Bonded duty-free shops 9. This Part does not apply to goods sold at a bonded duty-free shop as defined in section 44(4). (1) Unless the Collector otherwise permits, the master of an aircraft arriving in the Islands shall immediately \u2014 (a) take the aircraft to the apron of the airport; (b) make report of the aircraft by delivering to the Customs officer on duty, in such form as the Collector may direct \u2014 (i) a General Declaration; and (ii) particulars of the goods on board the aircraft; (c) produce to such officer such other documents relating to the flight as he may require; (d) unload all goods in the aircraft except such as are to be carried on to another Customs airport or to a foreign destination and are permitted by such officer to remain in the aircraft; and (e) unless such officer otherwise permits, deposit all goods unloaded from the aircraft into the transit shed: Provided that if, through circumstances over which the master has no control, an aircraft is prevented from complying with this regulation the master shall \u2014 (i) immediately report the situation to a Customs officer; and (ii) deal with all goods in the aircraft in accordance with such officer\u2019s instructions. Regulation 11 (2) Any act required to be performed by the master of the aircraft by virtue of this regulation may, subject to the Collector\u2019s assent, be performed by an agent of the owner of the aircraft.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_11\", \"num\": \"11.\", \"text\": \"Unloading times 11. No person shall, without the authority of the Collector, unload or permit the unloading of any goods imported by air save between the hours of 8:30 a.m. and 4:00 p.m. at times when the Customs is not engaged in examining passengers\u2019 baggage.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_12\", \"num\": \"12.\", \"text\": \"Removal of goods from transit shed 12. Save as the Collector may specially authorise in that behalf, no person shall remove any goods other than current periodicals and newspapers from a transit shed without the permission of the Customs officer on duty.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_13\", \"num\": \"13.\", \"text\": \"No loading or embarking without authority 13. No goods shall be loaded and no passenger shall embark or be permitted to embark on any departing aircraft without the authority of a Customs officer.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_14\", \"num\": \"14.\", \"text\": \"Prescribed aprons 14. The following places are prescribed to be aprons \u2014 (a) the rectangular hard surface area of the Owen Roberts Airport between the ends of the taxi-track, the LACSA hangar, the security fence and the terminal building and the offices of the Director of Civil Aviation; and (b) the hard surface area of the Gerrard Smith Airport in front of the terminal building and extending eighty feet towards the runway. 15. Prescribed transit shed 15. The compartment at the eastern end of the terminal building at Owen Roberts Airport is prescribed to be a transit shed. PART IV - Warehouse\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_16\", \"num\": \"16.\", \"text\": \"Warehouses, classes of goods, etc. 16. The Governor may, from time to time, by notice in the Gazette prescribe \u2014 (a) the class or classes of goods which may be deposited in any warehouse; (b) the hours of business of any warehouse for the purpose of \u2014 (i) making deposits therein; and (ii) making withdrawals therefrom; and (c) special rules for the conduct of the business of any warehouse. Regulation 17\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_17\", \"num\": \"17.\", \"text\": \"Forms of deposit, etc 17. (1) There shall, within the time prescribed, if any, be submitted to Customs in respect of all goods \u2014 (a) deposited in a warehouse; (b) cleared for home consumption; (c) removed from one warehouse to another; and (d) re-exported, the appropriate entry and clearance form in Form C in Schedule 1. In case (a) the form shall be submitted in triplicate and in cases (b), (c) and (d) in duplicate. (2) All goods the subject of paragraphs (b), (c) and (d) of subregulation (1), shall be cleared from a warehouse within three working days of the passing of the entry relevant thereto.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_18\", \"num\": \"18.