In this Act \u2014 \u201cchairperson\u201d means the chairperson of the Council of the Commission; \u201cChief Officer\u201d means the Clerk of the Parliament as provided by section 6; \u201cCivil Service Appeals Commission\u201d means the Civil Services Appeals Commission appointed under section 58 of the Public Service Management Act (2018 Revision); \u201cClerk\u201d means the person appointed to the office of Clerk of the Parliament; \u201cCommission\u201d means the Parliament Management Commission established by section 3; \u201cconstituency assistant\u201d means a person appointed under Part 1 of Schedule 2; \u201cCouncil\u201d means the Council of the Commission established under section 5; \u201celectoral district\u201d has the meaning assigned by the Elections Act (2022 Revision); Parliament (Management) Act (2023 Revision) \u201cfinancial year\u201d has the meaning assigned by the Public Management and Finance Act (2018 Revision); \u201cmember\u201d means a member of the Council; \u201cpublic officer\u201d has the meaning assigned by the Cayman Islands Constitution Order, 2009; \u201cSpeaker\u201d means a person elected by the Parliament in accordance with section 65 of the Cayman Islands Constitution Order, 2009; and \u201cstaff\u201d means persons who are employed by the Commission and the words \u201cstaff member\u201d shall be construed accordingly. PART 2 - THE PARLIAMENT MANAGEMENT COMMISSION\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_3\", \"num\": \"3.\", \"text\": \"The Parliament Management Commission 3. (1) There is established a body known as the Parliament Management Commission which has the functions conferred upon it by this Act. (2) Nothing in subsection (1) shall be construed as affecting any power conferred on the Speaker of the Parliament by any Act in force in the Islands.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_4\", \"num\": \"4.\", \"text\": \"General functions of the Commission 4. (1) The Commission shall be responsible for the administration and management of the Parliament and the functions of the Commission include \u2014 (a) carrying out the budgetary, financial and operational matters relating to the Parliament; (b) establishing the executive, management and administrative structure of the Commission for the necessary discharge of the functions of the Commission; (c) preparing regular budgets, financial and operational reports for submission to the Parliament; (d) providing clerical staff, attendants and other staff to enable the Parliament and committees of the Parliament to operate efficiently; (da) providing constituency assistants to elected Members of the Parliament; (e) providing advice on parliamentary procedures and the functions of Parliament generally; (f) providing an accurate and efficient reporting of proceedings of the Parliament and of meetings of committees of the Parliament as required; (g) providing adequate library and research facilities and services for members of the Parliament; Parliament (Management) Act (2023 Revision) (h) providing security services within the precincts of the Parliament for the safe, orderly and efficient conduct of the business of the Parliament; (i) selling laws and engaging in similar revenue earning activity; (j) maintaining the Parliament building; and (k) subject to this Act, making such rules as it thinks fit to regulate its own internal management. (2) A copy of the rules made under subsection (1)(k) shall be tabled in the Parliament and shall be subject to the affirmative resolution procedure. (3) The Commission cannot sue or be sued in its own right and any suit relating to any act or omission or alleged act or alleged omission of the Commission shall be brought against the Crown in right of its government of the Islands.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_5\", \"num\": \"5.\", \"text\": \"Council of the Commission 5. (1) There shall be a Council of the Commission which, subject to this Act, shall be responsible for carrying out the general functions of the Commission. (2) The Council shall comprise \u2014 (a) the Speaker; (b) the Premier; (c) the Leader of the Opposition; (d) the Deputy Speaker (e) three members of the Parliament appointed in writing by the Speaker, acting in accordance with the advice of the Premier; (f) two members of the Parliament appointed in writing by the Speaker, acting in accordance with the advice of the Leader of the Opposition; and (g) the Clerk of the Parliament (ex-officio, non-voting). (3) The Speaker shall be the chairperson of the Council. (4) The Council shall elect a member, not including the Clerk, to act as chairperson of the Council, in the absence of the Speaker. (5) The Clerk shall be the secretary to the Council and, in the absence of the Clerk, the chairperson shall designate another member of staff to act as secretary. (6) Where a member participates in the exercise of the powers or the carrying out of the functions of the Commission, neither the Council nor any member shall be liable in damages for anything done or omitted in the discharge of their respective functions or duties unless it is shown that the act or omission was negligent or in bad faith. (7) The Commission shall indemnify a member against all claims, damages, costs, charges or expenses incurred by that member in the discharge or purported discharge of the member\u2019s functions or duties under this Act except claims, Parliament (Management) Act (2023 Revision) damages, costs, charges or expenses caused by the negligence or bad faith of that member.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_6\", \"num\": \"6.\", \"text\": \"The Chief Officer 6. (1) The Clerk shall be the Chief Officer of the Commission and shall be an employee of the Commission. (2) The Chief Officer shall be supervised in the performance of the Chief Officer\u2019s duties by the Speaker. (3) Subject to section 21, after the commencement of this Act, the Chief Officer shall be appointed by the Speaker acting in accordance with the decision of the Council. (4) Before appointing a Chief Officer, the Council shall be satisfied that the person to be appointed has the necessary skills, knowledge and integrity to carry out the duties required of the position concerned in a highly competent and politically neutral manner. (5) The Chief Officer shall be employed at such remuneration and on such terms and conditions as are equivalent to those of a Chief Officer under the Public Service Management Act (2018 Revision). (6) The Chief Officer shall be entrusted with the day to day administration of the Commission to the extent of the authority delegated to the Chief Officer by the Council. (7) The Chief Officer shall be answerable to the Council for the acts and decisions made in carrying the Chief Officer\u2019s services to the Council. (8) The Public Service Management Act (2018 Revision) shall apply to the powers, duties and functions of the Chief Officer, except where that Act conflicts with \u2014 (a) this Act; (b) the Parliament (Immunities, Powers and Privileges) Act (2015 Revision); and (c) the Parliament Standing Orders (2018 Consolidation), in which case those latter laws and the orders shall prevail to the extent of the inconsistency. (9) In the appointment, supervision  and termination of the Chief Officer the Speaker, acting in accordance with the decision of the Council, shall exercise the powers, duties and functions assigned to appointing officers under the Public Service Management Act (2018 Revision), but only where the context applies. Parliament (Management) Act (2023 Revision)\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_7\", \"num\": \"7.