(1) In these Regulations \u2014 \u201cChief Medical Officer\u201d means the person holding or acting in that office in the public service of the Islands; \u201cdisaster\u201d has the meaning assigned by section 2 of the Disaster Preparedness and Hazard Management Act (2019 Revision); \u201cdisposal schedule\u201d has the meaning assigned by section 2(1) of the National Archive and Public Records Act (2026 Revision); \u201cexcluded income\u201d means the income from holiday employment or part-time employment received by students in full-time education; \u201charm\u201d means \u2014 (a) ill-treatment, including physical abuse, sexual abuse, and other forms of abuse; or (b) the impairment of \u2014 (i) mental or physical health; or Regulation 2 Financial Assistance Regulations (2026 Revision) (ii) behavioural, emotional, intellectual, physical or social development; \u201colder person\u201d means a person who is sixty-five years of age or older; \u201cprincipal Act\u201d means the Financial Assistance Act [Act 10 of 2022]; \u201cregistered business\u201d means a trade or business licensed or registered to be carried on as a trade or business under the Trade and Business Licensing Act (2021 Revision) or any other Act; and \u201crelevant expenses\u201d means expenses which \u2014 (a) an applicant or a member of an applicant\u2019s household has a legal obligation to pay and which are evidenced by an invoice from a registered business; or (b) correlate with a category of financial assistance set out in the Schedule. (2) Further to the definition of the word \u201chousehold\u201d in section 2(1) of the principal Act \u2014 (a) for the purposes of determining whether a person satisfies the criteria for eligibility for financial assistance under regulation 3, where \u2014 (i) the person is an adult who lives at the same address as the person\u2019s parents; and (ii) the person\u2019s parents have not applied for financial assistance, the adult shall be treated as a person who lives alone at the address; (b) for the purposes of determining whether a person satisfies the criteria for eligibility for financial assistance under regulation 3, where \u2014 (i) the person is an adult who lives with the person\u2019s spouse, civil partner or dependant at the same address as the person\u2019s parents; and (ii) the person\u2019s parents have not applied for financial assistance, the adult and the spouse, civil partner or dependant shall be treated as persons who live together at the address and who benefit from one another\u2019s combined income and share living accommodations, and the person\u2019s parents shall not be treated as part of the household; (c) for the purposes of determining whether a person satisfies the criteria for eligibility for financial assistance under regulation 4(1) or (2), where \u2014 (i) the person is an older person who lives at the same address as the person\u2019s adult child or adult grandchild; (ii) the adult child or adult grandchild contributes to the maintenance of the older person in furtherance of the duty under section 5 of the Maintenance Act (1996 Revision); and (iii) the adult child or adult grandchild has not applied for financial assistance, the older person shall be treated as a person who lives alone at the address; Financial Assistance Regulations (2026 Revision) Regulation 3 (d) for the purposes of determining whether a person satisfies the criteria for eligibility for financial assistance under regulation 4(1) or (2), where \u2014 (i) the person is an older person who lives with the person\u2019s spouse, civil partner or dependant at the same address as the person\u2019s adult child or adult grandchild; (ii) the adult child or adult grandchild contributes to the maintenance of the older person in furtherance of the duty under section 5 of the Maintenance Act (1996 Revision); and (iii) the adult child or adult grandchild has not applied for financial assistance, the older person and the spouse, civil partner or dependant shall be treated as persons who live together at the address and who benefit from one another\u2019s combined income and share living accommodations, and the adult child or adult grandchild shall not be treated as part of the household; and (e) for the purposes of determining whether a person satisfies the criteria for eligibility for financial assistance under regulation 4(1) or (2), where \u2014 (i) a person referred to in regulation 4(3)(b) lives at the same address as another person; and (ii) the other person has not applied for financial assistance, the person referred to in regulation 4(3)(b) shall be treated as a person who lives alone at the address.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_3\", \"num\": \"3.\", \"text\": \"General criteria for eligibility for financial assistance 3. An applicant under section 10 of the principal Act is eligible for financial assistance, the categories and maximum amounts of which are set out in the Schedule, if, in respect of a period for which an application is made \u2014 (a) in the case of a household of one to three persons \u2014 (i) the aggregate income of the applicant\u2019s household does not exceed three thousand dollars per month from all sources, including income from a business venture, but not including any excluded income and any savings of the household which do not exceed three thousand dollars; and (ii) the Director has determined that the aggregate income of the applicant\u2019s household is not sufficient to meet the relevant expenses of the applicant\u2019s household; (b) in the case of a household of four to six persons \u2014 (i) the aggregate income of the applicant\u2019s household does not exceed three thousand five hundred dollars per month from all sources, including income from a business venture, but not including any Regulation 4 Financial Assistance Regulations (2026 Revision) excluded income and savings of the household which do not exceed three thousand five hundred dollars; and (ii) the Director has determined that the aggregate income of the applicant\u2019s household is not sufficient to meet the relevant expenses of the applicant\u2019s household; and (c) in the case of a household of seven or more persons \u2014 (i) the aggregate income of the applicant\u2019s household does not exceed four thousand dollars per month from all sources, including income from a business venture, but not including any excluded income and savings of the household which do not exceed four thousand dollars; and (ii) the Director has determined that the aggregate income of the applicant\u2019s household is not sufficient to meet the relevant expenses of the applicant\u2019s household.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_4\", \"num\": \"4.