Public Lands Regulations (2024 Revision) Regulation 3 PART 2 - PUBLIC ACCESS TO PUBLIC LAND\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_3\", \"num\": \"3.\", \"text\": \"Maintaining public access to public land and removing obstacles 3. (1) The Commission may, in order to protect the right of access to and use of public land by members of the public \u2014 (a) clear and maintain any public right of way, public footpath or public thoroughfare over private or public land; and (b) remove any sign, obstruction or obstacle from such right of way, footpath, thoroughfare or public land. (2) Where the Commission incurs any expenses in removing obstructions or obstacles from a public right of way, footpath or thoroughfare under this regulation, the Commission may recover the expenses as a civil debt due to the Crown from any person who has blocked or obstructed such public right of way, footpath or thoroughfare.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_4\", \"num\": \"4.\", \"text\": \"Times of opening of public land and facilities 4. (1) The Commission may post a notice of the days and hours of opening and closing of public land or a facility on public land in accordance with paragraph (2). (2) The Commission shall \u2014 (a) place the notice referred to in paragraph (1) in a conspicuous place at the entrance to the public land or the facility on the public land; and (b) without delay, update the notice of any change in the opening or closing time of the public land or the facility on the public land.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_5\", \"num\": \"5.\", \"text\": \"Closure of public land and facilities 5. (1) The Commission, upon written direction from the Cabinet, may close an area of public land or a facility on public land either temporarily or permanently to the public, by \u2014 (a) designating the area of public land or the facility on public land as \u201cclosed to public use\u201d or subject to \u201can emergency closure\u201d; or (b) designating \u201cno admittance\u201d, \u201cclosed to public use\u201d and \u201cno trespassing\u201d areas in respect of the public land or the facility on public land. (2) The Commission shall publish a notice in the Gazette of any designation made under paragraph (1), other than a designation of an emergency closure. (3) The Commission shall notify in writing the Commissioner of Police of any closure of an area of public land or a facility on public land under paragraph (1). (4) The Commission shall \u2014 (a) post the designation in a conspicuous place at the entrance to the public land or the facility on public land; and Regulation 6 Public Lands Regulations (2024 Revision) (b) in the event of any change in the designation, amend the notice under paragraph (2) without delay, and publish the amended notice in the Gazette. 6. Entry into restricted or closed areas 6. (1) A person shall not, without lawful authority, enter any \u2014 (a) public land or facility on public land before the posted time for opening or after the posted time for closing; or (b) public land or facility on public land which is closed in accordance with regulation 5. (2) A person who contravenes paragraph (1) commits an offence and is liable on summary conviction to a fine of five hundred dollars. PART 3 - TRAFFIC CONTROL\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_7\", \"num\": \"7.\", \"text\": \"Operating vehicles on public land 7. (1) A person shall not, without a permit, drive a vehicle on public land, except on roads, driveways or parking areas designated for such purpose. (2) The Commission may, in consultation with the Traffic Management Panel, post speed limits, traffic signs or traffic control measures regulating the use of vehicles on public land. (3) A person shall not operate a vehicle on public land in excess of posted speed limits or in breach of posted traffic signs or traffic control measures. (4) This regulation does not apply to a person authorised to operate an emergency vehicle or an inspector. (5) A person who contravenes paragraph (1) or (3) commits an offence and is liable on summary conviction to a fine of five hundred dollars.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_8\", \"num\": \"8.\", \"text\": \"Parking 8. (1) Subject to paragraphs (3) and (4), a person shall not, other than in Cayman Brac or Little Cayman \u2014 (a) park a motor vehicle, trailer, boat or other vessel on public land, except in a parking area designated for such purpose; or (b) park or leave a motor vehicle, trailer, boat or other vessel on public land after the closing time of a parking area designated for such purpose or after the posted time for closing of the public land or the facility on public land. (2) Paragraph (1)(b) does not apply where a person notifies the Commission, in accordance with paragraph (3) and (4), of the person\u2019s intention to park overnight on public land after the closing time of the parking area designated Public Lands Regulations (2024 Revision) Regulation 8 for such purpose or after the posted time for closing of the public land or the facility on public land, the person\u2019s trailer, car or other motor vehicle for the purpose of a fishing excursion. (3) A person referred to in paragraph (2) shall notify the Commission by \u2014 (a) telephone call or message to the secretary to the Commission; (b) email to the official email address of the Commission; (c) text message to the official mobile telephone number of the Commission; or (d) letter addressed and delivered to the office of the Commission. (4) A person referred to in paragraph (2), when notifying the Commission in accordance with paragraph (3), shall provide to the Commission the following information, in respect of the trailer, car or other motor vehicle referred to in paragraph (2) \u2014 (a) the name of its owner; (b) the telephone number of its owner; and (c) its license plate number. (5) A person who contravenes paragraph (1) commits an offence and is liable on summary conviction to a fine of \u2014 (a) one thousand dollars in respect of a first offence; and (b) two thousand dollars for a subsequent offence, and if the offence is a continuing offence, one hundred dollars for each day or part of a day during which the offence continues but not exceeding a total maximum fine of two thousand dollars for the continuing offence. (6) An inspector, upon finding a motor vehicle, trailer, boat or other vessel parked or left contrary to this regulation, may have it towed and stored in a suitable place, at the expense of the owner. (7) For the purposes of this regulation \u2014 (a) a reference to \u201cmotor vehicle\u201d or \u201cvessel\u201d shall not include an emergency vehicle; and (b) the official address, official email address, official telephone number or official mobile phone number of the Commission shall be considered as the respective address, email address, telephone number or mobile phone number of the Commission so indicated on any official Government website or other official means of communication. Regulation 9 Public Lands Regulations (2024 Revision) 9. Overnight docking, etc. 9. (1) A person shall not, except in accordance with the terms and conditions of a permit, do any of the following on public land or at a public wharf, ramp, dock or jetty \u2014 (a) dock a boat or vessel overnight; (b) service or repair a boat or vessel or cause it to be serviced or repaired; or (c) use the wharf, ramp, dock or jetty for commercial purposes. (2) A person shall not dock a boat or vessel at a public wharf, ramp, dock or jetty, or use the wharf, ramp, dock or jetty, except \u2014 (a) for the purpose of loading or unloading the boat or vessel; or (b) with the consent of a law enforcement agency. (3) A person who contravenes paragraph (1) or (2) commits an offence and is liable on summary conviction to a fine of \u2014 (a) one thousand dollars in respect of a first offence; and (b) two thousand dollars for a subsequent offence, and if the offence is a continuing offence, one hundred dollars for each day or part of a day during which the offence continues but not exceeding a total maximum fine of two thousand dollars for the continuing offence. PART 4 - RECREATIONAL ACTIVITIES\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_10\", \"num\": \"10.