\", \"text\": \"Vacation of office by member 7. (1) A member who holds office under section 5(2)(a) to (c) shall vacate office where the member \u2014 (a) resigns that member\u2019s office as the Speaker, Premier or the Leader of the Opposition; (b) resigns as member of the Parliament, or otherwise ceases to be a member of the Parliament; or (c) is disqualified as a member of the Parliament pursuant to section 62 of the Constitution. (2) A member of the Council who holds office under section 5(2)(d) or (e) ceases to be a member of the Council if one of the following events occurs \u2014 (a) the appointment is rescinded by the person making the appointment acting on the advice \u2014 (i) of the Premier, if the appointment was made under section 5(2)(d); or (ii) of the Leader of the Opposition if the appointment was made under section 5(2)(e), and the person making the appointment resolves to appoint to the Council, instead of that member, another member of the Parliament; (b) the appointed  member ceases to be a Member of the Parliament before the Parliament is dissolved or expires; or (c) the appointed member fails to comply with that member\u2019s obligations under section 9. (3) An appointed member may, by written notice to the chairperson of the Council, resign the office at any time. (4) Members of the Council immediately before the dissolution of the Parliament continue to hold office until the first meeting of the Parliament after the general election of its members.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_8\", \"num\": \"8.\", \"text\": \"Meetings and decisions of the Council 8. (1) The chairperson shall summon regular meetings of the Council as often as may be required, but not less frequently than once in three months, and shall summon extraordinary meetings when required to do so in accordance with rules made under section 22. (2) At a meeting of the Council, the chairperson of the Council or, if the chairperson is not present, the member selected by the members present to act as temporary chairperson shall preside at the meeting. Parliament (Management) Act (2023 Revision) (3) At every meeting of the Council, a quorum shall consist of five members, and decisions shall be adopted by a simple majority of the votes of the members present and voting. (4) The Council may act notwithstanding that a vacancy exists among the appointed members and shall have power to \u2014 (a) act by sub-committee; and (b) delegate any of its duties and powers from time to time to such subcommittees and to any of their members and to the staff and agents of the Commission. (5) A delegation under subsection (4)(a) or (b) is revocable at will and does not prevent the exercise by the Council of any duties or powers so delegated. (6) For the purposes of this Act, a member shall be deemed to be present at a meeting of the Council if the member has access to the meeting by conference telephone or by some other conference facility. (7) The chairperson shall call an extraordinary meeting of the Council, if requested to do so in writing by three members, and such request shall include a statement of the agenda proposed for the meeting. (8) Subject to this Act, the Council may regulate its own procedure. (9) The Council may invite anyone, including members of the Parliament who are not members of the Council, public officers or any member of the public to attend any meeting of the Council and to participate in such meeting or to provide information to the Council on any of the functions of the Council as set out in section 4(1).\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_9\", \"num\": \"9.\", \"text\": \"Conflicts and pecuniary interest of member 9. (1) If a member has a conflict or pecuniary interest, direct or indirect, in any contract, proposed contract, licence or other matter and is present at a meeting of the Council at which the contract, proposed contract, licence or other matter is the subject of consideration, the member shall, at the meeting and as soon as practicable after its commencement \u2014 (a) disclose the fact; (b) not take part in the consideration or discussion of the contract, proposed contract, licence or other matter or vote on any question with respect to it; and (c) be excluded from the meeting for the duration of the consideration, discussion and voting procedure. (2) A disclosure under subsection (1) shall be recorded in the minutes of the Council. Parliament (Management) Act (2023 Revision)\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_10\", \"num\": \"10.\", \"text\": \"Conflicts and pecuniary interests for the purposes of section 9 10. (1) For the purposes of section 9, a member shall be treated, subject to subsection (2) and to section 11, as having a conflict or indirectly a pecuniary interest in a contract, proposed contract, licence or other matter if \u2014 (a) the member, or any nominee of the member, is a member of a company or other body with which the contract was made or is proposed to be made or which has a direct pecuniary interest in the licence or other matter under consideration; (b) the member is a partner, or is in the employment, of a person with whom the contract was made or is proposed to be made or who has a direct pecuniary interest in the licence or other matter under consideration; or (c) the member or any partner of the member is a professional adviser to a person who has a direct or indirect pecuniary interest in a contract, proposed contract, licence or other matter. (2) Subsection (1) does not apply to membership of or employment under any public body.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_11\", \"num\": \"11.\", \"text\": \"Removal or exclusion of disability, etc. 11. (1) The Parliament may, in the public interest and subject to such conditions as it may think fit, appoint persons to act as members for any specified period, in any case in which the number of members disabled by section 9 at any one time would be so great a proportion of the whole as to impede the transaction of business. (2) Nothing in section 9 precludes any member from taking part in the consideration or discussion of, or voting on, any question whether an application should be made to the Parliament for the exercise of the powers conferred by subsection (1). (3) Section 9 shall not apply to an interest in a contract, proposed contract, licence or other matter which a member has as a member of the public or to an interest in any matter relating to the terms on which the right to participate in any service is offered to the public. (4) Where a member has an indirect pecuniary interest in a contract, proposed contract, licence or other matter by reason only of a beneficial interest in securities of a company or other body, and \u2014 (a) the nominal value of those securities does not exceed one thousand dollars or one-thousandth of the total nominal value of the issued share capital of the company or other body, whichever is the lesser; and (b) if the share capital is of more than one class, the total nominal value of shares of any one class in which the member has a beneficial interest does not exceed one-thousandth of the total issued share capital of that class, Parliament (Management) Act (2023 Revision) section 9 shall not prohibit the member from taking part in the consideration or discussion of the contract, proposed contract, licence or other matter or from voting on any question with respect to it, without prejudice, however, to the member\u2019s duty to disclose their interest.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_12\", \"num\": \"12.