\", \"text\": \"Special category persons 4. (1) Notwithstanding regulation 3, an applicant under section 10 of the principal Act who falls within a special category referred to in paragraph (3) is eligible for financial assistance, the categories and maximum amounts of which are set out in the Schedule, if, in respect of a period for which an application is made \u2014 (a) in the case of a household of one to three persons \u2014 (i) the aggregate income of the applicant\u2019s household does not exceed three thousand dollars per month from all sources, including income from a business venture, but not including any excluded income and any savings of the household which do not exceed fifteen thousand dollars; and (ii) the Director has determined that the aggregate income of the applicant\u2019s household is not sufficient to meet the relevant expenses of the applicant\u2019s household; (b) in the case of a household of four to six persons \u2014 (i) the aggregate income of the applicant\u2019s household does not exceed three thousand five hundred dollars per month from all sources, including income from a business venture, but not including any excluded income and savings of the household which do not exceed fifteen thousand dollars; and (ii) the Director has determined that the aggregate income of the applicant\u2019s household is not sufficient to meet the relevant expenses of the applicant\u2019s household; and (c) in the case of a household of seven or more persons \u2014 Financial Assistance Regulations (2026 Revision) Regulation 4 (i) the aggregate income of the applicant\u2019s household does not exceed four thousand dollars per month from all sources, including income from a business venture, but not including any excluded income and savings of the household which do not exceed fifteen thousand dollars; and (ii) the Director has determined that the aggregate income of the applicant\u2019s household is not sufficient to meet the relevant expenses of the applicant\u2019s household. (2) Notwithstanding regulation 3, where an applicant under section 10 of the principal Act applies for financial assistance and a member of the applicant\u2019s household falls within a special category referred to in paragraph (3), the applicant is eligible for financial assistance, the categories and maximum amounts of which are set out in the Schedule, if, in respect of a period for which an application is made \u2014 (a) in the case of a household of one to three persons \u2014 (i) the aggregate income of the applicant\u2019s household does not exceed three thousand dollars per month from all sources, including income from a business venture, but not including any excluded income and any savings of the household which do not exceed fifteen thousand dollars; and (ii) the Director has determined that the aggregate income of the applicant\u2019s household is not sufficient to meet the relevant expenses of the applicant\u2019s household; (b) in the case of a household of four to six persons \u2014 (i) the aggregate income of the applicant\u2019s household does not exceed three thousand five hundred dollars per month from all sources, including income from a business venture, but not including any excluded income and savings of the household which do not exceed fifteen thousand dollars; and (ii) the Director has determined that the aggregate income of the applicant\u2019s household is not sufficient to meet the relevant expenses of the applicant\u2019s household; and (c) in the case of a household of seven or more persons \u2014 (i) the aggregate income of the applicant\u2019s household does not exceed four thousand dollars per month from all sources, including income from a business venture, but not including any excluded income and savings of the household which do not exceed fifteen thousand dollars; and Regulation 5 Financial Assistance Regulations (2026 Revision) (ii) the Director has determined that the aggregate income of the applicant\u2019s household is not sufficient to meet the relevant expenses of the applicant\u2019s household. (3) For the purposes of this regulation, an applicant or a member of the applicant\u2019s household falls within a special category if the applicant or the member of the applicant\u2019s household is \u2014 (a) an older person; or (b) a person with a disability that is likely to render the person incapable by reason of infirmity of body or mind of working, and the infirmity is certified as likely to be permanent by a medical doctor or a medical officer, as applicable.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_5\", \"num\": \"5.\", \"text\": \"Special provision for certain households 5. Notwithstanding regulations 3 and 4, an applicant under section 10 of the principal Act is eligible for financial assistance, the categories and maximum amounts of which are set out in the Schedule, if \u2014 (a) the applicant is the guardian of a person with a disability; (b) in respect of a period for which an application is made \u2014 (i) in the case of a household of one to three persons, the aggregate income of the applicant\u2019s household exceeds three thousand dollars per month from all sources, including income from a business venture but not including any excluded income; (ii) in the case of a household of four to six persons, the aggregate income of the applicant\u2019s household exceeds three thousand five hundred dollars per month from all sources, including income from a business venture but not including any excluded income; and (iii) in the case of a household of seven or more persons, the aggregate income of the applicant\u2019s household exceeds four thousand dollars per month from all sources, including income from a business venture but not including any excluded income; and (c) the Director has determined that the aggregate income of the applicant\u2019s household is not sufficient to meet the relevant expenses of the applicant\u2019s household.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_6\", \"num\": \"6.\", \"text\": \"Special provision where recipient becomes employed 6. Notwithstanding regulations 3 and 4, where \u2014 (a) a recipient becomes employed and the income is in excess of the amounts specified in regulation 3 or 4(1) or (2), as applicable; and Financial Assistance Regulations (2026 Revision) Regulation 7 (b) the Director is satisfied that the recipient is still in need of financial support for the purpose of assisting the recipient with the transition to becoming economically or financially self-sufficient, the Director, for a period of no more than one month after the date of the commencement of the employment, may continue to issue part or the whole of the payments of financial assistance previously payable to the recipient.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_7\", \"num\": \"7.