This Act may be cited as the Animals Act (2024 Revision).\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_2\", \"num\": \"2.\", \"text\": \"Interpretation 2. In this Act \u2014 \u201canimal\u201d includes live mammals, reptiles (other than marine turtles), amphibians, birds, fish, invertebrates and insects; \u201canimal welfare officer\u201d means a person appointed under section 84; \u201cbiological product\u201d means any product derived from a living organism and includes substances used for the treatment or diagnosis of animal disease, and sera, vaccines, antigens, hormones and semen; \u201ccaptive animal\u201d means any animal not being a domestic species of animal which is in captivity, confined or otherwise reduced into possession of control; \u201ccarcass\u201d means the body of any animal and includes any part thereof whether processed or fresh; \u201ccattle\u201d includes bulls, cows, oxen, heifers and calves; \u201cCayman waters\u201d means all the water surrounding the Islands within a distance of twelve nautical miles from the sea-shore, inland waters and the North Sound of Grand Cayman; Animals Act (2024 Revision) \u201cclose season\u201d with respect to any animal or class of animals, means the season of the year prescribed by regulation when such animals are not to be taken or hunted; \u201cCommittee\u201d means the Animal Welfare Advisory Committee established under section 66; \u201cCrown land\u201d means land vested in the Governor and not leased to any person; \u201cDirector\u201d means the Director of the Department of Agriculture and any person authorised by the Director; \u201cdistrainer\u201d means the owner of any land trespassed upon by any cattle, sheep, goat or pig, who seizes and detains such animal and includes any person acting under the authority of such owner; \u201cdomestic animal\u201d means any animal which is naturally tame or is tamed or in the process of being tamed for serving some purpose for the use of mankind; \u201cgame bird\u201d means any bird specified as such in Schedule 1 of the National Conservation Act. 2013 [Law 24 of 2013]; \u201chorses\u201d include mules, hinnies and asses; \u201chunt\u201d means to kill, capture, pursue or wilfully molest by any method or agent any animal and includes any attempt so to do; \u201clivestock\u201d means any domestic animal kept for profit; \u201cmaster\u201d in relation to a vessel, includes the pilot of an aircraft or hovercraft; \u201cMinister\u201d means the minister responsible for the time being for agriculture; \u201cNational Conservation Council\u201d means the National Conservation Council established under section 3 of the National Conservation Act, 2013[Law 24 of 2013]; \u201cnotifiable disease\u201d means African horse sickness, African swine fever, anaplasmosis, anthrax, avian leukosis complex, babesiasis, blue tongue, brucellosis, contagious bovine pleuro-pneumonia, cow pox (variola vaccina), epizootic abortion, epizootic lymphangitis, equine encephalitis (groups A and B), equine infectious anaemia, foot and mouth disease, fowl cholera, fowl pest (salmonella pullorum and gillinarum infections), glanders, haemorrhagic septicemia, infectious laryngotracheitis, Johne\u2019s disease, leptospirosis, melioidosis, psittacosis, rabies, rinderpest, sarcoptic mange of horse, sheep pox (variola ovina), sheep scab (psoroptic mange of sheep), swine erysipelas, swine fever, theileriasis, trichimoniasis, trypanosomiasis (including dourine, mal de caderas, surrah and trypanosoma vivax infections), tuberculosis, tularemia, vesicular stomatitis, vibriosis and such other diseases as the Cabinet may, from time to time by order under section 19, declare to be notifiable diseases within the meaning of this Act; \u201coperating licence\u201d means a licence issued under section 29; Animals Act (2024 Revision) \u201cowner\u201d of an animal includes any person for the time being having control of such animal and the occupant of any dwelling place or farm where such animal is kept; \u201cpet animal\u201d means an animal kept for companionship or amusement; \u201cprescribed\u201d means prescribed by this Act or any regulation; \u201cprotected animal\u201d means every animal specified in Parts 1 and 2 of Schedule 1 of the National Conservation Act. 2013 [Law 24 of 2013]; \u201cpublic place\u201d means any street, road or other place (whether or not enclosed) to which the public have or are permitted to have access whether for payment or otherwise and includes the common parts of a building containing two or more separate buildings; \u201csanctuary\u201d means an animal sanctuary as designated in Schedule 4 of the National Conservation Act. 2013 [Law 24 of 2013]; \u201csell\u201d includes to offer or expose for sale; \u201cspecified town\u201d means any town specified by the Cabinet to be such for the purpose of section 37; \u201cstray\u201d means an animal found in any public place, or on any premises other than the premises on which the animal is being kept or is for the time being allowed to remain, but shall not include any animal that is accompanied by, and under the direct control of, any person who is capable of exercising control over it;. \u201ctake\u201d means to take or capture any animal from its natural habitat, and \u201ctaking\u201d and other cognate expressions shall be construed accordingly; and \u201cvessel\u201d includes ship, boat, carriage, aircraft and hovercraft. PART 2 - Import and Export of Animals\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_3\", \"num\": \"3.\", \"text\": \"Restriction on importation and exportation of animals 3. (1) No animal of any description may be imported directly or indirectly into the Islands from any country outside the Islands or from any one island into any other otherwise than in accordance with this Act. (2) No animal of any description may be exported from the Islands to any country or from one of the Islands to another of the Islands otherwise than in accordance with this Act.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_4\", \"num\": \"4.\", \"text\": \"Import of certain animals from certain areas prohibited 4. Save as specifically permitted by this Act, no animal of any description may be imported into the Islands from any country in Asia, Africa or Central and South America. Animals Act (2024 Revision)\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_5\", \"num\": \"5.\", \"text\": \"No live animal or biological product to be imported or exported save under licence 5. (1) No animal or carcass other than fish caught directly from the sea may be imported into or exported from the Islands save by way of George Town seaport or Owen Roberts Airport and ports of entry in Cayman Brac and Little Cayman under licence from the Director. (2) No biological product may be imported or exported save under licence from the Director.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_6\", \"num\": \"6.\", \"text\": \"Responsibility of masters of vessels and agents 6. (1) No master or agent of any vessel shall permit any animal to be accepted for consignment to the Islands unless satisfied that an import licence in respect of such animal has been issued under this Act. (2) No master or agent of any vessel shall permit any animal to be disembarked from such vessel on arrival at the Islands until such animal has been inspected by the Director.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_7\", \"num\": \"7.\", \"text\": \"Animals unlawfully imported 7. Any animal, biological product or carcass brought into the Islands in contravention of this Act may be ordered to be destroyed or otherwise dealt with as the Director may, in the Director\u2019s discretion, decide.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_8\", \"num\": \"8.\", \"text\": \"Import of dung, etc., prohibited 8. No dung, litter, used animal bedding, blankets, pads, dressings or clothing shall be imported into the Islands, save as may be incidental to the licensed import of an animal.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_9\", \"num\": \"9.\", \"text\": \"Application for a licence to import an animal, etc. 9. (1) An application for a licence to import or export an animal, carcass or biological product of any animal may be made in writing to the Director giving particulars of the animal and of its present whereabouts and the means of transport by which it is proposed to be imported or exported. (2) An application for a licence under subsection (1) shall be accompanied by the prescribed application fee.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_10\", \"num\": \"10.\", \"text\": \"Director may grant or refuse licence 10. (1) Subject to subsection (2), on the receipt of an application for a licence to import or export any animal, carcass or biological product and the prescribed application fee, the Director shall consider the application and either \u2014 (a) may reject the application and notify the applicant accordingly; or Animals Act (2024 Revision) (b) on payment by the applicant of the prescribed licence fee, issue a licence in the prescribed form subject to such conditions, including quarantine, health and husbandry conditions, as the Director may consider desirable. (2) When considering an application for a licence to import a live or viable specimen of an alien or genetically altered animal, the Director, in accordance with any directives issued by the National Conservation Council, shall consult with that Council and take into account any views of the Council before granting any such licence. (3) Prescribed application and licence fees paid in accordance with this section and section 9 are not refundable.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_11\", \"num\": \"11.\", \"text\": \"Cabinet may make regulations 11. (1) The Cabinet may make regulations prohibiting, restricting and generally regulating the import or export of animals, carcasses and biological products generally and of specific animals, prescribing forms of licences and fees payable on the issue of such licences. (2) Where the regulations under subsection (1) relate to the importation of a live or viable specimen of alien or genetically altered animals the Cabinet shall consult with the National Conservation Council prior to making such regulations.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_12\", \"num\": \"12.\", \"text\": \"Cabinet may grant exemptions 12. The Cabinet may grant exemption from section 4 in any particular case.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_13\", \"num\": \"13.\", \"text\": \"Offences: Part 2 13. (1) Subject to subsection (2) a person who contravenes this Part or any regulations made hereunder commits an offence and is liable on summary conviction to a fine of five hundred dollars and to imprisonment for six months. (2) A person who imports a live or viable specimen of an alien or genetically altered animal without a licence commits an offence and is liable on conviction to a fine of five hundred thousand dollars or to imprisonment for a term of four years or to both.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_14\", \"num\": \"14.\", \"text\": \"Powers of constables 14. Any constable having reasonable cause to suspect that any animal which has been imported into the Islands contrary to this Act is being held or concealed in or on any premises may, on obtaining a search warrant for this purpose, at all reasonable times enter and search such premises and take possession of such animal and, pending the outcome of any legal proceedings, dispose of such animal according to the directions of the Director. Animals Act (2024 Revision) PART 3 - Control of Diseases of Animals\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_15\", \"num\": \"15.\", \"text\": \"Persons to report cases of notifiable diseases 15. Every person owning or having in that person\u2019s control any animal which that person has reason to believe is or has recently been affected by a notifiable disease shall report the same to the nearest police station as soon as practicable.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_16\", \"num\": \"16.\", \"text\": \"Right of access by Director to diseased animals 16. Where the Director has reason to believe that any animal affected by or having been exposed to disease is present on or in any holding, farm, apiary or other premises the Director may at any reasonable time enter and inspect such animal.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_17\", \"num\": \"17.\", \"text\": \"Standstill orders 17. (1) Where the Director is of the opinion that any given area is threatened with the spread of any notifiable animal disease the Director may issue a standstill order controlling the movements of persons and animals into, out of and within the said area. Such order shall be valid for three days after the date of publication and may thereafter be renewed by the Cabinet for such further period as to the Cabinet may appear desirable. (2) Where an order under subsection (1) is in force the Director may require such disinfective and disease control measures to be carried out as may be calculated to limit the spread of the disease.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_18\", \"num\": \"18.\", \"text\": \"Destruction of infected animals, etc., and compensation 18. Animals found to be suffering from any notifiable disease shall be destroyed without compensation to the owners, and where animals have, in the opinion of the Director, been exposed to a notifiable disease the Director may order their destruction and, in the latter case, compensation shall be paid to the owners at the market value as assessed by the Director. Any person aggrieved by any decision as to market value arrived at by the Director may, within ten days, appeal to the Cabinet whose decision shall be final.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_19\", \"num\": \"19.\", \"text\": \"Cabinet may make regulations 19. The Cabinet may make regulations varying the list of notifiable diseases and generally for the detection and control of disease in animals.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_20\", \"num\": \"20.\", \"text\": \"Offences: Part 3 20. A person who fails to obey a standstill order, obstructs the Director in carrying out the Director\u2019s duties under this Part or otherwise contravenes this Part or any regulation commits an offence and is liable on summary conviction to a fine of five hundred dollars and to imprisonment for six months. Animals Act (2024 Revision) PART 4 - Improvement of Livestock\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_21\", \"num\": \"21.