These regulations may be cited as the Public Health (Garbage and Refuse Disposal) Regulations (2011 Revision).\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_2\", \"num\": \"2.\", \"text\": \"Definitions 2. In these regulations \u2014 \u201cconstruction waste material\u201d includes waste building material from the construction, alteration and remodelling of a building or structure of any kind, such as lumber, concrete, steel, roofing, etc.; \u201ccontainer service\u201d means the delivery, removal and emptying of a garbage container; \u201cDepartment\u201d means the Environmental Health Department; \u201cDirector\u201d means the Chief Environmental Health Officer; \u201cgarbage\u201d includes waste food, vegetables, fruits, meats and other putrescible matter; \u201crefuse\u201d includes waste paper, bottles, cans, boxes, yard clippings and trash; \u201cresidential premises\u201d means a house, apartment, tenement house, guest house, lodging house or condominium; Regulation 3 \u201cservice area\u201d means an area designated by the Department, subject to the approval of the Minister, to be provided with a garbage and refuse collection service; and \u201cunit\u201d means living accommodation used or intended for the domestic use of one or more individuals living as a single housekeeping entity, with facilities, whether exclusive or shared, for cooking, eating, living, sleeping and sanitary purposes.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_3\", \"num\": \"3.\", \"text\": \"Duties of occupiers of premises 3. All occupiers of premises in service areas shall \u2014 (a) provide, for the collection of garbage, a water tight metal or plastic container or containers with tight fitting covers; (b) ensure that such containers are of a type and description approved by the Department: Provided that, for commercial establishments and residences having small volumes of garbage and refuse, plastic bags with openings securely tied, with wet garbage wrapped in several thickness of paper, may be used in lieu of containers; (c) place the containers or bags for collection in front or at the side of premises on streets abutting the premises or in such other place as may be approved by the Department; (d) remove containers from streets after collection; (e) so place containers as not to obstruct traffic; and (f) refrain from dumping any garbage or refuse on any property belonging to another or on or within the vicinity of any public highway, beach, waterfront or public place.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_4\", \"num\": \"4.\", \"text\": \"Disposal of garbage 4. (1) The use of the garbage collection service in service areas is mandatory save for large commercial establishments specifically exempted by the Department. (2) Large commercial establishments may deliver garbage and refuse in private vehicles to landfill disposal sites designated by the Department. (3) All garbage and refuse from service areas shall be deposited at the landfill disposal sites designated by the Department. (4) Save with the permission in writing of the Department the burning of garbage at private premises in a service area is prohibited. (5) No garbage or refuse shall be permitted to accumulate in or on any premises. Regulation 5 (6) All commercial concerns shall provide for the proper storage of all garbage and refuse to prevent the harbourage of vermin and to prevent scattering by animals or by the wind. (7) Approval shall be obtained from the Department prior to construction of any special type garbage or refuse storage bin or facility.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_5\", \"num\": \"5.\", \"text\": \"Collection service 5. (1) A collection service will be provided in residential parts of service areas at least twice per week on days which will be notified, from time to time, in the Gazette, and containers shall be placed as required by regulation 3(c) before 6 a.m. on each day of collection. (2) Residential premises with ten or more units will require commercial containers with the appropriate service frequency determined by the Department.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_6\", \"num\": \"6.\", \"text\": \"Designation of garbage vehicles 6. All vehicles carrying garbage and refuse shall be so designed and loaded as to prevent spillage during transit.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_7\", \"num\": \"7.