\", \"text\": \"Landed account 18. Before the deposit in any warehouse of any consignment of goods, Customs shall examine such goods and raise a landed account thereof. (2) A copy of every landed account shall be supplied in the importer of the relevant consignment who may produce such copy in support of any claim for loss or damage incurred to such consignment up to the time of\u2019 the removal thereof from the transit shed. (3) Every warehouse keeper shall check every consignment of goods deposited in his warehouse against the landed account relevant to such consignment and shall make immediate report to Customs of any discrepancy between the actual quantity and condition of such goods and landed account thereof. (4) Upon receipt of a report under subregulation (3), Customs shall re- examine the relevant goods and make such adjustment to the landed account as may be justified under section 22(3).\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_19\", \"num\": \"19.\", \"text\": \"Approved transport 19. The Collector may, from time to time, by notice in the Gazette approve certain persons as transporters for the purpose of section 17(1) and may revoke such approval.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_20\", \"num\": \"20.\", \"text\": \"Warehouse rotation number 20. Every warehouse keeper upon receipt of a consignment of goods shall, under the direction of the Collector, mark each package of such consignment with a serial number to be known as the warehouse \u201crotation number\u201d. Regulation 21\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_21\", \"num\": \"21.\", \"text\": \"Warehouse register 21. Every warehouse keeper shall maintain in a form approved by the Collector a register of all consignments of goods deposited in his warehouse which shall be identified therein by the relevant rotation number.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_22\", \"num\": \"22.\", \"text\": \"Manner of stowage 22. Every warehouse keeper shall stow, or cause to be stowed, every consignment of goods deposited in such a manner that \u2014 (a) the rotation number can readily be seen; and (b) the goods are accessible for the purpose of checking quantity and quality and for the purposes of section 22(3).\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_23\", \"num\": \"23.\", \"text\": \"Operations by warehouse keepers 23. (1) Every warehouse keeper may, by virtue of section 22(6), conduct the following operations \u2014 (a) repair damaged packages: (b) repack goods into sound packages; (c) make up deficiencies in packages, varying if necessary the total number of such packages; (d) clean and relabel cartons, packages and bottles; and (e) destroy and dispose of damaged or defective goods. (2) Before conducting any operation under subregulation (1), every warehouse keeper shall give not less than twenty-four hours\u2019 notice thereof to Customs. (3) When, for any purpose of subregulation (1), new packages are used such packages shall be marked with the relevant rotation number.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_24\", \"num\": \"24.\", \"text\": \"Withdrawal conditions 24. No warehoused goods may be withdrawn in amounts of less than one case save for the purposes of \u2014 (a) drawing samples; (b) clearing a remnant case; or (c) for shipment as stores.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_25\", \"num\": \"25.\", \"text\": \"Remnants 25. No remnant case shall remain on deposit in any warehouse for a period exceeding fourteen days. Regulation 26\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_26\", \"num\": \"26.\", \"text\": \"Deposit against withdrawals 26. The Collector may accept in advance from any warehouse keeper a deposit of an agreed fixed sum against withdrawals from the relevant warehouse over a period of any one week provided that \u2014 (a) the fixed deposit is paid on the first working day of the week of withdrawal; and (b) all amounts due in respect of such withdrawals are accounted for on the first working day of the week following.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_27\", \"num\": \"27.\", \"text\": \"Withdrawals for certain purposes 27. Whenever goods are to be removed from a warehouse otherwise than against payment of duty or under regulation 26, the owner thereof shall either \u2014 (a) deposit with Customs the relevant amount of duty; or (b) deliver to Customs a Removable Bond in Form D in Schedule 1 and issued by a bank licensed under the Banks and Trust Companies Law (2009 Revision), which deposit shall be repaid or bond discharged, as the case may be, upon return of the relevant goods to Customs control.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_28\", \"num\": \"28.