\", \"text\": \"Recreational activities in general 10. (1) The Commission may post signs prohibiting or regulating recreational activities in particular areas of public land. (2) A person shall not engage in a game or recreational activity on public land \u2014 (a) in a manner that contravenes a prohibition or rule on a sign posted by the Commission under paragraph (1); or (b) in such a manner as to \u2014 (i) subject any other person not engaged in the game or activity to a substantial risk of injury, without the other person\u2019s consent; or (ii) expose a facility or property to a substantial risk of damage. (3) A person who contravenes paragraph (2) commits an offence and is liable on summary conviction to a fine of \u2014 (a) five hundred dollars in respect of a first offence; and (b) seven hundred and fifty dollars for a subsequent offence, Public Lands Regulations (2024 Revision) Regulation 11 and if the offence is a continuing offence, one hundred dollars for each day or part of a day during which the offence continues but not exceeding a total maximum fine of two thousand dollars for the continuing offence. (4) Notwithstanding paragraph (3), where a person causes damage to a facility or property, the cost for the repair of the facility or property may be recovered, as a civil debt due to the Crown, from any person who caused such damage to the facility or property.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_11\", \"num\": \"11.\", \"text\": \"Non-motorised vehicles 11. (1) The Commission may post traffic signs or traffic control measures regulating the use of pedal bicycles, skateboards, scooters, rollerblades or other nonmotorised means of transport on public land. (2) A person who operates a pedal bicycle, skateboard, scooter, rollerblades or other non-motorised means of transport on public land shall comply with posted traffic signs and traffic control measures regulating non-motorised vehicles. (3) A person who contravenes paragraph (2) commits an offence and is liable on summary conviction to a fine of one hundred dollars.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_12\", \"num\": \"12.\", \"text\": \"Horses and horseback riding 12. (1) A person shall not, without a permit, ride a horse on public land. (2) A person who contravenes paragraph (1) commits an offence and is liable on summary conviction to a fine of \u2014 (a) one thousand dollars in respect of a first offence; and (b) two thousand dollars for a subsequent offence, and if the offence is a continuing offence, one hundred dollars for each day or part of a day during which the offence continues but not exceeding a total maximum fine of two thousand dollars for the continuing offence. (3) This regulation does not apply to a person who rides a horse at the Agricultural Grounds or along Barker\u2019s Beach or Barker\u2019s National Park. 13. Camping 13. (1) A person who is not legally and ordinarily resident in the Islands shall not camp on public land unless the person has a permit to do so and camps in accordance with the terms and conditions of the permit. (2) A person who is legally and ordinarily resident in the Islands may camp on public land, without a permit, in the following circumstances \u2014 (a) for a period not exceeding five consecutive days; (b) on a public general holiday; Regulation 14 Public Lands Regulations (2024 Revision) (c) notwithstanding paragraph (a), for a period of seven days prior to, or seven days following, a public general holiday; or (d) notwithstanding paragraphs (a) and (c) \u2014 (i) for a period of ten days prior to Good Friday; (ii) for a period of ten days following Easter Monday; or (iii) a period of time prior to Good Friday and following Easter Monday, where the total period does not exceed ten days. (3) A person who contravenes this regulation commits an offence and is liable on summary conviction to a fine of five hundred dollars. PART 5 - PROHIBITED CONDUCT AND BEHAVIOUR\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_14\", \"num\": \"14.\", \"text\": \"Audio devices and noise 14. (1) Subject to paragraph (2), a person shall not, on public land or in a facility on public land, make noise that is likely to cause annoyance or discomfort to other members of the public by operating \u2014 (a) a powered public address system, amplified music speaker system, sound emitting electronic equipment including electrical speakers, radio, phonograph, television or other such equipment; (b) engine-driven equipment, electric generators and compressors; or (c) a portable radio or music player, where the person has been required by a law enforcement agency to desist from making such noise. (2) Paragraph (1) does not apply to national events and political meetings. (3) A person who contravenes paragraph (1) commits an offence and is liable on summary conviction to a fine of five hundred dollars.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_15\", \"num\": \"15.\", \"text\": \"Indecent conduct 15. (1) A person shall not engage in indecent conduct on public land. (2) A person who contravenes paragraph (1) commits an offence and is liable on summary conviction to a fine of one thousand dollars. (3) For the purposes of this regulation, \u201cindecent conduct\u201d includes \u2014 (a) urinating or defecating in places other than those designated for such purposes; (b) displaying nudity; or (c) engaging in sexual intercourse or other sexual acts. Public Lands Regulations (2024 Revision) Regulation 16 16. Barbequing and fires 16. (1) A person shall not start or maintain a cooking fire on public land except in \u2014 (a) a public barbeque facility; (b) a personal portable barbeque or fire pit; or (c) a personal portable stove. (2) A person shall not start or maintain a bonfire or open fire on public land except in accordance with the terms and conditions of a permit. (3) A person shall not leave an open fire or live coals unattended in a picnic area or other area on public land. (4) A person who contravenes paragraph (1), (2) or (3) commits an offence and is liable on summary conviction to a fine of \u2014 (a) one thousand dollars in respect of a first offence; and (b) two thousand dollars for a subsequent offence, and if the offence is a continuing offence, one hundred dollars for each day or part of a day during which the offence continues but not exceeding a total maximum fine of two thousand dollars for the continuing offence. PART 6 - PROTECTION OF PUBLIC LANDS\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_17\", \"num\": \"17.