\", \"text\": \"Power to appoint staff, etc. 12. (1) The Chief Officer shall be responsible for employing, at such remuneration and on such terms and conditions, including retirement medical benefits, as are in accordance with those set out under the Public Service Management Act (2018 Revision), such staff as the Council considers necessary to carry out the functions of the Commission. (2) The Chief Officer shall be responsible for engaging persons under contract for services, at such remuneration and on such terms and conditions as are in accordance with those set out under the Public Service Management Act (2018 Revision), for professional, technical or other assistance as the Council considers necessary to carry out the functions of the Commission. (3) The Chief Officer, who shall manage the staff of the Commission, shall have the same powers, duties and functions as relate to chief officers under Part VII of the Public Service Management Act (2018 Revision), including the power to appoint, promote, discipline, transfer, terminate and retire staff; and the Chief Officer shall comply with all relevant procedures under that Act as relate to the exercise of such powers, duties and functions. 12A. Constituency assistants 12A. Part 1 of Schedule 2 shall apply to the constituency assistants to elected Members of the Parliament.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_13\", \"num\": \"13.\", \"text\": \"Structure of the Commission 13. (1) The Council, shall, by Order \u2014 (a) prescribe the executive, management and administrative structure of the Commission for the necessary discharge of the functions of the Commission; (b) amend Schedule 1 which sets out the salaries, allowances or other benefits of the elected members of the Cabinet, of the other elected members of the Parliament, and of the Speaker; and (c) amend Schedule 2 which \u2014 (i) provides for the appointment of constituency assistants; and (ii) sets out the allowances for elected Members of the Parliament for Cayman Brac and Little Cayman, for constituency offices and for the office of the Leader of the Opposition. Parliament (Management) Act (2023 Revision) (2) An Order under subsection (1) may be amended by the Council and any Order or its amendment shall be subject to the affirmative resolution procedure. PART 3 - FINANCIAL MATTERS\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_14\", \"num\": \"14.\", \"text\": \"Chief Officer and accounts 14. (1) The Chief Officer shall be responsible and accountable to the Council for \u2014 (a) the budget voted by the Parliament for the work of the Commission; and (b) all monies paid into the Commission. (2) The Chief Officer shall prepare in each financial year an estimate, and where necessary, a supplementary estimate of \u2014 (a) the expenditure of the Commission; and (b) any other expenditure incurred by the Commission in providing any service to the Parliament or to members of the Parliament. (3) The Chief Officer shall as soon as possible after the preparation of an estimate of the expenditure referred to in subsection (2), first submit the estimate to the Council for approval and thereafter to the Minister of Finance.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_15\", \"num\": \"15.\", \"text\": \"Fees paid into the general revenue 15. All fees and other sums payable to the Commission for services and products provided by the Commission shall be paid into the general revenue of the Government.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_16\", \"num\": \"16.\", \"text\": \"Accounts and audit 16. (1) The Commission shall keep accounts of its financial transactions in such form and manner as accord with the Public Management and Finance Act (2020 Revision) and any other relevant Act. (2) The Commission shall in carrying out its financial functions \u2014 (a) make its decisions in accordance with the budget process established by the Cabinet under section 17 of the Public Management and Finance Act (2020 Revision); and (b) ensure that its decisions are consistent with the principles of responsible financial management set out in section 14(3) of the Public Management and Finance Act (2020 Revision). (3) The accounts of the Commission shall be audited by the Auditor General in accordance with the Public Management and Finance Act (2020 Revision). Parliament (Management) Act (2023 Revision)\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_17\", \"num\": \"17.\", \"text\": \"Expenses 17. Any expenditure required to be made by virtue of this Act shall be charged on and paid out of the general revenue of the Government. PART 4 - GENERAL\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_18\", \"num\": \"18.\", \"text\": \"Grievance procedure 18. (1) The Council may, by rules made under section 4, establish procedures for addressing grievances of staff and those procedures shall be based on grievance procedures set out in the Public Service Management Act (2018 Revision). (2) For the purposes of this section, a grievance is a matter of concern to a staff member which \u2014 (a) relates to workplace conditions or safety, the behaviour of a member of the Commission, a member of the Parliament or another staff member in the workplace; and (b) the staff member wishes to be addressed through a formal grievance process rather than directly through informal interaction with the person against whom the staff member has raised a complaint of grievance.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_19\", \"num\": \"19.\", \"text\": \"Appeal to the Civil Service Appeals Commission by staff 19. (1) The Civil Service Appeals Commission shall hear appeals from staff in accordance with this section. (2) Subject to this section, the Civil Service Appeals Commission shall follow the procedure set out in the Public Service Management Act (2018 Revision) in relation to the hearing of appeals from staff members. (3) Subject to subsection (4), a staff member may appeal to the Civil Service Appeals Commission about any decision of the Chief Officer made under this Act in relation to that staff member. (4) An appeal by a staff member shall be limited to any decision of a Chief Officer which may be the subject of an appeal to the Civil Service Appeals Commission under Part VII of the Public Service Management Act (2018 Revision). (5) Where a staff member makes an appeal under subsection (2), the staff member shall provide evidence to the Civil Service Appeals Commission to show that the Chief Officer has acted in an unfair or biased manner, or in a manner inconsistent with the proper carrying out of any power, duty or function by the Chief Officer in relation to that staff member and its decision shall be final. (6) The Civil Service Appeals Commission shall, within thirty days, render a decision and such decision shall be based on the information provided by the staff member together with information provided by the Chief Officer or any Parliament (Management) Act (2023 Revision) other information that the Civil Service Appeals Commission considers relevant. (7) Where the decision being appealed against involves dismissal or other termination of employment, the Civil Service Appeals Commission may, before hearing the matter in full and rendering a final decision thereon, make such interim orders as it thinks fit including \u2014 (a) temporary reinstatement of the appellant; and (b) placing the staff member on suspension on such terms and conditions as it thinks fit.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_20\", \"num\": \"20.