(1) An application for a permit under section 47 of the Law shall include \u2014 (a) two passport-sized photographs of the applicant; (b) sufficient information to identify the applicant and to describe the applicant\u2019s address in the Islands; (c) a description of the vehicle the applicant proposes to use for the carriage of passengers for hire or reward and in respect of which the application is made; and (d) the application fee, except that an applicant who is a Caymanian shall be exempt from paying the application fee. (2) Application fees shall be as follows \u2014 Description of vehicle Fee $ 1. Vehicles constructed or adapted to seat less than ten passengers 2. Vehicles constructed or adapted to seat ten to twenty-five passengers 3. Vehicles constructed or adapted to seat more than twenty-five passengers. Traffic (Public Passenger Vehicles) Regulations (2020 Revision) SCHEDULE\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_4\", \"num\": \"4.\", \"text\": \"Conditions for grant of permit 4. (1) Upon receipt of an application for a permit under regulation 3, the Board, in determining whether to grant the application, shall have regard in particular to the conditions in paragraph (2) as to the suitability of the applicant. (2) Subject to paragraphs (3) and 3(C) the conditions are that the applicant \u2014 (a)   (i) in the case of an application by a public transport operator, is a Caymanian and is not less than twenty-one years of age; (ii) in the case of an application by any person to drive a taxi, is a Caymanian and is not less than twenty-one years of age; and (iii) in the case of an application by any other person, is not less than twenty-one years of age; (b) has paid the application fee to the Board or is exempt from paying the application fee; (c) has provided the Board with satisfactory evidence that there is in force in relation to the proposed use of the vehicle a policy of insurance of such security \u2014 (i) to comply (in respect of that use) with the requirements of the Vehicle Insurance (Third Party Risks) Law (2012 Revision); and (ii) to provide such insurance coverage lastability in respect of the death of, or bodily injuries to, passengers as may be specified in a direction by the Governor generally in relation to particular categories of vehicles; (d) has provided the Board with satisfactory evidence that the vehicle in respect of which the application is made has passed the inspection carried out by or on behalf of the Board as required by the Law; (e) in the case of an application for a renewal of a permit, has given the Board a statement of the number of months the applicant was engaged in the business of carrying passengers for hire or reward during the period in which that business was authorised by the permit to be renewed; (f) is able to speak, read and write the English language sufficiently to perform the duties of carrying passengers for hire or reward; (g) has, in the previous three months, undergone a medical examination by a registered health practitioner who has certified that the applicant is fit to drive passengers for hire or reward; (h) is the holder of a valid current driving licence authorising that person to drive the vehicle that person proposes to use for carrying passengers for hire or reward; (i) has undergone and passed any test required by the Board in respect of the applicant\u2019s first aid and driving skills and knowledge; and SCHEDULE Traffic (Public Passenger Vehicles) Regulations (2020 Revision) (j) has undertaken to use the vehicle (in respect of which the application for a permit is made) only in providing such one or more of the descriptions of services by which passengers may be carried for hire or reward as are specified by the Board in respect of that category of vehicle. (3) Where the applicant is over seventy years of age, in addition to the conditions prescribed in paragraph (2), that person shall \u2014 (a) undergo annual medical examinations, including ophthalmologic tests, conducted by a registered health practitioner and be certified as being fit to drive passengers for hire or reward; (b) pass a driving test carried out by a driving examiner appointed by the Director of Vehicle Licensing or that person\u2019s delegate; and (c) submit to any additional tests that may be required of that person by the Public Transport Board to demonstrate competency to operate a public passenger vehicle, and such additional tests may include \u2014 (i) general local knowledge; (ii) first aid; and (iii) customer service related skills. (3A) Where the applicant has a physical impairment