\", \"text\": \"Exemption of certain categories of persons 7. (1) In respect of an application for financial assistance, if a person referred to in paragraph (2) is without other means of financial support, the person is exempt from the requirement to satisfy the eligibility criteria under section 10(1) and (3)(b) of the principal Act and under regulations 3 and 4. (2) For the purposes of paragraph (1), any of the following persons who are without other means of financial support are exempt \u2014 (a) persons in respect of whom an act of domestic violence, as defined under section 3 of the Protection from Domestic Violence Act (2021 Revision), is committed; (b) persons who are victims of a disaster; and (c) any other persons who the Director considers to be \u2014 (i) at significant risk of harm; or (ii) in need of urgent aid. (3) A person referred to in paragraph (2) shall be physically present in the Islands at the time that the person makes an application, unless the Director decides to waive that requirement because the applicant is absent from the Islands due to medical reasons or because there are exceptional circumstances which justify the waiver. (4) For the purposes of this regulation, a person referred to in paragraph (2) shall be issued financial assistance at the discretion of the Director.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_8\", \"num\": \"8.\", \"text\": \"Form and manner of application 8. An applicant may make an application in such form as is approved by the Director, or in another manner, being in writing, as the Director may accept in the circumstances, and the application shall be accompanied by \u2014 (a) a completed and signed release of information form, in such form as is approved by the Director; and (b) relevant documents in support of the application. Regulation 9 Financial Assistance Regulations (2026 Revision)\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_9\", \"num\": \"9.\", \"text\": \"Additional information required for applications for medical expenses 9. An application for financial assistance for medical expenses which are not covered under a person\u2019s health insurance contract, in addition to any other prescribed or requested relevant information, shall, where requested by the Director, be accompanied by one or both of the following \u2014 (a) a referral obtained from a medical doctor or a medical officer, as applicable; or (b) a form approved by the Director and completed by a medical doctor or a medical officer, as applicable.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_10\", \"num\": \"10.\", \"text\": \"Review of applications based on medical grounds 10. The Director may refer a person\u2019s case to the Chief Medical Officer, or a medical doctor or a medical officer nominated by the Chief Medical Officer, for review \u2014 (a) in the case of an applicant, where the applicant makes an application based on medical reasons; and (b) in the case of a recipient whose financial assistance is based on medical reasons, where the medical report of the recipient has expired and the Director has to make a determination whether the financial assistance in respect of that recipient should continue.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_11\", \"num\": \"11.\", \"text\": \"Time within which application to be evaluated and determined 11. Pursuant to section 11(1) of the Act, the Director shall, within ten working days after receiving a complete application, evaluate the application and determine whether the application should be granted or refused.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_12\", \"num\": \"12.\", \"text\": \"Considerations before payment of financial assistance commences 12. (1) Where an applicant under section 10 of the principal Act makes an application due to termination of employment for reasons of redundancy and the Director grants the application, if the applicant receives a redundancy payment, the payment of financial assistance shall not commence until a date after the end of the period which the Director determines as a reasonable period within which the redundancy payment can meet the applicant\u2019s financial needs. (2) Where an applicant under section 10 of the principal Act makes an application while serving a term of imprisonment in accordance with section 10(2) of the principal Act and the Director grants the application, the payment of the financial assistance shall commence on a date to be determined by the Director and that date shall not be prior to the date that the applicant is released from prison. Financial Assistance Regulations (2026 Revision) Regulation 13\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_13\", \"num\": \"13.\", \"text\": \"Payments of financial assistance 13. (1) The Director shall determine the manner, the commencement date and the duration of payments of financial assistance. (2) The Director shall, at intervals determined by the Director, review the circumstances of a recipient for the purposes of determining whether the recipient continues to satisfy the relevant criteria for eligibility for financial assistance. (3)  The amount of financial assistance to be paid to a recipient shall be determined by the Director, based on the difference between the aggregate income of the recipient\u2019s household and the relevant expenses of the recipient\u2019s household. (4)  Notwithstanding paragraph (3) and the categories and maximum amounts of financial assistance set out in the Schedule, and subject to paragraph (5), where the Director is satisfied that a recipient is still in need of financial assistance, the Director may issue an additional payment of financial assistance of no more than three hundred dollars to the recipient in respect of the recipient\u2019s household. (5)  Where the recipient referred to in paragraph (4) or a member of the recipient\u2019s household falls within a special category referred to in regulation 4(3), if the Director is satisfied that that recipient is still in need of financial assistance, the Director may, instead of issuing an additional payment of financial assistance of no more than three hundred dollars, issue an additional payment of financial assistance of no more than five hundred and fifty dollars to that recipient in respect of that recipient\u2019s household.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_14\", \"num\": \"14.\", \"text\": \"Financial assistance for accommodation 14. (1) The amount of financial assistance for accommodation shall be determined by the Director in accordance with the size of the household. (2) Where a recipient chooses accommodation, the cost of which is in excess of the amount of the financial assistance for accommodation determined by the Director under paragraph (1), the recipient shall pay the excess amount for the chosen accommodation.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_15\", \"num\": \"15.