\", \"text\": \"Destroying or removing property, plants, filling material, etc. 17. (1) Subject to paragraph (2), a person shall not \u2014 (a) deface, destroy, damage, misuse, or defile any building, structure, fence, wall, bridge, sign, light or other work or thing on public land or at a facility on public land; (b) tamper with or destroy any water system or utility on public land or at a facility on public land or divert or remove water or electricity from such water system or utility; (c) deface, destroy, damage, misuse, or defile any plant or animal material on public land or at a facility on public land; or (d) deface, destroy, damage or tamper with a security camera on public land or at a facility on public land. (2) A person may take or remove \u2014 (a) by non-mechanical means; and (b) for domestic propagation purposes, any part of a plant referred to in paragraph 1(c). Regulation 18 Public Lands Regulations (2024 Revision) (3) A person who contravenes paragraph (1) commits an offence and is liable on summary conviction to a fine of \u2014 (a) one thousand dollars in respect of a first offence; and (b) two thousand dollars for a subsequent offence, and if the offence is a continuing offence, one hundred dollars for each day or part of a day during which the offence continues but not exceeding a total maximum fine of two thousand dollars for the continuing offence.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_18\", \"num\": \"18.\", \"text\": \"Littering, dumping or storage 18. (1) A person shall not \u2014 (a) deposit, leave, or spill refuse or other substances; or (b) store material of any description, on public land or at a facility on public land, other than in such places as are designated for that purpose. (2) A person shall not clean or dispose of fish or shellfish on public land except at a public dock or public boat ramp. (3) A person who contravenes paragraph (1) or (2) commits an offence and is liable on summary conviction to a fine of \u2014 (a) five hundred dollars in respect of a first offence; and (b) seven hundred and fifty dollars for a subsequent offence, and if the offence is a continuing offence, one hundred dollars for each day or part of a day during which the offence continues but not exceeding a total maximum fine of two thousand dollars for the continuing offence. 19. Construction of structures, road, etc. 19. (1) A person shall not erect or construct any temporary structure, road, driveway, wall, bridge or other work on public land or at a facility on public land except in accordance with the terms and conditions of a permit for the utilisation of that public land or facility. (2) A person who contravenes paragraph (1) commits an offence and is liable on summary conviction to a fine of \u2014 (a) one thousand dollars in respect of a first offence; and (b) two thousand dollars for a subsequent offence, and if the offence is a continuing offence, one hundred dollars for each day or part of a day during which the offence continues but not exceeding a total maximum fine of two thousand dollars for the continuing offence. Public Lands Regulations (2024 Revision) Regulation 20 (3) This regulation does not apply to \u2014 (a)  a government entity; (b)  a national event; and (c)  a political meeting. (4) For the purposes of this regulation \u2014 \u201cgovernment entity\u201d means any body of the Government and includes a ministry, portfolio, statutory authority, government company, the Office of the Ombudsman, the Office of the Director of Public Prosecutions, and the Audit Office; and \u201ctemporary structure\u201d does not include a tent used for a camp. PART 7 \u2013 ANIMALS\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_20\", \"num\": \"20.\", \"text\": \"Control of animals 20. (1) A person in charge of an animal shall not bring or allow the animal to be on public land unless \u2014 (a) the animal is on a leash or lead or in a cage; (b) the animal is at all times entirely within the control of the person; and (c) while on the respective public land, the person immediately cleans up, removes and disposes of the animal\u2019s defecation. (2) A person who contravenes paragraph (1) commits an offence and is liable on summary conviction to a fine of \u2014 (a) one thousand dollars in respect of a first offence; and (b) two thousand dollars for a subsequent offence, and if the offence is a continuing offence, one hundred dollars for each day or part of a day during which the offence continues but not exceeding a total maximum fine of two thousand dollars for the continuing offence.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_21\", \"num\": \"21.\", \"text\": \"Areas where animals prohibited 21. (1) A person in charge of an animal shall not bring or allow the animal on any athletic playing area, children\u2019s playground area or in any facility unless the Commission or the manager of the facility has posted a sign permitting the animal to be there. (2) A person who contravenes paragraph (1) commits an offence and is liable on summary conviction to a fine of \u2014 (a) one thousand dollars in respect of a first offence; and (b) two thousand dollars for a subsequent offence, Regulation 22 Public Lands Regulations (2024 Revision) and if the offence is a continuing offence, one hundred dollars for each day or part of a day during which the offence continues but not exceeding a total maximum fine of two thousand dollars for the continuing offence. (1) Notwithstanding regulation 20(1), a person shall not leave unsupervised any livestock to run on public land. (2) A person shall not leave unsupervised any livestock to pasture or graze on public land, except on the Agricultural Grounds. (3) A person who contravenes paragraph (1) or (2) commits an offence and is liable on summary conviction to a fine of \u2014 (a) one thousand dollars in respect of a first offence; and (b) two thousand dollars for a subsequent offence, and if the offence is a continuing offence, one hundred dollars for each day or part of a day during which the offence continues but not exceeding a total maximum fine of two thousand dollars for the continuing offence. (4) In this regulation, \u201clivestock\u201d includes cattle, pigs, horses, sheep, goats or donkeys. PART 8 - COMMERCIAL ACTIVITIES AND ORGANISED EVENTS\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_23\", \"num\": \"23.\", \"text\": \"Sale of alcohol 23. (1) Subject to paragraph (2), a person shall not, on public land or at a facility on public land, organise an event for commercial purposes for a group of twentyfive or more persons except in accordance with the terms and conditions of a permit. (2) This regulation does not apply to \u2014 (a) a tour group that stops on public land or at a facility for touring, sightseeing or a picnic; (b) a school group on public land for an educational purpose; (c) a marriage ceremony; (d) a national event; (e) a political meeting; (f) a religious organisation or church; (g) a group carrying out activities on public land in the public interest, such as cleaning up or maintaining beaches; (h) an event organised by a registered non-profit organisation for the purposes of charity fundraising; or (i) a one-time non-profit fundraising event which does not require registration under the Non-Profit Organisations Act (2020 Revision). (3) A person who contravenes paragraph (1) commits an offence and is liable on summary conviction to a fine of \u2014 (a) one thousand dollars in respect of a first offence; and (b) two thousand dollars for a subsequent offence, and if the offence is a continuing offence, one hundred dollars for each day or part of a day during which the offence continues but not exceeding a total maximum fine of two thousand dollars for the continuing offence. 