which has a substantial adverse effect on that person\u2019s ability to carry out normal day to day activities, the Board shall provide adequate and appropriate facilities, accommodation and equipment to assist the applicant to undergo any test that that person is required to undergo pursuant to paragraph (2)(i) or (3)(c). (3B) For the purposes of paragraphs (2)(i) and (3)(c), in the case of an application for a permit, or for the renewal of a permit, to drive a school vehicle, the Board shall not require the applicant to undergo \u2014 (a) a test of general local knowledge; (b) a test to demonstrate customer service related skills; or (c) a test of knowledge of tours for visitors to the Islands. (3C) Where the applicant is a public transport operator, in addition to the conditions prescribed in paragraph (2) \u2014 (a) he shall provide the Board with satisfactory evidence that the vehicle in respect of which the application is made, is not leased to any person to carry passengers for hire or reward; and (b) except in the case of an application to drive a taxi \u2014 (i) he shall provide the Board with satisfactory evidence that every person employed by that person to drive the vehicle, is a Caymanian; or (ii) if a non-Caymanian is employed by that person to drive the vehicle, that person shall provide the Board with satisfactory evidence that Traffic (Public Passenger Vehicles) Regulations (2020 Revision) SCHEDULE that person\u2019s employment of that non-Caymanian is in compliance with the Immigration (Transition) Law, 2018 [Law 33 of 2018]. (4) For the purposes of paragraph (2)(j), the description of services for the carriage of passengers for hire or reward which may be specified by the Board are \u2014 (a) the provision of tours, whether or not pre-paid, for visitors to the Islands; (b) the provision of a bus service on a bus route in accordance with a regular schedule; (c) plying for hire as a taxi; (d) contract hire; and (e) such other services as may be specified in a direction given to the Board by the Governor under section 46 of the Law. (5) The Board shall not specify any description of service for the purposes of paragraph (2)(j) except under a direction of the Governor in Cabinet given under section 46 of the Law in respect of categories of vehicles.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_5\", \"num\": \"5.\", \"text\": \"Conduct of driver 5. (1) A person who is granted a permit by the Board under Part 4 of the Law to drive an omnibus or taxi shall not conduct himself in any way which causes annoyance or nuisance to any other person or which brings himself, the Islands or the operation of tourism in the Islands into disrepute. (2) Without prejudice to paragraph (1), a person who is granted a permit by the Board to drive a bus or taxi shall carry on the business authorised by the permit in accordance with paragraphs (3) to (5). (3) The driver of a bus or taxi shall not solicit a passenger or prospective passenger \u2014 (a) by the use of any bell, horn, whistle or other signal or by driving that person\u2019s vehicle back and forth in front of any public place; or (b) on behalf of any tourist accommodation, restaurant, night club, bar or watersports business. (4) The driver of a bus or taxi shall not \u2014 (a) divert or attempt to divert any person (whether or not a passenger in that person\u2019s or another person\u2019s vehicle) from travelling to any tourist accommodation, restaurant, night club, bar or watersports business; or (b) solicit or accept (or agree to solicit or accept) anything in money or money\u2019s worth in relation to \u2014 (i) the soliciting of a person for any tourist accommodation, restaurant, night club, bar or watersports business; or (ii) the diversion or attempted diversion of a person who is travelling to or is at any such premises. SCHEDULE Traffic (Public Passenger Vehicles) Regulations (2020 Revision) (5) In the course of that person\u2019s business of carrying passengers for hire or reward, the driver of a bus or taxi \u2014 (a) shall comply with the Law and all other laws of the Islands; (b) shall maintain a neat appearance and comply with any guidance given by the Board in relation to the mode of dress for drivers of buses and taxis; (c) shall not carry in that person\u2019s vehicle any firearms or other weapons; (d) shall maintain a written record of the journeys that person undertakes; (e) shall, in respect of each journey in which that person carries a passenger in the course of that person\u2019s business, select the route for the journey which (subject to any direction