\", \"text\": \"Appointment or authorization of representative 15. (1) A person may appoint another person (a \u201crepresentative\u201d) to \u2014 (a) make an application on behalf of the person; or (b) otherwise act on behalf of the person in the capacity of an applicant, a recipient or a member of a household, for the purposes of the principal Act and these Regulations. (2) Where a person under paragraph (1) wishes to appoint a representative \u2014 (a) the person shall apply in writing to the Director; and Regulation 16 Financial Assistance Regulations (2026 Revision) (b) after having regard to the matters specified in paragraph (3), the Director may accept the appointment. (3) For the purposes of paragraph (2)(b), the Director shall consider the following \u2014 (a) whether the Director has previously terminated or revoked \u2014 (i) the appointment; or (ii) an authorization by the Director, of the person who is being proposed as a representative; (b) whether, having regard to the circumstances, the application for the appointment may have been made under duress or as a result of coercion; and (c) any other relevant matters. (4) Where the Director accepts the appointment, the Director shall endorse the letter of appointment. (5) Where a person is unable to \u2014 (a) make an application; or (b) appoint a representative in respect of the matters set out in paragraph (1), the Director may authorize another person to be a representative to make the application or to otherwise act on behalf of the person in the capacity of an applicant, a recipient or a member of a household, for the purposes of the principal Act and these Regulations. (6) An appointment or authorization made under this regulation may be terminated or revoked by \u2014 (a) the person on whose behalf the representative is acting, by notice in writing, submitted to the representative and the Director; (b) the representative, by notice in writing, submitted to the person on whose behalf the representative is acting and the Director; or (c) the Director, where the Director determines that \u2014 (i) the application for the appointment was made under duress or as a result of coercion; or (ii) the financial assistance is not being used for the benefit of the recipient.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_16\", \"num\": \"16.\", \"text\": \"Application for reconsideration of decision of Director 16. (1) For the purposes of section 18(2) of the Act, an applicant or a recipient who is aggrieved by a decision of the Director made in relation to the applicant or the recipient may apply for a reconsideration of the decision of the Director using the application form approved by the Director for that purpose. Financial Assistance Regulations (2026 Revision) Regulation 17 (2) An application form under paragraph (1) shall contain the following \u2014 (a) the particulars of the applicant or the recipient; (b) the date of notice of the relevant decision of the Director; (c) details of the decision being requested for reconsideration; (d) the grounds for disagreement with the decision and the manner in which the applicant or the recipient is aggrieved; (e) any new relevant information and evidence thereof; and (f) where the application is a late application under section 18(4) of the Act, the reasons for the late submission of the application.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_17\", \"num\": \"17.\", \"text\": \"Matters related to the disclosure of data or information to correct false information 17. Where data or information is being disclosed in accordance with section 26(2)(c) of the Act, the Director or a person authorized in writing by the Director to issue external communications on behalf of the Department shall disclose the data or information in the form of an official statement on the official Government website of the Department or in any other official means of communication, no later than seven days after the false information was published.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_18\", \"num\": \"18.\", \"text\": \"Effect of death on pending application 18. Where an applicant dies before the Director determines an application, the application shall be treated as having been withdrawn. 19. Maintenance of records 19. (1) The Director shall cause to be kept, in accordance with the relevant disposal schedule, proper accounts and records of the transactions and affairs of the Department, including records of \u2014 (a) applications; (b) decisions made in respect of applications; (c) decisions made in respect of applications for reconsiderations of decisions of the Director; and (d) amounts of financial assistance paid to recipients. (2) Pursuant to paragraph (1)(a), the Director shall assign each application a file number. (3) Pursuant to paragraph (1)(d), the Director shall do all things necessary to ensure that \u2014 (a) payments of financial assistance are correctly made and properly authorized; and Regulation 19 Financial Assistance Regulations (2026 Revision) (b) the funds appropriated by the Parliament for the purpose of providing financial assistance are properly brought to account. Financial Assistance Regulations (2026 Revision) SCHEDULE SCHEDULE (regulations 3, 4 and 5) CATEGORIES OF FINANCIAL ASSISTANCE Category of financial assistance Allowance Financial assistance applicable only to a person referred to in regulation 4(3) 1. No more than $1,500.00 per month. Financial assistance applicable only to a person referred to in regulation 7(2) 1. No more than $1,500.00. Utilities (electricity, water and propane gas) 1. For propane gas, no more than $110.00 each time, for no more than 3 times per year. 2. For electricity and water \u2014 (a) where the household consists of one person, no more than $300.00 per month; and (b) where the household consists of more than one person, no more than $600.00 per month. Medical expenses 1. For medical travel expenses which are not covered under a person\u2019s health insurance contract, no more than $800.00 per year. 2. For dental expenses which are not covered under a person\u2019s health insurance contract \u2014 (a) in the case of dentures, no more than $500.00 per year; and (b) in the case of medically required braces not covered by insurance, no more than $1,500.00 per year. 3. For optical expenses which are not covered under a person\u2019s health insurance contract, no more than $360.00 in a two-year period, with exceptions being made where an ophthalmologist or optician has recommended a special prescription. SCHEDULE Financial Assistance Regulations Category of financial assistance Allowance 4.    For expenses relating to medical equipment and supplies which are not covered under a person\u2019s health insurance contract (other than medical travel expenses, dental expenses and optical expenses referred to above), no more than $1,000.00 per year. Clothing 1. For clothing, no more than $250.00 per person in a household, per year or no more than $750.00 per household, per year, whichever is lesser. Accommodation 1. For accommodation \u2014 (a) no more than $3,000.00 per month; and (b) in the case of rental accommodation, a one-time payment equal to the amount of the rental deposit in respect of the rental accommodation, which shall be no more than $3,000.00. Burial assistance 1. For burials \u2014 (a) no more than $3,500.00 for a funeral package; and (b) in the case of a burial vault, no more than $1,200.00 for the burial vault. Food 1. For food, no more than $850.00 per household per month. Pre-school assistance 1. For pre-school, no more than $600.00 per month per child. Assistance with child related fees 1. For children\u2019s camps, no more than $600.00 per child, per year or no more than $1,500.00 per household, per year, whichever is lesser. 2. For after-school care, no more than $200.00 per child, per month or no more than $600.00 per household, per month, whichever is lesser. 