\", \"text\": \"Cabinet may make regulations for the improvement of livestock 21. The Cabinet may make regulations for regulating and controlling the husbandry, breeding and slaughter of livestock and bringing about the improvement thereof. Such regulations may include the \u2014 (a) establishment of artificial insemination stations and the regulation of the same; (b) inspection and licensing of sires; (c) establishment and maintenance of livestock registers; (d) castration of scrub animals; (e) importation and manufacture of feed and medicines; (f) housing and care of livestock; (g) improvement of pasture; (h) purchase and importation of semen; (i) culling of animals having an excess population; (j) slaughter and dressing of carcasses and the inspection and supervision of slaughterhouses and slaughterpersons; and (k) fees to be charged for services rendered by the Department of Agriculture.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_22\", \"num\": \"22.\", \"text\": \"Importation of semen prohibited except under licence 22. The importation of semen into the Islands otherwise than under licence from the Director is prohibited.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_23\", \"num\": \"23.\", \"text\": \"Offences: Part 4 23. A person who contravenes this Part or any regulation or who obstructs the Director in carrying out the Director\u2019s duties hereunder commits an offence. PART 5 - Licensing of Dogs\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_24\", \"num\": \"24.\", \"text\": \"Dog licences 24. (1) Subject to this section, a person shall not keep a dog over the age of four months unless \u2014 (a) that person is sixteen years of age or older; and (b) that person holds a dog licence for the dog. (2) A dog licence is personal to the person to whom the dog licence is issued and is not transferable. Animals Act (2024 Revision) (3) A person who imports a dog into the Islands is not required to hold a dog licence in respect of that dog if \u2014 (a) before the dog is imported the Director is satisfied that the dog will be exported from the Islands within the period of thirty days from the date of the importation; and (b) the dog is exported from the Islands within that period. (4) A person to whom a licence under section 29 has been issued is not required to hold a licence for a dog under the age of four months which was born and is being kept at premises to which the licence relates. (5) A person is not required to obtain a licence for a dog which is being kept by a society established for the purpose of caring for animals. (6) Subject to subsections (3), (4) and (5), a person who keeps a dog contrary to subsection (1) commits an offence and is liable on summary conviction to a fine of five hundred dollars.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_25\", \"num\": \"25.\", \"text\": \"Issue of licences 25. (1) The Director shall, at such place as the Director shall authorise, issue dog licences and identification tags. (2) A dog licence shall be for a period of one year and may be renewed in accordance with this section. (3) An application for a dog licence or a renewal of a dog licence shall be in such form as the Director shall determine and shall contain the name and the address of the applicant and, if the dog is not kept at that address, the address at which it is kept. (4) A dog licence shall be in a form determined by the Director but shall be numbered and accompanied by an identification tag which shall bear the same number as that on the licence and which shall be suitable for attachment to a dog\u2019s collar. (5) If the Director is satisfied that a dog\u2019s identification tag has been lost the Director may, on production of the dog licence and the appropriate fee, issue a new identification tag in respect of the dog. (6) The Director shall keep registers and records of dogs, dog keepers and dog licences as the Minister shall direct.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_26\", \"num\": \"26.\", \"text\": \"Dog found without a collar 26. Every person keeping a dog shall ensure that such dog while in any highway or other public place is on a lead and is wearing a collar with an identification tag bearing the licence number attached thereto. Animals Act (2024 Revision)\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_27\", \"num\": \"27.\", \"text\": \"Identity of person keeping dog 27. A person \u2014 (a) in whose custody, charge or possession, or in whose house a dog is found or is seen; or (b) in whose name a dog licence is issued, is deemed to be the person who keeps such dog unless the contrary is proved.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_28\", \"num\": \"28.\", \"text\": \"Regulations 28. The Cabinet may make regulations prescribing the forms of licence required under this Part, the fees for such licences, the form of identification tag to be issued to persons who have taken out a dog licence and the fees for such identification tags. Part 6 \u2013 Licensed Operations\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_29\", \"num\": \"29.\", \"text\": \"Licences for professional operations 29. (1) A person shall not \u2014 (a) keep pet animals belonging to another person for which a charge is made; (b) breed pet animals; (c) sell a pet animal or act as broker in relation to the sale or transfer of animals; (d) train or keep animals for guard duties other than the guarding of that person\u2019s own premises; or (e) keep animals for public display, unless that person holds an operating licence. (2) A person intending to carry on an activity specified in subsection (1) shall apply to the Director for an operating licence. (3) The Director may, subject to this section, issue an operating licence under this section to a person who applies to the Director under subsection (2) (\u201can applicant\u201d). (4) The Director shall not issue an operating licence unless the Director is satisfied \u2014 (a) that the applicant is a suitable person to hold such a licence for the activity in question; and (b) that the premises where the activity will be carried on are suitable. (5) An operating licence \u2014 (a) shall state the name of the licensee; and Animals Act (2024 Revision) (b) shall identify the premises to which the licence relates. (6) Operating licences are annual and subject to the payment of the prescribed fee. (7) A person who contravenes subsection (1) commits an offence and is liable on conviction to a fine of ten thousand dollars.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_30\", \"num\": \"30.\", \"text\": \"Cancellation of licence under section 29 30. Subject to section 31, if the Director is satisfied \u2014 (a) that a person to whom an operating licence has been issued is no longer a suitable person to hold such licence; or (b) that the premises to which an operating licence relates are no longer suitable for the activity for which they are being used, the Director may cancel the licence.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_31\", \"num\": \"31.\", \"text\": \"Appeals 31. (1) A person aggrieved by a decision of the Director not to issue or to cancel an operating licence may appeal against the decision to a summary court whose decision on appeal shall be final. (2) The Rules Committee of the Grand Court may make rules prescribing the procedure for appeals under subsection (1).\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_32\", \"num\": \"32.\", \"text\": \"Regulations 32. The Cabinet may make regulations prescribing the form of licences required under this Part. PART 7 - Nuisances by, and Control of, Animals\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_33\", \"num\": \"33.\", \"text\": \"Responsibility for trespass by animals 33. The owner of any livestock, other than honey bees, shall take proper and effective measures to prevent them from trespassing on land in the occupation or ownership of another, and from straying on to the public highway and, subject to sections 34 and 35, the owner of such animals shall be responsible in damages for any injury or damage caused or done by the animal when so trespassing or straying.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_34\", \"num\": \"34.\", \"text\": \"Exception in respect of land abutting on a public road 34. (1) No person in occupation of land abutting on a public road shall be entitled to recover any damages in respect of any trespass on such land by any livestock while the same are being driven lawfully on such road, under proper care and control, unless such land is secured by a fence along such road sufficient to keep out ordinary livestock of the class of animals committing the trespass. Animals Act (2024 Revision) (2) The onus of showing that any livestock were being so driven as aforesaid shall be on the owner of the livestock.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_35\", \"num\": \"35.\", \"text\": \"Liability for allowing trespass by livestock 35. A person who leaves open any properly constructed gate in working order or injures any fence or other contrivance provided for the purpose of confining any livestock, thereby allowing such livestock to trespass off the land on which the same is confined shall be liable for all consequential damage caused by the trespassing of such livestock.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_36\", \"num\": \"36.\", \"text\": \"Penalty for allowing animals to cause danger 36. A person who, having the possession or ownership of an animal, permits it to stray on the highway commits an offence and is liable on summary conviction to a fine of five hundred dollars.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_37\", \"num\": \"37.\", \"text\": \"Swine not to be kept in specified towns 37. It is unlawful to keep swine in any specified town, and any swine being found kept in any specified town are liable to be forfeited and destroyed at the direction of the Director who shall arrange for the disposal of such swine or the carcasses thereof at the Director\u2019s discretion.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_38\", \"num\": \"38.\", \"text\": \"Power of constable to take swine into possession 38. Any constable may, upon view, take up any swine which the constable shall find in any specified town, and may enter any building in any such town where that constable has reasonable cause to believe that swine are being kept and take and seize any swine there found.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_39\", \"num\": \"39.\", \"text\": \"Civil liability of dog owner 39. The owner of every dog shall be liable in damages for injuries done to any person, or any cattle or sheep, by that owner\u2019s dog, and it shall not be necessary for the party seeking such damages to show a previous mischievous propensity in the dog, or the owner\u2019s knowledge of such propensity or that the injury was attributable to neglect on the part of such owner. Such damages shall be recoverable in any court of competent jurisdiction.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_40\", \"num\": \"40.\", \"text\": \"Keeping dogs under proper control 40. (1) If a dog is dangerously out of control in a public place, the owner and, if different, the person for the time being in charge of the dog, commits an offence. (2) If a dog is dangerously out of control in a public place and while so out of control injures any person, the owner and, if different, the person for the time being in control of the dog, commits an aggravated offence. Animals Act (2024 Revision) (3) In proceedings for an offence under subsection (1) or (2) against a person who is the owner of a dog but who was not, at the material time, in charge of it, it shall be a defence for the accused to prove that the dog was, at the material time, in the charge of a person whom the accused reasonably believed to be a fit and proper person to be in charge of it. (4) If the owner or, if different, the person for the time being in charge of a dog, allows it to enter a place which is not a public place but where it is not permitted to be and while it is there it injures any person or there are grounds for reasonable apprehension that it will do so, that owner, or person for the time being in charge, commits an offence, or, if the dog injures any person, an aggravated offence under this section. (5) A person who commits an offence under subsection (1), (2) or (4) other than an aggravated offence is liable on summary conviction to imprisonment for six months and to a fine of four thousand dollars; and a person who commits an aggravated offence under any of those subsections is liable \u2014 (a) on summary conviction, to a fine of four thousand dollars or to imprisonment for six months; or (b) on conviction on indictment to a fine and to imprisonment for two years.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_41\", \"num\": \"41.\", \"text\": \"Power of court with respect to dangerous dogs 41. (1) Where \u2014 (a) a person has been convicted of an offence against section 40; or (b) it is made to appear to a summary court that a dog has been dangerously out of control on more than one occasion or is likely to spread disease to any person or animal, then the court may order either \u2014 (i) that the dog be handed over to the Department of Agriculture for the immediate destruction of the dog by the Department; or (ii) that the person who is keeping the dog observe such requirements in relation to the future keeping of the dog as the court thinks fit to specify in the order. (2) A person who fails to comply with a requirement imposed upon that person by an order made under subsection (1)(b)(ii) commits an offence. (3) If a court which has convicted a person of an offence against subsection (2) is not satisfied that the dog can or will be properly controlled in the future, the court may, in addition to punishing that person for the offence, order the destruction of the dog. (4) A person who obstructs any officer of the court so that such officer is prevented from carrying out an order of the court made under subsection (1)(b)(i) shall pay Animals Act (2024 Revision) a fine of forty dollars in respect of each day the carrying out of the order remains in abeyance through that person\u2019s default.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_42\", \"num\": \"42.\", \"text\": \"Muzzles and leads 42. In this Act \u2014 (a) references to a dog being muzzled are to its being securely fitted with a muzzle sufficient to prevent it biting any person; and (b) references to its being kept on a lead are to its being securely held on a lead by a person who is not less than sixteen years old.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_43\", \"num\": \"43.