from the passenger) that person reasonably believes will provide the passenger with the shortest journey time; (f) shall, where the taxi or bus is parked at a taxi-stand or at a bus stop, remain in or in attendance on the vehicle and shall not leave the doors of the vehicle open; (g) shall not drive the vehicle at any time when that person\u2019s ability to do so is impaired; (h) while driving passengers shall not, without their consent \u2014 (i) smoke; or (ii) play any radio, tape or other recorder; (i) shall maintain that person\u2019s vehicle and its interior in a clean and roadworthy condition and in a state of repair such that it would at all times pass an inspection carried out by a vehicle inspector under section 61 of the Law; and (j) upon finding any unclaimed property in that person\u2019s vehicle, shall hand it within twenty-four hours to the officer in charge of the police station at George Town or Cayman Brac.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_6\", \"num\": \"6.\", \"text\": \"Refusal to carry passengers 6. (1) Subject to paragraphs (2) to (6), when a driver of a taxi is plying for hire that person shall not refuse to accept a passenger for a lawful journey; and a driver of a bus, while the bus has a vacant seat, shall not refuse to accept a passenger for a lawful journey who is waiting at a bus stop. (2) The driver of a taxi may refuse to carry \u2014 (a) any animal; and (b) any item of baggage which cannot conveniently and safely be carried in that person\u2019s vehicle. (3) The driver of a taxi, when that person\u2019s vehicle is empty and plying for hire, and the driver of a bus, while the bus has a vacant seat, shall not refuse to pick up a passenger unless the passenger \u2014 Traffic (Public Passenger Vehicles) Regulations (2020 Revision) SCHEDULE (a) does not, when requested, tender the proper fare; (b) is consuming alcoholic liquor or appears to be intoxicated, or appears to be under the influence of a drug the consumption of which is prohibited by the Misuse of Drugs Law (2017 Revision); or (c) has asked the driver to carry baggage of an unreasonable quantity, size or weight. (4) The driver of a bus or taxi shall not refuse to carry a person in that person\u2019s vehicle solely by reason of the person\u2019s race, sex, religion, nationality, age or disability. (5) The driver of a taxi shall not carry any person as an additional passenger in that person\u2019s vehicle without the voluntary consent of the passenger that person has already agreed to carry in the vehicle. (6) The driver of a taxi may refuse to carry a person in that person\u2019s vehicle where \u2014 (a) he reasonably believes that person to be incapable of paying the proper fare for the journey that person has requested; (b) that person has avoided or attempted to avoid payment of any proper fare that person has incurred for the hire of any taxi; or (c) that person has withheld that person\u2019s true name and address from the driver when the driver is lawfully demanding payment of the proper fare due from that person for the hire of the taxi.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_7\", \"num\": \"7.\", \"text\": \"Identification and information 7. (1) Every vehicle which is used as a taxi shall be clearly identifiable as a taxi, with the word \u201ctaxi\u201d clearly visible in a manner approved by the Board as a means of identification of the vehicle in daylight and darkness; and every vehicle which is used as a bus shall be clearly identifiable as a bus in daylight and darkness and shall be painted in a colour approved by the Board. (2) The driver of every taxi shall, while plying for hire, display in the vehicle \u2014 (a) a notice in a form approved by the Board which clearly shows the registration and permit numbers of the vehicle and the conditions of hire; (b) a fare distance table in a form approved by the Board; and (c) a card and photograph in a form approved by the Board which clearly identify the person driving or in charge of the taxi as the driver authorised to drive it by a permit granted under the Law. (3) The driver of every taxi shall, while plying for hire, display on the roof of the vehicle an illuminated sign of a type approved by the Board clearly indicating that the vehicle is available for hire as a taxi. SCHEDULE Traffic (Public Passenger Vehicles) Regulations (2020 Revision) (4) The driver of every bus shall, while driving the vehicle in the course of a business, display \u2014 (a) a notice in the vehicle in a form approved by the Board which clearly shows the registration and permit numbers of the