\", \"text\": \"Alterations 28. No alteration shall be made to the structure or accommodation of any warehouse unless leave in that behalf has first been accorded in writing by the Governor.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_29\", \"num\": \"29.\", \"text\": \"Security 29. Every warehouse keeper shall forthwith inform the Collector of any fire, breaking or other incident affecting the security of the warehouse for which he is responsible or any of the contents thereof.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_30\", \"num\": \"30.\", \"text\": \"Customs facilities 30. Every warehouse keeper shall provide desk space and toilet facilities for the use of Customs officers engaged in duty in the warehouse for which he is responsible.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_31\", \"num\": \"31.\", \"text\": \"Only uncustomed goods to be stored 31. No customed goods shall be stored in any warehouse.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_32\", \"num\": \"32.\", \"text\": \"Working hours 32. Subject to any special directions given by the Collector from time to time, warehouses may be open for business only on days other than public holidays and at the following times \u2014 Regulation 33 (a) on Saturdays from 8:00 a.m. until 12:00 p.m.; (b) from Mondays to Fridays inclusive from 8:00 a.m. to 12:00 p.m. and from 1:00 p.m. until 4:00 p.m. 33. Goods which may be stored 33. Subject to any special leave given by the Collector from time to time in writing, no goods shall be stored in any warehouse other than \u2014 (a) potable spirits, wines, beers, cider and perry; and (b) tobacco and tobacco products. PART V - Special Attendance\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_34\", \"num\": \"34.\", \"text\": \"Powers of Collector 34. The powers of the Collector under paragraph (c)(i) of section 7 may be exercised upon the following conditions \u2014 (a) in the case of the withdrawal of goods from a warehouse, the giving of not less than twenty-four hours\u2019 notice in writing to the Collector; (b) in the case of any Customs activity at an airport, the giving of not less than twenty-four hours\u2019 notice in writing to the Collector, but, in the case of non-commercial flights, an immediate request by telephone may be accepted; (c) in the case of any Customs activity at a seaport, the giving of not less than four hours\u2019 notice in writing to the Collector; or (d) in the case of Customs attendance required with regard to goods in danger of perishing, an immediate request by telephone may be accepted, and, in all the above cases, the giving of a deposit or bond to secure payment of the special attendance charge prescribed.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_35\", \"num\": \"35.\", \"text\": \"Exercise of powers 35. The powers of the Collector under paragraph (c)(ii) of section 7 may be exercised upon condition that payment of the special attendance charge as prescribed is secured by the giving of a deposit or bond.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_36\", \"num\": \"36.\", \"text\": \"Charges 36. The charge for special attendance shall be calculated from the time when such attendance is requested to be made available, regardless of whether or not the person requesting such attendance is then ready to make use of the service so requested. Regulation 37\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_37\", \"num\": \"37.\", \"text\": \"Apportionment of charges 37. Where special attendance is required upon more than one person, the amount chargeable for such attendance shall be apportioned between such persons upon the basis of these regulations.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_38\", \"num\": \"38.\", \"text\": \"Minimum time of attendance 38. Special attendance arising from a telephone request made under paragraph (b) of regulation 34 shall be deemed to be for a minimum period of two hours. 39. Rate of charge 39. Special attendance is charged at the Customs Department\u2019s rate of overtime pay as authorised, from time to time, by the Government. PART VI - Anthrax 40. Import prohibition 40. The importation directly or indirectly from any country specified in Schedule 2 of any animal or tissue of any animal or any goods comprised wholly or partly of the tissue of any animal is prohibited. PART VII - Bonded Duty-free Shops\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_41\", \"num\": \"41.\", \"text\": \"Prescribed goods 41. The Governor may, by notice in the Gazette, prescribe the class or classes of bonded duty-free goods which may be deposited in a bonded duty-free shop.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_42\", \"num\": \"42.