\", \"text\": \"Fouling by dogs 43. (1) If a dog defecates at any time on any public place and a person who is in charge of the dog at that time fails to remove the faeces from the public place forthwith, that person commits an offence unless that person has a reasonable excuse for failing to do so. (2) A person who commits an offence under subsection (1) is liable on summary conviction to a fine of two thousand dollars. (3) In this section \u2014 (a) placing the faeces in a receptacle which is provided for the disposal of waste shall be a sufficient removal from the public place; and (b) being unaware of the defecation (whether by reason of not being in the vicinity or otherwise), or not having a device for or other suitable means of removing the faeces, shall not be a reasonable excuse for failing to remove the faeces.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_44\", \"num\": \"44.\", \"text\": \"Dogs dangerously out of control 44. A dog shall be regarded as being dangerously out of control on any occasion on which there are grounds for reasonable apprehension that it will injure any person or another domestic animal, whether or not it does so, but references to a dog injuring a person or animal or there being grounds for reasonable apprehension that it will do so do not include references to any case in which the dog is being used for lawful purposes by a constable, a public officer or a security guard in uniform while carrying out that person\u2019s duties.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_45\", \"num\": \"45.\", \"text\": \"Prohibited dogs 45. (1) This section applies to any dog of a breed specified, from time to time, for the purposes of this section by regulations made by the Cabinet after consultation with the Director. (2) No person shall \u2014 (a) breed, or breed from, a dog to which this section applies; Animals Act (2024 Revision) (b) sell or exchange such a dog, or offer, advertise or expose such a dog for sale or exchange; (c) make or offer to make a gift of such a dog, or advertise or expose such a dog as a gift; (d) allow such a dog of which that person is the owner or of which that person is for the time being in charge in a public place without being muzzled and kept on a lead; or (e) abandon such a dog of which that person is the owner or, being the owner or for the time being in charge of such a dog, allow it to stray. (3) After such day as the Cabinet may by notice published in the Gazette appoint for the purposes of this section, no person shall have any dog to which this section applies in that person\u2019s possession or custody except in pursuance of the power of seizure conferred by this Act or unless such dog is registered pursuant to regulations made by the Cabinet. (4) Subsection (2)(b) and (c) shall not make unlawful anything done with a view to the dog in question being removed from the Islands before the day appointed under subsection (3). (5) The Cabinet may, by regulations, provide that the prohibition in subsection (2) shall not apply in such cases and subject to compliance with such conditions as are specified in the regulations, and any such provision may take the form of a scheme of exemption containing such arrangements (including provision for the payment of charges or fees) as it thinks appropriate. (6) A person who contravenes this section commits an offence and is liable on summary conviction to a fine of four thousand dollars and to imprisonment for six months, except that a person who publishes an advertisement in contravention of subsection (2)(b) or (c) \u2014 (a) shall not, on being convicted, be liable to imprisonment if that person shows that that person published the advertisement to the order of someone else and did not themselves devise it; or (b) shall not be convicted if, in addition, that person shows that that person did not know and had no reasonable cause to suspect that it related to a dog to which this section applies. (7) Regulations under subsection (1) adding dogs of any breed to those to which this section applies may provide that subsections (3) and (4) shall apply in relation to those dogs with the substitution, for the day appointed under subsection (3), of a later day. (8) Where a court finds a person guilty of an offence under this section, it may also, if it thinks fit, make an order disqualifying the owner for having custody of a dog for such period as is specified in the order. Animals Act (2024 Revision) (9) A person who is disqualified from having custody of an animal by virtue of an order made under subsection (8) may, at any time after the end of the period of one year beginning with the date of the order, apply to the court for a direction terminating the disqualification. (10) On an application under subsection (9) the court may \u2014 (a) having regard to the applicant\u2019s character, the applicant\u2019s conduct since the disqualification was imposed and any other circumstances of the case, grant or refuse the application; and (b) order the applicant to pay all or any part of the costs of the application, and, where an application in respect of the order is refused, no further application in respect of that order shall be made before the end of the period of one year beginning with the date of the refusal. (11) An officer appointed by the Director may inspect any premises where a dog to which this section applies is being held and any person so appointed under this section may, on producing that person\u2019s authority if so required, enter any such premises at all reasonable times and inspect them and any dog found there for the purpose of ascertaining that the provisions of this Act have been complied with. (12) A person who wilfully obstructs or delays a person in the exercise of that person\u2019s power of entry or inspection under this section commits an offence.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_46\", \"num\": \"46.\", \"text\": \"Ferocious dogs 46. A person who suffers any ferocious dog to be at large or who sets on or urges any dog to attack, worry or put in fear any person or domestic or protected animal commits an offence and is liable on summary conviction to a fine of five hundred dollars and to imprisonment for six months.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_47\", \"num\": \"47.\", \"text\": \"Stray dogs 47. A constable may seize and detain any dog found in a highway or place of public resort which the constable has reason to believe is a stray and, if the owner can be traced, shall give notice of seizure to the said owner to whom the dog shall be restored upon such owner paying all expenses incurred by its detention.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_48\", \"num\": \"48.\", \"text\": \"Disposal of seized dogs 48. Dogs seized under section 47 shall be retained at the police station or in a dog pound for a period of seven days if unclaimed by the owner, after which they may be sold or handed over to the Department of Agriculture for destruction. The proceeds of sale of stray dogs shall be appropriated to the expenses of the maintenance of the dog pound. (2) If the finder retains the dog in the finder\u2019s possession the finder shall hand the dog over to any person who can show themselves to be the owner thereof and makes claim thereto within fifteen days. When an animal is impounded, the poundkeeper, if the poundkeeper knows the owner, shall serve notice in writing on the owner, and for so doing shall be entitled to the prescribed fee in that behalf.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_52\", \"num\": \"52.\", \"text\": \"Poundkeeper to supply food and water 52. (1) The poundkeeper shall supply every impounded animal with food and water on the following scale \u2014 (a) cattle, twenty pounds of grass and five gallons of water daily; (b) sheep and goats, six pounds of grass and five gallons of water daily; (c) other animals, according to the rules of good animal husbandry. (2) The above quantities shall be divided into morning and evening feeds and waterings, there being an interval of not less than eight hours between morning and evening feeds and waterings.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_53\", \"num\": \"53.\", \"text\": \"Pound fees to be paid by owner prior to recovery of an animal 53. Animals Act (2024 Revision)\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_54\", \"num\": \"54.\", \"text\": \"Poundkeeper to keep records 54. The poundkeeper shall keep a written record of all animals impounded, stating the name and address of the distrainer or finder, the place, date and time when the animal was found, the date and time when it was impounded and the description of the animal, and such record shall be open for the inspection of the public at all reasonable times.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_55\", \"num\": \"55.\", \"text\": \"Entire animals to be kept separately 55. Entire animals which are impounded shall be kept separately from other impounded animals.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_56\", \"num\": \"56.\", \"text\": \"Fees to be accounted for 56. Poundkeepers shall account to the Treasury for fees received in such manner as may be prescribed and shall, by way of remuneration, receive such proportion of such fees as may, from time to time, be prescribed.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_57\", \"num\": \"57.\", \"text\": \"Impounding 57. The lawful occupier of any land may seize any animal trespassing thereon and may impound the same as the distrainer thereof. The distrainer shall, with all reasonable dispatch, convey the same to the nearest pound and the poundkeeper shall, at any time between 6 a.m. and 6 p.m., receive the said animal into the pound.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_58\", \"num\": \"58.\", \"text\": \"Distrainer entitled to seizure fee 58. The distrainer shall be entitled to receive a seizure fee in accordance with the prescribed scale \u2014 (a) from the owner of the animal, if tendered before the delivery thereof to the poundkeeper; or (b) from the poundkeeper, after receipt by the poundkeeper of the fee.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_59\", \"num\": \"59.\", \"text\": \"Distrainer to care for animals during detention by the distrainer 59. A distrainer shall properly water, feed and care for any animal while it is detained by the distrainer and shall be liable in damages for any neglect of such animal. Where such animal appears to be suffering from any notifiable disease, the distrainer shall report the matter to the nearest police station without delay.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_60\", \"num\": \"60.\", \"text\": \"Enticing animal to trespass is an offence 60. Any person who drives, leads or entices any animal into any place with intent to impound or procure the impounding of the same commits an offence.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_61\", \"num\": \"61.\", \"text\": \"Rescuing is an offence 61. Every person who rescues or attempts to rescue any animal seized or impounded under this Act commits an offence. Animals Act (2024 Revision)\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_62\", \"num\": \"62.\", \"text\": \"Owner\u2019s right to distrained animal 62. The owner of any animal distrained, on payment of the prescribed fee before any animal is sold under section 63, is entitled to recover such animal.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_63\", \"num\": \"63.\", \"text\": \"Sale of unclaimed impounded animals 63. (1) Where any animal has been impounded for four days and upwards and no person has claimed the same under section 62, the poundkeeper shall put up the same for sale by public auction and shall sell and deliver the same to the best bidder for ready money after having received the price thereof and, if the price is not paid, the poundkeeper may again put up the animal for sale. (2) Public notice of every sale under subsection (1) shall be given by publication in a local daily newspaper at least one clear day before the day of the sale. (3) It shall not be lawful for the poundkeeper or the owner of the animal to purchase any animal sold as aforesaid. (4) The proceeds of sale shall be paid to the Treasury for the account of the general revenue. (5) Notwithstanding any irregularity prior to the sale, the purchaser at such sale shall have good and valid title against all comers.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_64\", \"num\": \"64.\", \"text\": \"Regulations 64. The Cabinet may, from time to time, make regulations prescribing fees payable under this Act, designating specified towns and generally for the implementation of this Act.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_65\", \"num\": \"65.\", \"text\": \"Riding animals in public places 65. (1) The Cabinet may, by Order, prohibit the riding or driving of any animal in any public place either absolutely or at such times or subject to such conditions as are specified in the Order. (2) A person who contravenes an Order made under subsection (1) commits an offence and is liable on summary conviction to a fine of five hundred dollars and to imprisonment for six months. Part 8 - Animal Welfare Advisory Committee\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_66\", \"num\": \"66.\", \"text\": \"Animal Welfare Advisory Committee 66. (1) There is established an Animal Welfare Advisory Committee for the purposes set out in this Act. (2) The Committee consists of \u2014 (a) the Director or the Director\u2019s designate who shall be chairperson; and Animals Act (2024 Revision) (b) five other members appointed by the Minister subject to such terms and conditions as the Minister may determine and who shall be selected as follows \u2014 (i) one member from the Cayman Humane Society; (ii) one member from the Cayman Horse Association; (iii) one member from the Agricultural Society; (iv) one member from the Royal Cayman Islands Police Force; and (v) one member from the general public who has demonstrated an interest in animal welfare.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_67\", \"num\": \"67.\", \"text\": \"Role of Committee 67. The Committee shall be responsible for \u2014 (a) advising the Ministry on the policy matters relating to the care of animals in the Islands; (b) educating the public on the care of animals; (c) making recommendations on reports submitted by the animal welfare officer; and (d) such other duties as the Minister may, from time to time, determine.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_68\", \"num\": \"68.\", \"text\": \"Disqualification of members 68. (1) The Minister shall terminate the appointment of any member who \u2014 (a) resigns that member\u2019s office; (b) commits serious misconduct in relation to that member\u2019s duties; (c) is absent, without leave of the chairperson of the Committee, from three consecutive meetings of the Committee; or (d) fails to comply with that member\u2019s obligations under this Act. (2) The Minister, at the Minister\u2019s discretion, may terminate the appointment of any member and select a new member in accordance with the requirements set out in section 66(2).