(1) The Governor may, by Order published in the Gazette, prohibit the killing within the Islands, the territorial waters or the fisheries zone thereof, and for such period as may be therein specified, of such animals, being animals listed in the Schedule, as are specified in such Order. (2) Whoever contravenes subsection (1) is guilty of an offence and liable on summary conviction to a fine of ten thousand dollars and to imprisonment for three years. (3) Where any offence under this section is committed by any company or other body corporate or by any society, association or body of persons, every person charged with or concerned or acting in control or management of the affairs of such company, body corporate, society, association or body of persons, shall also be guilty of such offence unless he proves that such offence was committed without his knowledge or consent and that he took all reasonable steps to prevent the commission of the offence. Species included in this Part are referred to- (a) by the name of the species; or (b) as being all of the species included in a higher taxon or designated part thereof. 2. The abbreviation \u201cspp.\u201d is used to denote all species of a higher taxon. 3. Other references to taxa higher than species are for the purpose of information or classification only. 4. An asterisk (*) placed against the name of a species or higher taxon indicates that one or more geographically separate populations, sub-species or species of that taxon are included in Part II and that these populations, sub-species or species are excluded from Part I. 5. SPECIES PROTECTION AND\nPROPAGATION LAW\n(1999 Revision)\nENACTED by the Legislature of the Cayman Islands.\n1.\nShort title\n1.\nThis Law may be cited as the Endangered Species Protection and Propagation Law\n(1999 Revision).\n2.\nDefinitions\n2.\nIn this Law \u2014\n\u201clive or dead animal\u201d and \u201cplant\u201d includes the parts and products thereof\nitemised in the Schedule; and\n\u201cGovernor\u201d means the Governor in Council.\n3.\nImport and export of certain animals and plants prohibited\n3.\n(1) The importation and exportation of live or dead animals and plants referred to\nin the Schedule is, subject to sections 4 and 8, prohibited.\n(2) Where a live or dead animal or plant of any of the families for the time being\nspecified in Parts I and II of the Schedule or an article for the time being\nspecified in Part III of the Schedule is being imported or exported or has been\nimported to any place in the Islands for the purpose of being exported, any\ncustoms officer may require any person possessing or having control of the\nanimal, plant or article to furnish proof that its importation or exportation is or\n\nSection 4\nEndangered Species Protection and Propagation Law\n\nPage 6\nRevised as at 8th day of June, 1999\nc\n\nwas not unlawful by virtue of this section; and if such proof is not furnished to\nthe satisfaction of such customs officer such animal, plant or article is liable to\nforfeiture.\n4.\nExceptions\n4.\n(1) Section 3 has no application to live or dead animals or plants the subject of a\nlicence issued by the Governor.\n(2) For the avoidance of doubt it is hereby declared that section 3 has no\napplication to the bringing into the Islands of turtles taken within the fishery\nlimits of the Islands if taking such turtles is customary and traditional and the\nturtles are intended only for consumption by persons within the Islands.\n5.\nLicence application\n5.\nApplication for a licence under section 4 may be made to the Governor who may\ngrant such a licence only upon the recommendation of the Chief Agricultural and\nVeterinary Officer.\n6.\nConditions of licences\n6.\nLicences granted under section 4 are revocable by the Governor at any time and\nshall, in any event, expire after one year from the date of issue or after any shorter\nperiod therein specified and are subject to such general or special conditions as the\nGovernor may impose including conditions as to the place and mode of import or\nexport, the premises where the licensed animal or plant shall be kept when in the\nIslands and quarantine requirements.\n7.\nProhibition on killing\n7.\n(1) The Governor may, by Order published in the Gazette, prohibit the killing\nwithin the Islands, the territorial waters or the fisheries zone thereof, and for\nsuch period as may be therein specified, of such animals, being animals listed\nin the Schedule, as are specified in such Order.\n(2) Whoever contravenes subsection (1) is guilty of an offence and liable on\nsummary conviction to a fine of ten thousand dollars and to imprisonment for\nthree years.\n(3) Where any offence under this section is committed by any company or other\nbody corporate or by any society, association or body of persons, every person\ncharged with or concerned or acting in control or management of the affairs of\nsuch company, body corporate, society, association or body of persons, shall\nalso be guilty of such offence unless he proves that such offence was\ncommitted without his knowledge or consent and that he took all reasonable\nsteps to prevent the commission of the offence.\n\nEndangered Species Protection and Propagation Law (1999 Revision)\nSection 8\n\nc\nRevised as at 8th day of June, 1999\nPage 7\n\n8.\nRegulations\n8.\nThe Governor may make regulations prescribing \u2014\n(a)\nthe forms to be used for the purposes of this Law;\n(b) fees upon application and the grant of licences;\n(c)\nfor the making and certification of products produced under licence;\n(d) amendments to the Schedule; and\n(e)\nsuch other matters as may be desirable for the implementation of\nthis Law.\n9.\nOffences\n9.\nWhoever \u2014\n(a)\ncontravenes section 3;\n(b) makes any statement orally or in writing or propounds any document in\nthe truth of which he does not believe for the purpose of obtaining a\nlicence or other advantage under this Law, the onus of showing his belief\nbeing upon him;\n(c)\nhandles, deals in or has in his possession any animal or plant introduced\ninto the Islands in contravention of section 3; or\n(d) contravenes any term or condition of a licence granted to him under\nthis Law,\nis guilty of an offence and liable on summary conviction to a fine of eight\nhundred dollars and to