\", \"text\": \"Bond 42. Every shopkeeper shall enter into a bond in a comprehensive form, with an approved surety, to comply with the terms of the conditions of approval and to provide security for the duty on the maximum quantity of uncustomed goods likely to be in the shop at any one time.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_43\", \"num\": \"43.\", \"text\": \"Security 43. The shopkeeper shall be responsible for the physical security of the shop covered by his bond, and for safeguarding the revenue by protecting the goods from improper interference or removal irrespective of any official controls that may be applied. The shop keeper shall forthwith inform the Collector in writing of any incident affecting the security of the shop for which he is responsible or affecting any of the contents thereof. Regulation 44\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_44\", \"num\": \"44.\", \"text\": \"Losses 44. If, at any time after the goods have been deposited in a bonded duty-free shop and before they are lawfully removed therefrom, they are found to be missing or deficient and it is not shown to the satisfaction of the Collector that the absence or deficiency can be accounted for by natural wastage, accident or other legitimate cause, then without prejudice to any penalty or forfeiture incurred under the Law or any other law, the Collector may require the shopkeeper to pay forthwith the whole or any part of the duty due on the missing goods or on the whole or any part of the deficiency.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_45\", \"num\": \"45.\", \"text\": \"Hours of opening 45. Subject to any special directions given by the Collector, a bonded duty-free shop at an airport may be open for the sale of uncustomed goods only from ninety minutes before the scheduled time of departure of an international flight until the actual departure of that flight.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_46\", \"num\": \"46.\", \"text\": \"Receipts into shop 46. Except with the prior consent of the Collector, the import account of all uncustomed goods shall be taken before their receipt into the shop. On receipt of the goods in the shop, the shopkeeper shall advise receipt to the Collector, and produce the goods to an officer for examination as and when required.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_47\", \"num\": \"47.\", \"text\": \"Customed goods 47. No customed spirits, wines or tobacco shall be stored in a bonded duty-free shop.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_48\", \"num\": \"48.\", \"text\": \"Sales 48. Sales from a bonded duty-free shop shall be made only to entitled passengers and aircrew who are about to depart in an aircraft for a destination outside the Islands. Passengers shall be required to produce boarding-cards to prove their entitlement and the flight-numbers and seats allocated to them shall be noted in the shopkeeper\u2019s records.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_49\", \"num\": \"49.\", \"text\": \"Wrapping, etc., after sale 49. All goods shall be placed in a package marked with the name of the airport and containing a written warning that it must be exported unopened. Packages shall be closed by sealing or stapling immediately the goods are sold, and an invoice or till receipt identifying the goods shall be fixed to each customer\u2019s airline ticket or boarding-card. Regulation 50\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_50\", \"num\": \"50.\", \"text\": \"Display of notices 50. Drawback (Passengers\u2019 Spirits and Wines)\n4.\nSellers to prepare receipts\n4.\nEvery seller shall, in respect of every sale, prepare a dated and serially numbered\nreceipt in triplicate and shall mark such triplicate receipts A, B, and C respectively.\n5.\nForms of receipt\n5.\nReceipts shall be in Form A in Schedule 1 and shall contain the following\ninformation \u2014\n(a)\nthe name of the seller;\n(b) the name of the passenger (buyer) in block letters;\n(c)\nthe number and capacity of bottles or other vessels sold;\n(d) a description of the contents of each such bottle or vessel;\n(e)\nthe country of origin of such contents;\n(f)\nthe flight number of the aircraft or the name of the ship;\n(g) the signature of the buyer;\n(h) the amount paid by the buyer;\n(i)\nthe amount intended to be claimed in drawback; and\n(j)\nthe signature of the seller.\n6.\nProcedure to be followed by the seller\n6.