3. For school uniforms, no more than the sum of three school uniforms and one physical education uniform per child, per year. REGULATIONS\n[Act 10 of 2022]\n\n1.\nCitation\n1.\nThese Regulations may be cited as the Financial Assistance Regulations (2026\nRevision).\n2.\nDefinitions\n2.\n(1) In these Regulations \u2014\n\u201cChief Medical Officer\u201d means the person holding or acting in that office in\nthe public service of the Islands;\n\u201cdisaster\u201d has the meaning assigned by section 2 of the Disaster Preparedness\nand Hazard Management Act (2019 Revision);\n\u201cdisposal schedule\u201d has the meaning assigned by section 2(1) of the National\nArchive and Public Records Act (2026 Revision);\n\u201cexcluded income\u201d means the income from holiday employment or part-time\nemployment received by students in full-time education;\n\u201charm\u201d means \u2014\n(a) ill-treatment, including physical abuse, sexual abuse, and other forms of\nabuse; or\n(b) the impairment of \u2014\n(i)\nmental or physical health; or\n\nRegulation 2\nFinancial Assistance Regulations (2026 Revision)\n\nPage 6\nRevised as at 31st December, 2025\nc\n\n(ii) behavioural, emotional, intellectual, physical or social development;\n\u201colder person\u201d means a person who is sixty-five years of age or older;\n\u201cprincipal Act\u201d means the Financial Assistance Act [Act 10 of 2022];\n\u201cregistered business\u201d means a trade or business licensed or registered to be\ncarried on as a trade or business under the Trade and Business Licensing Act\n(2021 Revision) or any other Act; and\n\u201crelevant expenses\u201d means expenses which \u2014\n(a) an applicant or a member of an applicant\u2019s household has a legal obligation\nto pay and which are evidenced by an invoice from a registered business;\nor\n(b) correlate with a category of financial assistance set out in the Schedule.\n(2) Further to the definition of the word \u201chousehold\u201d in section 2(1) of the principal\nAct \u2014\n(a)\nfor the purposes of determining whether a person satisfies the criteria for\neligibility for financial assistance under regulation 3, where \u2014\n(i)\nthe person is an adult who lives at the same address as the person\u2019s\nparents; and\n(ii) the person\u2019s parents have not applied for financial assistance,\nthe adult shall be treated as a person who lives alone at the address;\n(b) for the purposes of determining whether a person satisfies the criteria for\neligibility for financial assistance under regulation 3, where \u2014\n(i)\nthe person is an adult who lives with the person\u2019s spouse, civil partner\nor dependant at the same address as the person\u2019s parents; and\n(ii) the person\u2019s parents have not applied for financial assistance,\nthe adult and the spouse, civil partner or dependant shall be treated as\npersons who live together at the address and who benefit from one\nanother\u2019s combined income and share living accommodations, and the\nperson\u2019s parents shall not be treated as part of the household;\n(c)\nfor the purposes of determining whether a person satisfies the criteria for\neligibility for financial assistance under regulation 4(1) or (2), where \u2014\n(i)\nthe person is an older person who lives at the same address as the\nperson\u2019s adult child or adult grandchild;\n(ii) the adult child or adult grandchild contributes to the maintenance of\nthe older person in furtherance of the duty under section 5 of the\nMaintenance Act (1996 Revision); and\n(iii) the adult child or adult grandchild has not applied for financial\nassistance,\nthe older person shall be treated as a person who lives alone at the address;\n\nFinancial Assistance Regulations (2026 Revision)\nRegulation 3\n\nc\nRevised as at 31st December, 2025\nPage 7\n\n(d) for the purposes of determining whether a person satisfies the criteria for\neligibility for financial assistance under regulation 4(1) or (2), where \u2014\n(i)\nthe person is an older person who lives with the person\u2019s spouse, civil\npartner or dependant at the same address as the person\u2019s adult child\nor adult grandchild;\n(ii) the adult child or adult grandchild contributes to the maintenance of\nthe older person in furtherance of the duty under section 5 of the\nMaintenance Act (1996 Revision); and\n(iii) the adult child or adult grandchild has not applied for financial\nassistance,\nthe older person and the spouse, civil partner or dependant shall be treated\nas persons who live together at the address and who benefit from one\nanother\u2019s combined income and share living accommodations, and the\nadult child or adult grandchild shall not be treated as part of the household;\nand\n(e)\nfor the purposes of determining whether a person satisfies the criteria for\neligibility for financial assistance under regulation 4(1) or (2), where \u2014\n(i)\na person referred to in regulation 4(3)(b) lives at the same address as\nanother person; and\n(ii) the other person has not applied for financial assistance,\nthe person referred to in regulation 4(3)(b) shall be treated as a person who\nlives alone at the address.\n3.\nGeneral criteria for eligibility for financial assistance\n3.\nAn applicant under section 10 of the principal Act is eligible for financial assistance,\nthe categories and maximum amounts of which are set out in the Schedule, if, in\nrespect of a period for which an application is made \u2014\n(a)\nin the case of a household of one to three persons \u2014\n(i)\nthe aggregate income of the applicant\u2019s household does not exceed\nthree thousand dollars per month from all sources, including income\nfrom a business venture, but not including any excluded income and\nany savings of the household which do not exceed three thousand\ndollars; and\n(ii) the Director has determined that the aggregate income of the\napplicant\u2019s household is not sufficient to meet the relevant expenses\nof the applicant\u2019s household;\n(b) in the case of a household of four to six persons \u2014\n(i)\nthe aggregate income of the applicant\u2019s household does not exceed\nthree thousand five hundred dollars per month from all sources,\nincluding income from a business venture, but not including any\n\nRegulation 4\nFinancial Assistance Regulations (2026 Revision)\n\nPage 8\nRevised as at 31st December, 2025\nc\n\nexcluded income and savings of the household which do not exceed\nthree thousand five hundred dollars; and\n(ii) the Director has determined that the aggregate income of the\napplicant\u2019s household is not sufficient to meet the relevant expenses\nof the applicant\u2019s household; and\n(c) in the case of a household of seven or more persons \u2014\n(i)\nthe aggregate income of the applicant\u2019s household does not exceed\nfour thousand dollars per month from all sources, including income\nfrom a business venture, but not including any excluded income and\nsavings of the household which do not exceed four thousand dollars;\nand\n(ii) the Director has determined that the aggregate income of the\napplicant\u2019s household is not sufficient to meet the relevant expenses\nof the applicant\u2019s household.