\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_69\", \"num\": \"69.\", \"text\": \"Meetings and decisions of Committee 69. (1) The chairperson of the Committee shall summon regular meetings of the Committee as often as may be required, but not less frequently than once in two months. (2) At every meeting of the Committee, a quorum shall consist of three members, and decisions shall be adopted by a simple majority of the votes of the members present and voting except that in the case of an equality of votes the chairperson shall, in addition, have a casting vote. Animals Act (2024 Revision) (3) The Committee may act notwithstanding that a vacancy exists among the members. PART 9 - Protection of Animals and Wild Life\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_70\", \"num\": \"70.\", \"text\": \"Cruelty to animals an offence 70. (1) A person who \u2014 (a) beats, ill-treats, over-rides, over-drives, overloads, tortures, infuriates or terrifies an animal or causes or procures, or, being the owner, permits any animal to be so used; (b) by wantonly or unreasonably doing or omitting to do any act, or causing or procuring the commission or omission of any act, causes any unnecessary suffering or, being the owner, permits any unnecessary suffering to be so caused to any animal; (c) works, or causes to be worked, any domestic animal in such a condition as to be unfit for work, whether from emaciation, or from any gall, sore or otherwise, and whether or not that condition is caused by disease or deficient feeding; (d) wilfully, without any reasonable cause or excuse, administers or causes or procures, or, being the owner, permits, such administration of, any poisonous or injurious drug or substance to any animal, or wilfully, without any reasonable cause or excuse, causes any such substance to be taken by any animal; (e) subjects, causes or procures, or, being the owner permits, to be subjected, any animal to any operation which is performed without due care and humanity; or (f) tethers, confines or keeps any animal on a lead under such conditions or in such manner as to cause that animal unnecessary suffering, commits an offence of cruelty and is liable on summary conviction to a fine of four thousand dollars and to imprisonment for one year. (2) A person who, being the owner or having charge or control of any animal, without reasonable cause or excuse, abandons it, whether permanently or not, in circumstances likely to cause the animal any unnecessary suffering or causes or procures or, being the owner, permits it to be so abandoned, commits an offence of cruelty and is liable on conviction to a fine of four thousand dollars and to imprisonment for one year. (3) The owner of an animal who leaves an animal on premises shall ensure that there is a person on the premises or a person who will visit the premises to maintain that animal, and that the animal \u2014 Animals Act (2024 Revision) (a) has access to drinking water and food; (b) has access to accommodation which is suitable as regards drainage, size, cleanliness and ventilation; (c) is able to move freely; and (d) has reasonable shelter against the sun and rain. (4) An owner of an animal who contravenes subsection (3) commits an offence of cruelty and is liable on summary conviction to a fine of four thousand dollars and to imprisonment for one year. (5) For the purposes of subsection (2), an owner shall be considered to have permitted cruelty in relation to an animal within the meaning of this Act if the owner fails to exercise reasonable care and supervision in respect of the care and protection of the animal. (6) A person who \u2014 (a) sells, or offers or exposes for sale, or gives away, or causes or procures any person to sell or offer or expose for sale or give away, or knowingly be party to the sale or offering or exposing for sale or giving away of any grain or seed which has been rendered poisonous except for bona fide use in agriculture; or (b) knowingly puts or places, or causes any person to put or place, or knowingly be party to the putting or placing, in or upon any land or building of any poison, or any fluid or edible matter (not being sown seed or grain) which has been rendered poisonous, commits an offence of cruelty and is liable on summary conviction to a fine of four thousand dollars and to imprisonment for one year. (7) In any proceedings relating to an offence under subsection (6), it shall be a defence of an accused that the poison was placed for the purpose of destroying insects and other invertebrates, rats, mice or other small ground vermin where such is found to be necessary in the interests of public health, public safety or agriculture, or the preservation of other animals, domestic or wild, or for the purpose of manuring the land, and that the accused took all necessary precautions to prevent injury to any other animal or to any person. (8) The Director or a person authorised by the Director, may use any prescribed poison to destroy any animal on any public or private land where it is necessary, in the opinion of the Director, in the interests of public health, public safety or agriculture, or to preserve other domestic or wild animals and, in using such poison, the Director or the person authorised by the Director shall use all necessary precautions to prevent injury to any other animal or to any person. (9) The Director shall, from time to time, issue guidance as to the manner in which an animal, while restrained by a chain or other means, may be able to move freely. Animals Act (2024 Revision)\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_71\", \"num\": \"71.\", \"text\": \"Bull-baiting, etc. 71. A person who \u2014 (a) in any manner encourages, aids or assists at the fighting or baiting of any bull, dog, cock or any other kind of animal; (b) keeps, uses or acts in the management of any such animal; (c) being the owner or occupier of any place or premises, permits such place or premises to be used for the purpose of fighting or baiting any such animal; or (d) receives money for the admission of any person to any place or premises kept or used for the purpose of fighting or baiting of any such animal, commits an offence.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_72\", \"num\": \"72.\", \"text\": \"Causing avoidable pain or suffering to any animal 72. A person who conveys, carries or places in or upon any cart or vehicle, or upon any vessel or boat, any animal in such a manner or position as to subject that animal to avoidable or unnecessary pain or suffering, commits an offence.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_73\", \"num\": \"73.\", \"text\": \"Using or employing animals brought to be destroyed 73. A person who uses or employs, or permits to be used or employed, in any manner of work, any animal brought or delivered to that person for the purpose of being destroyed, and a person who is found employing or using such an animal, commits an offence.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_74\", \"num\": \"74.\", \"text\": \"Causing unnecessary suffering in killing an animal 74. A person who, in killing any animal, wilfully or carelessly causes unnecessary suffering to such animal commits an offence.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_75\", \"num\": \"75.\", \"text\": \"Docking or nicking the tail of any horse, etc. 75. A person who wilfully docks or nicks the tail of any horse, mule, hinny or similar animal commits an offence.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_76\", \"num\": \"76.\", \"text\": \"Destruction of an injured animal 76. (1) Where any offence appears to have been committed under sections 70 to 73, it shall be lawful for the Director or any constable to seize and take before a court the animal in relation to which the offence is alleged to have been committed, whether or not any person alleged to have committed the offence is held in custody, and the court may make such order as to the care or disposal of the animal as may be deemed to be appropriate, including an order for the destruction of the animal. (2) Where an order has been made for the destruction of an animal under subsection (1), no compensation shall be payable to the owner of the animal. Animals Act (2024 Revision) (3) Where any constable finds any animal so severely injured or in such state of health that it cannot, without undue suffering, be moved the constable may (with the consent of the owner if the animal is a domestic animal) destroy the said animal or cause it to be destroyed. (4) Where, for the purpose of subsection (3), the owner cannot be found or refuses their consent, the constable may act on the certificate of a medical officer, a veterinary officer, the Director or a Justice of the Peace.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_77\", \"num\": \"77.\", \"text\": \"Penalties for offences under sections 70 to 75 77. (1) A person who commits an offence contrary to sections 70 to 75 is liable on summary conviction to a fine of five hundred dollars and to imprisonment for six months. (2) A person who is convicted under subsection (1) may, in addition to the penalties prescribed therein, be ordered to pay the expenses incurred in the care, maintenance, destruction and removal of the animal or the carcass thereof. (3) If the owner of any animal commits the offence of cruelty to the animal within the meaning of this Act, the court, upon that owner\u2019s conviction, may, if it thinks fit, in addition to any other punishment, deprive the convicted person of the ownership of the animal and disqualify that person from having custody of any animal for such period as is specified in the order. (4) No order shall be made under subsection (3), unless it is shown by evidence as to a previous conviction, or as to the character of the owner, or otherwise, that the animal, if left with the owner, is likely to be exposed to further cruelty. (5) A person who is disqualified from having custody of an animal by virtue of an order made under subsection (3) may, at any time after the end of the period of one year beginning with the date of the order, apply to the court for a direction terminating the disqualification. (1) An animal welfare officer shall, for the purpose of performing the animal welfare officer\u2019s duties under this Act, have all the rights and immunities of constables acting generally in the ordinary course of their duty, and every constable shall, for the purpose of enforcing this Act, have all the powers of an animal welfare officer. (2) The duties of an animal welfare officer shall include \u2014 (a) preventing cruelty or suffering to animals; (b) capturing and detaining any stray or vicious animals; (c) protecting game animals, ensuring the preservation of protected animals and supervising the closed seasons; (d) upon the receipt of a written complaint from the Director, the Committee or any named member of the public, entering and searching any premises to ensure that the provisions of this Act are not being contravened; (e) where the animal welfare finds a person is in contravention of this Act, notifying such person in writing of the possibility of prosecution; (f) collecting evidence, taking photographs and writing reports to be submitted to the Ministry for use in any criminal proceedings under the Law; and (g) testifying in court in any proceedings under this Act. Animals Act (2024 Revision) (3) Each animal welfare officer shall be provided by the Ministry with a certificate of that animal welfare officer\u2019s appointment as an animal welfare officer signed by the Minister and bearing a photograph of the animal welfare officer. (4) An animal welfare officer shall, if requested to do so, produce that certificate for inspection to any person in relation to whom the animal welfare officer is about to exercise, is exercising or has exercised a power under this Act. (5) A certificate appearing to have been provided under subsection (3) is, without proof of the signature of the person who signed it or that person\u2019s authority to sign it, evidence of the appointment to which the certificate appears to relate. (6) An animal welfare officer may apprehend without warrant any person who commits or attempts to commit an arrestable offence in that animal welfare officer\u2019s view or whom the animal welfare officer reasonably suspects to have committed an arrestable offence. (7) An animal welfare officer may, in any public place, on any Crown lands, search any person whom the animal welfare officer has reasonable cause to suspect of having contravened this Act or any regulation, and may stop and search any vehicle, boat or other conveyance in or upon which the animal welfare officer has cause to suspect that there is any animal in respect of which any offence against this Act or any regulation has been committed or in or upon which the animal welfare officer has reasonable cause to suspect that there is any gun, catapult or any other weapon or trap used in the commission of any such offence. (8) Where a person having charge of a vehicle, boat or other conveyance or animal is apprehended by an animal welfare officer or a constable under this Act, it shall be lawful for that animal welfare officer, constable or any other constable to take charge of the vehicle, boat, or other conveyance or animal, and to deposit the vehicle, boat or other conveyance or animal in some place of safe custody until the termination of any proceedings relating to the animal or until the court makes an order as to the disposal of the vehicle or animal. (9) The reasonable costs of a detention under subsection (8), including the reasonable cost of veterinary treatment where such treatment is required, shall, in the event of a conviction in respect of the animal, be recoverable from the owner as a civil debt, or, where the owner themselves is convicted, shall be part of the costs of the case.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_86\", \"num\": \"86.\", \"text\": \"Regulations 86. 2023\nPage 7\n\nCAYMAN ISLANDS\n\nANIMALS ACT\n(2024 Revision)\n\nPART 1 - Preliminary\n1.\nShort title\n1.\nThis Act may be cited as the Animals Act (2024 Revision).\n2.\nInterpretation\n2.