In exercise of the power conferred by section 1(2) of the National Pensions (Amendment) Law, 2016, the Cabinet makes the following Order - This Order may be cited as the National Pensions (Amendment) Law, 2016 In this Order, “the principal Law” means the National Pensions Law (2012 Revision). The provisions of the National Pensions (Amendment) Law, 2016, shall come into force on the 31st day of December, 2016 with the exception of - (a) (i) section 3 insofar as that section amends section 3 of the principal Law in the definition of the words “year’s maximum pensionable earnings”; (ii) section 18 insofar as that section amends section 25(1) of the principal Law; (iii) sections 19, 20, 21, 22, 23, 26, 27, 31, 32 and 33 insofar as those sections respectively amend sections 26, 27, 28, 30, 33, 41, 43, 52B, 52C and 52D of the principal Law; and (iv) section 28(a), (b) and (c) insofar as those paragraphs respectively amend section 47(2), (3)(c) and (8)(c) of the which shall come into force on the 1st day of January, 2017; (b) section 4 which amends section 4 of the principal Law; (c) (i) section 2, insofar as that section amends the principal Law, with the exception of section 3, by deleting the word “Superintendent” wherever it appears and substituting the word “Director”;

(ii) section 3 insofar as that section amends section 3 of the principal Law in the definition of the word “Director”; Citation Interpretation Commencement

(iii) sections 6, 7 , 8, 11, 13, 35, 38, 41, 42, 44, 45, and 48 insofar as those sections respectively amend sections 6, 7, 8, 16, 17, 69, 79, 81, 82, 87, 88, and 94 of the principal Law; and (iv) sections 12, 28, 39 and 51 insofar as those sections respectively insert sections 16A, 47(13), 79A and 95A into the principal Law, which shall come into force on the 1st day of February, 2017, with the exception of section 16(4)(e), (f), (h), (j) and (l)(i) which shall come into force by a further Order made by Cabinet pursuant to section 1(2) of the National Pensions (Amendment) Law, 2016; (d) section 9 which amends section 9 of the principal Law; (e) (i) section 3 insofar as that section amends section 3 of the principal Law in the definition of the words “household domestic” and “employee”;

(ii) sections 14 and 49 insofar as those sections respectively insert sections 18A and 94A into the principal Law; and

(iii) sections 18 and 40 insofar as those sections respectively amend sections 25(2)(b) and 80 of the principal Law, which shall come into force on 1st March, 2017; (f) section 15 which amends section 20 of the principal Law; (g) section 16 which amends section 22 of the principal Law; (h) section 17 which amends section 23 of the principal Law; (i) section 18 which amends section 25(2)(a) of the principal Law; (j) section 24 insofar as that section amends section 34 of the principal Law which shall come into force on 31st day of December, 2017; (k) section 25 which amends section 39 of the principal Law; (l) (i) sections 28 and 47 insofar as those sections insert sections 47(10), (11) and (12) and 90A of the principal Law; and (ii) section 46 insofar as that section amends section 90 of the which shall come into force on 31st day of March, 2017; (m) section 29 which repeals and substitutes section 48 of the (n) section 30 which repeals and substitutes section 50 of the (o) section 34 insofar as that section repeals and substitutes section 53 of the principal Law which shall come into force on 31st day of December, 2019; and

(p) section 50 which amends section 95 of the principal Law.