\n4.\nSpecial category persons\n4.\n(1) Notwithstanding regulation 3, an applicant under section 10 of the principal Act\nwho falls within a special category referred to in paragraph (3) is eligible for\nfinancial assistance, the categories and maximum amounts of which are set out\nin the Schedule, if, in respect of a period for which an application is made \u2014\n(a)\nin the case of a household of one to three persons \u2014\n(i)\nthe aggregate income of the applicant\u2019s household does not exceed\nthree thousand dollars per month from all sources, including income\nfrom a business venture, but not including any excluded income and\nany savings of the household which do not exceed fifteen thousand\ndollars; and\n(ii) the Director has determined that the aggregate income of the\napplicant\u2019s household is not sufficient to meet the relevant expenses\nof the applicant\u2019s household;\n(b) in the case of a household of four to six persons \u2014\n(i)\nthe aggregate income of the applicant\u2019s household does not exceed\nthree thousand five hundred dollars per month from all sources,\nincluding income from a business venture, but not including any\nexcluded income and savings of the household which do not exceed\nfifteen thousand dollars; and\n(ii) the Director has determined that the aggregate income of the\napplicant\u2019s household is not sufficient to meet the relevant expenses\nof the applicant\u2019s household; and\n(c)\nin the case of a household of seven or more persons \u2014\n\nFinancial Assistance Regulations (2026 Revision)\nRegulation 4\n\nc\nRevised as at 31st December, 2025\nPage 9\n\n(i)\nthe aggregate income of the applicant\u2019s household does not exceed\nfour thousand dollars per month from all sources, including income\nfrom a business venture, but not including any excluded income and\nsavings of the household which do not exceed fifteen thousand\ndollars; and\n(ii) the Director has determined that the aggregate income of the\napplicant\u2019s household is not sufficient to meet the relevant expenses\nof the applicant\u2019s household.\n(2) Notwithstanding regulation 3, where an applicant under section 10 of the\nprincipal Act applies for financial assistance and a member of the applicant\u2019s\nhousehold falls within a special category referred to in paragraph (3), the\napplicant is eligible for financial assistance, the categories and maximum\namounts of which are set out in the Schedule, if, in respect of a period for which\nan application is made \u2014\n(a)\nin the case of a household of one to three persons \u2014\n(i)\nthe aggregate income of the applicant\u2019s household does not exceed\nthree thousand dollars per month from all sources, including income\nfrom a business venture, but not including any excluded income and\nany savings of the household which do not exceed fifteen thousand\ndollars; and\n(ii) the Director has determined that the aggregate income of the\napplicant\u2019s household is not sufficient to meet the relevant expenses\nof the applicant\u2019s household;\n(b) in the case of a household of four to six persons \u2014\n(i)\nthe aggregate income of the applicant\u2019s household does not exceed\nthree thousand five hundred dollars per month from all sources,\nincluding income from a business venture, but not including any\nexcluded income and savings of the household which do not exceed\nfifteen thousand dollars; and\n(ii) the Director has determined that the aggregate income of the\napplicant\u2019s household is not sufficient to meet the relevant expenses\nof the applicant\u2019s household; and\n(c)\nin the case of a household of seven or more persons \u2014\n(i)\nthe aggregate income of the applicant\u2019s household does not exceed\nfour thousand dollars per month from all sources, including income\nfrom a business venture, but not including any excluded income and\nsavings of the household which do not exceed fifteen thousand\ndollars; and\n\nRegulation 5\nFinancial Assistance Regulations (2026 Revision)\n\nPage 10\nRevised as at 31st December, 2025\nc\n\n(ii) the Director has determined that the aggregate income of the\napplicant\u2019s household is not sufficient to meet the relevant expenses\nof the applicant\u2019s household.\n(3) For the purposes of this regulation, an applicant or a member of the applicant\u2019s\nhousehold falls within a special category if the applicant or the member of the\napplicant\u2019s household is \u2014\n(a)\nan older person; or\n(b) a person with a disability that is likely to render the person incapable by\nreason of infirmity of body or mind of working, and the infirmity is\ncertified as likely to be permanent by a medical doctor or a medical officer,\nas applicable.\n5.\nSpecial provision for certain households\n5.\nNotwithstanding regulations 3 and 4, an applicant under section 10 of the principal\nAct is eligible for financial assistance, the categories and maximum amounts of which\nare set out in the Schedule, if \u2014\n(a)\nthe applicant is the guardian of a person with a disability;\n(b) in respect of a period for which an application is made \u2014\n(i)\nin the case of a household of one to three persons, the aggregate\nincome of the applicant\u2019s household exceeds three thousand dollars\nper month from all sources, including income from a business\nventure but not including any excluded income;\n(ii) in the case of a household of four to six persons, the aggregate income\nof the applicant\u2019s household exceeds three thousand five hundred\ndollars per month from all sources, including income from a business\nventure but not including any excluded income; and\n(iii) in the case of a household of seven or more persons, the aggregate\nincome of the applicant\u2019s household exceeds four thousand dollars\nper month from all sources, including income from a business\nventure but not including any excluded income; and\n(c)\nthe Director has determined that the aggregate income of the applicant\u2019s\nhousehold is not sufficient to meet the relevant expenses of the applicant\u2019s\nhousehold.\n6.\nSpecial provision where recipient becomes employed\n6.\nNotwithstanding regulations 3 and 4, where \u2014\n(a)\na recipient becomes employed and the income is in excess of the amounts\nspecified in regulation 3 or 4(1) or (2), as applicable; and\n\nFinancial Assistance Regulations (2026 Revision)\nRegulation 7\n\nc\nRevised as at 31st December, 2025\nPage 11\n\n(b) the Director is satisfied that the recipient is still in need of financial support\nfor the purpose of assisting the recipient with the transition to becoming\neconomically or financially self-sufficient,\nthe Director, for a period of no more than one month after the date of the\ncommencement of the employment, may continue to issue part or the whole of the\npayments of financial assistance previously payable to the recipient.\n7.\nExemption of certain categories of persons\n7.