\", \"text\": \"Removal of construction waste 7. It shall be the responsibility of contractors to remove and dispose of all construction waste material resulting from new construction or other works on or at any premises, and such waste construction material will be accepted at the landfill.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_8\", \"num\": \"8.\", \"text\": \"Dead animals 8. Dead animals not slaughtered for consumption shall be disposed of by burial at a depth of not less than two feet of earth or as directed by a public health inspector.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_9\", \"num\": \"9.\", \"text\": \"Large containers 9. Large containers specially approved by the Department shall be placed and serviced by the Department, and access to these containers shall be kept clear at all times; boxes and cartons shall be broken down effectively to utilise container capacity and wet garbage shall be placed in plastic bags being put into the container.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_10\", \"num\": \"10.\", \"text\": \"Fees 10. (1) The annual fees specified in the Schedule shall apply in respect of garbage and refuse disposal collection. (2) The fees specified in the Schedule in respect of a collection of refuse or garbage are payable by the occupier of any premises where that collection is carried out and, subject to subregulation (3), such fees shall become due and payable as follows \u2014 (a) for the six month period from 1st January, 2003 to 30th June, 2003, the due date is 31st January, 2003; and Regulation 10 (b) for each succeeding financial year covering the twelve month period 1st July in any year to 30th June of the following calendar year, the due date is 31st July, save that where invoices are billed on a half yearly basis the due dates are 31st July and 31st January. (3) The Director is authorised to change the billing cycle by giving notice published in the Gazette and in at least one local newspaper no less than thirty days prior to the commencement of such change. (4) Any fee in the Schedule which is due and payable under this regulation \u2014 (a) shall, in respect of premises in Grand Cayman, be paid to the member of the Cabinet charged with responsibility for finance, and shall, in respect of premises in Cayman Brac or Little Cayman, be paid to the District Commissioner; and (b) is recoverable by the Department as a civil debt. (5) Any fee or part of a fee specified in the Schedule which is due and payable shall carry interest at the prescribed rate in respect of the period beginning on the date when the fee or part of the fee becomes due and payable, and ending on the date on which the fee or part of the fee is paid. (6) In subregulation (5) \u2014 \u201cprescribed rate\u201d means such rate as may be determined by the Governor in Cabinet for the purposes of this regulation, and different rates may be prescribed for different fees or classes of fee. (7) The payment of fees may be made by means of cash, cheque, credit card, debit card or electronic transactions, save that where payment is made other than in cash or by cheque, the full amount is required to be paid at once. (8) The member of the Cabinet charged with responsibility for finance, where he is informed by the Director that he is satisfied that the occupier of any premises is complying, to the Director\u2019s satisfaction, with the conditions of any recycling scheme carried out by the Department, may abate the fee in respect of any garbage and refuse disposal collection that would, apart from this subregulation, be due and payable by the occupier of premises at which that collection is carried out. (9) The amounts by which any fee may be abated under subregulation (8) shall be determined by the member of the Cabinet charged with responsibility for finance having regard to \u2014 (a) the cost of operating the recycling scheme and any revenue or other financial benefit derived by the Department from the recycling scheme; and (b) the extent to which the occupier who is liable to pay the fee to be abated has complied with the conditions of the recycling scheme. Regulation 11 11. Waiver of fees: Cayman Brac, Little Cayman 11. The Governor in Cabinet may, from time to time, waive or reduce any or all of the fees specified in paragraphs 1, 2 and 3 of the Schedule in relation to any person or group of persons in Cayman Brac or Little Cayman. The fee for apartments, tenement houses and offices shall be paid by the person having control of the whole building. 