\", \"text\": \"Right of appeal by Chief Officer 20. (1) The Civil Service Appeals Commission shall hear appeals from the Chief Officer in accordance with this section. (2) Subject to subsection (3), the Chief Officer may appeal to the Civil Service Appeals Commission about any decision of the Speaker made under this Act in relation to the Chief Officer, and must do so within thirty days of a decision being notified. (3) An appeal by the Chief Officer shall be limited to any one or more of the following decisions of the Speaker, that is to say a decision relating to \u2014 (a) the remuneration of the Chief Officer; (b) the dismissal and early retirement of the Chief Officer; (c) the annual performance assessment of the Chief Officer; and (d) the calculation of the performance component of the remuneration of the Chief Officer. (4) The Civil Service Appeals Commission shall rule on the appeal referred to in subsection (1) and make a recommendation to the Commission within thirty days of the appeal being lodged; and its recommendation shall be based on the information provided by the appellant together with information provided by the Speaker, and any other information that the Commission considers relevant. (5) The Commission shall act upon the recommendation referred to in subsection (4) as it sees fit. (6) Where the Chief Officer makes an appeal under subsection (1), the Chief Officer shall provide evidence to the Civil Service Appeals Commission to show that the Speaker has acted in an unfair or biased manner, or in a manner which is inconsistent with the requirements relating to the decision appealed against.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_21\", \"num\": \"21.\", \"text\": \"Transition of public officers to staff of the Commission 21. (1) A person who is appointed or purported to be appointed prior to the date of the commencement of this Act as a public officer of the Parliament shall be deemed on that date to have been lawfully appointed by the Council. Parliament (Management) Act (2023 Revision) (2) A person who is appointed or purported to be appointed prior to the date of the commencement of this Act to the post of Clerk of the Parliament shall be deemed, on that date, to have been lawfully appointed by the Council. (3) After the commencement date of this Act, and subject to subsection (4), a person who, immediately prior to such date was a public officer of the Parliament and held office at that date (including the Chief Officer), may, at that person\u2019s option, exercisable in accordance with subsection (4), state whether or not the person wishes to be employed by the Commission. (4) The option referred to in subsection (3) is exercisable by \u2014 (a) the person referred to in that subsection, (other than the Chief Officer), giving notice in writing of the option to the Chief Officer within nine months of the commencement of this Act; and (b) the Chief Officer giving notice in writing of the option to the Speaker within nine months of the commencement of this Act. (5) A person referred to in this section who exercises the option to be employed by the Commission, shall, from one year of the date of commencement of this Act, be employed by the Commission and the employment of that person as a public officer of the Parliament shall for all purposes be deemed to be continuous service in the service of the Commission. Deputy Leader of the Opposition D 1 Earns at D1 and then an increase of one increment for each fouryear term completed as the Deputy Leader of the Opposition. Earns an allowance of 2.5% of monthly salary for serving as Deputy Leader of the Opposition. Councillor \/Parliamentary Secretary D 1 Earns at D1 and then an increase of one increment for each fouryear term completed as Councillor or Parliamentary Secretary. Earns a duty allowance between $1,000 and $2,000 per month, at the discretion of the Premier, but shall not earn more than a Minister. MPs D 1 Earns at D1 and then an increase of one increment for each fouryear term completed as an MLA. Parliament (Management) Act (2023 Revision) SCHEDULE 2 (Sections 12A and 13(1)(c)) CONSTITUENCY ASSISTANTS; CONSTITUENCY ALLOWANCE FOR MEMBERS OF THE PARLIAMENT; ALLOWANCES FOR THE OFFICES OF THE PREMIER AND THE LEADER OF THE OPPOSITION AND FOR MEMBERS OF THE PARLIAMENT FOR CAYMAN BRAC AND LITTLE CAYMAN PART 1 CONSTITUENCY ASSISTANTS 1. Constituency assistants shall be appointed in accordance with paragraph 4. 2. (1) Each elected Member of the Parliament is entitled to the services of a constituency assistant as follows \u2014 (a) in the case of an elected Member of the Parliament who is a Minister, to two full time constituency assistants and one part time constituency assistant; and (b) in the case of other elected Members of Parliament, one full time constituency assistant and one part time constituency assistant. (2) For the purposes of this Schedule \u2014 (a) a full time constituency assistant is a person who is contracted to work for such normal hours between 37 \u00bd and 40 hours per week as may be agreed and consistent with the Personnel Regulations (2022 Revision); and (b) a part time constituency assistant is a person who is contracted to work for such proportion of the normal hours for a full time constituency assistant as may be agreed and consistent with the Personnel Regulations (2022 Revision). 3. A constituency assistant shall be a contractor of the Commission and shall hold office pursuant to the terms of a contract for services with the Commission. 4. Remuneration under a constituency assistant\u2019s contract shall include salary and pension at such rates as may be prescribed by regulations and health benefits similar to those provided to public officers under the Public Service Management Act (2018 Revision). Parliament (Management) Act (2023 Revision) 5. Subject to paragraph 6, the Chief Officer, acting on the advice of the Member of the Parliament for an electoral district, shall appoint constituency assistants for that electoral district. 6. The duties and responsibilities of a constituency assistant shall be specified in the contract for services by the Chief Officer, acting on the advice of the Member of the Parliament on whose advice the constituency assistant was appointed. 7. The appointment of a constituency assistant shall cease \u2014 (a) on one month\u2019s notice by the constituency assistant, or by the Chief Officer acting on the advice of the Member of the Parliament on whose advice the appointment was made or for just cause without notice; (b) on the date on which the resignation of the constituency assistant takes effect; (c) if the Member of the Parliament who advised the appointment of the constituency assistant ceases to be a Member of the Parliament, other than by a dissolution of the Parliament, on the day of the cessation of that membership of Parliament; (d) after a dissolution of the Parliament, on nomination day, if the Member who advised the appointment is not nominated for election to the Parliament for the same electoral district; or (e) after a dissolution of the Parliament, on polling day if the Member who advised the appointment is nominated but is not elected to Parliament. 8. A constituency assistant whose employment is terminated by the Chief Officer under paragraph 7(a) shall receive a termination allowance as may be prescribed by regulations. 9. Any person employed as a constituency assistant immediately before the 5th July, 2022, the commencement date of the Parliament (Management) (Amendment) Act, 2022 (Act 6 of 2022), shall be treated for all purposes as if the appointment had been made as provided by this amending Act from the date of the appointment. 