25. Signage 25. (1) A person, other than a person referred to in paragraph (3), shall not erect any sign, billboard or other type of marketing material on public land except in accordance with the terms and conditions of a permit. (2) The Commission may remove any sign, billboard or other marketing material erected on public land and such removal shall be at the expense of the person who erected or caused the erection of such marketing material. (3) A person or political party who is nominated as a candidate for a general election of members of the Parliament under the Elections Act (2022 Revision) may erect election signage without requiring a permit under this regulation for the period Regulation 26 Public Lands Regulations (2024 Revision) commencing on the date of nomination and ending on the date of election as determined by the Elections Act (2022 Revision). (4) A person who contravenes paragraph (1) commits an offence and is liable on summary conviction to a fine of \u2014 (a) one thousand dollars in respect of a first offence; and (b) two thousand dollars for a subsequent offence, and if the offence is a continuing offence, one hundred dollars for each day or part of a day during which the offence continues but not exceeding a total maximum fine of two thousand dollars for the continuing offence. (5) For the purposes of paragraph (3), \u201celection signage\u201d means an outdoor sign that displays information or issues regarding the general election for or against a candidate in the upcoming general election. PART 9 \u2013 PERMITS\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_26\", \"num\": \"26.\", \"text\": \"Application for a permit other than a vendor\u2019s permit 26. (1) Where a person wishes to apply for a permit required under these Regulations, other than a vendor\u2019s permit, the person shall apply to the Commission in accordance with the procedure set out in this regulation. (2) An applicant under paragraph (1) shall submit to the Commission an application in writing which sets out the person\u2019s proposed use of, or activities on, public land. (3) The application referred to in paragraph (2) shall be accompanied by \u2014 (a) a non-refundable application fee of fifty dollars; (b) the relevant fee set out in Schedule 1; and (c) such other information or particulars relating to the application as the Commission may determine. (4) Subject to paragraph (5), where the Commission is satisfied that the application complies with the principal Act and these Regulations, the Commission may issue a permit, other than a vendor\u2019s permit, to the applicant to use public land or to carry out the activity in the manner proposed in the application. (5) A permit issued under this regulation shall be subject to such terms and conditions as the Commission may specify in order to minimise public disturbance on, or to protect, public land.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_27\", \"num\": \"27.\", \"text\": \"Application for vendor\u2019s permit 27. (1) An applicant for a vendor\u2019s permit under section 15 of the principal Act shall provide the following to the Commission \u2014 Public Lands Regulations (2024 Revision) Regulation 28 (a) an application in writing which sets out the applicant\u2019s proposed use of, or activities on, public land; (b) a declaration that the applicant will apply for a licence \u2014 (i) under the Trade and Business Licencing Act (2019 Revision), if a trade and business licence is required by that Act; and (ii) under the Liquor Licensing Act (2019 Revision), if the application involves the sale of alcohol on public land; (c) where the application is for renewal of a vendor\u2019s permit, evidence of compliance with the Acts in force in the Islands relating to pensions and to health insurance; (d) such other information or particulars relating to the application as the Commission may determine; and (e) the application fee prescribed under regulation 28. (2) Where an application contains a declaration referred to in paragraph (1)(b), the Commission may issue a provisional vendor\u2019s permit on such terms or conditions as specified by the Commission, subject to the applicant demonstrating to the Commission, within the timeframe specified by the Commission in the provisional permit, that the applicant has \u2014 (a) obtained the licence referred to in the declaration; and (b) satisfied any other terms or conditions specified by the Commission in the provisional vendor\u2019s permit. (3) Subject to paragraph (4), the Commission may grant, on such terms or conditions as specified by the Commission, a vendor\u2019s permit to the holder of a provisional vendor\u2019s permit who \u2014 (a) has obtained the relevant licence referred to in paragraph (2)(a); and (b) where applicable, has satisfied the terms or conditions referred to in paragraph (2)(b). PRELIMINARY\n1.\nCitation\n1.\nThese Regulations may be cited as the Public Lands Regulations (2024 Revision).\n2.\nDefinitions\n2.\nIn these Regulations \u2014\n\u201cAgricultural Grounds\u201d means the agricultural lands located in Grand Cayman\nat Block 32B, Parcels 270 and 143 or in Cayman Brac at Block 101A Parcel\n22REM2;\n\u201cBarker\u2019s Beach\u201d includes all that area of beach which is located at the western\nextremity from a line due north at latitude North 19\u00b0 23' 44\"and longitude West\n81\u00b0 22' 50\"and on the eastern extremity a line due north at latitude North 19\u00b0\n23' 17\" and longitude West 81\u00b0 21' 59\";\n\u201cBarker\u2019s National Park\u201d includes all the area, comprising of land, water\nfeatures and mangroves, East of a line due south from latitude North 19\u00b0 23' 33\"\nand longitude West 81\u00b0 22' 32\", to latitude North 19\u00b0 23' 26\" and longitude West\n81\u00b0 22' 37\", to latitude North 19\u00b0 23' 23\" and longitude West 81\u00b0 22' 33\", to\nlatitude North 19\u00b0 23' 11\" and longitude West 81\u00b0 22' 38\", to latitude North 19\u00b0\n\nRegulation 2\nPublic Lands Regulations (2024 Revision)\n\nPage 6\nRevised as at 31st December, 2023\nc\n\n23' 10\" and longitude West 81\u00b0 22' 35\", ending at latitude North 19\u00b0 22' 59\" and\nlongitude West 81\u00b0 22' 28\";\n\u201ccamp\u201d means \u2014\n(a) to erect a tent or shelter of natural or synthetic material;\n(b) to prepare a sleeping bag or other bedding material for use;\n(c) to park a motor vehicle, motor home or trailer; or\n(d) to moor a vessel for the apparent purpose of overnight occupancy;\n\u201cCommissioner of Police\u201d means the person appointed to that office under the\nPolice Act (2021 Revision);\n\u201cemergency vehicle\u201d has the meaning assigned by section 2 of the Traffic Act\n(2023 Revision);\n\u201claw enforcement agency\u201d means \u2014\n(a)\nthe Customs and Border Control Service as established under section 3 of\nthe Customs and Border Control Act (2024 Revision);\n(b) the department of Government responsible for commerce and investment;\n(c)\nthe department of Government responsible for the environment;\n(d) the inspectorate appointed under section 11 of the principal Act;\n(e)\nthe Royal Cayman Islands Police Service; or\n(f)\nthe Workforce, Opportunities and Residency Cayman Office as defined\nunder section 2 of the Immigration (Transition) Ac (2022 Revision);\n\u201cmotor vehicle\u201d has the meaning assigned by section 2 of the Traffic Act (2023\nRevision);\n\u201cpermit\u201d means a permit issued by the Commission under regulation 27;\n\u201cprincipal Act\u201d means the Public Lands Act (2020 Revision);\n\u201cpublic general holiday\u201d has the meaning assigned by section 2 of the Public\nHolidays Act (2007 Revision);\n\u201cTraffic Management Panel\u201d means the body established under section 107 of\nthe Traffic Act (2023 Revision);\n\u201cunauthorised\u201d means not permitted in accordance with these Regulations or\na permit granted under these Regulations; and\n\u201cvehicle\u201d has the meaning assigned by section 2 of the Traffic Act (2023\nRevision).