vehicle and the conditions of its use; (b) route and fare tables in a form and location in the vehicle approved by the Board; (c) destination indicators in a form approved by the Board showing the destination of the bus; and (d) a card and photograph in a form approved by the Board which clearly identify the person driving the bus as the driver authorised to drive it by a permit granted under the Law. (5) The driver \u2014 (a) of every taxi, while plying for hire; and (b) of every bus, while driving the vehicle in the course of a business, shall display on the rear of the vehicle a plate (in a form and location approved by the Board) which clearly shows, in respect of each description of service mentioned in the undertaking given under regulation 4(2)(j) for the use of the vehicle, the maximum number of passengers which may be carried for hire or reward in the provision of that service.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_8\", \"num\": \"8.\", \"text\": \"Standard and equipment of vehicles 8. (1) No person shall drive a bus or taxi in the course of a business unless both the condition and appearance of the vehicle are conducive to the safety and comfort of its passengers and the enhancement of tourism in the Islands. (2) Without prejudice to paragraph (1), no person shall drive a bus or taxi in the course of a business unless the vehicle \u2014 (a) is safe and roadworthy in complete compliance with the Law; (b) is equipped to a reasonable standard of comfort for its permitted use; (c) has an operating air-conditioning system that provides cooled air; (d) is clean, both inside and out; (e) is fully operational; and (f) is undamaged and free from rust, and has no exterior dents or cracks, and no missing lights, hubcaps or other parts. (3) No person shall drive a bus or taxi in the course of a business unless the vehicle is equipped with \u2014 (a) a tow rope; (b) a lifting jack and other tools necessary to change a wheel; Traffic (Public Passenger Vehicles) Regulations (2020 Revision) SCHEDULE (c) an appropriate fire extinguisher; (d) a first-aid kit; and (e) spare fuses, spare bulbs and an appropriate spare wheel and tyre.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_9\", \"num\": \"9.\", \"text\": \"Taximeters 9. (1) The driver of a taxi shall not carry on the business of plying for hire or carrying passengers for hire or reward unless that taxi is quoting the National Taxi Fare Schedule as set out in the Schedule. (2) A taxi shall not, at any time, charge above the National Taxi Fare Schedule as set out in the Schedule. (1) No driver of a bus carrying passengers for hire or reward on a bus route may pick up or set down passengers at any place other than at a bus stop. (2) No driver of any vehicle other than \u2014 (a) a bus permitted to operate a regular daily schedule on a bus route; or (b) an emergency vehicle, shall, except in an emergency or if required to do so by a constable in uniform, set down or pick up passengers at a bus stop. (3) No driver or other person in charge of a bus shall permit any person to board or get off the bus when it is in motion. (4) Between 6 a.m. and 6 p.m. on any day no driver of a bus or taxi shall pick up passengers, or wait for any period for that purpose, anywhere in the district of George Town on the following roads \u2014 (a) North Church Street from the northern part of its junction with Fort Street to where it meets Harbour Drive; (b) Harbour Drive; and (c) South Church Street from where it meets Harbour Drive to the southern part of its junction with Boilers Road.\", \"element\": \"section\", \"heading\": null}, {\"eId\": \"sec_11\", \"num\": \"11.\", \"text\": \"Offences 11. Regulations may be cited as the Traffic (Public Passenger Vehicles)\nRegulations (2020 Revision).\n2.\nInterpretation\n2.\nIn these Regulations \u2014\n\u201cbus\u201d includes an omnibus;\n\u201cbus route\u201d means the roads approved as bus routes by the Board;\n\u201cbus stop\u201d means a place designated as a bus stop by a sign in a form approved\nby the Board;\n\u201cCaymanian\u201d has the same meaning as in the Immigration (Transition) Law,\n2018 [Law 33 of 2018];\n\u201cNational Taxi Fare Schedule\u201d means the official schedule of taxi fares\nderived by distance in miles and number of passengers and such fares are capped\nat a maximum of fifteen passengers based on the taxi capacity;\n\u201cpassenger\u201d includes a person boarding or alighting from a bus or taxi or\nintending to do so;\n\u201cpublic transport operator\u201d means a person who \u2014\n\nSCHEDULE\nTraffic (Public Passenger