\nIn this Act \u2014\n\u201canimal\u201d includes live mammals, reptiles (other than marine turtles),\namphibians, birds, fish, invertebrates and insects;\n\u201canimal welfare officer\u201d means a person appointed under section 84;\n\u201cbiological product\u201d means any product derived from a living organism and\nincludes substances used for the treatment or diagnosis of animal disease, and\nsera, vaccines, antigens, hormones and semen;\n\u201ccaptive animal\u201d means any animal not being a domestic species of animal\nwhich is in captivity, confined or otherwise reduced into possession of control;\n\u201ccarcass\u201d means the body of any animal and includes any part thereof whether\nprocessed or fresh;\n\u201ccattle\u201d includes bulls, cows, oxen, heifers and calves;\n\u201cCayman waters\u201d means all the water surrounding the Islands within a distance\nof twelve nautical miles from the sea-shore, inland waters and the North Sound\nof Grand Cayman;\n\nSection 2\nAnimals Act (2024 Revision)\n\nPage 8\nRevised as at 31st December, 2023\nc\n\n\u201cclose season\u201d with respect to any animal or class of animals, means the season\nof the year prescribed by regulation when such animals are not to be taken or\nhunted;\n\u201cCommittee\u201d means the Animal Welfare Advisory Committee established\nunder section 66;\n\u201cCrown land\u201d means land vested in the Governor and not leased to any person;\n\u201cDirector\u201d means the Director of the Department of Agriculture and any person\nauthorised by the Director;\n\u201cdistrainer\u201d means the owner of any land trespassed upon by any cattle, sheep,\ngoat or pig, who seizes and detains such animal and includes any person acting\nunder the authority of such owner;\n\u201cdomestic animal\u201d means any animal which is naturally tame or is tamed or in\nthe process of being tamed for serving some purpose for the use of mankind;\n\u201cgame bird\u201d means any bird specified as such in Schedule 1 of the National\nConservation Act. 2013 [Law 24 of 2013];\n\u201chorses\u201d include mules, hinnies and asses;\n\u201chunt\u201d means to kill, capture, pursue or wilfully molest by any method or agent\nany animal and includes any attempt so to do;\n\u201clivestock\u201d means any domestic animal kept for profit;\n\u201cmaster\u201d in relation to a vessel, includes the pilot of an aircraft or hovercraft;\n\u201cMinister\u201d means the minister responsible for the time being for agriculture;\n\u201cNational Conservation Council\u201d means the National Conservation Council\nestablished under section 3 of the National Conservation Act, 2013[Law 24 of\n2013];\n\u201cnotifiable disease\u201d means African horse sickness, African swine fever,\nanaplasmosis, anthrax, avian leukosis complex, babesiasis, blue tongue,\nbrucellosis, contagious bovine pleuro-pneumonia, cow pox (variola vaccina),\nepizootic abortion, epizootic lymphangitis, equine encephalitis (groups A and\nB), equine infectious anaemia, foot and mouth disease, fowl cholera, fowl pest\n(salmonella pullorum and gillinarum infections), glanders, haemorrhagic\nsepticemia, infectious laryngotracheitis, Johne\u2019s disease, leptospirosis,\nmelioidosis, psittacosis, rabies, rinderpest, sarcoptic mange of horse, sheep pox\n(variola ovina), sheep scab (psoroptic mange of sheep), swine erysipelas, swine\nfever, theileriasis, trichimoniasis, trypanosomiasis (including dourine, mal de\ncaderas, surrah and trypanosoma vivax infections), tuberculosis, tularemia,\nvesicular stomatitis, vibriosis and such other diseases as the Cabinet may, from\ntime to time by order under section 19, declare to be notifiable diseases within\nthe meaning of this Act;\n\u201coperating licence\u201d means a licence issued under section 29;\n\nAnimals Act (2024 Revision)\nSection 3\n\nc\nRevised as at 31st December, 2023\nPage 9\n\n\u201cowner\u201d of an animal includes any person for the time being having control of\nsuch animal and the occupant of any dwelling place or farm where such animal\nis kept;\n\u201cpet animal\u201d means an animal kept for companionship or amusement;\n\u201cprescribed\u201d means prescribed by this Act or any regulation;\n\u201cprotected animal\u201d means every animal specified in Parts 1 and 2 of Schedule\n1 of the National Conservation Act. 2013 [Law 24 of 2013];\n\u201cpublic place\u201d means any street, road or other place (whether or not enclosed)\nto which the public have or are permitted to have access whether for payment\nor otherwise and includes the common parts of a building containing two or\nmore separate buildings;\n\u201csanctuary\u201d means an animal sanctuary as designated in Schedule 4 of the\nNational Conservation Act. 2013 [Law 24 of 2013];\n\u201csell\u201d includes to offer or expose for sale;\n\u201cspecified town\u201d means any town specified by the Cabinet to be such for the\npurpose of section 37;\n\u201cstray\u201d means an animal found in any public place, or on any premises other\nthan the premises on which the animal is being kept or is for the time being\nallowed to remain, but shall not include any animal that is accompanied by, and\nunder the direct control of, any person who is capable of exercising control over\nit;.\n\u201ctake\u201d means to take or capture any animal from its natural habitat, and\n\u201ctaking\u201d and other cognate expressions shall be construed accordingly; and\n\u201cvessel\u201d includes ship, boat, carriage, aircraft and hovercraft.\nPART 2 - Import and Export of Animals\n3.\nRestriction on importation and exportation of animals\n3.\n(1) No animal of any description may be imported directly or indirectly into the\nIslands from any country outside the Islands or from any one island into any\nother otherwise than in accordance with this Act.\n(2) No animal of any description may be exported from the Islands to any country\nor from one of the Islands to another of the Islands otherwise than in accordance\nwith this Act.\n4.\nImport of certain animals from certain areas prohibited\n4.\nSave as specifically permitted by this Act, no animal of any description may be\nimported into the Islands from any country in Asia, Africa or Central and South\nAmerica.\n\nSection 5\nAnimals Act (2024 Revision)\n\nPage 10\nRevised as at 31st December, 2023\nc\n\n5.\nNo live animal or biological product to be imported or exported save under\nlicence\n5.\n(1) No animal or carcass other than fish caught directly from the sea may be\nimported into or exported from the Islands save by way of George Town seaport\nor Owen Roberts Airport and ports of entry in Cayman Brac and Little Cayman\nunder licence from the Director.\n(2) No biological product may be imported or exported save under licence from the\nDirector.\n6.\nResponsibility of masters of vessels and agents\n6.\n(1) No master or agent of any vessel shall permit any animal to be accepted for\nconsignment to the Islands unless satisfied that an import licence in respect of\nsuch animal has been issued under this Act.\n(2) No master or agent of any vessel shall permit any animal to be disembarked\nfrom such vessel on arrival at the Islands until such animal has been inspected\nby the Director.\n7.\nAnimals unlawfully imported\n7.\nAny animal, biological product or carcass brought into the Islands in contravention\nof this Act may be ordered to be destroyed or otherwise dealt with as the Director\nmay, in the Director\u2019s discretion, decide.\n8.\nImport of dung, etc., prohibited\n8.\nNo dung, litter, used animal bedding, blankets, pads, dressings or clothing shall be\nimported into the Islands, save as may be incidental to the licensed import of an\nanimal.\n9.\nApplication for a licence to import an animal, etc.\n9.\n(1) An application for a licence to import or export an animal, carcass or biological\nproduct of any animal may be made in writing to the Director giving particulars\nof the animal and of its present whereabouts and the means of transport by which\nit is proposed to be imported or exported.\n(2) An application for a licence under subsection (1) shall be accompanied by the\nprescribed application fee.\n10.\nDirector may grant or refuse licence\n10. (1) Subject to subsection (2), on the receipt of an application for a licence to import\nor export any animal, carcass or biological product and the prescribed\napplication fee, the Director shall consider the application and either \u2014\n(a)\nmay reject the application and notify the applicant accordingly; or\n\nAnimals Act (2024 Revision)\nSection 11\n\nc\nRevised as at 31st December, 2023\nPage 11\n\n(b) on payment by the applicant of the prescribed licence fee, issue a licence\nin the prescribed form subject to such conditions, including quarantine,\nhealth and husbandry conditions, as the Director may consider desirable.\n(2) When considering an application for a licence to import a live or viable\nspecimen of an alien or genetically altered animal, the Director, in accordance\nwith any directives issued by the National Conservation Council, shall consult\nwith that Council and take into account any views of the Council before granting\nany such licence.\n(3) Prescribed application and licence fees paid in accordance with this section and\nsection 9 are not refundable.\n11.\nCabinet may make regulations\n11. (1) The Cabinet may make regulations prohibiting, restricting and generally\nregulating the import or export of animals, carcasses and biological products\ngenerally and of specific animals, prescribing forms of licences and fees payable\non the issue of such licences.\n(2) Where the regulations under subsection (1) relate to the importation of a live or\nviable specimen of alien or genetically altered animals the Cabinet shall consult\nwith the National Conservation Council prior to making such regulations.\n12.\nCabinet may grant exemptions\n12. The Cabinet may grant exemption from section 4 in any particular case.\n13.\nOffences: Part 2\n13. (1) Subject to subsection (2) a person who contravenes this Part or any regulations\nmade hereunder commits an offence and is liable on summary conviction to a\nfine of five hundred dollars and to imprisonment for six months.\n(2) A person who imports a live or viable specimen of an alien or genetically altered\nanimal without a licence commits an offence and is liable on conviction to a fine\nof five hundred thousand dollars or to imprisonment for a term of four years or\nto both.\n14.\nPowers of constables\n14. Any constable having reasonable cause to suspect that any animal which has been\nimported into the Islands contrary to this Act is being held or concealed in or on any\npremises may, on obtaining a search warrant for this purpose, at all reasonable times\nenter and search such premises and take possession of such animal and, pending the\noutcome of any legal proceedings, dispose of such animal according to the directions\nof the Director.\n\nSection 15\nAnimals Act (2024 Revision)\n\nPage 12\nRevised as at 31st December, 2023\nc\n\nPART 3 - Control of Diseases of Animals\n15.\nPersons to report cases of notifiable diseases\n15. Every person owning or having in that person\u2019s control any animal which that person\nhas reason to believe is or has recently been affected by a notifiable disease shall\nreport the same to the nearest police station as soon as practicable.\n16.\nRight of access by Director to diseased animals\n16. Where the Director has reason to believe that any animal affected by or having been\nexposed to disease is present on or in any holding, farm, apiary or other premises the\nDirector may at any reasonable time enter and inspect such animal.\n17.\nStandstill orders\n17. (1) Where the Director is of the opinion that any given area is threatened with the\nspread of any notifiable animal disease the Director may issue a standstill order\ncontrolling the movements of persons and animals into, out of and within the\nsaid area. Such order shall be valid for three days after the date of publication\nand may thereafter be renewed by the Cabinet for such further period as to the\nCabinet may appear desirable.\n(2) Where an order under subsection (1) is in force the Director may require such\ndisinfective and disease control measures to be carried out as may be calculated\nto limit the spread of the disease.\n18.\nDestruction of infected animals, etc., and compensation\n18. Animals found to be suffering from any notifiable disease shall be destroyed without\ncompensation to the owners, and where animals have, in the opinion of the Director,\nbeen exposed to a notifiable disease the Director may order their destruction and, in\nthe latter case, compensation shall be paid to the owners at the market value as\nassessed by the Director. Any person aggrieved by any decision as to market value\narrived at by the Director may, within ten days, appeal to the Cabinet whose decision\nshall be final.\n19.\nCabinet may make regulations\n19. The Cabinet may make regulations varying the list of notifiable diseases and\ngenerally for the detection and control of disease in animals.\n20.\nOffences: Part 3\n20. A person who fails to obey a standstill order, obstructs the Director in carrying out\nthe Director\u2019s duties under this Part or otherwise contravenes this Part or any\nregulation commits an offence and is liable on summary conviction to a fine of five\nhundred dollars and to imprisonment for six months.\n\nAnimals Act (2024 Revision)\nSection 21\n\nc\nRevised as at 31st December, 2023\nPage 13\n\nPART 4 - Improvement of Livestock\n21.\nCabinet may make regulations for the improvement of livestock\n21. The Cabinet may make regulations for regulating and controlling the husbandry,\nbreeding and slaughter of livestock and bringing about the improvement thereof. Such\nregulations may include the \u2014\n(a)\nestablishment of artificial insemination stations and the regulation of\nthe same;\n(b) inspection and licensing of sires;\n(c)\nestablishment and maintenance of livestock registers;\n(d) castration of scrub animals;\n(e)\nimportation and manufacture of feed and medicines;\n(f)\nhousing and care of livestock;\n(g) improvement of pasture;\n(h) purchase and importation of semen;\n(i)\nculling of animals having an excess population;\n(j)\nslaughter and dressing of carcasses and the inspection and supervision of\nslaughterhouses and slaughterpersons; and\n(k) fees to be charged for services rendered by the Department of Agriculture.\n22.\nImportation of semen prohibited except under licence\n22. The importation of semen into the Islands otherwise than under licence from the\nDirector is prohibited.\n23.\nOffences: Part 4\n23. A person who contravenes this Part or any regulation or who obstructs the Director\nin carrying out the Director\u2019s duties hereunder commits an offence.\nPART 5 - Licensing of Dogs\n24.\nDog licences\n24. (1) Subject to this section, a person shall not keep a dog over the age of four months\nunless \u2014\n(a)\nthat person is sixteen years of age or older; and\n(b) that person holds a dog licence for the dog.\n(2) A dog licence is personal to the person to whom the dog licence is issued and is\nnot transferable.