\n\nPublic Lands Regulations (2024 Revision)\nRegulation 3\n\nc\nRevised as at 31st December, 2023\nPage 7\n\nPART 2 - PUBLIC ACCESS TO PUBLIC LAND\n3.\nMaintaining public access to public land and removing obstacles\n3.\n(1) The Commission may, in order to protect the right of access to and use of public\nland by members of the public \u2014\n(a)\nclear and maintain any public right of way, public footpath or public\nthoroughfare over private or public land; and\n(b) remove any sign, obstruction or obstacle from such right of way, footpath,\nthoroughfare or public land.\n(2) Where the Commission incurs any expenses in removing obstructions or\nobstacles from a public right of way, footpath or thoroughfare under this\nregulation, the Commission may recover the expenses as a civil debt due to the\nCrown from any person who has blocked or obstructed such public right of way,\nfootpath or thoroughfare.\n4.\nTimes of opening of public land and facilities\n4.\n(1) The Commission may post a notice of the days and hours of opening and closing\nof public land or a facility on public land in accordance with paragraph (2).\n(2) The Commission shall \u2014\n(a)\nplace the notice referred to in paragraph (1) in a conspicuous place at the\nentrance to the public land or the facility on the public land; and\n(b) without delay, update the notice of any change in the opening or closing\ntime of the public land or the facility on the public land.\n5.\nClosure of public land and facilities\n5.\n(1) The Commission, upon written direction from the Cabinet, may close an area of\npublic land or a facility on public land either temporarily or permanently to the\npublic, by \u2014\n(a)\ndesignating the area of public land or the facility on public land as \u201cclosed\nto public use\u201d or subject to \u201can emergency closure\u201d; or\n(b) designating \u201cno admittance\u201d, \u201cclosed to public use\u201d and \u201cno trespassing\u201d\nareas in respect of the public land or the facility on public land.\n(2) The Commission shall publish a notice in the Gazette of any designation made\nunder paragraph (1), other than a designation of an emergency closure.\n(3) The Commission shall notify in writing the Commissioner of Police of any\nclosure of an area of public land or a facility on public land under paragraph (1).\n(4) The Commission shall \u2014\n(a)\npost the designation in a conspicuous place at the entrance to the public\nland or the facility on public land; and\n\nRegulation 6\nPublic Lands Regulations (2024 Revision)\n\nPage 8\nRevised as at 31st December, 2023\nc\n\n(b) in the event of any change in the designation, amend the notice under\nparagraph (2) without delay, and publish the amended notice in the\nGazette.\n6.\nEntry into restricted or closed areas\n6.\n(1) A person shall not, without lawful authority, enter any \u2014\n(a)\npublic land or facility on public land before the posted time for opening or\nafter the posted time for closing; or\n(b) public land or facility on public land which is closed in accordance with\nregulation 5.\n(2) A person who contravenes paragraph (1) commits an offence and is liable on\nsummary conviction to a fine of five hundred dollars.\nPART 3 - TRAFFIC CONTROL\n7.\nOperating vehicles on public land\n7.\n(1) A person shall not, without a permit, drive a vehicle on public land, except on\nroads, driveways or parking areas designated for such purpose.\n(2) The Commission may, in consultation with the Traffic Management Panel, post\nspeed limits, traffic signs or traffic control measures regulating the use of\nvehicles on public land.\n(3) A person shall not operate a vehicle on public land in excess of posted speed\nlimits or in breach of posted traffic signs or traffic control measures.\n(4) This regulation does not apply to a person authorised to operate an emergency\nvehicle or an inspector.\n(5) A person who contravenes paragraph (1) or (3) commits an offence and is liable\non summary conviction to a fine of five hundred dollars.\n8.\nParking\n8.\n(1) Subject to paragraphs (3) and (4), a person shall not, other than in Cayman Brac\nor Little Cayman \u2014\n(a)\npark a motor vehicle, trailer, boat or other vessel on public land, except in\na parking area designated for such purpose; or\n(b) park or leave a motor vehicle, trailer, boat or other vessel on public land\nafter the closing time of a parking area designated for such purpose or after\nthe posted time for closing of the public land or the facility on public land.\n(2) Paragraph (1)(b) does not apply where a person notifies the Commission, in\naccordance with paragraph (3) and (4), of the person\u2019s intention to park\novernight on public land after the closing time of the parking area designated\n\nPublic Lands Regulations (2024 Revision)\nRegulation 8\n\nc\nRevised as at 31st December, 2023\nPage 9\n\nfor such purpose or after the posted time for closing of the public land or the\nfacility on public land, the person\u2019s trailer, car or other motor vehicle for the\npurpose of a fishing excursion.\n(3) A person referred to in paragraph (2) shall notify the Commission by \u2014\n(a)\ntelephone call or message to the secretary to the Commission;\n(b) email to the official email address of the Commission;\n(c)\ntext message to the official mobile telephone number of the Commission;\nor\n(d) letter addressed and delivered to the office of the Commission.\n(4) A person referred to in paragraph (2), when notifying the Commission in\naccordance with paragraph (3), shall provide to the Commission the following\ninformation, in respect of the trailer, car or other motor vehicle referred to in\nparagraph (2) \u2014\n(a)\nthe name of its owner;\n(b) the telephone number of its owner; and\n(c)\nits license plate number.\n(5) A person who contravenes paragraph (1) commits an offence and is liable on\nsummary conviction to a fine of \u2014\n(a)\none thousand dollars in respect of a first offence; and\n(b) two thousand dollars for a subsequent offence,\nand if the offence is a continuing offence, one hundred dollars for each day or\npart of a day during which the offence continues but not exceeding a total\nmaximum fine of two thousand dollars for the continuing offence.\n(6) An inspector, upon finding a motor vehicle, trailer, boat or other vessel parked\nor left contrary to this regulation, may have it towed and stored in a suitable\nplace, at the expense of the owner.\n(7) For the purposes of this regulation \u2014\n(a) a reference to \u201cmotor vehicle\u201d or \u201cvessel\u201d shall not include an emergency\nvehicle; and\n(b) the official address, official email address, official telephone number or\nofficial mobile phone number of the Commission shall be considered as\nthe respective address, email address, telephone number or mobile phone\nnumber of the Commission so indicated on any official Government\nwebsite or other official means of communication.\n\nRegulation 9\nPublic Lands Regulations (2024 Revision)\n\nPage 10\nRevised as at 31st December, 2023\nc\n\n9.\nOvernight docking, etc.\n9.