\n(1) In respect of an application for financial assistance, if a person referred to in\nparagraph (2) is without other means of financial support, the person is exempt\nfrom the requirement to satisfy the eligibility criteria under section 10(1) and\n(3)(b) of the principal Act and under regulations 3 and 4.\n(2) For the purposes of paragraph (1), any of the following persons who are without\nother means of financial support are exempt \u2014\n(a)\npersons in respect of whom an act of domestic violence, as defined under\nsection 3 of the Protection from Domestic Violence Act (2021 Revision),\nis committed;\n(b) persons who are victims of a disaster; and\n(c)\nany other persons who the Director considers to be \u2014\n(i)\nat significant risk of harm; or\n(ii) in need of urgent aid.\n(3) A person referred to in paragraph (2) shall be physically present in the Islands\nat the time that the person makes an application, unless the Director decides to\nwaive that requirement because the applicant is absent from the Islands due to\nmedical reasons or because there are exceptional circumstances which justify\nthe waiver.\n(4) For the purposes of this regulation, a person referred to in paragraph (2) shall be\nissued financial assistance at the discretion of the Director.\n8.\nForm and manner of application\n8.\nAn applicant may make an application in such form as is approved by the Director,\nor in another manner, being in writing, as the Director may accept in the\ncircumstances, and the application shall be accompanied by \u2014\n(a)\na completed and signed release of information form, in such form as is\napproved by the Director; and\n(b) relevant documents in support of the application.\n\nRegulation 9\nFinancial Assistance Regulations (2026 Revision)\n\nPage 12\nRevised as at 31st December, 2025\nc\n\n9.\nAdditional information required for applications for medical expenses\n9.\nAn application for financial assistance for medical expenses which are not covered\nunder a person\u2019s health insurance contract, in addition to any other prescribed or\nrequested relevant information, shall, where requested by the Director, be\naccompanied by one or both of the following \u2014\n(a)\na referral obtained from a medical doctor or a medical officer, as\napplicable; or\n(b) a form approved by the Director and completed by a medical doctor or a\nmedical officer, as applicable.\n10.\nReview of applications based on medical grounds\n10. The Director may refer a person\u2019s case to the Chief Medical Officer, or a medical\ndoctor or a medical officer nominated by the Chief Medical Officer, for review \u2014\n(a)\nin the case of an applicant, where the applicant makes an application based\non medical reasons; and\n(b) in the case of a recipient whose financial assistance is based on medical\nreasons, where the medical report of the recipient has expired and the\nDirector has to make a determination whether the financial assistance in\nrespect of that recipient should continue.\n11.\nTime within which application to be evaluated and determined\n11. Pursuant to section 11(1) of the Act, the Director shall, within ten working days after\nreceiving a complete application, evaluate the application and determine whether the\napplication should be granted or refused.\n12.\nConsiderations before payment of financial assistance commences\n12. (1) Where an applicant under section 10 of the principal Act makes an application\ndue to termination of employment for reasons of redundancy and the Director\ngrants the application, if the applicant receives a redundancy payment, the\npayment of financial assistance shall not commence until a date after the end of\nthe period which the Director determines as a reasonable period within which\nthe redundancy payment can meet the applicant\u2019s financial needs.\n(2) Where an applicant under section 10 of the principal Act makes an application\nwhile serving a term of imprisonment in accordance with section 10(2) of the\nprincipal Act and the Director grants the application, the payment of the\nfinancial assistance shall commence on a date to be determined by the Director\nand that date shall not be prior to the date that the applicant is released from\nprison.\n\nFinancial Assistance Regulations (2026 Revision)\nRegulation 13\n\nc\nRevised as at 31st December, 2025\nPage 13\n\n13.\nPayments of financial assistance\n13. (1) The Director shall determine the manner, the commencement date and the\nduration of payments of financial assistance.\n(2) The Director shall, at intervals determined by the Director, review the\ncircumstances of a recipient for the purposes of determining whether the\nrecipient continues to satisfy the relevant criteria for eligibility for financial\nassistance.\n(3)  The amount of financial assistance to be paid to a recipient shall be determined\nby the Director, based on the difference between the aggregate income of the\nrecipient\u2019s household and the relevant expenses of the recipient\u2019s household.\n(4)  Notwithstanding paragraph (3) and the categories and maximum amounts of\nfinancial assistance set out in the Schedule, and subject to paragraph (5), where\nthe Director is satisfied that a recipient is still in need of financial assistance, the\nDirector may issue an additional payment of financial assistance of no more\nthan three hundred dollars to the recipient in respect of the recipient\u2019s\nhousehold.\n(5)  Where the recipient referred to in paragraph (4) or a member of the recipient\u2019s\nhousehold falls within a special category referred to in regulation 4(3), if the\nDirector is satisfied that that recipient is still in need of financial assistance, the\nDirector may, instead of issuing an additional payment of financial assistance\nof no more than three hundred dollars, issue an additional payment of financial\nassistance of no more than five hundred and fifty dollars to that recipient in\nrespect of that recipient\u2019s household.\n14.\nFinancial assistance for accommodation\n14. (1) The amount of financial assistance for accommodation shall be determined by\nthe Director in accordance with the size of the household.\n(2) Where a recipient chooses accommodation, the cost of which is in excess of the\namount of the financial assistance for accommodation determined by the\nDirector under paragraph (1), the recipient shall pay the excess amount for the\nchosen accommodation.\n15.\nAppointment or authorization of representative\n15. (1) A person may appoint another person (a \u201crepresentative\u201d) to \u2014\n(a) make an application on behalf of the person; or\n(b) otherwise act on behalf of the person in the capacity of an applicant, a\nrecipient or a member of a household, for the purposes of the principal Act\nand these Regulations.\n(2) Where a person under paragraph (1) wishes to appoint a representative \u2014\n(a)\nthe person shall apply in writing to the Director; and\n\nRegulation 16\nFinancial Assistance Regulations (2026 Revision)\n\nPage 14\nRevised as at 31st December, 2025\nc\n\n(b) after having regard to the matters specified in paragraph (3), the Director\nmay accept the appointment.