10. For the purposes of this Schedule, the words \u201cthis amending Act\u201d means the Legislative Assembly (Management) Act, 2020 (Law 48 of 2020) as amended by the Parliament (Management) (Amendment) Act, 2022 (Act 6 of 2022). Parliament (Management) Act (2023 Revision) PART 2 CONSTITUENCY ALLOWANCE FOR MEMBERS OF THE PARLIAMENT; ALLOWANCES FOR THE OFFICES OF THE LEADER OF THE OPPOSITION AND FOR MEMBERS OF THE PARLIAMENT FOR CAYMAN BRAC AND LITTLE CAYMAN Constituency Allowance 1. (1) A constituency allowance covers payment for the costs of maintaining a constituency office in order to facilitate access to constituents and such costs include \u2014 (a) utilities of a constituency office; (b) supplies for a constituency office; and (c) the general maintenance of a constituency office. (2) The constituency allowance is $5,000 per month for each elected Member of the Parliament. Executive Allowance for the Premier 2. The Premier shall receive an executive allowance of $5,000 per month. Executive Allowance for the Leader of the Opposition 3. The Leader of the Opposition shall receive an executive allowance of $3,500 per month. Allowance for Cayman Brac and Little Cayman Representatives 4. (1) There are two components to the allowance for Cayman Brac and Little Cayman Representatives and the allowance is $5,000 per month. (2) The two components and their corresponding maximum amounts per month are as follows \u2014 (a) accommodation - $2,500; and (b) transportation - $2,500. Severance 5. Each Member of the Parliament who does not stand for re-election or, having stood for re-election, is not elected at the next election, shall be entitled to a severance payment equal to three months of the salary paid to that Member under Schedule 1 as at the date of that election and the payment does not include any duty allowances under Schedule 1 or any allowances permitted under this Schedule. and\n\u201cstaff\u201d means persons who are employed by the Commission and the words\n\u201cstaff member\u201d shall be construed accordingly.\nPART 2 - THE PARLIAMENT MANAGEMENT COMMISSION\n3.\nThe Parliament Management Commission\n3.\n(1) There is established a body known as the Parliament Management Commission\nwhich has the functions conferred upon it by this Act.\n(2) Nothing in subsection (1) shall be construed as affecting any power conferred\non the Speaker of the Parliament by any Act in force in the Islands.\n4.\nGeneral functions of the Commission\n4.\n(1) The Commission shall be responsible for the administration and management of\nthe Parliament and the functions of the Commission include \u2014\n(a)\ncarrying out the budgetary, financial and operational matters relating to the\nParliament;\n(b) establishing the executive, management and administrative structure of the\nCommission for the necessary discharge of the functions of the\nCommission;\n(c)\npreparing regular budgets, financial and operational reports for submission\nto the Parliament;\n(d) providing clerical staff, attendants and other staff to enable the Parliament\nand committees of the Parliament to operate efficiently;\n\n(da) providing constituency assistants to elected Members of the Parliament;\n(e)\nproviding advice on parliamentary procedures and the functions of\nParliament generally;\n(f)\nproviding an accurate and efficient reporting of proceedings of the\nParliament and of meetings of committees of the Parliament as required;\n(g) providing adequate library and research facilities and services for members\nof the Parliament;\n\nParliament (Management) Act (2023 Revision)\nSection 5\n\nc\nRevised as at 31st December, 2022\nPage 7\n\n(h) providing security services within the precincts of the Parliament for the\nsafe, orderly and efficient conduct of the business of the Parliament;\n(i)\nselling laws and engaging in similar revenue earning activity;\n(j)\nmaintaining the Parliament building; and\n(k) subject to this Act, making such rules as it thinks fit to regulate its own\ninternal management.\n(2) A copy of the rules made under subsection (1)(k) shall be tabled in the\nParliament and shall be subject to the affirmative resolution procedure.\n(3) The Commission cannot sue or be sued in its own right and any suit relating to\nany act or omission or alleged act or alleged omission of the Commission shall\nbe brought against the Crown in right of its government of the Islands.\n5.\nCouncil of the Commission\n5.\n(1) There shall be a Council of the Commission which, subject to this Act, shall be\nresponsible for carrying out the general functions of the Commission.\n(2) The Council shall comprise \u2014\n(a)\nthe Speaker;\n(b) the Premier;\n(c)\nthe Leader of the Opposition;\n(d) the Deputy Speaker\n(e)\nthree members of the Parliament appointed in writing by the Speaker,\nacting in accordance with the advice of the Premier;\n(f)\ntwo members of the Parliament appointed in writing by the Speaker, acting\nin accordance with the advice of the Leader of the Opposition; and\n(g) the Clerk of the Parliament (ex-officio, non-voting).\n(3) The Speaker shall be the chairperson of the Council.\n(4) The Council shall elect a member, not including the Clerk, to act as chairperson\nof the Council, in the absence of the Speaker.\n(5) The Clerk shall be the secretary to the Council and, in the absence of the Clerk,\nthe chairperson shall designate another member of staff to act as secretary.\n(6) Where a member participates in the exercise of the powers or the carrying out\nof the functions of the Commission, neither the Council nor any member shall\nbe liable in damages for anything done or omitted in the discharge of their\nrespective functions or duties unless it is shown that the act or omission was\nnegligent or in bad faith.\n(7) The Commission shall indemnify a member against all claims, damages, costs,\ncharges or expenses incurred by that member in the discharge or purported\ndischarge of the member\u2019s functions or duties under this Act except claims,\n\nSection 6\nParliament (Management) Act (2023 Revision)\n\nPage 8\nRevised as at 31st December, 2022\nc\n\ndamages, costs, charges or expenses caused by the negligence or bad faith of\nthat member.\n6.\nThe Chief Officer\n6.\n(1) The Clerk shall be the Chief Officer of the Commission and shall be an\nemployee of the Commission.\n(2) The Chief Officer shall be supervised in the performance of the Chief Officer\u2019s\nduties by the Speaker.\n(3) Subject to section 21, after the commencement of this Act, the Chief Officer\nshall be appointed by the Speaker acting in accordance with the decision of the\nCouncil.\n(4) Before appointing a Chief Officer, the Council shall be satisfied that the person\nto be appointed has the necessary skills, knowledge and integrity to carry out\nthe duties required of the position concerned in a highly competent and\npolitically neutral manner.\n(5) The Chief Officer shall be employed at such remuneration and on such terms\nand conditions as are equivalent to those of a Chief Officer under the Public\nService Management Act (2018 Revision).\n(6) The Chief Officer shall be entrusted with the day to day administration of the\nCommission to the extent of the authority delegated to the Chief Officer by the\nCouncil.\n(7) The Chief Officer shall be answerable to the Council for the acts and decisions\nmade in carrying the Chief Officer\u2019s services to the Council.\n(8) The Public Service Management Act (2018 Revision) shall apply to the powers,\nduties and functions of the Chief Officer, except where that Act conflicts\nwith \u2014\n(a)\nthis Act;\n(b) the Parliament (Immunities, Powers and Privileges) Act (2015 Revision);\nand\n(c)\nthe Parliament Standing Orders (2018 Consolidation),\nin which case those latter laws and the orders shall prevail to the extent of the\ninconsistency.\n(9) In the appointment, supervision  and termination of the Chief Officer the\nSpeaker, acting in accordance with the decision of the Council, shall exercise\nthe powers, duties and functions assigned to appointing officers under the Public\nService Management Act (2018 Revision), but only where the context applies.\n\nParliament (Management) Act (2023 Revision)\nSection 7\n\nc\nRevised as at 31st December, 2022\nPage 9\n\n7.\nVacation of office by member\n7.\n(1) A member who holds office under section 5(2)(a) to (c) shall vacate office where\nthe member \u2014\n(a)\nresigns that member\u2019s office as the Speaker, Premier or the Leader of the\nOpposition;\n(b) resigns as member of the Parliament, or otherwise ceases to be a member\nof the Parliament; or\n(c)\nis disqualified as a member of the Parliament pursuant to section 62 of the\nConstitution.