\n\nSection 25\nAnimals Act (2024 Revision)\n\nPage 14\nRevised as at 31st December, 2023\nc\n\n(3) A person who imports a dog into the Islands is not required to hold a dog licence\nin respect of that dog if \u2014\n(a)\nbefore the dog is imported the Director is satisfied that the dog will be\nexported from the Islands within the period of thirty days from the date of\nthe importation; and\n(b) the dog is exported from the Islands within that period.\n(4) A person to whom a licence under section 29 has been issued is not required to\nhold a licence for a dog under the age of four months which was born and is\nbeing kept at premises to which the licence relates.\n(5) A person is not required to obtain a licence for a dog which is being kept by a\nsociety established for the purpose of caring for animals.\n(6) Subject to subsections (3), (4) and (5), a person who keeps a dog contrary to\nsubsection (1) commits an offence and is liable on summary conviction to a fine\nof five hundred dollars.\n25.\nIssue of licences\n25. (1) The Director shall, at such place as the Director shall authorise, issue dog\nlicences and identification tags.\n(2) A dog licence shall be for a period of one year and may be renewed in\naccordance with this section.\n(3) An application for a dog licence or a renewal of a dog licence shall be in such\nform as the Director shall determine and shall contain the name and the address\nof the applicant and, if the dog is not kept at that address, the address at which\nit is kept.\n(4) A dog licence shall be in a form determined by the Director but shall be\nnumbered and accompanied by an identification tag which shall bear the same\nnumber as that on the licence and which shall be suitable for attachment to a\ndog\u2019s collar.\n(5) If the Director is satisfied that a dog\u2019s identification tag has been lost the\nDirector may, on production of the dog licence and the appropriate fee, issue a\nnew identification tag in respect of the dog.\n(6) The Director shall keep registers and records of dogs, dog keepers and dog\nlicences as the Minister shall direct.\n26.\nDog found without a collar\n26. Every person keeping a dog shall ensure that such dog while in any highway or other\npublic place is on a lead and is wearing a collar with an identification tag bearing the\nlicence number attached thereto.\n\nAnimals Act (2024 Revision)\nSection 27\n\nc\nRevised as at 31st December, 2023\nPage 15\n\n27.\nIdentity of person keeping dog\n27. A person \u2014\n(a)\nin whose custody, charge or possession, or in whose house a dog is found\nor is seen; or\n(b) in whose name a dog licence is issued,\nis deemed to be the person who keeps such dog unless the contrary is proved.\n28.\nRegulations\n28. The Cabinet may make regulations prescribing the forms of licence required under\nthis Part, the fees for such licences, the form of identification tag to be issued to\npersons who have taken out a dog licence and the fees for such identification tags.\nPart 6 \u2013 Licensed Operations\n29.\nLicences for professional operations\n29. (1) A person shall not \u2014\n(a)\nkeep pet animals belonging to another person for which a charge is made;\n(b) breed pet animals;\n(c)\nsell a pet animal or act as broker in relation to the sale or transfer of\nanimals;\n(d) train or keep animals for guard duties other than the guarding of that\nperson\u2019s own premises; or\n(e)\nkeep animals for public display,\nunless that person holds an operating licence.\n(2) A person intending to carry on an activity specified in subsection (1) shall apply\nto the Director for an operating licence.\n(3) The Director may, subject to this section, issue an operating licence under this\nsection to a person who applies to the Director under subsection (2) (\u201can\napplicant\u201d).\n(4) The Director shall not issue an operating licence unless the Director is\nsatisfied \u2014\n(a)\nthat the applicant is a suitable person to hold such a licence for the activity\nin question; and\n(b) that the premises where the activity will be carried on are suitable.\n(5) An operating licence \u2014\n(a)\nshall state the name of the licensee; and\n\nSection 30\nAnimals Act (2024 Revision)\n\nPage 16\nRevised as at 31st December, 2023\nc\n\n(b) shall identify the premises to which the licence relates.\n(6) Operating licences are annual and subject to the payment of the prescribed fee.\n(7) A person who contravenes subsection (1) commits an offence and is liable on\nconviction to a fine of ten thousand dollars.\n30.\nCancellation of licence under section 29\n30. Subject to section 31, if the Director is satisfied \u2014\n(a)\nthat a person to whom an operating licence has been issued is no longer a\nsuitable person to hold such licence; or\n(b) that the premises to which an operating licence relates are no longer\nsuitable for the activity for which they are being used,\nthe Director may cancel the licence.\n31.\nAppeals\n31. (1) A person aggrieved by a decision of the Director not to issue or to cancel an\noperating licence may appeal against the decision to a summary court whose\ndecision on appeal shall be final.\n(2) The Rules Committee of the Grand Court may make rules prescribing the\nprocedure for appeals under subsection (1).\n32.\nRegulations\n32. The Cabinet may make regulations prescribing the form of licences required under\nthis Part.\nPART 7 - Nuisances by, and Control of, Animals\n33.\nResponsibility for trespass by animals\n33. The owner of any livestock, other than honey bees, shall take proper and effective\nmeasures to prevent them from trespassing on land in the occupation or ownership of\nanother, and from straying on to the public highway and, subject to sections 34 and\n35, the owner of such animals shall be responsible in damages for any injury or\ndamage caused or done by the animal when so trespassing or straying.\n34.\nException in respect of land abutting on a public road\n34. (1) No person in occupation of land abutting on a public road shall be entitled to\nrecover any damages in respect of any trespass on such land by any livestock\nwhile the same are being driven lawfully on such road, under proper care and\ncontrol, unless such land is secured by a fence along such road sufficient to keep\nout ordinary livestock of the class of animals committing the trespass.\n\nAnimals Act (2024 Revision)\nSection 35\n\nc\nRevised as at 31st December, 2023\nPage 17\n\n(2) The onus of showing that any livestock were being so driven as aforesaid shall\nbe on the owner of the livestock.\n35.\nLiability for allowing trespass by livestock\n35. A person who leaves open any properly constructed gate in working order or injures\nany fence or other contrivance provided for the purpose of confining any livestock,\nthereby allowing such livestock to trespass off the land on which the same is confined\nshall be liable for all consequential damage caused by the trespassing of such\nlivestock.\n36.\nPenalty for allowing animals to cause danger\n36. A person who, having the possession or ownership of an animal, permits it to stray\non the highway commits an offence and is liable on summary conviction to a fine of\nfive hundred dollars.\n37.\nSwine not to be kept in specified towns\n37. It is unlawful to keep swine in any specified town, and any swine being found kept in\nany specified town are liable to be forfeited and destroyed at the direction of the\nDirector who shall arrange for the disposal of such swine or the carcasses thereof at\nthe Director\u2019s discretion.\n38.\nPower of constable to take swine into possession\n38. Any constable may, upon view, take up any swine which the constable shall find in\nany specified town, and may enter any building in any such town where that constable\nhas reasonable cause to believe that swine are being kept and take and seize any swine\nthere found.\n39.\nCivil liability of dog owner\n39. The owner of every dog shall be liable in damages for injuries done to any person, or\nany cattle or sheep, by that owner\u2019s dog, and it shall not be necessary for the party\nseeking such damages to show a previous mischievous propensity in the dog, or the\nowner\u2019s knowledge of such propensity or that the injury was attributable to neglect\non the part of such owner. Such damages shall be recoverable in any court of\ncompetent jurisdiction.\n40.\nKeeping dogs under proper control\n40. (1) If a dog is dangerously out of control in a public place, the owner and, if\ndifferent, the person for the time being in charge of the dog, commits an offence.\n(2) If a dog is dangerously out of control in a public place and while so out of control\ninjures any person, the owner and, if different, the person for the time being in\ncontrol of the dog, commits an aggravated offence.\n\nSection 41\nAnimals Act (2024 Revision)\n\nPage 18\nRevised as at 31st December, 2023\nc\n\n(3) In proceedings for an offence under subsection (1) or (2) against a person who\nis the owner of a dog but who was not, at the material time, in charge of it, it\nshall be a defence for the accused to prove that the dog was, at the material time,\nin the charge of a person whom the accused reasonably believed to be a fit and\nproper person to be in charge of it.\n(4) If the owner or, if different, the person for the time being in charge of a dog,\nallows it to enter a place which is not a public place but where it is not permitted\nto be and while it is there it injures any person or there are grounds for\nreasonable apprehension that it will do so, that owner, or person for the time\nbeing in charge, commits an offence, or, if the dog injures any person, an\naggravated offence under this section.\n(5) A person who commits an offence under subsection (1), (2) or (4) other than an\naggravated offence is liable on summary conviction to imprisonment for six\nmonths and to a fine of four thousand dollars; and a person who commits an\naggravated offence under any of those subsections is liable \u2014\n(a)\non summary conviction, to a fine of four thousand dollars or to\nimprisonment for six months; or\n(b) on conviction on indictment to a fine and to imprisonment for two years.\n41.\nPower of court with respect to dangerous dogs\n41. (1) Where \u2014\n(a)\na person has been convicted of an offence against section 40; or\n(b) it is made to appear to a summary court that a dog has been dangerously\nout of control on more than one occasion or is likely to spread disease to\nany person or animal,\nthen the court may order either \u2014\n(i)\nthat the dog be handed over to the Department of Agriculture for the\nimmediate destruction of the dog by the Department; or\n(ii) that the person who is keeping the dog observe such requirements in\nrelation to the future keeping of the dog as the court thinks fit to\nspecify in the order.\n(2) A person who fails to comply with a requirement imposed upon that person by\nan order made under subsection (1)(b)(ii) commits an offence.\n(3) If a court which has convicted a person of an offence against subsection (2) is\nnot satisfied that the dog can or will be properly controlled in the future, the\ncourt may, in addition to punishing that person for the offence, order the\ndestruction of the dog.\n(4) A person who obstructs any officer of the court so that such officer is prevented\nfrom carrying out an order of the court made under subsection (1)(b)(i) shall pay\n\nAnimals Act (2024 Revision)\nSection 42\n\nc\nRevised as at 31st December, 2023\nPage 19\n\na fine of forty dollars in respect of each day the carrying out of the order remains\nin abeyance through that person\u2019s default.\n42.\nMuzzles and leads\n42. In this Act \u2014\n(a)\nreferences to a dog being muzzled are to its being securely fitted with a\nmuzzle sufficient to prevent it biting any person; and\n(b) references to its being kept on a lead are to its being securely held on a\nlead by a person who is not less than sixteen years old.\n43.\nFouling by dogs\n43. (1) If a dog defecates at any time on any public place and a person who is in charge\nof the dog at that time fails to remove the faeces from the public place forthwith,\nthat person commits an offence unless that person has a reasonable excuse for\nfailing to do so.\n(2) A person who commits an offence under subsection (1) is liable on summary\nconviction to a fine of two thousand dollars.\n(3) In this section \u2014\n(a)\nplacing the faeces in a receptacle which is provided for the disposal of\nwaste shall be a sufficient removal from the public place; and\n(b) being unaware of the defecation (whether by reason of not being in the\nvicinity or otherwise), or not having a device for or other suitable means\nof removing the faeces, shall not be a reasonable excuse for failing to\nremove the faeces.\n44.\nDogs dangerously out of control\n44. A dog shall be regarded as being dangerously out of control on any occasion on which\nthere are grounds for reasonable apprehension that it will injure any person or another\ndomestic animal, whether or not it does so, but references to a dog injuring a person\nor animal or there being grounds for reasonable apprehension that it will do so do not\ninclude references to any case in which the dog is being used for lawful purposes by\na constable, a public officer or a security guard in uniform while carrying out that\nperson\u2019s duties.\n45.\nProhibited dogs\n45. (1) This section applies to any dog of a breed specified, from time to time, for the\npurposes of this section by regulations made by the Cabinet after consultation\nwith the Director.\n(2) No person shall \u2014\n(a)\nbreed, or breed from, a dog to which this section applies;\n\nSection 45\nAnimals Act (2024 Revision)\n\nPage 20\nRevised as at 31st December, 2023\nc\n\n(b) sell or exchange such a dog, or offer, advertise or expose such a dog for\nsale or exchange;\n(c)\nmake or offer to make a gift of such a dog, or advertise or expose such a\ndog as a gift;\n(d) allow such a dog of which that person is the owner or of which that person\nis for the time being in charge in a public place without being muzzled and\nkept on a lead; or\n(e)\nabandon such a dog of which that person is the owner or, being the owner\nor for the time being in charge of such a dog, allow it to stray.\n(3) After such day as the Cabinet may by notice published in the Gazette appoint\nfor the purposes of this section, no person shall have any dog to which this\nsection applies in that person\u2019s possession or custody except in pursuance of the\npower of seizure conferred by this Act or unless such dog is registered pursuant\nto regulations made by the Cabinet.\n(4) Subsection (2)(b) and (c) shall not make unlawful anything done with a view to\nthe dog in question being removed from the Islands before the day appointed\nunder subsection (3).\n(5) The Cabinet may, by regulations, provide that the prohibition in subsection (2)\nshall not apply in such cases and subject to compliance with such conditions as\nare specified in the regulations, and any such provision may take the form of a\nscheme of exemption containing such arrangements (including provision for the\npayment of charges or fees) as it thinks appropriate.