\nThe seller shall \u2014\n(a)\nhand receipt A to the buyer;\n(b) retain receipt B;\n(c)\npack, or cause to be packed, all the goods listed in each receipt in a single\ncontainer;\n(d) attach securely to such container receipt C relevant thereto; and\n(e)\ndeliver the goods so packed into Customs charge at such place as the\nCollector shall direct.\n\nCustoms Regulations\nRegulation 7\n\nc\nRevised as at 31st day of July, 2011\nPage 9\n\n7.\nDelivery of goods to buyer\n7.\nCustoms shall, at the time of embarkation, hand to each buyer, against the surrender\nof receipt A, the container with goods relevant to such receipt.\n8.\nCollection and payment of drawback\n8.\nSellers may claim drawback in respect of any month on or before the 7th day of the\nmonth following by presenting to Customs the originals or copies of relevant receipt\nB, and Customs shall make payment of such drawback on or before the 17th day of\nthe month of such presentation.\n9.\nBonded duty-free shops\n9.\nThis Part does not apply to goods sold at a bonded duty-free shop as defined in\nsection 44(4).\nPART III - (1) Unless the Collector otherwise permits, the master of an aircraft arriving in the\nIslands shall immediately \u2014\n(a)\ntake the aircraft to the apron of the airport;\n(b) make report of the aircraft by delivering to the Customs officer on duty,\nin such form as the Collector may direct \u2014\n(i)\na General Declaration; and\n(ii) particulars of the goods on board the aircraft;\n(c)\nproduce to such officer such other documents relating to the flight as he\nmay require;\n(d) unload all goods in the aircraft except such as are to be carried on to\nanother Customs airport or to a foreign destination and are permitted by\nsuch officer to remain in the aircraft; and\n(e)\nunless such officer otherwise permits, deposit all goods unloaded from\nthe aircraft into the transit shed:\nProvided that if, through circumstances over which the master has no\ncontrol, an aircraft is prevented from complying with this regulation the\nmaster shall \u2014\n(i)\nimmediately report the situation to a Customs officer; and\n(ii) deal with all goods in the aircraft in accordance with such officer\u2019s\ninstructions.\n\nRegulation 11\nCustoms Regulations\n\nPage 10\nRevised as at 31st day of July, 2011\nc\n\n(2) Any act required to be performed by the master of the aircraft by virtue of this\nregulation may, subject to the Collector\u2019s assent, be performed by an agent of\nthe owner of the aircraft.\n11.\nUnloading times\n11. No person shall, without the authority of the Collector, unload or permit the\nunloading of any goods imported by air save between the hours of 8:30 a.m. and\n4:00 p.m. at times when the Customs is not engaged in examining passengers\u2019\nbaggage.\n12.\nRemoval of goods from transit shed\n12. Save as the Collector may specially authorise in that behalf, no person shall remove\nany goods other than current periodicals and newspapers from a transit shed without\nthe permission of the Customs officer on duty.\n13.\nNo loading or embarking without authority\n13. No goods shall be loaded and no passenger shall embark or be permitted to embark\non any departing aircraft without the authority of a Customs officer.\n14.\nPrescribed aprons\n14. The following places are prescribed to be aprons \u2014\n(a)\nthe rectangular hard surface area of the Owen Roberts Airport between\nthe ends of the taxi-track, the LACSA hangar, the security fence and the\nterminal building and the offices of the Director of Civil Aviation; and\n(b) the hard surface area of the Gerrard Smith Airport in front of the terminal\nbuilding and extending eighty feet towards the runway.\n15.\nPrescribed transit shed\n15. The compartment at the eastern end of the terminal building at Owen Roberts\nAirport is prescribed to be a transit shed.\nPART IV - Warehouse\n16.\nWarehouses, classes of goods, etc.\n16. The Governor may, from time to time, by notice in the Gazette prescribe \u2014\n(a)\nthe class or classes of goods which may be deposited in any warehouse;\n(b) the hours of business of any warehouse for the purpose of \u2014\n(i)\nmaking deposits therein; and\n(ii) making withdrawals therefrom; and\n(c)\nspecial rules for the conduct of the business of any warehouse.\n\nCustoms Regulations\nRegulation 17\n\nc\nRevised as at 31st day of July, 2011\nPage 11\n\n17.\nForms of deposit, etc\n17. (1) There shall, within the time prescribed, if any, be submitted to Customs in\nrespect of all goods \u2014\n(a)\ndeposited in a warehouse;\n(b) cleared for home consumption;\n(c)\nremoved from one warehouse to another; and\n(d) re-exported,\nthe appropriate entry and clearance form in Form C in Schedule 1. In case (a)\nthe form shall be submitted in triplicate and in cases (b), (c) and (d) in\nduplicate.