\n(1) A person shall not, except in accordance with the terms and conditions of a\npermit, do any of the following on public land or at a public wharf, ramp, dock\nor jetty \u2014\n(a)\ndock a boat or vessel overnight;\n(b) service or repair a boat or vessel or cause it to be serviced or repaired; or\n(c)\nuse the wharf, ramp, dock or jetty for commercial purposes.\n(2) A person shall not dock a boat or vessel at a public wharf, ramp, dock or jetty,\nor use the wharf, ramp, dock or jetty, except \u2014\n(a)\nfor the purpose of loading or unloading the boat or vessel; or\n(b) with the consent of a law enforcement agency.\n(3) A person who contravenes paragraph (1) or (2) commits an offence and is liable\non summary conviction to a fine of \u2014\n(a)\none thousand dollars in respect of a first offence; and\n(b) two thousand dollars for a subsequent offence,\nand if the offence is a continuing offence, one hundred dollars for each day or\npart of a day during which the offence continues but not exceeding a total\nmaximum fine of two thousand dollars for the continuing offence.\nPART 4 - RECREATIONAL ACTIVITIES\n10.\nRecreational activities in general\n10. (1) The Commission may post signs prohibiting or regulating recreational activities\nin particular areas of public land.\n(2) A person shall not engage in a game or recreational activity on public land \u2014\n(a)\nin a manner that contravenes a prohibition or rule on a sign posted by the\nCommission under paragraph (1); or\n(b) in such a manner as to \u2014\n(i)\nsubject any other person not engaged in the game or activity to a\nsubstantial risk of injury, without the other person\u2019s consent; or\n(ii) expose a facility or property to a substantial risk of damage.\n(3) A person who contravenes paragraph (2) commits an offence and is liable on\nsummary conviction to a fine of \u2014\n(a)\nfive hundred dollars in respect of a first offence; and\n(b) seven hundred and fifty dollars for a subsequent offence,\n\nPublic Lands Regulations (2024 Revision)\nRegulation 11\n\nc\nRevised as at 31st December, 2023\nPage 11\n\nand if the offence is a continuing offence, one hundred dollars for each day or\npart of a day during which the offence continues but not exceeding a total\nmaximum fine of two thousand dollars for the continuing offence.\n(4) Notwithstanding paragraph (3), where a person causes damage to a facility or\nproperty, the cost for the repair of the facility or property may be recovered, as\na civil debt due to the Crown, from any person who caused such damage to the\nfacility or property.\n\n11.\nNon-motorised vehicles\n11. (1) The Commission may post traffic signs or traffic control measures regulating\nthe use of pedal bicycles, skateboards, scooters, rollerblades or other nonmotorised means of transport on public land.\n(2) A person who operates a pedal bicycle, skateboard, scooter, rollerblades or other\nnon-motorised means of transport on public land shall comply with posted\ntraffic signs and traffic control measures regulating non-motorised vehicles.\n(3) A person who contravenes paragraph (2) commits an offence and is liable on\nsummary conviction to a fine of one hundred dollars.\n12.\nHorses and horseback riding\n12. (1) A person shall not, without a permit, ride a horse on public land.\n(2) A person who contravenes paragraph (1) commits an offence and is liable on\nsummary conviction to a fine of \u2014\n(a)\none thousand dollars in respect of a first offence; and\n(b) two thousand dollars for a subsequent offence,\nand if the offence is a continuing offence, one hundred dollars for each day or\npart of a day during which the offence continues but not exceeding a total\nmaximum fine of two thousand dollars for the continuing offence.\n(3) This regulation does not apply to a person who rides a horse at the Agricultural\nGrounds or along Barker\u2019s Beach or Barker\u2019s National Park.\n13.\nCamping\n13. (1) A person who is not legally and ordinarily resident in the Islands shall not camp\non public land unless the person has a permit to do so and camps in accordance\nwith the terms and conditions of the permit.\n(2) A person who is legally and ordinarily resident in the Islands may camp on\npublic land, without a permit, in the following circumstances \u2014\n(a)\nfor a period not exceeding five consecutive days;\n(b) on a public general holiday;\n\nRegulation 14\nPublic Lands Regulations (2024 Revision)\n\nPage 12\nRevised as at 31st December, 2023\nc\n\n(c)\nnotwithstanding paragraph (a), for a period of seven days prior to, or seven\ndays following, a public general holiday; or\n(d) notwithstanding paragraphs (a) and (c) \u2014\n(i)\nfor a period of ten days prior to Good Friday;\n(ii) for a period of ten days following Easter Monday; or\n(iii) a period of time prior to Good Friday and following Easter Monday,\nwhere the total period does not exceed ten days.\n(3) A person who contravenes this regulation commits an offence and is liable on\nsummary conviction to a fine of five hundred dollars.\nPART 5 - PROHIBITED CONDUCT AND BEHAVIOUR\n14.\nAudio devices and noise\n14. (1) Subject to paragraph (2), a person shall not, on public land or in a facility on\npublic land, make noise that is likely to cause annoyance or discomfort to other\nmembers of the public by operating \u2014\n(a)\na powered public address system, amplified music speaker system, sound\nemitting electronic equipment including electrical speakers, radio,\nphonograph, television or other such equipment;\n(b) engine-driven equipment, electric generators and compressors; or\n(c)\na portable radio or music player,\nwhere the person has been required by a law enforcement agency to desist from\nmaking such noise.\n(2) Paragraph (1) does not apply to national events and political meetings.\n(3) A person who contravenes paragraph (1) commits an offence and is liable on\nsummary conviction to a fine of five hundred dollars.\n15.\nIndecent conduct\n15. (1) A person shall not engage in indecent conduct on public land.\n(2) A person who contravenes paragraph (1) commits an offence and is liable on\nsummary conviction to a fine of one thousand dollars.\n(3) For the purposes of this regulation, \u201cindecent conduct\u201d includes \u2014\n(a)\nurinating or defecating in places other than those designated for such\npurposes;\n(b) displaying nudity; or\n(c)\nengaging in sexual intercourse or other sexual acts.\n\nPublic Lands Regulations (2024 Revision)\nRegulation 16\n\nc\nRevised as at 31st December, 2023\nPage 13\n\n16.\nBarbequing and fires\n16. (1) A person shall not start or maintain a cooking fire on public land except in \u2014\n(a)\na public barbeque facility;\n(b) a personal portable barbeque or fire pit; or\n(c)\na personal portable stove.\n(2) A person shall not start or maintain a bonfire or open fire on public land except\nin accordance with the terms and conditions of a permit.\n(3) A person shall not leave an open fire or live coals unattended in a picnic area or\nother area on public land.\n(4) A person who contravenes paragraph (1), (2) or (3) commits an offence and is\nliable on summary conviction to a fine of \u2014\n(a)\none thousand dollars in respect of a first offence; and\n(b) two thousand dollars for a subsequent offence,\nand if the offence is a continuing offence, one hundred dollars for each day or\npart of a day during which the offence continues but not exceeding a total\nmaximum fine of two thousand dollars for the continuing offence.\nPART 6 - PROTECTION OF PUBLIC LANDS\n17.\nDestroying or removing property, plants, filling material, etc.