Regulation 1

Port Authority Law (1999 Revision) In exercise of the powers conferred by section 13 of the Port Authority Law (1999 Revision) the Cabinet makes the following Regulations — Citation These Regulations may be cited as the Port (Amendment) Regulations, 2019. Insertion of regulations 146A, 146B and 146C in the Port Regulations (2018 Revision) – designation of temporary watersports areas for watersports events, etc. The Port Regulations (2018 Revision) are amended by inserting after regulation 146, the following regulations —water sports areas for watersports events “Designation of temporary watersports areas for watersports events 146A. (1) Notwithstanding regulation 146, the Director, after consultation with the Commissioner of Police, may designate areas within the territorial waters of the Islands as temporary watersports areas for the purpose of watersports events. A designation made under paragraph (1) is subject to compliance with the requirements in regulations 146B, 146C and Schedule 8A.

Regulation 2

(3) The restrictions on vessels under regulation 30 shall apply to areas designated as temporary watersports areas as they apply to watersports areas. Submission of application for authorization of watersports event and designation of temporary watersports areas 146B. (1) An application for the authorization of a watersports event in respect of which a designated temporary watersports area will be required, shall be submitted to the Director in the form prescribed in Schedule 8A — (a) one month in advance of the scheduled event; or (b) less than one month before the event, if, subject to approval by the Director, there are exceptional circumstances which caused a delay in the submission of the application. (2) The Director, after consultation with the Commissioner of Police, may — (a) approve an application made under paragraph (1); and (b) designate the respective area to be a temporary watersports area for the purpose of carrying out the watersports event. Requirements for approval of a watersports event 146C. The approval of an application under 146B is subject to compliance with the law and any requirements specified by the Director, after consultation with the Commissioner of Police, including — (a) the dates approved for the watersports event; (b) the time of day during which the watersports event may be conducted; the types of activities permitted during the watersports event; and (d) the measures which the organizers of the watersports event are required to take in order to properly manage the event and to ensure the safety of persons at the event, including making provision for a sufficient number of — (i) safety marshals, to prevent unauthorised persons from entering the designated area during the event; and (ii) emergency medical technicians, to assist in the event of an accident or emergency.”.

Regulation 3