3. The fee for a hotel, restaurant, guest house, lodging house and business premises other that offices, shall be paid- (a) by the person licensed under the Tourism Law (1995 Revision) or taking an annual license in respect thereof under the Trade and Business Licensing Law (2007 Revision) (as the case may be); or (b) if there is no such person, then by the person having the control or management thereof. 4. The fee for a bar shall be paid by the person who is the licensee thereof under the Liquor Licensing Law (2000 Revision). Revision)\n\n1.\nCitation\n1.\nThese regulations may be cited as the Public Health (Garbage and Refuse Disposal)\nRegulations (2011 Revision).\n2.\nDefinitions\n2.\nIn these regulations \u2014\n\u201cconstruction waste material\u201d includes waste building material from the\nconstruction, alteration and remodelling of a building or structure of any kind,\nsuch as lumber, concrete, steel, roofing, etc.;\n\u201ccontainer service\u201d means the delivery, removal and emptying of a garbage\ncontainer;\n\u201cDepartment\u201d means the Environmental Health Department;\n\u201cDirector\u201d means the Chief Environmental Health Officer;\n\u201cgarbage\u201d includes waste food, vegetables, fruits, meats and other putrescible\nmatter;\n\u201crefuse\u201d includes waste paper, bottles, cans, boxes, yard clippings and trash;\n\u201cresidential premises\u201d means a house, apartment, tenement house, guest\nhouse, lodging house or condominium;\n\nRegulation 3\nPublic Health (Garbage and Refuse Disposal) Regulations\n\nPage 6\nRevised as at 31st day of July, 2011\nc\n\n\u201cservice area\u201d means an area designated by the Department, subject to the\napproval of the Minister, to be provided with a garbage and refuse collection\nservice; and\n\u201cunit\u201d means living accommodation used or intended for the domestic use of\none or more individuals living as a single housekeeping entity, with facilities,\nwhether exclusive or shared, for cooking, eating, living, sleeping and sanitary\npurposes.\n3.\nDuties of occupiers of premises\n3.\nAll occupiers of premises in service areas shall \u2014\n(a)\nprovide, for the collection of garbage, a water tight metal or plastic\ncontainer or containers with tight fitting covers;\n(b) ensure that such containers are of a type and description approved by the\nDepartment:\nProvided that, for commercial establishments and residences having\nsmall volumes of garbage and refuse, plastic bags with openings securely\ntied, with wet garbage wrapped in several thickness of paper, may be\nused in lieu of containers;\n(c)\nplace the containers or bags for collection in front or at the side of\npremises on streets abutting the premises or in such other place as may be\napproved by the Department;\n(d) remove containers from streets after collection;\n(e)\nso place containers as not to obstruct traffic; and\n(f)\nrefrain from dumping any garbage or refuse on any property belonging to\nanother or on or within the vicinity of any public highway, beach,\nwaterfront or public place.\n4.\nDisposal of garbage\n4.\n(1) The use of the garbage collection service in service areas is mandatory save\nfor large commercial establishments specifically exempted by the Department.\n(2) Large commercial establishments may deliver garbage and refuse in private\nvehicles to landfill disposal sites designated by the Department.\n(3) All garbage and refuse from service areas shall be deposited at the landfill\ndisposal sites designated by the Department.\n(4) Save with the permission in writing of the Department the burning of garbage\nat private premises in a service area is prohibited.\n(5) No garbage or refuse shall be permitted to accumulate in or on any premises.\n\nPublic Health (Garbage and Refuse Disposal) Regulations\nRegulation 5\n\nc\nRevised as at 31st day of July, 2011\nPage 7\n\n(6) All commercial concerns shall provide for the proper storage of all garbage\nand refuse to prevent the harbourage of vermin and to prevent scattering by\nanimals or by the wind.\n(7) Approval shall be obtained from the Department prior to construction of any\nspecial type garbage or refuse storage bin or facility.\n5.\nCollection service\n5.\n(1) A collection service will be provided in residential parts of service areas at\nleast twice per week on days which will be notified, from time to time, in the\nGazette, and containers shall be placed as required by regulation 3(c) before 6\na.m. on each day of collection.\n(2) Residential premises with ten or more units will require commercial containers\nwith the appropriate service frequency determined by the Department.\n6.\nDesignation of garbage vehicles\n6.