\n(2) All goods the subject of paragraphs (b), (c) and (d) of subregulation (1), shall\nbe cleared from a warehouse within three working days of the passing of the\nentry relevant thereto.\n18.\nLanded account\n18. Before the deposit in any warehouse of any consignment of goods, Customs shall\nexamine such goods and raise a landed account thereof.\n(2) A copy of every landed account shall be supplied in the importer of the\nrelevant consignment who may produce such copy in support of any claim for\nloss or damage incurred to such consignment up to the time of\u2019 the removal\nthereof from the transit shed.\n(3) Every warehouse keeper shall check every consignment of goods deposited in\nhis warehouse against the landed account relevant to such consignment and\nshall make immediate report to Customs of any discrepancy between the\nactual quantity and condition of such goods and landed account thereof.\n(4) Upon receipt of a report under subregulation (3), Customs shall re- examine\nthe relevant goods and make such adjustment to the landed account as may be\njustified under section 22(3).\n19.\nApproved transport\n19. The Collector may, from time to time, by notice in the Gazette approve certain\npersons as transporters for the purpose of section 17(1) and may revoke such\napproval.\n20.\nWarehouse rotation number\n20. Every warehouse keeper upon receipt of a consignment of goods shall, under the\ndirection of the Collector, mark each package of such consignment with a serial\nnumber to be known as the warehouse \u201crotation number\u201d.\n\nRegulation 21\nCustoms Regulations\n\nPage 12\nRevised as at 31st day of July, 2011\nc\n\n21.\nWarehouse register\n21. Every warehouse keeper shall maintain in a form approved by the Collector a\nregister of all consignments of goods deposited in his warehouse which shall be\nidentified therein by the relevant rotation number.\n22.\nManner of stowage\n22. Every warehouse keeper shall stow, or cause to be stowed, every consignment of\ngoods deposited in such a manner that \u2014\n(a)\nthe rotation number can readily be seen; and\n(b) the goods are accessible for the purpose of checking quantity and quality\nand for the purposes of section 22(3).\n23.\nOperations by warehouse keepers\n23. (1) Every warehouse keeper may, by virtue of section 22(6), conduct the\nfollowing operations \u2014\n(a)\nrepair damaged packages:\n(b) repack goods into sound packages;\n(c)\nmake up deficiencies in packages, varying if necessary the total number\nof such packages;\n(d) clean and relabel cartons, packages and bottles; and\n(e)\ndestroy and dispose of damaged or defective goods.\n(2) Before conducting any operation under subregulation (1), every warehouse\nkeeper shall give not less than twenty-four hours\u2019 notice thereof to Customs.\n(3) When, for any purpose of subregulation (1), new packages are used such\npackages shall be marked with the relevant rotation number.\n24.\nWithdrawal conditions\n24. No warehoused goods may be withdrawn in amounts of less than one case save for\nthe purposes of \u2014\n(a)\ndrawing samples;\n(b) clearing a remnant case; or\n(c)\nfor shipment as stores.\n25.\nRemnants\n25. No remnant case shall remain on deposit in any warehouse for a period exceeding\nfourteen days.\n\nCustoms Regulations\nRegulation 26\n\nc\nRevised as at 31st day of July, 2011\nPage 13\n\n26.\nDeposit against withdrawals\n26. The Collector may accept in advance from any warehouse keeper a deposit of an\nagreed fixed sum against withdrawals from the relevant warehouse over a period of\nany one week provided that \u2014\n(a)\nthe fixed deposit is paid on the first working day of the week of\nwithdrawal; and\n(b) all amounts due in respect of such withdrawals are accounted for on the\nfirst working day of the week following.\n27.\nWithdrawals for certain purposes\n27. Whenever goods are to be removed from a warehouse otherwise than against\npayment of duty or under regulation 26, the owner thereof shall either \u2014\n(a)\ndeposit with Customs the relevant amount of duty; or\n(b) deliver to Customs a Removable Bond in Form D in Schedule 1 and\nissued by a bank licensed under the Banks and Trust Companies Law\n(2009 Revision),\nwhich deposit shall be repaid or bond discharged, as the case may be, upon\nreturn of the relevant goods to Customs control.\n28.\nAlterations\n28. No alteration shall be made to the structure or accommodation of any warehouse\nunless leave in that behalf has first been accorded in writing by the Governor.