Vehicles) Regulations (2020 Revision)\n\nPage 6\nRevised as at 31st December, 2019\nc\n\n(a) is the registered owner of a public passenger-vehicle which that person\nundertakes to use only in providing one of the following descriptions of\nservices \u2014\n(i)\nthe provision of tours, whether or not pre-paid, for visitors to the\nIslands;\n(ii) the provision of a bus service on a bus route in accordance with a\nregular schedule;\n(iii) plying for hire as a taxi;\n(iv) contract hire; and\n(v) such other services as may be specified in a direction given to the\nBoard under section 46 of the Law;\n(b) is responsible for the payment of any person employed to drive the vehicle\nfor the purpose of providing the services; and\n(c) is responsible for the maintenance and operation of the vehicle; and\n\u201ctaxi Fare\u201d means the amount charged for a specific number of passengers\nbeing carried in a taxi with a defined start and end location;\n3.\nApplication for grant of permit\n3.\n(1) An application for a permit under section 47 of the Law shall include \u2014\n(a) two passport-sized photographs of the applicant;\n(b) sufficient information to identify the applicant and to describe the\napplicant\u2019s address in the Islands;\n(c) a description of the vehicle the applicant proposes to use for the carriage\nof passengers for hire or reward and in respect of which the application is\nmade; and\n(d) the application fee, except that an applicant who is a Caymanian shall be\nexempt from paying the application fee.\n(2) Application fees shall be as follows \u2014\nDescription of vehicle\nFee $\n1.\nVehicles constructed or adapted to seat less than ten passengers\n75\n2.\nVehicles constructed or adapted to seat ten to twenty-five\npassengers\n100\n3.\nVehicles constructed or adapted to seat more than twenty-five\npassengers.\n125\n\nTraffic (Public Passenger Vehicles) Regulations (2020 Revision)\nSCHEDULE\n\nc\nRevised as at 31st December, 2019\nPage 7\n\n4.\nConditions for grant of permit\n4.\n(1) Upon receipt of an application for a permit under regulation 3, the Board, in\ndetermining whether to grant the application, shall have regard in particular to\nthe conditions in paragraph (2) as to the suitability of the applicant.\n(2) Subject to paragraphs (3) and 3(C) the conditions are that the applicant \u2014\n(a)   (i)\nin the case of an application by a public transport operator, is a\nCaymanian and is not less than twenty-one years of age;\n(ii) in the case of an application by any person to drive a taxi, is a\nCaymanian and is not less than twenty-one years of age; and\n(iii) in the case of an application by any other person, is not less than\ntwenty-one years of age;\n(b) has paid the application fee to the Board or is exempt from paying the\napplication fee;\n(c) has provided the Board with satisfactory evidence that there is in force in\nrelation to the proposed use of the vehicle a policy of insurance of such\nsecurity \u2014\n(i)\nto comply (in respect of that use) with the requirements of the Vehicle\nInsurance (Third Party Risks) Law (2012 Revision); and\n(ii) to provide such insurance coverage lastability in respect of the death\nof, or bodily injuries to, passengers as may be specified in a direction\nby the Governor generally in relation to particular categories of\nvehicles;\n(d) has provided the Board with satisfactory evidence that the vehicle in\nrespect of which the application is made has passed the inspection carried\nout by or on behalf of the Board as required by the Law;\n(e) in the case of an application for a renewal of a permit, has given the Board\na statement of the number of months the applicant was engaged in the\nbusiness of carrying passengers for hire or reward during the period in\nwhich that business was authorised by the permit to be renewed;\n(f)\nis able to speak, read and write the English language sufficiently to\nperform the duties of carrying passengers for hire or reward;\n(g) has, in the previous three months, undergone a medical examination by a\nregistered health practitioner who has certified that the applicant is fit to\ndrive passengers for hire or reward;\n(h) is the holder of a valid current driving licence authorising that person to\ndrive the vehicle that person proposes to use for carrying passengers for\nhire or reward;\n(i)\nhas undergone and passed any test required by the Board in respect of the\napplicant\u2019s first aid and driving skills and knowledge; and\n\nSCHEDULE\nTraffic (Public Passenger Vehicles) Regulations (2020 Revision)\n\nPage 8\nRevised as at 31st December, 2019\nc\n\n(j)\nhas undertaken to use the vehicle (in respect of which the application for a\npermit is made) only in providing such one or more of the descriptions of\nservices by which passengers may be carried for hire or reward as are\nspecified by the Board in respect of that category of vehicle.