Public Service Pensions Act (2023 Revision) PUBLIC SERVICE PENSIONS (EX-GRATIA PENSIONS) (AMENDMENT) (NO.2) In exercise of the powers conferred by section 4 of the Public Service Pensions Act (2023 Revision), the Cabinet makes the following Regulations — Citation These Regulations may be cited as the Public Service Pensions (Ex-Gratia Pensions) (Amendment) (No.2) Regulations, 2025. Amendment of regulation 2A of the Public Service Pensions (ex-Gratia Pensions) Regulations (2019 Revision) - eligibility for ex-gratia defined benefit pensions The Public Service Pensions (Ex-Gratia Pensions) Regulations (2019 Revision) are amended in regulation 2A(1) by repealing subparagraphs (a) and (b) and substituting the following subparagraphs — “(a) is eligible for early retirement or normal retirement; or (b) has been certified by the Chief Medical Officer as being permanently disabled,”.

Regulation 3 Public Service Pensions (Ex-Gratia Pensions) (Amendment) (No.2)

Amendment of regulation 3A of the Public Service Pensions (ex-Gratia Pensions) Regulations (2019 Revision) - application for ex-gratia defined benefit pension and grant The Public Service Pensions (Ex-Gratia Pensions) Regulations (2019 Revision) are amended in regulation 3A as follows — (a) in paragraph (5), by repealing subparagraphs (a) and (b) and substituting the following subparagraphs — “(a) has taken early retirement or normal retirement; (b) has retired after having been certified by the Chief Medical Officer as being permanently disabled; or”; and (b) by repealing paragraph (7) and substituting the following paragraph — “ (7) The provisions of the Act relating to the payment of pensions or other benefits under the Act, including the circumstances in which benefits cease to become payable shall apply (with any necessary modifications) to the payment of ex-gratia defined benefit pensions under this regulation.”.