\n17. (1) Subject to paragraph (2), a person shall not \u2014\n(a)\ndeface, destroy, damage, misuse, or defile any building, structure, fence,\nwall, bridge, sign, light or other work or thing on public land or at a facility\non public land;\n(b) tamper with or destroy any water system or utility on public land or at a\nfacility on public land or divert or remove water or electricity from such\nwater system or utility;\n(c)\ndeface, destroy, damage, misuse, or defile any plant or animal material on\npublic land or at a facility on public land; or\n(d) deface, destroy, damage or tamper with a security camera on public land\nor at a facility on public land.\n(2) A person may take or remove \u2014\n(a)\nby non-mechanical means; and\n(b) for domestic propagation purposes,\nany part of a plant referred to in paragraph 1(c).\n\nRegulation 18\nPublic Lands Regulations (2024 Revision)\n\nPage 14\nRevised as at 31st December, 2023\nc\n\n(3) A person who contravenes paragraph (1) commits an offence and is liable on\nsummary conviction to a fine of \u2014\n(a)\none thousand dollars in respect of a first offence; and\n(b) two thousand dollars for a subsequent offence,\nand if the offence is a continuing offence, one hundred dollars for each day or\npart of a day during which the offence continues but not exceeding a total\nmaximum fine of two thousand dollars for the continuing offence.\n\n18.\nLittering, dumping or storage\n18. (1) A person shall not \u2014\n(a)\ndeposit, leave, or spill refuse or other substances; or\n(b) store material of any description,\non public land or at a facility on public land, other than in such places as are\ndesignated for that purpose.\n(2) A person shall not clean or dispose of fish or shellfish on public land except at\na public dock or public boat ramp.\n(3) A person who contravenes paragraph (1) or (2) commits an offence and is liable\non summary conviction to a fine of \u2014\n(a)\nfive hundred dollars in respect of a first offence; and\n(b) seven hundred and fifty dollars for a subsequent offence,\nand if the offence is a continuing offence, one hundred dollars for each day or\npart of a day during which the offence continues but not exceeding a total\nmaximum fine of two thousand dollars for the continuing offence.\n\n19.\nConstruction of structures, road, etc.\n19. (1) A person shall not erect or construct any temporary structure, road, driveway,\nwall, bridge or other work on public land or at a facility on public land except\nin accordance with the terms and conditions of a permit for the utilisation of that\npublic land or facility.\n(2) A person who contravenes paragraph (1) commits an offence and is liable on\nsummary conviction to a fine of \u2014\n(a)\none thousand dollars in respect of a first offence; and\n(b) two thousand dollars for a subsequent offence,\nand if the offence is a continuing offence, one hundred dollars for each day or\npart of a day during which the offence continues but not exceeding a total\nmaximum fine of two thousand dollars for the continuing offence.\n\nPublic Lands Regulations (2024 Revision)\nRegulation 20\n\nc\nRevised as at 31st December, 2023\nPage 15\n\n(3) This regulation does not apply to \u2014\n(a)  a government entity;\n(b)  a national event; and\n(c)  a political meeting.\n(4) For the purposes of this regulation \u2014\n\u201cgovernment entity\u201d means any body of the Government and includes a\nministry, portfolio, statutory authority, government company, the Office of the\nOmbudsman, the Office of the Director of Public Prosecutions, and the Audit\nOffice; and\n\u201ctemporary structure\u201d does not include a tent used for a camp.\nPART 7 \u2013 ANIMALS\n20.\nControl of animals\n20. (1) A person in charge of an animal shall not bring or allow the animal to be on\npublic land unless \u2014\n(a)\nthe animal is on a leash or lead or in a cage;\n(b) the animal is at all times entirely within the control of the person; and\n(c)\nwhile on the respective public land, the person immediately cleans up,\nremoves and disposes of the animal\u2019s defecation.\n(2) A person who contravenes paragraph (1) commits an offence and is liable on\nsummary conviction to a fine of \u2014\n(a)\none thousand dollars in respect of a first offence; and\n(b) two thousand dollars for a subsequent offence,\nand if the offence is a continuing offence, one hundred dollars for each day or\npart of a day during which the offence continues but not exceeding a total\nmaximum fine of two thousand dollars for the continuing offence.\n21.\nAreas where animals prohibited\n21. (1) A person in charge of an animal shall not bring or allow the animal on any\nathletic playing area, children\u2019s playground area or in any facility unless the\nCommission or the manager of the facility has posted a sign permitting the\nanimal to be there.\n(2) A person who contravenes paragraph (1) commits an offence and is liable on\nsummary conviction to a fine of \u2014\n(a)\none thousand dollars in respect of a first offence; and\n(b) two thousand dollars for a subsequent offence,\n\nRegulation 22\nPublic Lands Regulations (2024 Revision)\n\nPage 16\nRevised as at 31st December, 2023\nc\n\nand if the offence is a continuing offence, one hundred dollars for each day or\npart of a day during which the offence continues but not exceeding a total\nmaximum fine of two thousand dollars for the continuing offence.\n(3) For the purposes of this regulation, \u201canimal\u201d does not include a dog used as a\nguide to assist a visually impaired person.\n\n22.\nPasturing, grazing and running at large\n22. (1) Notwithstanding regulation 20(1), a person shall not leave unsupervised any\nlivestock to run on public land.\n(2) A person shall not leave unsupervised any livestock to pasture or graze on public\nland, except on the Agricultural Grounds.\n(3) A person who contravenes paragraph (1) or (2) commits an offence and is liable\non summary conviction to a fine of \u2014\n(a)\none thousand dollars in respect of a first offence; and\n(b) two thousand dollars for a subsequent offence,\nand if the offence is a continuing offence, one hundred dollars for each day or\npart of a day during which the offence continues but not exceeding a total\nmaximum fine of two thousand dollars for the continuing offence.\n(4) In this regulation, \u201clivestock\u201d includes cattle, pigs, horses, sheep, goats or\ndonkeys.\nPART 8 - COMMERCIAL ACTIVITIES AND ORGANISED\nEVENTS\n23.\nSale of alcohol\n23. (1) A person shall not sell alcohol on public land except in accordance with the\nterms and conditions of \u2014\n(a) a valid vendor\u2019s permit; and\n(b) a licence issued under the Liquor Licensing Act (2019 Revision).\n(2) A person who contravenes paragraph (1) commits an offence and is liable on\nsummary conviction to a fine of \u2014\n(a)\none thousand dollars in respect of a first offence; and\n(b) two thousand dollars for a subsequent offence,\nand if the offence is a continuing offence, one hundred dollars for each day or\npart of a day during which the offence continues but not exceeding a total\nmaximum fine of two thousand dollars for the continuing offence.\n\nPublic Lands Regulations (2024 Revision)\nRegulation 24\n\nc\nRevised as at 31st December, 2023\nPage 17\n\n24.\nOrganised events\n24. (1) Subject to paragraph (2), a person shall not, on public land or at a facility on\npublic land, organise an event for commercial purposes for a group of twentyfive or more persons except in accordance with the terms and conditions of a\npermit.