\n(3) Where the applicant is over seventy years of age, in addition to the conditions\nprescribed in paragraph (2), that person shall \u2014\n(a) undergo annual medical examinations, including ophthalmologic tests,\nconducted by a registered health practitioner and be certified as being fit\nto drive passengers for hire or reward;\n(b) pass a driving test carried out by a driving examiner appointed by the\nDirector of Vehicle Licensing or that person\u2019s delegate; and\n(c) submit to any additional tests that may be required of that person by the\nPublic Transport Board to demonstrate competency to operate a public\npassenger vehicle, and such additional tests may include \u2014\n(i)\ngeneral local knowledge;\n(ii) first aid; and\n(iii) customer service related skills.\n(3A) Where the applicant has a physical impairment which has a substantial adverse\neffect on that person\u2019s ability to carry out normal day to day activities, the Board\nshall provide adequate and appropriate facilities, accommodation and\nequipment to assist the applicant to undergo any test that that person is required\nto undergo pursuant to paragraph (2)(i) or (3)(c).\n(3B) For the purposes of paragraphs (2)(i) and (3)(c), in the case of an application for\na permit, or for the renewal of a permit, to drive a school vehicle, the Board shall\nnot require the applicant to undergo \u2014\n(a) a test of general local knowledge;\n(b) a test to demonstrate customer service related skills; or\n(c) a test of knowledge of tours for visitors to the Islands.\n(3C) Where the applicant is a public transport operator, in addition to the conditions\nprescribed in paragraph (2) \u2014\n(a) he shall provide the Board with satisfactory evidence that the vehicle in\nrespect of which the application is made, is not leased to any person to\ncarry passengers for hire or reward; and\n(b) except in the case of an application to drive a taxi \u2014\n(i)\nhe shall provide the Board with satisfactory evidence that every\nperson employed by that person to drive the vehicle, is a Caymanian;\nor\n(ii) if a non-Caymanian is employed by that person to drive the vehicle,\nthat person shall provide the Board with satisfactory evidence that\n\nTraffic (Public Passenger Vehicles) Regulations (2020 Revision)\nSCHEDULE\n\nc\nRevised as at 31st December, 2019\nPage 9\n\nthat person\u2019s employment of that non-Caymanian is in compliance\nwith the Immigration (Transition) Law, 2018 [Law 33 of 2018].\n(4) For the purposes of paragraph (2)(j), the description of services for the carriage\nof passengers for hire or reward which may be specified by the Board are \u2014\n(a) the provision of tours, whether or not pre-paid, for visitors to the Islands;\n(b) the provision of a bus service on a bus route in accordance with a regular\nschedule;\n(c) plying for hire as a taxi;\n(d) contract hire; and\n(e) such other services as may be specified in a direction given to the Board\nby the Governor under section 46 of the Law.\n(5) The Board shall not specify any description of service for the purposes of\nparagraph (2)(j) except under a direction of the Governor in Cabinet given under\nsection 46 of the Law in respect of categories of vehicles.\n5.\nConduct of driver\n5.\n(1) A person who is granted a permit by the Board under Part 4 of the Law to drive\nan omnibus or taxi shall not conduct himself in any way which causes\nannoyance or nuisance to any other person or which brings himself, the Islands\nor the operation of tourism in the Islands into disrepute.\n(2) Without prejudice to paragraph (1), a person who is granted a permit by the\nBoard to drive a bus or taxi shall carry on the business authorised by the permit\nin accordance with paragraphs (3) to (5).\n(3) The driver of a bus or taxi shall not solicit a passenger or prospective\npassenger \u2014\n(a) by the use of any bell, horn, whistle or other signal or by driving that\nperson\u2019s vehicle back and forth in front of any public place; or\n(b) on behalf of any tourist accommodation, restaurant, night club, bar or\nwatersports business.