .................................................................................................................................... 10\nSCHEDULE 1\n11\nPROCEDURE OF THE COUNCIL\n11\n\nArrangement of Sections\nNational Honours and Awards Act (2021 Revision)\n\nPage 4\nRevised as at 31st December, 2020\nc\n\nSCHEDULE 2\n12\nDESCRIPTION OF INSIGNIA, THE RIBBON AND SEAL\n12\nENDNOTES\n15\nTable of Legislation history: ................................................................................................................. 15\nTable of Endnote references: .............................................................................................................. 16\n\nNational Honours and Awards Act (2021 Revision)\nSection 1\n\nc\nRevised as at 31st December, 2020\nPage 5\n\nCAYMAN ISLANDS\n\nNATIONAL HONOURS AND AWARDS ACT\n(2021 Revision)\n1.\nShort title\n1.\nThis Act may be cited as the National Honours and Awards Act (2021 Revision).\n2.\nInterpretation1\n2.\nIn this Act \u2014\n\u201caward\u201d means an award issued under this Act;2\n\u201cCaymanian\u201d has the meaning assigned by the repealed Immigration Law\n(2015 Revision);\n\u201cChairperson\u201d means the Chairperson of the Council appointed under\nsection 4(1);\n\u201cChancellor\u201d means the Premier of the Islands as defined by section 124 of the\nCayman Islands Constitution Order 2009 [UKSI 2009\/1379];\n\u201cConstitution\u201d means the Constitution of the Cayman Islands set out in\nSchedule 2 to the Cayman Islands Constitution Order 2009 [UKSI 2009\/1379];\n\u201cCouncil\u201d means the Council for the Order established under section 4;\n\u201cOrder\u201d means the Order of the Cayman Islands established under section 3;\n\u201cpermanent resident\u201d has the meaning assigned by the repealed Immigration\nLaw (2015 Revision);\n\u201cPremier\u201d means the Premier as defined in section 124 of the Cayman Islands\nConstitution Order 2009 [UKSI 2009\/1379];\n\u201cSecretary\u201d means the Secretary to the Council appointed under section 4(3).\n\nSection 3\nNational Honours and Awards Act (2021 Revision)\n\nPage 6\nRevised as at 31st December, 2020\nc\n\n3.\nOrder of the Cayman Islands3\n3.\n(1) There is established a society of honour to be known as the Order of the Cayman\nIslands which shall comprise the Chancellor and Principal Companion and three\nlevels of membership as follows \u2014\n(a) Companion;\n(b) Officer; and\n(c) Member.\n(2) The Premier shall, by virtue of that office, be the Chancellor of the Order and\nPrincipal Companion of the Order.\n(3) The Chancellor is charged with the administration of the Order.\n4.\nCouncil of the Order4\n4.\n(1) There is established a Council for the Order to be known as \u201cthe Council\u201d which\nshall be governed by the procedure in Schedule 1 and which is responsible for\nconsidering nominations for the various levels of the Order and shall consist of\nthe following members \u2014\n(a) the Chairperson who shall be the Chief Justice or the Chief Justice\u2019s\ndesignate;\n(b) two persons designated by the Chancellor;\n(c) one person designated by the Leader of the Opposition; and\n(d) one person designated by the Speaker of the Cayman Islands Parliament.\n(2) The members of the Council designated under subsection 1(b), (c) and (d)\nmay \u2014\n(a) serve for a period of five years;\n(b) be reappointed; and\n(c) resign their tenure.\n(3) The names of the persons designated pursuant to subsection (1) shall be\npublished by the Cabinet Secretary by notice published in the Gazette.\n(4) A member of the Council may terminate membership from the Council by\nnotifying the Cabinet Secretary in writing of the member\u2019s intention to terminate\nthat membership and the notification shall include the date upon which the\ntermination is to take effect.\n(5) The Chancellor may terminate a member of the Council by notifying the\nmember in writing after consultation with the person who designated the\nmember under subsection (2).\n(6) The notification under subsection (5) shall include the date upon which the\ntermination from the Council is to take effect.\n\nNational Honours and Awards Act (2021 Revision)\nSection 4A\n\nc\nRevised as at 31st December, 2020\nPage 7\n\n4A.\nSecretary of the Order5\n4A. (1) The Cabinet Secretary shall, by virtue of that office, be the secretary of the Order\nand is responsible for \u2014\n(a) maintaining a stock of insignia;\n(b) maintaining a register of the names of members of the Order;\n(c) organising investitures of the Order;\n(d) preparing the Warrants of Appointment;\n(e) maintaining the records of minutes of the meetings of the Council; and\n(f)\nproviding administrative support to the Council of the Order.