\n(2) A member of the Council who holds office under section 5(2)(d) or (e) ceases\nto be a member of the Council if one of the following events occurs \u2014\n(a)\nthe appointment is rescinded by the person making the appointment acting\non the advice \u2014\n(i)\nof the Premier, if the appointment was made under section 5(2)(d);\nor\n(ii) of the Leader of the Opposition if the appointment was made under\nsection 5(2)(e),\nand the person making the appointment resolves to appoint to the Council,\ninstead of that member, another member of the Parliament;\n(b) the appointed  member ceases to be a Member of the Parliament before the\nParliament is dissolved or expires; or\n(c)\nthe appointed member fails to comply with that member\u2019s obligations\nunder section 9.\n(3) An appointed member may, by written notice to the chairperson of the Council,\nresign the office at any time.\n(4) Members of the Council immediately before the dissolution of the Parliament\ncontinue to hold office until the first meeting of the Parliament after the general\nelection of its members.\n8.\nMeetings and decisions of the Council\n8.\n(1) The chairperson shall summon regular meetings of the Council as often as may\nbe required, but not less frequently than once in three months, and shall summon\nextraordinary meetings when required to do so in accordance with rules made\nunder section 22.\n(2) At a meeting of the Council, the chairperson of the Council or, if the chairperson\nis not present, the member selected by the members present to act as temporary\nchairperson shall preside at the meeting.\n\nSection 9\nParliament (Management) Act (2023 Revision)\n\nPage 10\nRevised as at 31st December, 2022\nc\n\n(3) At every meeting of the Council, a quorum shall consist of five members, and\ndecisions shall be adopted by a simple majority of the votes of the members\npresent and voting.\n(4) The Council may act notwithstanding that a vacancy exists among the appointed\nmembers and shall have power to \u2014\n(a)\nact by sub-committee; and\n(b) delegate any of its duties and powers from time to time to such subcommittees and to any of their members and to the staff and agents of the\nCommission.\n(5) A delegation under subsection (4)(a) or (b) is revocable at will and does not\nprevent the exercise by the Council of any duties or powers so delegated.\n(6) For the purposes of this Act, a member shall be deemed to be present at a\nmeeting of the Council if the member has access to the meeting by conference\ntelephone or by some other conference facility.\n(7) The chairperson shall call an extraordinary meeting of the Council, if requested\nto do so in writing by three members, and such request shall include a statement\nof the agenda proposed for the meeting.\n(8) Subject to this Act, the Council may regulate its own procedure.\n(9) The Council may invite anyone, including members of the Parliament who are\nnot members of the Council, public officers or any member of the public to\nattend any meeting of the Council and to participate in such meeting or to\nprovide information to the Council on any of the functions of the Council as set\nout in section 4(1).\n9.\nConflicts and pecuniary interest of member\n9.\n(1) If a member has a conflict or pecuniary interest, direct or indirect, in any\ncontract, proposed contract, licence or other matter and is present at a meeting\nof the Council at which the contract, proposed contract, licence or other matter\nis the subject of consideration, the member shall, at the meeting and as soon as\npracticable after its commencement \u2014\n(a)\ndisclose the fact;\n(b) not take part in the consideration or discussion of the contract, proposed\ncontract, licence or other matter or vote on any question with respect to it;\nand\n(c)\nbe excluded from the meeting for the duration of the consideration,\ndiscussion and voting procedure.\n(2) A disclosure under subsection (1) shall be recorded in the minutes of the\nCouncil.\n\nParliament (Management) Act (2023 Revision)\nSection 10\n\nc\nRevised as at 31st December, 2022\nPage 11\n\n10.\nConflicts and pecuniary interests for the purposes of section 9\n10. (1) For the purposes of section 9, a member shall be treated, subject to subsection\n(2) and to section 11, as having a conflict or indirectly a pecuniary interest in a\ncontract, proposed contract, licence or other matter if \u2014\n(a)\nthe member, or any nominee of the member, is a member of a company or\nother body with which the contract was made or is proposed to be made or\nwhich has a direct pecuniary interest in the licence or other matter under\nconsideration;\n(b) the member is a partner, or is in the employment, of a person with whom\nthe contract was made or is proposed to be made or who has a direct\npecuniary interest in the licence or other matter under consideration; or\n(c)\nthe member or any partner of the member is a professional adviser to a\nperson who has a direct or indirect pecuniary interest in a contract,\nproposed contract, licence or other matter.\n(2) Subsection (1) does not apply to membership of or employment under any\npublic body.\n11.\nRemoval or exclusion of disability, etc.\n11. (1) The Parliament may, in the public interest and subject to such conditions as it\nmay think fit, appoint persons to act as members for any specified period, in any\ncase in which the number of members disabled by section 9 at any one time\nwould be so great a proportion of the whole as to impede the transaction of\nbusiness.\n(2) Nothing in section 9 precludes any member from taking part in the consideration\nor discussion of, or voting on, any question whether an application should be\nmade to the Parliament for the exercise of the powers conferred by subsection\n(1).\n(3) Section 9 shall not apply to an interest in a contract, proposed contract, licence\nor other matter which a member has as a member of the public or to an interest\nin any matter relating to the terms on which the right to participate in any service\nis offered to the public.\n(4) Where a member has an indirect pecuniary interest in a contract, proposed\ncontract, licence or other matter by reason only of a beneficial interest in\nsecurities of a company or other body, and \u2014\n(a)\nthe nominal value of those securities does not exceed one thousand dollars\nor one-thousandth of the total nominal value of the issued share capital of\nthe company or other body, whichever is the lesser; and\n(b) if the share capital is of more than one class, the total nominal value of\nshares of any one class in which the member has a beneficial interest does\nnot exceed one-thousandth of the total issued share capital of that class,\n\nSection 12\nParliament (Management) Act (2023 Revision)\n\nPage 12\nRevised as at 31st December, 2022\nc\n\nsection 9 shall not prohibit the member from taking part in the consideration or\ndiscussion of the contract, proposed contract, licence or other matter or from\nvoting on any question with respect to it, without prejudice, however, to the\nmember\u2019s duty to disclose their interest.\n12.\nPower to appoint staff, etc.\n12. (1) The Chief Officer shall be responsible for employing, at such remuneration and\non such terms and conditions, including retirement medical benefits, as are in\naccordance with those set out under the Public Service Management Act (2018\nRevision), such staff as the Council considers necessary to carry out the\nfunctions of the Commission.\n(2) The Chief Officer shall be responsible for engaging persons under contract for\nservices, at such remuneration and on such terms and conditions as are in\naccordance with those set out under the Public Service Management Act (2018\nRevision), for professional, technical or other assistance as the Council\nconsiders necessary to carry out the functions of the Commission.