\n(6) A person who contravenes this section commits an offence and is liable on\nsummary conviction to a fine of four thousand dollars and to imprisonment for\nsix months, except that a person who publishes an advertisement in\ncontravention of subsection (2)(b) or (c) \u2014\n(a)\nshall not, on being convicted, be liable to imprisonment if that person\nshows that that person published the advertisement to the order of someone\nelse and did not themselves devise it; or\n(b) shall not be convicted if, in addition, that person shows that that person\ndid not know and had no reasonable cause to suspect that it related to a dog\nto which this section applies.\n(7) Regulations under subsection (1) adding dogs of any breed to those to which\nthis section applies may provide that subsections (3) and (4) shall apply in\nrelation to those dogs with the substitution, for the day appointed under\nsubsection (3), of a later day.\n(8) Where a court finds a person guilty of an offence under this section, it may also,\nif it thinks fit, make an order disqualifying the owner for having custody of a\ndog for such period as is specified in the order.\n\nAnimals Act (2024 Revision)\nSection 46\n\nc\nRevised as at 31st December, 2023\nPage 21\n\n(9) A person who is disqualified from having custody of an animal by virtue of an\norder made under subsection (8) may, at any time after the end of the period of\none year beginning with the date of the order, apply to the court for a direction\nterminating the disqualification.\n(10) On an application under subsection (9) the court may \u2014\n(a)\nhaving regard to the applicant\u2019s character, the applicant\u2019s conduct since\nthe disqualification was imposed and any other circumstances of the case,\ngrant or refuse the application; and\n(b) order the applicant to pay all or any part of the costs of the application,\nand, where an application in respect of the order is refused, no further\napplication in respect of that order shall be made before the end of the period of\none year beginning with the date of the refusal.\n(11) An officer appointed by the Director may inspect any premises where a dog to\nwhich this section applies is being held and any person so appointed under this\nsection may, on producing that person\u2019s authority if so required, enter any such\npremises at all reasonable times and inspect them and any dog found there for\nthe purpose of ascertaining that the provisions of this Act have been\ncomplied with.\n(12) A person who wilfully obstructs or delays a person in the exercise of that\nperson\u2019s power of entry or inspection under this section commits an offence.\n46.\nFerocious dogs\n46. A person who suffers any ferocious dog to be at large or who sets on or urges any dog\nto attack, worry or put in fear any person or domestic or protected animal commits an\noffence and is liable on summary conviction to a fine of five hundred dollars and to\nimprisonment for six months.\n47.\nStray dogs\n47. A constable may seize and detain any dog found in a highway or place of public resort\nwhich the constable has reason to believe is a stray and, if the owner can be traced,\nshall give notice of seizure to the said owner to whom the dog shall be restored upon\nsuch owner paying all expenses incurred by its detention.\n48.\nDisposal of seized dogs\n48. Dogs seized under section 47 shall be retained at the police station or in a dog pound\nfor a period of seven days if unclaimed by the owner, after which they may be sold\nor handed over to the Department of Agriculture for destruction. The proceeds of sale\nof stray dogs shall be appropriated to the expenses of the maintenance of the dog\npound.\n\nSection 49\nAnimals Act (2024 Revision)\n\nPage 22\nRevised as at 31st December, 2023\nc\n\n49.\nFinders of stray dogs\n49. (1) Any person finding a stray dog may take possession of the same and shall,\nwithin twenty-four hours, report the matter to the nearest police station\nwhereafter that finder may \u2014\n(a)\nretain the dog in that finder\u2019s possession; or\n(b) hand the dog over to the police.\n(2) If the finder retains the dog in the finder\u2019s possession the finder shall hand the\ndog over to any person who can show themselves to be the owner thereof and\nmakes claim thereto within fifteen days. If the finder hands the dog over to the\npolice the dog shall be dealt with as if it had been found and seized by a\nconstable.\n50.\nEstablishment of pounds and appointment of poundkeepers\n50. The Cabinet may establish pounds in the Islands and appoint poundkeepers in respect\nof each pound, and all persons who are poundkeepers at the 12th April, 1977 shall\ncontinue as such subject to dismissal by the Cabinet without notice.\n51.\nPoundkeepers to give notice to owner of impounded animal\n51. When an animal is impounded, the poundkeeper, if the poundkeeper knows the\nowner, shall serve notice in writing on the owner, and for so doing shall be entitled\nto the prescribed fee in that behalf.\n52.\nPoundkeeper to supply food and water\n52. (1) The poundkeeper shall supply every impounded animal with food and water on\nthe following scale \u2014\n(a)\ncattle, twenty pounds of grass and five gallons of water daily;\n(b) sheep and goats, six pounds of grass and five gallons of water daily;\n(c)\nother animals, according to the rules of good animal husbandry.\n(2) The above quantities shall be divided into morning and evening feeds and\nwaterings, there being an interval of not less than eight hours between morning\nand evening feeds and waterings.\n53.\nPound fees to be paid by owner prior to recovery of an animal\n53. Before delivering any impounded animal to its owners, the poundkeeper shall demand\nand receive the fee prescribed for that animal\u2019s maintenance while impounded.\n\nAnimals Act (2024 Revision)\nSection 54\n\nc\nRevised as at 31st December, 2023\nPage 23\n\n54.\nPoundkeeper to keep records\n54. The poundkeeper shall keep a written record of all animals impounded, stating the\nname and address of the distrainer or finder, the place, date and time when the animal\nwas found, the date and time when it was impounded and the description of the\nanimal, and such record shall be open for the inspection of the public at all reasonable\ntimes.\n55.\nEntire animals to be kept separately\n55. Entire animals which are impounded shall be kept separately from other impounded\nanimals.\n56.\nFees to be accounted for\n56. Poundkeepers shall account to the Treasury for fees received in such manner as may\nbe prescribed and shall, by way of remuneration, receive such proportion of such fees\nas may, from time to time, be prescribed.\n57.\nImpounding\n57. The lawful occupier of any land may seize any animal trespassing thereon and may\nimpound the same as the distrainer thereof. The distrainer shall, with all reasonable\ndispatch, convey the same to the nearest pound and the poundkeeper shall, at any time\nbetween 6 a.m. and 6 p.m., receive the said animal into the pound.\n58.\nDistrainer entitled to seizure fee\n58. The distrainer shall be entitled to receive a seizure fee in accordance with the\nprescribed scale \u2014\n(a)\nfrom the owner of the animal, if tendered before the delivery thereof to the\npoundkeeper; or\n(b) from the poundkeeper, after receipt by the poundkeeper of the fee.\n59.\nDistrainer to care for animals during detention by the distrainer\n59. A distrainer shall properly water, feed and care for any animal while it is detained by\nthe distrainer and shall be liable in damages for any neglect of such animal. Where\nsuch animal appears to be suffering from any notifiable disease, the distrainer shall\nreport the matter to the nearest police station without delay.\n60.\nEnticing animal to trespass is an offence\n60. Any person who drives, leads or entices any animal into any place with intent to\nimpound or procure the impounding of the same commits an offence.\n61.\nRescuing is an offence\n61. Every person who rescues or attempts to rescue any animal seized or impounded\nunder this Act commits an offence.\n\nSection 62\nAnimals Act (2024 Revision)\n\nPage 24\nRevised as at 31st December, 2023\nc\n\n62.\nOwner\u2019s right to distrained animal\n62. The owner of any animal distrained, on payment of the prescribed fee before any\nanimal is sold under section 63, is entitled to recover such animal.\n63.\nSale of unclaimed impounded animals\n63. (1) Where any animal has been impounded for four days and upwards and no person\nhas claimed the same under section 62, the poundkeeper shall put up the same\nfor sale by public auction and shall sell and deliver the same to the best bidder\nfor ready money after having received the price thereof and, if the price is not\npaid, the poundkeeper may again put up the animal for sale.\n(2) Public notice of every sale under subsection (1) shall be given by publication in\na local daily newspaper at least one clear day before the day of the sale.\n(3) It shall not be lawful for the poundkeeper or the owner of the animal to purchase\nany animal sold as aforesaid.\n(4) The proceeds of sale shall be paid to the Treasury for the account of the general\nrevenue.\n(5) Notwithstanding any irregularity prior to the sale, the purchaser at such sale\nshall have good and valid title against all comers.\n64.\nRegulations\n64. The Cabinet may, from time to time, make regulations prescribing fees payable under\nthis Act, designating specified towns and generally for the implementation of this\nAct.\n65.\nRiding animals in public places\n65. (1) The Cabinet may, by Order, prohibit the riding or driving of any animal in any\npublic place either absolutely or at such times or subject to such conditions as\nare specified in the Order.\n(2) A person who contravenes an Order made under subsection (1) commits an\noffence and is liable on summary conviction to a fine of five hundred dollars\nand to imprisonment for six months.\nPart 8 - Animal Welfare Advisory Committee\n66.\nAnimal Welfare Advisory Committee\n66. (1) There is established an Animal Welfare Advisory Committee for the purposes\nset out in this Act.\n(2) The Committee consists of \u2014\n(a)\nthe Director or the Director\u2019s designate who shall be chairperson; and\n\nAnimals Act (2024 Revision)\nSection 67\n\nc\nRevised as at 31st December, 2023\nPage 25\n\n(b) five other members appointed by the Minister subject to such terms and\nconditions as the Minister may determine and who shall be selected as\nfollows \u2014\n(i)\none member from the Cayman Humane Society;\n(ii) one member from the Cayman Horse Association;\n(iii) one member from the Agricultural Society;\n(iv) one member from the Royal Cayman Islands Police Force; and\n(v) one member from the general public who has demonstrated an\ninterest in animal welfare.\n67.\nRole of Committee\n67. The Committee shall be responsible for \u2014\n(a)\nadvising the Ministry on the policy matters relating to the care of animals\nin the Islands;\n(b) educating the public on the care of animals;\n(c)\nmaking recommendations on reports submitted by the animal welfare\nofficer; and\n(d) such other duties as the Minister may, from time to time, determine.\n68.\nDisqualification of members\n68. (1) The Minister shall terminate the appointment of any member who \u2014\n(a)\nresigns that member\u2019s office;\n(b) commits serious misconduct in relation to that member\u2019s duties;\n(c)\nis absent, without leave of the chairperson of the Committee, from three\nconsecutive meetings of the Committee; or\n(d) fails to comply with that member\u2019s obligations under this Act.\n(2) The Minister, at the Minister\u2019s discretion, may terminate the appointment of any\nmember and select a new member in accordance with the requirements set out\nin section 66(2).\n69.\nMeetings and decisions of Committee\n69. (1) The chairperson of the Committee shall summon regular meetings of the\nCommittee as often as may be required, but not less frequently than once in two\nmonths.\n(2) At every meeting of the Committee, a quorum shall consist of three members,\nand decisions shall be adopted by a simple majority of the votes of the members\npresent and voting except that in the case of an equality of votes the chairperson\nshall, in addition, have a casting vote.\n\nSection 70\nAnimals Act (2024 Revision)\n\nPage 26\nRevised as at 31st December, 2023\nc\n\n(3) The Committee may act notwithstanding that a vacancy exists among the\nmembers.\nPART 9 - Protection of Animals and Wild Life\n70.\nCruelty to animals an offence\n70. (1) A person who \u2014\n(a)\nbeats, ill-treats, over-rides, over-drives, overloads, tortures, infuriates or\nterrifies an animal or causes or procures, or, being the owner, permits any\nanimal to be so used;\n(b) by wantonly or unreasonably doing or omitting to do any act, or causing\nor procuring the commission or omission of any act, causes any\nunnecessary suffering or, being the owner, permits any unnecessary\nsuffering to be so caused to any animal;\n(c)\nworks, or causes to be worked, any domestic animal in such a condition as\nto be unfit for work, whether from emaciation, or from any gall, sore or\notherwise, and whether or not that condition is caused by disease or\ndeficient feeding;\n(d) wilfully, without any reasonable cause or excuse, administers or causes or\nprocures, or, being the owner, permits, such administration of, any\npoisonous or injurious drug or substance to any animal, or wilfully,\nwithout any reasonable cause or excuse, causes any such substance to be\ntaken by any animal;\n(e)\nsubjects, causes or procures, or, being the owner permits, to be subjected,\nany animal to any operation which is performed without due care and\nhumanity; or\n(f)\ntethers, confines or keeps any animal on a lead under such conditions or in\nsuch manner as to cause that animal unnecessary suffering,\ncommits an offence of cruelty and is liable on summary conviction to a fine of\nfour thousand dollars and to imprisonment for one year.\n(2) A person who, being the owner or having charge or control of any animal,\nwithout reasonable cause or excuse, abandons it, whether permanently or not,\nin circumstances likely to cause the animal any unnecessary suffering or causes\nor procures or, being the owner, permits it to be so abandoned, commits an\noffence of cruelty and is liable on conviction to a fine of four thousand dollars\nand to imprisonment for one year.