\n29.\nSecurity\n29. Every warehouse keeper shall forthwith inform the Collector of any fire, breaking\nor other incident affecting the security of the warehouse for which he is responsible\nor any of the contents thereof.\n30.\nCustoms facilities\n30. Every warehouse keeper shall provide desk space and toilet facilities for the use of\nCustoms officers engaged in duty in the warehouse for which he is responsible.\n31.\nOnly uncustomed goods to be stored\n31. No customed goods shall be stored in any warehouse.\n32.\nWorking hours\n32. Subject to any special directions given by the Collector from time to time,\nwarehouses may be open for business only on days other than public holidays and at\nthe following times \u2014\n\nRegulation 33\nCustoms Regulations\n\nPage 14\nRevised as at 31st day of July, 2011\nc\n\n(a)\non Saturdays from 8:00 a.m. until 12:00 p.m.;\n(b) from Mondays to Fridays inclusive from 8:00 a.m. to 12:00 p.m. and\nfrom 1:00 p.m. until 4:00 p.m.\n33.\nGoods which may be stored\n33. Subject to any special leave given by the Collector from time to time in writing, no\ngoods shall be stored in any warehouse other than \u2014\n(a)\npotable spirits, wines, beers, cider and perry; and\n(b) tobacco and tobacco products.\nPART V - Special Attendance\n34.\nPowers of Collector\n34. The powers of the Collector under paragraph (c)(i) of section 7 may be exercised\nupon the following conditions \u2014\n(a)\nin the case of the withdrawal of goods from a warehouse, the giving of\nnot less than twenty-four hours\u2019 notice in writing to the Collector;\n(b) in the case of any Customs activity at an airport, the giving of not less\nthan twenty-four hours\u2019 notice in writing to the Collector, but, in the case\nof non-commercial flights, an immediate request by telephone may be\naccepted;\n(c)\nin the case of any Customs activity at a seaport, the giving of not less\nthan four hours\u2019 notice in writing to the Collector; or\n(d) in the case of Customs attendance required with regard to goods in\ndanger of perishing, an immediate request by telephone may be accepted,\nand, in all the above cases, the giving of a deposit or bond to secure payment\nof the special attendance charge prescribed.\n35.\nExercise of powers\n35. The powers of the Collector under paragraph (c)(ii) of section 7 may be exercised\nupon condition that payment of the special attendance charge as prescribed is\nsecured by the giving of a deposit or bond.\n36.\nCharges\n36. The charge for special attendance shall be calculated from the time when such\nattendance is requested to be made available, regardless of whether or not the\nperson requesting such attendance is then ready to make use of the service so\nrequested.\n\nCustoms Regulations\nRegulation 37\n\nc\nRevised as at 31st day of July, 2011\nPage 15\n\n37.\nApportionment of charges\n37. Where special attendance is required upon more than one person, the amount\nchargeable for such attendance shall be apportioned between such persons upon the\nbasis of these regulations.\n38.\nMinimum time of attendance\n38. Special attendance arising from a telephone request made under paragraph (b) of\nregulation 34 shall be deemed to be for a minimum period of two hours.\n39.\nRate of charge\n39. Special attendance is charged at the Customs Department\u2019s rate of overtime pay as\nauthorised, from time to time, by the Government.\nPART VI - Anthrax\n40.\nImport prohibition\n40. The importation directly or indirectly from any country specified in Schedule 2 of\nany animal or tissue of any animal or any goods comprised wholly or partly of the\ntissue of any animal is prohibited.\nPART VII - Bonded Duty-free Shops\n41.\nPrescribed goods\n41. The Governor may, by notice in the Gazette, prescribe the class or classes of bonded\nduty-free goods which may be deposited in a bonded duty-free shop.\n42.\nBond\n42. Every shopkeeper shall enter into a bond in a comprehensive form, with an\napproved surety, to comply with the terms of the conditions of approval and to\nprovide security for the duty on the maximum quantity of uncustomed goods likely\nto be in the shop at any one time.\n43.\nSecurity\n43. The shopkeeper shall be responsible for the physical security of the shop covered by\nhis bond, and for safeguarding the revenue by protecting the goods from improper\ninterference or removal irrespective of any official controls that may be applied.\nThe shop keeper shall forthwith inform the Collector in writing of any incident\naffecting the security of the shop for which he is responsible or affecting any of the\ncontents thereof.