\n(2) Where the recipient of an award is promoted from one level to a higher level of\naward the insignia of the lower shall be returned to the Secretary of the Order.\n5.\nDuties of the Council\n5.\nThe Council shall \u2014\n(a) consider nominations of persons who are residents of the Cayman Islands\ntogether with recommendations and supporting material received by the\nCouncil for the awards;\n(b) compile separate lists in respect of each grade of award and where\napplicable in respect of each class in the grade of nominees to whom an\naward may be made;\n(c) submit to the Chancellor the list compiled under paragraph (b) with the\nrecommendations respecting awards;\n(ca) make rules specifying the use of certificates and the wearing of medals and\ninsignia;6 and\n(d) advise the Chancellor in respect of any matter concerning the Order that is\nreferred to the Council by the Chancellor for consideration.\n6.\nEligibility7\n6.\n(1) The following persons are eligible to be admitted to the Order in the category of\nmembership stipulated \u2014\n(a) a Caymanian or permanent resident of the Islands as an Ordinary member;\nand\n(b) a person other than a Caymanian or a permanent resident of the Islands as\nan Honorary member.\n(2) A citizen of the United Kingdom who lives and works in the United Kingdom\nor is resident in a foreign country is not eligible to be admitted to the Order.\n\nSection 6A\nNational Honours and Awards Act (2021 Revision)\n\nPage 8\nRevised as at 31st December, 2020\nc\n\n6A.\nNominations8\n6A. (1) Any person or organisation may, in the time and manner prescribed, submit to\nthe Secretary of the Order, for consideration by the Council, a nomination for\nadmission at any level of the Order.\n(2) The person or organisation submitting a nomination under subsection (1) shall\ndo so in the prescribed manner.\n6B.\nSubmission of nominees9\n6B. The Council shall consider the nominations submitted under section 6A and\nfollowing the Council\u2019s deliberation, the Secretary of the Order will submit the names\nof the successful nominees to the Chancellor\u2019s office.\n6C.\nNominations refused10\n6C. Successful candidates shall be admitted to the various levels of the Order in keeping\nwith the nominations of the Council but a candidate whose nomination is refused by\nthe Council shall not be nominated to the Order.\n7.\nWarrant of Appointment11\n7.\nEach person admitted to the Order shall receive a Warrant of Appointment signed by\nthe Chancellor and sealed with the seal of the Order.\n7A.\nQuotas12\n7A. The annual quotas of awards to be appointed by the Council is as follows \u2014\n(a) Companion - two;\n(b) Officer - three; and\n(c) Member - five.\n7B.\nSpecial appointments13\n7B. (1) The Chancellor may make appointments to the Order independent of the Council.\n(2) The annual quota of awards to be appointed by the Chancellor is as follows \u2014\n(a) Companion - one;\n(b) Officer - one; and\n(c) Member - one.\n7C.\nInvestiture14\n7C. The Chancellor of the Order shall designate the dates for investiture ceremonies to\ntake place.\n\nNational Honours and Awards Act (2021 Revision)\nSection 8\n\nc\nRevised as at 31st December, 2020\nPage 9\n\n8.\nUse of certificates and wearing of medals and insignia\n8.\n(1) A recipient of an award shall, in recognition of the award conferred on that\nperson, be entitled to \u2014\n(a) receive and use the prescribed certificate;\n(b) have the prescribed letters placed after that recipent\u2019s name on occasions\nwhen the use of such letters is customary; and\n(c) receive and to wear as a decoration the prescribed medal or insignia.\n(2) A recipient of an award shall comply with the rules made by the Council\nregarding the use of certificates and the wearing of medals and insignia.15\n8A.\nMotto16\n8A. The Motto of the Order is \u201cDETERMINATION CONQUERS ALL\u201d.\n8B.\nPrecedence of the Order and when wearing insignia prohibited17\n8B. (1) The Order of the Cayman Islands shall take precedence immediately after all\nUK Orders and Decorations but before the Certificate and Badge of Honour and\nUK Campaign, Commemorative or Long Service Medals.\n(2) A Caymanian who is a serving member of the United Kingdom Armed Forces,\nor Police Force shall not wear the medal whilst in uniform.\n8C.