\n(4) The driver of a bus or taxi shall not \u2014\n(a) divert or attempt to divert any person (whether or not a passenger in that\nperson\u2019s or another person\u2019s vehicle) from travelling to any tourist\naccommodation, restaurant, night club, bar or watersports business; or\n(b) solicit or accept (or agree to solicit or accept) anything in money or\nmoney\u2019s worth in relation to \u2014\n(i)\nthe soliciting of a person for any tourist accommodation, restaurant,\nnight club, bar or watersports business; or\n(ii) the diversion or attempted diversion of a person who is travelling to\nor is at any such premises.\n\nSCHEDULE\nTraffic (Public Passenger Vehicles) Regulations (2020 Revision)\n\nPage 10\nRevised as at 31st December, 2019\nc\n\n(5) In the course of that person\u2019s business of carrying passengers for hire or reward,\nthe driver of a bus or taxi \u2014\n(a) shall comply with the Law and all other laws of the Islands;\n(b) shall maintain a neat appearance and comply with any guidance given by\nthe Board in relation to the mode of dress for drivers of buses and taxis;\n(c) shall not carry in that person\u2019s vehicle any firearms or other weapons;\n(d) shall maintain a written record of the journeys that person undertakes;\n(e) shall, in respect of each journey in which that person carries a passenger\nin the course of that person\u2019s business, select the route for the journey\nwhich (subject to any direction from the passenger) that person reasonably\nbelieves will provide the passenger with the shortest journey time;\n(f)\nshall, where the taxi or bus is parked at a taxi-stand or at a bus stop, remain\nin or in attendance on the vehicle and shall not leave the doors of the\nvehicle open;\n(g) shall not drive the vehicle at any time when that person\u2019s ability to do so\nis impaired;\n(h) while driving passengers shall not, without their consent \u2014\n(i)\nsmoke; or\n(ii) play any radio, tape or other recorder;\n(i)\nshall maintain that person\u2019s vehicle and its interior in a clean and\nroadworthy condition and in a state of repair such that it would at all\ntimes pass an inspection carried out by a vehicle inspector under\nsection 61 of the Law; and\n(j)\nupon finding any unclaimed property in that person\u2019s vehicle, shall hand\nit within twenty-four hours to the officer in charge of the police station at\nGeorge Town or Cayman Brac.\n6.\nRefusal to carry passengers\n6.\n(1) Subject to paragraphs (2) to (6), when a driver of a taxi is plying for hire that\nperson shall not refuse to accept a passenger for a lawful journey; and a driver\nof a bus, while the bus has a vacant seat, shall not refuse to accept a passenger\nfor a lawful journey who is waiting at a bus stop.\n(2) The driver of a taxi may refuse to carry \u2014\n(a) any animal; and\n(b) any item of baggage which cannot conveniently and safely be carried in\nthat person\u2019s vehicle.\n(3) The driver of a taxi, when that person\u2019s vehicle is empty and plying for hire, and\nthe driver of a bus, while the bus has a vacant seat, shall not refuse to pick up a\npassenger unless the passenger \u2014\n\nTraffic (Public Passenger Vehicles) Regulations (2020 Revision)\nSCHEDULE\n\nc\nRevised as at 31st December, 2019\nPage 11\n\n(a) does not, when requested, tender the proper fare;\n(b) is consuming alcoholic liquor or appears to be intoxicated, or appears to\nbe under the influence of a drug the consumption of which is prohibited\nby the Misuse of Drugs Law (2017 Revision); or\n(c) has asked the driver to carry baggage of an unreasonable quantity, size or\nweight.\n(4) The driver of a bus or taxi shall not refuse to carry a person in that person\u2019s\nvehicle solely by reason of the person\u2019s race, sex, religion, nationality, age or\ndisability.\n(5) The driver of a taxi shall not carry any person as an additional passenger in that\nperson\u2019s vehicle without the voluntary consent of the passenger that person has\nalready agreed to carry in the vehicle.\n(6) The driver of a taxi may refuse to carry a person in that person\u2019s vehicle\nwhere \u2014\n(a) he reasonably believes that person to be incapable of paying the proper\nfare for the journey that person has requested;\n(b) that person has avoided or attempted to avoid payment of any proper fare\nthat person has incurred for the hire of any taxi; or\n(c) that person has withheld that person\u2019s true name and address from the\ndriver when the driver is lawfully demanding payment of the proper fare\ndue from that person for the hire of the taxi.\n7.\nIdentification and information\n7.\n(1) Every vehicle which is used as a taxi shall be clearly identifiable as a taxi, with\nthe word \u201ctaxi\u201d clearly visible in a manner approved by the Board as a means\nof identification of the vehicle in daylight and darkness; and every vehicle which\nis used as a bus shall be clearly identifiable as a bus in daylight and darkness\nand shall be painted in a colour approved by the Board.