\n(3) The owner of an animal who leaves an animal on premises shall ensure that\nthere is a person on the premises or a person who will visit the premises to\nmaintain that animal, and that the animal \u2014\n\nAnimals Act (2024 Revision)\nSection 70\n\nc\nRevised as at 31st December, 2023\nPage 27\n\n(a)\nhas access to drinking water and food;\n(b) has access to accommodation which is suitable as regards drainage, size,\ncleanliness and ventilation;\n(c)\nis able to move freely; and\n(d) has reasonable shelter against the sun and rain.\n(4) An owner of an animal who contravenes subsection (3) commits an offence of\ncruelty and is liable on summary conviction to a fine of four thousand dollars\nand to imprisonment for one year.\n(5) For the purposes of subsection (2), an owner shall be considered to have\npermitted cruelty in relation to an animal within the meaning of this Act if the\nowner fails to exercise reasonable care and supervision in respect of the care\nand protection of the animal.\n(6) A person who \u2014\n(a)\nsells, or offers or exposes for sale, or gives away, or causes or procures\nany person to sell or offer or expose for sale or give away, or knowingly\nbe party to the sale or offering or exposing for sale or giving away of any\ngrain or seed which has been rendered poisonous except for bona fide use\nin agriculture; or\n(b) knowingly puts or places, or causes any person to put or place, or\nknowingly be party to the putting or placing, in or upon any land or\nbuilding of any poison, or any fluid or edible matter (not being sown seed\nor grain) which has been rendered poisonous,\ncommits an offence of cruelty and is liable on summary conviction to a fine of\nfour thousand dollars and to imprisonment for one year.\n(7) In any proceedings relating to an offence under subsection (6), it shall be a\ndefence of an accused that the poison was placed for the purpose of destroying\ninsects and other invertebrates, rats, mice or other small ground vermin where\nsuch is found to be necessary in the interests of public health, public safety or\nagriculture, or the preservation of other animals, domestic or wild, or for the\npurpose of manuring the land, and that the accused took all necessary\nprecautions to prevent injury to any other animal or to any person.\n(8) The Director or a person authorised by the Director, may use any prescribed\npoison to destroy any animal on any public or private land where it is necessary,\nin the opinion of the Director, in the interests of public health, public safety or\nagriculture, or to preserve other domestic or wild animals and, in using such\npoison, the Director or the person authorised by the Director shall use all\nnecessary precautions to prevent injury to any other animal or to any person.\n(9) The Director shall, from time to time, issue guidance as to the manner in which\nan animal, while restrained by a chain or other means, may be able to move\nfreely.\n\nSection 71\nAnimals Act (2024 Revision)\n\nPage 28\nRevised as at 31st December, 2023\nc\n\n71.\nBull-baiting, etc.\n71. A person who \u2014\n(a)\nin any manner encourages, aids or assists at the fighting or baiting of any\nbull, dog, cock or any other kind of animal;\n(b) keeps, uses or acts in the management of any such animal;\n(c)\nbeing the owner or occupier of any place or premises, permits such place\nor premises to be used for the purpose of fighting or baiting any such\nanimal; or\n(d) receives money for the admission of any person to any place or premises\nkept or used for the purpose of fighting or baiting of any such animal,\ncommits an offence.\n72.\nCausing avoidable pain or suffering to any animal\n72. A person who conveys, carries or places in or upon any cart or vehicle, or upon any\nvessel or boat, any animal in such a manner or position as to subject that animal to\navoidable or unnecessary pain or suffering, commits an offence.\n73.\nUsing or employing animals brought to be destroyed\n73. A person who uses or employs, or permits to be used or employed, in any manner of\nwork, any animal brought or delivered to that person for the purpose of being\ndestroyed, and a person who is found employing or using such an animal, commits\nan offence.\n74.\nCausing unnecessary suffering in killing an animal\n74. A person who, in killing any animal, wilfully or carelessly causes unnecessary\nsuffering to such animal commits an offence.\n75.\nDocking or nicking the tail of any horse, etc.\n75. A person who wilfully docks or nicks the tail of any horse, mule, hinny or similar\nanimal commits an offence.\n76.\nDestruction of an injured animal\n76. (1) Where any offence appears to have been committed under sections 70 to 73, it\nshall be lawful for the Director or any constable to seize and take before a court\nthe animal in relation to which the offence is alleged to have been committed,\nwhether or not any person alleged to have committed the offence is held in\ncustody, and the court may make such order as to the care or disposal of the\nanimal as may be deemed to be appropriate, including an order for the\ndestruction of the animal.\n(2) Where an order has been made for the destruction of an animal under\nsubsection (1), no compensation shall be payable to the owner of the animal.\n\nAnimals Act (2024 Revision)\nSection 77\n\nc\nRevised as at 31st December, 2023\nPage 29\n\n(3) Where any constable finds any animal so severely injured or in such state of\nhealth that it cannot, without undue suffering, be moved the constable may (with\nthe consent of the owner if the animal is a domestic animal) destroy the said\nanimal or cause it to be destroyed.\n(4) Where, for the purpose of subsection (3), the owner cannot be found or refuses\ntheir consent, the constable may act on the certificate of a medical officer, a\nveterinary officer, the Director or a Justice of the Peace.\n77.\nPenalties for offences under sections 70 to 75\n77. (1) A person who commits an offence contrary to sections 70 to 75 is liable on\nsummary conviction to a fine of five hundred dollars and to imprisonment for\nsix months.\n(2) A person who is convicted under subsection (1) may, in addition to the penalties\nprescribed therein, be ordered to pay the expenses incurred in the care,\nmaintenance, destruction and removal of the animal or the carcass thereof.\n(3) If the owner of any animal commits the offence of cruelty to the animal within\nthe meaning of this Act, the court, upon that owner\u2019s conviction, may, if it thinks\nfit, in addition to any other punishment, deprive the convicted person of the\nownership of the animal and disqualify that person from having custody of any\nanimal for such period as is specified in the order.\n(4) No order shall be made under subsection (3), unless it is shown by evidence as\nto a previous conviction, or as to the character of the owner, or otherwise, that\nthe animal, if left with the owner, is likely to be exposed to further cruelty.\n(5) A person who is disqualified from having custody of an animal by virtue of an\norder made under subsection (3) may, at any time after the end of the period of\none year beginning with the date of the order, apply to the court for a direction\nterminating the disqualification.\n(6) On an application under subsection (5), the court may \u2014\n(a)\nhaving regard to the applicant\u2019s character, the applicant\u2019s conduct since\nthe disqualification was imposed and any other circumstances of the case,\ngrant or refuse the application; and\n(b) order the applicant to pay all or any part of the costs of the application,\nand where an application in respect of the order is refused no further application\nin respect of that order shall be heard if made before the end of the period of one\nyear beginning with the date of the refusal.\n78.\nRepealed\n78. (1) An animal welfare officer shall, for the purpose of performing the animal\nwelfare officer\u2019s duties under this Act, have all the rights and immunities of\nconstables acting generally in the ordinary course of their duty, and every\nconstable shall, for the purpose of enforcing this Act, have all the powers of an\nanimal welfare officer.\n(2) The duties of an animal welfare officer shall include \u2014\n(a)\npreventing cruelty or suffering to animals;\n(b) capturing and detaining any stray or vicious animals;\n(c)\nprotecting game animals, ensuring the preservation of protected animals\nand supervising the closed seasons;\n(d) upon the receipt of a written complaint from the Director, the Committee\nor any named member of the public, entering and searching any premises\nto ensure that the provisions of this Act are not being contravened;\n(e)\nwhere the animal welfare finds a person is in contravention of this Act,\nnotifying such person in writing of the possibility of prosecution;\n(f)\ncollecting evidence, taking photographs and writing reports to be\nsubmitted to the Ministry for use in any criminal proceedings under the\nLaw; and\n(g) testifying in court in any proceedings under this Act.\n\nAnimals Act (2024 Revision)\nSection 86\n\nc\nRevised as at 31st December, 2023\nPage 31\n\n(3) Each animal welfare officer shall be provided by the Ministry with a certificate\nof that animal welfare officer\u2019s appointment as an animal welfare officer signed\nby the Minister and bearing a photograph of the animal welfare officer.\n(4) An animal welfare officer shall, if requested to do so, produce that certificate\nfor inspection to any person in relation to whom the animal welfare officer is\nabout to exercise, is exercising or has exercised a power under this Act.\n(5) A certificate appearing to have been provided under subsection (3) is, without\nproof of the signature of the person who signed it or that person\u2019s authority to\nsign it, evidence of the appointment to which the certificate appears to relate.\n(6) An animal welfare officer may apprehend without warrant any person who\ncommits or attempts to commit an arrestable offence in that animal welfare\nofficer\u2019s view or whom the animal welfare officer reasonably suspects to have\ncommitted an arrestable offence.\n(7) An animal welfare officer may, in any public place, on any Crown lands, search\nany person whom the animal welfare officer has reasonable cause to suspect of\nhaving contravened this Act or any regulation, and may stop and search any\nvehicle, boat or other conveyance in or upon which the animal welfare officer\nhas cause to suspect that there is any animal in respect of which any offence\nagainst this Act or any regulation has been committed or in or upon which the\nanimal welfare officer has reasonable cause to suspect that there is any gun,\ncatapult or any other weapon or trap used in the commission of any such offence.\n(8) Where a person having charge of a vehicle, boat or other conveyance or animal\nis apprehended by an animal welfare officer or a constable under this Act, it\nshall be lawful for that animal welfare officer, constable or any other constable\nto take charge of the vehicle, boat, or other conveyance or animal, and to deposit\nthe vehicle, boat or other conveyance or animal in some place of safe custody\nuntil the termination of any proceedings relating to the animal or until the court\nmakes an order as to the disposal of the vehicle or animal.\n(9) The reasonable costs of a detention under subsection (8), including the\nreasonable cost of veterinary treatment where such treatment is required, shall,\nin the event of a conviction in respect of the animal, be recoverable from the\nowner as a civil debt, or, where the owner themselves is convicted, shall be part\nof the costs of the case.\n86.\nRegulations\n86. The Cabinet may make regulations for the better carrying out of this Part and in\nparticular may \u2014\n(a)\nrepealed by section 16 of the Animals (Amendment) Law, 2014 [Law 14\nof 2014];\n(b) repealed by section 16 of the Animals (Amendment) Law, 2014 [Law 14\nof 2014];\n\nSection 87\nAnimals Act (2024 Revision)\n\nPage 32\nRevised as at 31st December, 2023\nc\n\n(c)\nmake provision for the stocking of any areas with animals of various\ncategories;\n(d) repealed by section 16 of the Animals (Amendment) Law, 2014 [Law 14\nof 2014];\n(e)\nrestrict or impose conditions in respect of the keeping of animals in\ncaptivity;\n(f)\nrepealed by section 16 of the Animals (Amendment) Law, 2014 [Law 14\nof 2014]; `\n(g) require persons to render returns containing such information as may be\nprescribed;\n(h) prescribe the form and make provision for the issue of licences and the\nfees therefor;\n(i)\nprescribe, regulate and secure the periodical treatment of all or any cattle\nby effective dipping or by the use of some other means of control and\neradication of ticks either with respect to the Islands as a whole or any part\nthereof; and\n(j)\ncontrol the quality of animal feeding stuffs imported into the Islands or\noffered for sale to the public.\n87.\nJurisdiction over offences committed at sea\n87. Any offence against this Act committed at sea within twelve miles of the shore of any\nof the Islands shall be deemed to have been committed in any place adjoining such\nsea and may be tried and punished accordingly.\n88.\nPower to exempt from this Act\n88. Notwithstanding anything to the contrary contained in this Act, the Cabinet may, by\nwriting under the Cabinet\u2019s hand for purposes of conservation or for scientific,\nhistoric or educational purposes or for the purpose of protecting human life or aircraft\noperations, exempt either absolutely or for such time and subject to such conditions\nas the Cabinet may think fit, any person or institution from all or any of the provisions\nof this Act.\n89.\nForfeiture of things seized\n89. (1) Any animal or any part thereof, in respect of which there is a conviction for an\noffence against this Act, shall be forfeited to the Crown.\n(2) Any boat, gun, catapult or other weapon or any trap used in commission of any\noffence in respect of which there is a conviction may, in the discretion of the\ncourt, be forfeited to the Crown.\n\nAnimals Act (2024 Revision)\nSection 90\n\nc\nRevised as at 31st December, 2023\nPage 33\n\n90.\nOffences: Part 9\n90. A person who commits an offence contrary to sections 70 to 89 is liable on summary\nconviction to a fine of five hundred dollars and to imprisonment for six months.\nPART 10 - General\n91.\nRegulations\n91. Without prejudice to the Cabinet\u2019s powers to make regulations under any part of this\nAct, the Cabinet may make regulations generally for the better implementation\nthereof and may, from time to time, prescribe fees to be charged for any service\nrendered to any member of the public.\n92.\nGeneral offence\n92. (1) Any contravention of any regulation made under this Act is an offence against\nthis Act and punishable accordingly.\n(2) Where no punishment is specifically prescribed, a person who contravenes this\nAct or any regulations commits an offence and is liable on summary conviction\nto a fine of five hundred dollars and to imprisonment for three months.\n93.\nDirector is subject to directions\n93.