\n\nRegulation 44\nCustoms Regulations\n\nPage 16\nRevised as at 31st day of July, 2011\nc\n\n44.\nLosses\n44. If, at any time after the goods have been deposited in a bonded duty-free shop and\nbefore they are lawfully removed therefrom, they are found to be missing or\ndeficient and it is not shown to the satisfaction of the Collector that the absence or\ndeficiency can be accounted for by natural wastage, accident or other legitimate\ncause, then without prejudice to any penalty or forfeiture incurred under the Law or\nany other law, the Collector may require the shopkeeper to pay forthwith the whole\nor any part of the duty due on the missing goods or on the whole or any part of the\ndeficiency.\n45.\nHours of opening\n45. Subject to any special directions given by the Collector, a bonded duty-free shop at\nan airport may be open for the sale of uncustomed goods only from ninety minutes\nbefore the scheduled time of departure of an international flight until the actual\ndeparture of that flight.\n46.\nReceipts into shop\n46. Except with the prior consent of the Collector, the import account of all uncustomed\ngoods shall be taken before their receipt into the shop. On receipt of the goods in the\nshop, the shopkeeper shall advise receipt to the Collector, and produce the goods to\nan officer for examination as and when required.\n47.\nCustomed goods\n47. No customed spirits, wines or tobacco shall be stored in a bonded duty-free shop.\n48.\nSales\n48. Sales from a bonded duty-free shop shall be made only to entitled passengers and\naircrew who are about to depart in an aircraft for a destination outside the Islands.\nPassengers shall be required to produce boarding-cards to prove their entitlement\nand the flight-numbers and seats allocated to them shall be noted in the\nshopkeeper\u2019s records.\n49.\nWrapping, etc., after sale\n49. All goods shall be placed in a package marked with the name of the airport and\ncontaining a written warning that it must be exported unopened. Packages shall be\nclosed by sealing or stapling immediately the goods are sold, and an invoice or till\nreceipt identifying the goods shall be fixed to each customer\u2019s airline ticket or\nboarding-card.\n\nCustoms Regulations\nRegulation 50\n\nc\nRevised as at 31st day of July, 2011\nPage 17\n\n50.\nDisplay of notices\n50. Shopkeepers shall make arrangements to ensure that notices are displayed advising\npassengers that they are entitled to purchase duty-free goods only if they are about\nto depart on an aircraft for a destination outside the Islands, and that all goods must\nbe exported intact by entitled passengers. The notice shall also contain a warning\nthat illegal purchase or disposal of uncustomed goods is an offence under the Law\nwhich may attract severe penalties, including confiscation of the goods.\n51.\nRecords\n51. Every shopkeeper shall maintain, in a form approved by the Collector, a register of\nall uncustomed goods deposited in his bonded duty-free shop and of all\ntransactions made.\n52.\nOfficial inspections\n52. Every shopkeeper shall, on demand, allow any officer authorised by the Collector to\nenter the premises at any time and to have access to all approved areas for the\npurposes of search or enquiry. Goods shall be stored in such a manner as to allow\nthe officer easy access for the purposes of inspection or taking stock at any time.\n53.\nInspection of accounts\n53. The register shall be kept at the bonded duty-free shop and be available for\ninspection by an officer at any time. The officer may take such extracts of the\nparticulars and make such entries in the accounts as he may require and may sign or\ninitial any of the records. He may also require the production of any document or\naccount relating to the goods and may make copies or take extracts from these\ndocuments.\n54.\nReturns\n54. The shopkeeper shall deliver returns of sales and stock in such manner and at such\ntimes as the Collector shall require.\n55.\nStocktaking\n55. At least once a quarter every shopkeeper shall take physical stock of all bonded\ngoods in the shop. Prior notice of the intended stocktaking shall be given to the\nofficer. A return shall be delivered to the officer showing the quantity of goods in\nstock on the day on which the stock was taken. This return shall be certified as\naccurate by the shopkeeper.\n\nRegulation 56\nCustoms Regulations\n\nPage 18\nRevised as at 31st day of July, 2011\nc\n\nPART VIII - Charges for Goods Held in the Transit Shed and\nthe Queen\u2019s Warehouse at Owen Roberts Airport\n56.\nCharges for the transit shed\n56.