\n(3) For the purposes of paragraph (2)(b), the Director shall consider the\nfollowing \u2014\n(a)\nwhether the Director has previously terminated or revoked \u2014\n(i)\nthe appointment; or\n(ii) an authorization by the Director,\nof the person who is being proposed as a representative;\n(b) whether, having regard to the circumstances, the application for the\nappointment may have been made under duress or as a result of coercion;\nand\n(c)\nany other relevant matters.\n(4) Where the Director accepts the appointment, the Director shall endorse the letter\nof appointment.\n(5) Where a person is unable to \u2014\n(a)\nmake an application; or\n(b) appoint a representative in respect of the matters set out in paragraph (1),\nthe Director may authorize another person to be a representative to make the\napplication or to otherwise act on behalf of the person in the capacity of an\napplicant, a recipient or a member of a household, for the purposes of the\nprincipal Act and these Regulations.\n(6) An appointment or authorization made under this regulation may be terminated\nor revoked by \u2014\n(a)\nthe person on whose behalf the representative is acting, by notice in\nwriting, submitted to the representative and the Director;\n(b) the representative, by notice in writing, submitted to the person on whose\nbehalf the representative is acting and the Director; or\n(c)\nthe Director, where the Director determines that \u2014\n(i)\nthe application for the appointment was made under duress or as a\nresult of coercion; or\n(ii) the financial assistance is not being used for the benefit of the\nrecipient.\n16.\nApplication for reconsideration of decision of Director\n16. (1) For the purposes of section 18(2) of the Act, an applicant or a recipient who is\naggrieved by a decision of the Director made in relation to the applicant or the\nrecipient may apply for a reconsideration of the decision of the Director using\nthe application form approved by the Director for that purpose.\n\nFinancial Assistance Regulations (2026 Revision)\nRegulation 17\n\nc\nRevised as at 31st December, 2025\nPage 15\n\n(2) An application form under paragraph (1) shall contain the following \u2014\n(a)\nthe particulars of the applicant or the recipient;\n(b) the date of notice of the relevant decision of the Director;\n(c)\ndetails of the decision being requested for reconsideration;\n(d) the grounds for disagreement with the decision and the manner in which\nthe applicant or the recipient is aggrieved;\n(e)\nany new relevant information and evidence thereof; and\n(f)\nwhere the application is a late application under section 18(4) of the Act,\nthe reasons for the late submission of the application.\n17.\nMatters related to the disclosure of data or information to correct false\ninformation\n17. Where data or information is being disclosed in accordance with section 26(2)(c) of\nthe Act, the Director or a person authorized in writing by the Director to issue external\ncommunications on behalf of the Department shall disclose the data or information\nin the form of an official statement on the official Government website of the\nDepartment or in any other official means of communication, no later than seven days\nafter the false information was published.\n18.\nEffect of death on pending application\n18. Where an applicant dies before the Director determines an application, the application\nshall be treated as having been withdrawn.\n19.\nMaintenance of records\n19. (1) The Director shall cause to be kept, in accordance with the relevant disposal\nschedule, proper accounts and records of the transactions and affairs of the\nDepartment, including records of \u2014\n(a)\napplications;\n(b) decisions made in respect of applications;\n(c)\ndecisions made in respect of applications for reconsiderations of decisions\nof the Director; and\n(d) amounts of financial assistance paid to recipients.\n(2) Pursuant to paragraph (1)(a), the Director shall assign each application a file\nnumber.\n(3) Pursuant to paragraph (1)(d), the Director shall do all things necessary to ensure\nthat \u2014\n(a)\npayments of financial assistance are correctly made and properly\nauthorized; and\n\nRegulation 19\nFinancial Assistance Regulations (2026 Revision)\n\nPage 16\nRevised as at 31st December, 2025\nc\n\n(b) the funds appropriated by the Parliament for the purpose of providing\nfinancial assistance are properly brought to account.\n\nFinancial Assistance Regulations (2026 Revision)\n\nSCHEDULE\n\nc\nRevised as at 31st December, 2025\nPage 17\n\n SCHEDULE\n(regulations 3, 4 and 5)\n CATEGORIES OF FINANCIAL ASSISTANCE\n\nCategory of financial assistance\nAllowance\nFinancial assistance applicable only to a person\nreferred to in regulation 4(3)\n\n1.\nNo more than $1,500.00 per month.\n\nFinancial assistance applicable only to a person\nreferred to in regulation 7(2)\n\n1.\nNo more than $1,500.00.\nUtilities (electricity, water and propane gas)\n1.\nFor propane gas, no more than $110.00 each\ntime, for no more than 3 times per year.\n\n2.\nFor electricity and water \u2014\n(a) where the household consists of one\nperson, no more than $300.00 per\nmonth; and\n(b) where the household consists of more\nthan one person, no more than $600.00\nper month.\n\nMedical expenses\n1.\nFor medical travel expenses which are not\ncovered under a person\u2019s health insurance\ncontract, no more than $800.00 per year.\n\n2.\nFor dental expenses which are not covered\nunder a person\u2019s health insurance contract \u2014\n(a) in the case of dentures, no more than\n$500.00 per year; and\n(b) in the case of medically required braces\nnot covered by insurance, no more than\n$1,500.00 per year.\n\n3.\nFor optical expenses which are not covered\nunder a person\u2019s health insurance contract, no\nmore than $360.00 in a two-year period, with\nexceptions\nbeing\nmade\nwhere\nan\nophthalmologist or optician has recommended a\nspecial prescription.\n\nSCHEDULE\nFinancial Assistance Regulations\n\nPage 18\nRevised as at 31st December, 2025\nc\n\nCategory of financial assistance\nAllowance\n4.    For expenses relating to medical equipment and\nsupplies which are not covered under a person\u2019s\nhealth insurance contract (other than medical\ntravel expenses, dental expenses and optical\nexpenses referred to above), no more than\n$1,000.00 per year.\n\nClothing\n1.\nFor clothing, no more than $250.00 per person\nin a household, per year or no more than\n$750.00 per household, per year, whichever is\nlesser.\n\nAccommodation\n1.\nFor accommodation \u2014\n(a) no more than $3,000.00 per month; and\n(b) in the case of rental accommodation, a\none-time payment equal to the amount of\nthe rental deposit in respect of the rental\naccommodation, which shall be no more\nthan $3,000.00.\n\nBurial assistance\n1. For burials \u2014\n(a) no more than $3,500.00 for a funeral\npackage; and\n(b) in the case of a burial vault, no more than\n$1,200.00 for the burial vault.\n\nFood\n1. For after-school care, no more than $200.00 per\nchild, per month or no more than $600.00 per\nhousehold, per month, whichever is lesser.\n\n3.