\nRefusal18\n8C. A person nominated under this Act may refuse to accept that honour or award without\nbeing required to provide a reason for doing so and shall not by any person be\ncompelled to provide any such reason.\n8D.\nTermination of membership19\n8D. (1) The Chancellor may, after consultation with the Council of the Order, terminate\nthe appointment of a member who is deemed unanimously by the Chancellor\nand the Council of the Order to be unsuitable to remain a member of the Order.\n(2) A person who has accepted an award under this Act may terminate the person\u2019s\nmembership of the Order by notifying the Secretary of the Order, in writing, and\nreturning the award to the Secretary of the Order.\n9.\nPreservation of rights to honour and award\n9.\n(1) Nothing in this Act prohibits Her Majesty, the Governor or the Cabinet from\nhonouring or awarding any resident of the Islands or other person.\n(2) An award granted under this Act shall not supersede any award granted by Her\nMajesty.\n\nSection 10\nNational Honours and Awards Act (2021 Revision)\n\nPage 10\nRevised as at 31st December, 2020\nc\n\n10.\nRegulations20\n10. The Cabinet may make regulations prescribing all matters that are required or\npermitted under this Act to be prescribed, or are necessary or convenient to be\nprescribed for giving effect to the purposes of this Act and may after consultation\nwith the Council, by regulation, amend a Schedule.\n10A. Validation21\n10A. An award purporting to have been issued under this Act at any time before the coming\ninto force of the National Honours and Awards (Amendment) Act, 2018 [Law 21 of\n2018] is deemed for all purposes to have been validly issued.\n\nNational Honours and Awards Act (2021 Revision)\nSCHEDULE 122\n\nc\nRevised as at 31st December, 2020\nPage 11\n\n SCHEDULE 122\n(section 4(1))\nPROCEDURE OF THE COUNCIL\n1.\nThe Council shall meet at such times as may be convenient or expedient for the\ntransaction of business and at such places as it may deem fit.\n2.\nThe Chairperson shall preside at meetings of the Council and, in the case of that\nChairperson\u2019s absence from any meeting, the members present shall elect one from\namongst their number to preside at that meeting.\n3.\nThe quorum for meetings of the Council shall be three members of the Council.\n4.\nThe decisions of the Council shall be by a simple majority of votes of the members\npresent and voting, except that, in the case of an equality of votes, the chairperson of\nthe meeting shall, in addition, have a casting vote.\n5.\nRepealed by section 11(b)(ii) of the National Honours and Awards (Amendment)\nAct, 2018 [Law 21 of 2018].\n6.\nSubject to the provisions of this Schedule, the Council shall have power to regulate\nits own proceedings, and may delegate to any member or sub-committee of its\nmembers the power and authority to carry out on behalf of the Council such duties as\nthe Council may determine.\n\nSCHEDULE 223\nNational Honours and Awards Act (2021 Revision)\n\nPage 12\nRevised as at 31st December, 2020\nc\n\nSCHEDULE 223\n(section 4A(1))\nDESCRIPTION OF INSIGNIA, THE RIBBON AND SEAL\n1.\nMiniature Badge \u2014\n(a) Members of the Order may wear the insignia of their particular level in\nminiature form with other miniature medals, to which they are entitled, or\nappropriate occasions after 6pm.\n(b) On such occasions when miniatures are worn, Companions of the Order\nshould also wear their full size neck badge.\n2.\nInsignia of the Order \u2014\nThe Badge of the Order, a stylised five petalled flower with the arms of the Cayman\nIslands, within a circlet in the centre. The badge is ensigned with a device which may\nbe described as follows \u2014\nBetween two wild Banana Orchids or a Cross Azure all issuant from a coronet; or \u2014\n(i)\nCompanions shall wear a blue enamelled badge of the Order\nsuspended from a ribbon worn around their neck, or in the case of\nladies, worn on a bow on the left shoulder;\n(ii) Officers shall wear a blue enamelled badge of the Order on a ribbon\nsuspended from the left lapel of their jacket, or in the case of ladies,\nworn on a bow on the left shoulder;\n(iii) Members shall wear the badge of the Order in gold on a ribbon\nsuspended from the left lapel of their jacket, or in the case of ladies,\nworn on a bow on the left shoulder.\n3.\nRibbon of the Order \u2014\nThe ribbon of the Order is Royal Blue with thin white borders with a broad white\nstripe in the centre.\n4.\nSeal of the Order \u2014\nThe Seal of the Order shall consist of the badge of the Order within a circlet bearing\nthe Motto.\n\nNational