\n(2) The driver of every taxi shall, while plying for hire, display in the vehicle \u2014\n(a) a notice in a form approved by the Board which clearly shows the\nregistration and permit numbers of the vehicle and the conditions of hire;\n(b) a fare distance table in a form approved by the Board; and\n(c) a card and photograph in a form approved by the Board which clearly\nidentify the person driving or in charge of the taxi as the driver authorised\nto drive it by a permit granted under the Law.\n(3) The driver of every taxi shall, while plying for hire, display on the roof of the\nvehicle an illuminated sign of a type approved by the Board clearly indicating\nthat the vehicle is available for hire as a taxi.\n\nSCHEDULE\nTraffic (Public Passenger Vehicles) Regulations (2020 Revision)\n\nPage 12\nRevised as at 31st December, 2019\nc\n\n(4) The driver of every bus shall, while driving the vehicle in the course of a\nbusiness, display \u2014\n(a) a notice in the vehicle in a form approved by the Board which clearly\nshows the registration and permit numbers of the vehicle and the\nconditions of its use;\n(b) route and fare tables in a form and location in the vehicle approved by the\nBoard;\n(c) destination indicators in a form approved by the Board showing the\ndestination of the bus; and\n(d) a card and photograph in a form approved by the Board which clearly\nidentify the person driving the bus as the driver authorised to drive it by a\npermit granted under the Law.\n(5) The driver \u2014\n(a) of every taxi, while plying for hire; and\n(b) of every bus, while driving the vehicle in the course of a business,\nshall display on the rear of the vehicle a plate (in a form and location approved\nby the Board) which clearly shows, in respect of each description of service\nmentioned in the undertaking given under regulation 4(2)(j) for the use of the\nvehicle, the maximum number of passengers which may be carried for hire or\nreward in the provision of that service.\n8.\nStandard and equipment of vehicles\n8.\n(1) No person shall drive a bus or taxi in the course of a business unless both the\ncondition and appearance of the vehicle are conducive to the safety and comfort\nof its passengers and the enhancement of tourism in the Islands.\n(2) Without prejudice to paragraph (1), no person shall drive a bus or taxi in the\ncourse of a business unless the vehicle \u2014\n(a) is safe and roadworthy in complete compliance with the Law;\n(b) is equipped to a reasonable standard of comfort for its permitted use;\n(c) has an operating air-conditioning system that provides cooled air;\n(d) is clean, both inside and out;\n(e) is fully operational; and\n(f)\nis undamaged and free from rust, and has no exterior dents or cracks, and\nno extinguisher;\n(d) a first-aid kit; and\n(e) spare fuses, spare bulbs and an appropriate spare wheel and tyre.\n9.\nTaximeters\n9.\n(1) The driver of a taxi shall not carry on the business of plying for hire or carrying\npassengers for hire or reward unless that taxi is quoting the National Taxi Fare\nSchedule as set out in the Schedule.\n(2) A taxi shall not, at any time, charge above the National Taxi Fare Schedule as\nset out in the Schedule.\n(3) A taxi may, in addition to the fare set out in Part 1 of the Schedule, charge for\nthe considerations set out in Part 2 of the Schedule.\n10.\nBus stops and the picking up, etc., of passengers by buses and taxis\n10. (1) No driver of a bus carrying passengers for hire or reward on a bus route may\npick up or set down passengers at any place other than at a bus stop.\n(2) No driver of any vehicle other than \u2014\n(a) a bus permitted to operate a regular daily schedule on a bus route; or\n(b) an emergency vehicle,\nshall, except in an emergency or if required to do so by a constable in uniform,\nset down or pick up passengers at a bus stop.\n(3) No driver or other person in charge of a bus shall permit any person to board or\nget off the bus when it is in motion.\n(4) Between 6 a.m. and 6 p.m. on any day no driver of a bus or taxi shall pick up\npassengers, or wait for any period for that purpose, anywhere in the district of\nGeorge Town on the following roads \u2014\n(a) North Church Street from the northern part of its junction with Fort Street\nto where it meets Harbour Drive;\n(b) Harbour Drive; and\n(c) South Church Street from where it meets Harbour Drive to the southern\npart of its junction with Boilers Road.\n11.\nOffences\n11.