\nAll vehicles carrying garbage and refuse shall be so designed and loaded as to\nprevent spillage during transit.\n7.\nRemoval of construction waste\n7.\nIt shall be the responsibility of contractors to remove and dispose of all construction\nwaste material resulting from new construction or other works on or at any\npremises, and such waste construction material will be accepted at the landfill.\n8.\nDead animals\n8.\nDead animals not slaughtered for consumption shall be disposed of by burial at a\ndepth of not less than two feet of earth or as directed by a public health inspector.\n9.\nLarge containers\n9.\nLarge containers specially approved by the Department shall be placed and serviced\nby the Department, and access to these containers shall be kept clear at all times;\nboxes and cartons shall be broken down effectively to utilise container capacity and\nwet garbage shall be placed in plastic bags being put into the container.\n10.\nFees\n10. (1) The annual fees specified in the Schedule shall apply in respect of garbage and\nrefuse disposal collection.\n(2) The fees specified in the Schedule in respect of a collection of refuse or\ngarbage are payable by the occupier of any premises where that collection is\ncarried out and, subject to subregulation (3), such fees shall become due and\npayable as follows \u2014\n(a)\nfor the six month period from 1st January, 2003 to 30th June, 2003, the\ndue date is 31st January, 2003; and\n\nRegulation 10\nPublic Health (Garbage and Refuse Disposal) Regulations\n\nPage 8\nRevised as at 31st day of July, 2011\nc\n\n(b) for each succeeding financial year covering the twelve month period 1st\nJuly in any year to 30th June of the following calendar year, the due date\nis 31st July, save that where invoices are billed on a half yearly basis the\ndue dates are 31st July and 31st January.\n(3) The Director is authorised to change the billing cycle by giving notice\npublished in the Gazette and in at least one local newspaper no less than thirty\ndays prior to the commencement of such change.\n(4) Any fee in the Schedule which is due and payable under this regulation \u2014\n(a)\nshall, in respect of premises in Grand Cayman, be paid to the member of\nthe Cabinet charged with responsibility for finance, and shall, in respect\nof premises in Cayman Brac or Little Cayman, be paid to the District\nCommissioner; and\n(b) is recoverable by the Department as a civil debt.\n(5) Any fee or part of a fee specified in the Schedule which is due and payable\nshall carry interest at the prescribed rate in respect of the period beginning on\nthe date when the fee or part of the fee becomes due and payable, and ending\non the date on which the fee or part of the fee is paid.\n(6) In subregulation (5) \u2014\n\u201cprescribed rate\u201d means such rate as may be determined by the Governor in\nCabinet for the purposes of this regulation, and different rates may be\nprescribed for different fees or classes of fee.\n(7) The payment of fees may be made by means of cash, cheque, credit card, debit\ncard or electronic transactions, save that where payment is made other than in\ncash or by cheque, the full amount is required to be paid at once.\n(8) The member of the Cabinet charged with responsibility for finance, where he\nis informed by the Director that he is satisfied that the occupier of any\npremises is complying, to the Director\u2019s satisfaction, with the conditions of\nany recycling scheme carried out by the Department, may abate the fee in\nrespect of any garbage and refuse disposal collection that would, apart from\nthis subregulation, be due and payable by the occupier of premises at which\nthat collection is carried out.\n(9) The amounts by which any fee may be abated under subregulation (8) shall be\ndetermined by the member of the Cabinet charged with responsibility for\nfinance having regard to \u2014\n(a)\nthe cost of operating the recycling scheme and any revenue or other\nfinancial benefit derived by the Department from the recycling\nscheme; and\n(b) the extent to which the occupier who is liable to pay the fee to be abated\nhas complied with the conditions of the recycling scheme.\n\nPublic Health (Garbage and Refuse Disposal) Regulations\nRegulation 11\n\nc\nRevised as at 31st day of July, 2011\nPage 9\n\n11.\nWaiver of fees: Cayman Brac, Little Cayman\n11. The Governor in Cabinet may, from time to time, waive or reduce any or all of the\nfees specified in paragraphs 1, 2 and 3 of the Schedule in relation to any person or\ngroup of persons in Cayman Brac