\n(3) The Chief Officer, who shall manage the staff of the Commission, shall have\nthe same powers, duties and functions as relate to chief officers under Part VII\nof the Public Service Management Act (2018 Revision), including the power to\nappoint, promote, discipline, transfer, terminate and retire staff; and the Chief\nOfficer shall comply with all relevant procedures under that Act as relate to the\nexercise of such powers, duties and functions.\n12A. Constituency assistants\n12A. Part 1 of Schedule 2 shall apply to the constituency assistants to elected Members of\nthe Parliament.\n13.\nStructure of the Commission\n13. (1) The Council, shall, by Order \u2014\n(a)\nprescribe the executive, management and administrative structure of the\nCommission for the necessary discharge of the functions of the\nCommission;\n(b) amend Schedule 1 which sets out the salaries, allowances or other benefits\nof the elected members of the Cabinet, of the other elected members of the\nParliament, and of the Speaker; and\n(c)\namend Schedule 2 which \u2014\n(i)\nprovides for the appointment of constituency assistants; and\n(ii) sets out the allowances for elected Members of the Parliament for\nCayman Brac and Little Cayman, for constituency offices and for the\noffice of the Leader of the Opposition.\n\nParliament (Management) Act (2023 Revision)\nSection 14\n\nc\nRevised as at 31st December, 2022\nPage 13\n\n(2) An Order under subsection (1) may be amended by the Council and any Order\nor its amendment shall be subject to the affirmative resolution procedure.\nPART 3 - FINANCIAL MATTERS\n14.\nChief Officer and accounts\n14. (1) The Chief Officer shall be responsible and accountable to the Council for \u2014\n(a)\nthe budget voted by the Parliament for the work of the Commission; and\n(b) all monies paid into the Commission.\n(2) The Chief Officer shall prepare in each financial year an estimate, and where\nnecessary, a supplementary estimate of \u2014\n(a)\nthe expenditure of the Commission; and\n(b) any other expenditure incurred by the Commission in providing any\nservice to the Parliament or to members of the Parliament.\n(3) The Chief Officer shall as soon as possible after the preparation of an estimate\nof the expenditure referred to in subsection (2), first submit the estimate to the\nCouncil for approval and thereafter to the Minister of Finance.\n15.\nFees paid into the general revenue\n15. All fees and other sums payable to the Commission for services and products\nprovided by the Commission shall be paid into the general revenue of the\nGovernment.\n16.\nAccounts and audit\n16. (1) The Commission shall keep accounts of its financial transactions in such form\nand manner as accord with the Public Management and Finance Act (2020\nRevision) and any other relevant Act.\n(2) The Commission shall in carrying out its financial functions \u2014\n(a)\nmake its decisions in accordance with the budget process established by\nthe Cabinet under section 17 of the Public Management and Finance Act\n(2020 Revision); and\n(b) ensure that its decisions are consistent with the principles of responsible\nfinancial management set out in section 14(3) of the Public Management\nand Finance Act (2020 Revision).\n(3) The accounts of the Commission shall be audited by the Auditor General in\naccordance with the Public Management and Finance Act (2020 Revision).\n\nSection 17\nParliament (Management) Act (2023 Revision)\n\nPage 14\nRevised as at 31st December, 2022\nc\n\n17.\nExpenses\n17. Any expenditure required to be made by virtue of this Act shall be charged on and\npaid out of the general revenue of the Government.\nPART 4 - GENERAL\n18.\nGrievance procedure\n18. (1) The Council may, by rules made under section 4, establish procedures for\naddressing grievances of staff and those procedures shall be based on grievance\nprocedures set out in the Public Service Management Act (2018 Revision).\n(2) For the purposes of this section, a grievance is a matter of concern to a staff\nmember which \u2014\n(a)\nrelates to workplace conditions or safety, the behaviour of a member of the\nCommission, a member of the Parliament or another staff member in the\nworkplace; and\n(b) the staff member wishes to be addressed through a formal grievance\nprocess rather than directly through informal interaction with the person\nagainst whom the staff member has raised a complaint of grievance.\n19.\nAppeal to the Civil Service Appeals Commission by staff\n19. (1) The Civil Service Appeals Commission shall hear appeals from staff in\naccordance with this section.\n(2) Subject to this section, the Civil Service Appeals Commission shall follow the\nprocedure set out in the Public Service Management Act (2018 Revision) in\nrelation to the hearing of appeals from staff members.\n(3) Subject to subsection (4), a staff member may appeal to the Civil Service\nAppeals Commission about any decision of the Chief Officer made under this\nAct in relation to that staff member.\n(4) An appeal by a staff member shall be limited to any decision of a Chief Officer\nwhich may be the subject of an appeal to the Civil Service Appeals Commission\nunder Part VII of the Public Service Management Act (2018 Revision).\n(5) Where a staff member makes an appeal under subsection (2), the staff member\nshall provide evidence to the Civil Service Appeals Commission to show that\nthe Chief Officer has acted in an unfair or biased manner, or in a manner\ninconsistent with the proper carrying out of any power, duty or function by the\nChief Officer in relation to that staff member and its decision shall be final.\n(6) The Civil Service Appeals Commission shall, within thirty days, render a\ndecision and such decision shall be based on the information provided by the\nstaff member together with information provided by the Chief Officer or any\n\nParliament (Management) Act (2023 Revision)\nSection 20\n\nc\nRevised as at 31st December, 2022\nPage 15\n\nother information that the Civil Service Appeals Commission considers\nrelevant.\n(7) Where the decision being appealed against involves dismissal or other\ntermination of employment, the Civil Service Appeals Commission may, before\nhearing the matter in full and rendering a final decision thereon, make such\ninterim orders as it thinks fit including \u2014\n(a)\ntemporary reinstatement of the appellant; and\n(b) placing the staff member on suspension on such terms and conditions as it\nthinks fit.\n20.\nRight of appeal by Chief Officer\n20. (1) The Civil Service Appeals Commission shall hear appeals from the Chief\nOfficer in accordance with this section.\n(2) Subject to subsection (3), the Chief Officer may appeal to the Civil Service\nAppeals Commission about any decision of the Speaker made under this Act in\nrelation to the Chief Officer, and must do so within thirty days of a decision\nbeing notified.\n(3) An appeal by the Chief Officer shall be limited to any one or more of the\nfollowing decisions of the Speaker, that is to say a decision relating to \u2014\n(a)\nthe remuneration of the Chief Officer;\n(b) the dismissal and early retirement of the Chief Officer;\n(c)\nthe annual performance assessment of the Chief Officer; and\n(d) the calculation of the performance component of the remuneration of the\nChief Officer.\n(4) The Civil Service Appeals Commission shall rule on the appeal referred to in\nsubsection (1) and make a recommendation to the Commission within thirty\ndays of the appeal being lodged; and its recommendation shall be based on the\ninformation provided by the appellant together with information provided by\nthe Speaker, and any other information that the Commission considers relevant.