\n(2) This regulation does not apply to \u2014\n(a)\na tour group that stops on public land or at a facility for touring, sightseeing\nor a picnic;\n(b) a school group on public land for an educational purpose;\n(c)\na marriage ceremony;\n(d) a national event;\n(e)\na political meeting;\n(f)\na religious organisation or church;\n(g) a group carrying out activities on public land in the public interest, such as\ncleaning up or maintaining beaches;\n(h) an event organised by a registered non-profit organisation for the purposes\nof charity fundraising; or\n(i)\na one-time non-profit fundraising event which does not require registration\nunder the Non-Profit Organisations Act (2020 Revision).\n(3) A person who contravenes paragraph (1) commits an offence and is liable on\nsummary conviction to a fine of \u2014\n(a)\none thousand dollars in respect of a first offence; and\n(b) two thousand dollars for a subsequent offence,\nand if the offence is a continuing offence, one hundred dollars for each day or\npart of a day during which the offence continues but not exceeding a total\nmaximum fine of two thousand dollars for the continuing offence.\n25.\nSignage\n25. (1) A person, other than a person referred to in paragraph (3), shall not erect any\nsign, billboard or other type of marketing material on public land except in\naccordance with the terms and conditions of a permit.\n(2) The Commission may remove any sign, billboard or other marketing material\nerected on public land and such removal shall be at the expense of the person\nwho erected or caused the erection of such marketing material.\n(3) A person or political party who is nominated as a candidate for a general election\nof members of the Parliament under the Elections Act (2022 Revision) may erect\nelection signage without requiring a permit under this regulation for the period\n\nRegulation 26\nPublic Lands Regulations (2024 Revision)\n\nPage 18\nRevised as at 31st December, 2023\nc\n\ncommencing on the date of nomination and ending on the date of election as\ndetermined by the Elections Act (2022 Revision).\n(4) A person who contravenes paragraph (1) commits an offence and is liable on\nsummary conviction to a fine of \u2014\n(a)\none thousand dollars in respect of a first offence; and\n(b) two thousand dollars for a subsequent offence,\nand if the offence is a continuing offence, one hundred dollars for each day or\npart of a day during which the offence continues but not exceeding a total\nmaximum fine of two thousand dollars for the continuing offence.\n(5) For the purposes of paragraph (3), \u201celection signage\u201d means an outdoor sign\nthat displays information or issues regarding the general election for or against\na candidate in the upcoming general election.\nPART 9 \u2013 PERMITS\n26.\nApplication for a permit other than a vendor\u2019s permit\n26. (1) Where a person wishes to apply for a permit required under these Regulations,\nother than a vendor\u2019s permit, the person shall apply to the Commission in\naccordance with the procedure set out in this regulation.\n(2) An applicant under paragraph (1) shall submit to the Commission an application\nin writing which sets out the person\u2019s proposed use of, or activities on, public\nland.\n(3) The application referred to in paragraph (2) shall be accompanied by \u2014\n(a)\na non-refundable application fee of fifty dollars;\n(b) the relevant fee set out in Schedule 1; and\n(c)\nsuch other information or particulars relating to the application as the\nCommission may determine.\n(4) Subject to paragraph (5), where the Commission is satisfied that the application\ncomplies with the principal Act and these Regulations, the Commission may\nissue a permit, other than a vendor\u2019s permit, to the applicant to use public land\nor to carry out the activity in the manner proposed in the application.\n(5) A permit issued under this regulation shall be subject to such terms and\nconditions as the Commission may specify in order to minimise public\ndisturbance on, or to protect, public land.\n27.\nApplication for vendor\u2019s permit\n27. (1) An applicant for a vendor\u2019s permit under section 15 of the principal Act shall\nprovide the following to the Commission \u2014\n\nPublic Lands Regulations (2024 Revision)\nRegulation 28\n\nc\nRevised as at 31st December, 2023\nPage 19\n\n(a)\nan application in writing which sets out the applicant\u2019s proposed use of, or\nactivities on, public land;\n(b) a declaration that the applicant will apply for a licence \u2014\n(i)\nunder the Trade and Business Licencing Act (2019 Revision), if a\ntrade and business licence is required by that Act; and\n(ii) under the Liquor Licensing Act (2019 Revision), if the application\ninvolves the sale of alcohol on public land;\n(c)\nwhere the application is for renewal of a vendor\u2019s permit, evidence of\ncompliance with the Acts in force in the Islands relating to pensions and\nto health insurance;\n(d) such other information or particulars relating to the application as the\nCommission may determine; and\n(e)\nthe application fee prescribed under regulation 28.\n(2) Where an application contains a declaration referred to in paragraph (1)(b), the\nCommission may issue a provisional vendor\u2019s permit on such terms or\nconditions as specified by the Commission, subject to the applicant\ndemonstrating to the Commission, within the timeframe specified by the\nCommission in the provisional permit, that the applicant has \u2014\n(a)\nobtained the licence referred to in the declaration; and\n(b) satisfied any other terms or conditions specified by the Commission in the\nprovisional vendor\u2019s permit.\n(3) Subject to paragraph (4), the Commission may grant, on such terms or\nconditions as specified by the Commission, a vendor\u2019s permit to the holder of a\nprovisional vendor\u2019s permit who \u2014\n(a)\nhas obtained the relevant licence referred to in paragraph (2)(a); and\n(b) where applicable, has satisfied the terms or conditions referred to in\nparagraph (2)(b).\n(4) Where the Commission is satisfied that the application for a vendor\u2019s permit, in\nrespect of which no licence referred to in paragraph (1)(b) is required, complies\nwith the principal Act and these Regulations, the Commission may issue a\nvendor\u2019s permit to the applicant on such terms or conditions as specified by the\nCommission.\n28.\nFees for vendor\u2019s permit\n28. An applicant for a vendor\u2019s permit shall pay \u2014\n(a)\non submission of the application, a non-refundable application fee of one\nhundred dollars; and\n\nRegulation 29\nPublic Lands Regulations (2024 Revision)\n\nPage 20\nRevised as at 31st December, 2023\nc\n\n(b) on issuance by the Commission to the applicant of the provisional vendor\u2019s\npermit or vendor\u2019s permit, a permit fee in the amount prescribed in\nSchedule 1.\n29.\nDisplay of vendor\u2019s permit\n29. (1) Pursuant to section 20 of the principal Act, a vendor\u2019s permit granted or renewed\nunder these Regulations shall be in the form set out in Schedule 2 and be\npublicly displayed.\n(2) A person who contravenes paragraph (1) commits an offence and is liable on\nsummary conviction to a fine of \u2014\n(a)\nfive hundred dollars in respect of a first offence; and\n(b) one thousand dollars for a subsequent offence,\nand if the offence is a continuing offence, one hundred dollars for each day or\npart of a day during which the offence continues but not exceeding a total\nmaximum fine of two thousand dollars for the continuing offence.\nPART 10 \u2013 GENERAL\n30.\nTicketable offences\n30.