\n(5) The Commission shall act upon the recommendation referred to in subsection\n(4) as it sees fit.\n(6) Where the Chief Officer makes an appeal under subsection (1), the Chief Officer\nshall provide evidence to the Civil Service Appeals Commission to show that\nthe Speaker has acted in an unfair or biased manner, or in a manner which is\ninconsistent with the requirements relating to the decision appealed against.\n21.\nTransition of public officers to staff of the Commission\n21. (1) A person who is appointed or purported to be appointed prior to the date of the\ncommencement of this Act as a public officer of the Parliament shall be deemed\non that date to have been lawfully appointed by the Council.\n\nSection 22\nParliament (Management) Act (2023 Revision)\n\nPage 16\nRevised as at 31st December, 2022\nc\n\n(2) A person who is appointed or purported to be appointed prior to the date of the\ncommencement of this Act to the post of Clerk of the Parliament shall be\ndeemed, on that date, to have been lawfully appointed by the Council.\n(3) After the commencement date of this Act, and subject to subsection (4), a person\nwho, immediately prior to such date was a public officer of the Parliament and\nheld office at that date (including the Chief Officer), may, at that person\u2019s\noption, exercisable in accordance with subsection (4), state whether or not the\nperson wishes to be employed by the Commission.\n(4) The option referred to in subsection (3) is exercisable by \u2014\n(a)\nthe person referred to in that subsection, (other than the Chief Officer),\ngiving notice in writing of the option to the Chief Officer within nine\nmonths of the commencement of this Act; and\n(b) the Chief Officer giving notice in writing of the option to the Speaker\nwithin nine months of the commencement of this Act.\n(5) A person referred to in this section who exercises the option to be employed by\nthe Commission, shall, from one year of the date of commencement of this Act,\nbe employed by the Commission and the employment of that person as a public\nofficer of the Parliament shall for all purposes be deemed to be continuous\nservice in the service of the Commission.\n(6) Where a person referred to in this section exercises the option not to be\nemployed by the Commission, the provisions of the Public Service Management\nAct (2018 Revision) and the Personnel Regulations (2022 Revision) which relate\nto redundancy shall apply to that person.\n22.\nRules regulating Council's internal procedure\n22. The Council may, subject to this Act, make such rules as it thinks fit to regulate its\nown internal procedure.\n23.\nRegulations by Cabinet\n23. (1) The Cabinet, after consultation with the Commission, may make regulations\nconsistent with this Act prescribing anything which by this Act is to be or may\nbe prescribed and generally for the better carrying out of its purposes and\nprovisions.\n(2) Repealed by section 6 of the Parliament (Management) (Amendment) Act, 2022\n[Act 6 of 2022].\n24.\nBinding of the Crown\n24. CONSTITUENCY ALLOWANCE FOR\nMEMBERS OF THE PARLIAMENT; ALLOWANCES FOR THE\nOFFICES OF THE PREMIER AND THE LEADER OF THE OPPOSITION\nAND FOR MEMBERS OF THE PARLIAMENT FOR CAYMAN BRAC\nAND LITTLE CAYMAN\nPART 1\nCONSTITUENCY ASSISTANTS\n1.\nConstituency assistants shall be appointed in accordance with paragraph 4.\n2.\n(1) Each elected Member of the Parliament is entitled to the services of a\nconstituency assistant as follows \u2014\n(a)\nin the case of an elected Member of the Parliament who is a Minister, to\ntwo full time constituency assistants and one part time constituency\nassistant; and\n(b) in the case of other elected Members of Parliament, one full time\nconstituency assistant and one part time constituency assistant.\n(2) For the purposes of this Schedule \u2014\n(a)\na full time constituency assistant is a person who is contracted to work for\nsuch normal hours between 37 \u00bd and 40 hours per week as may be agreed\nand consistent with the Personnel Regulations (2022 Revision); and\n(b) a part time constituency assistant is a person who is contracted to work for\nsuch proportion of the normal hours for a full time constituency assistant\nas may be agreed and consistent with the Personnel Regulations (2022\nRevision).\n3.\nA constituency assistant shall be a contractor of the Commission and shall hold office\npursuant to the terms of a contract for services with the Commission.\n4.\nRemuneration under a constituency assistant\u2019s contract shall include salary and\npension at such rates as may be prescribed by regulations and health benefits similar\nto those provided to public officers under the Public Service Management Act (2018\nRevision).\n\nSection 24\nParliament (Management) Act (2023 Revision)\n\nPage 20\nRevised as at 31st December, 2022\nc\n\n5.\nSubject to paragraph 6, the Chief Officer, acting on the advice of the Member of the\nParliament for an electoral district, shall appoint constituency assistants for that\nelectoral district.\n6.\nThe duties and responsibilities of a constituency assistant shall be specified in the\ncontract for services by the Chief Officer, acting on the advice of the Member of the\nParliament on whose advice the constituency assistant was appointed.\n7.\nThe appointment of a constituency assistant shall cease \u2014\n(a)\non one month\u2019s notice by the constituency assistant, or by the Chief Officer\nacting on the advice of the Member of the Parliament on whose advice the\nappointment was made or for just cause without notice;\n(b) on the date on which the resignation of the constituency assistant takes\neffect;\n(c)\nif the Member of the Parliament who advised the appointment of the\nconstituency assistant ceases to be a Member of the Parliament, other than\nby a dissolution of the Parliament, on the day of the cessation of that\nmembership of Parliament;\n(d) after a dissolution of the Parliament, on nomination day, if the Member\nwho advised the appointment is not nominated for election to the\nParliament for the same electoral district; or\n(e)\nafter a dissolution of the Parliament, on polling day if the Member who\nadvised the appointment is nominated but is not elected to Parliament.\n8.\nA constituency assistant whose employment is terminated by the Chief Officer under\nparagraph 7(a) shall receive a termination allowance as may be prescribed by\nregulations.\n9.\nAny person employed as a constituency assistant immediately before the 5th July,\n2022, the commencement date of the Parliament (Management) (Amendment) Act,\n2022 (Act 6 of 2022), shall be treated for all purposes as if the appointment had been\nmade as provided by this amending Act from the date of the appointment.\n10. For the purposes of this Schedule, the words \u201cthis amending Act\u201d means the\nLegislative Assembly (Management) Act, 2020 (Law 48 of 2020) as amended by the\nParliament (Management) (Amendment) Act, 2022 (Act 6 of 2022).\n\nParliament (Management) Act (2023 Revision)\nSection 24\n\nc\nRevised as at 31st December, 2022\nPage 21\n\nPART 2\nCONSTITUENCY ALLOWANCE FOR MEMBERS OF THE\nPARLIAMENT; and\n(c)\nthe general maintenance of a constituency office.\n(2) The constituency allowance is $5,000 per month for each elected Member of the\nParliament.\nExecutive Allowance for the Premier\n2.\nThe Premier shall receive an executive allowance of $5,000 per month.\nExecutive Allowance for the Leader of the Opposition\n3.\nThe Leader of the Opposition shall receive an executive allowance of $3,500 per\nmonth.\nAllowance for Cayman Brac and Little Cayman Representatives\n4.\n(1) There are two components to the allowance for Cayman Brac and Little Cayman\nRepresentatives and the allowance is $5,000 per month.\n(2) The two components and their corresponding maximum amounts per month are\nas follows \u2014\n(a)\naccommodation - $2,500;
