Memorandum of OBJECTS AND REASONS This Bill seeks to amend the Traffic Act (2023 Revision) (the “principal Act”) in order to redefine the term “pedal cycle” for the purposes of the principal Act and validate certain previous revenue collection actions of the Director of Licensing. Clause 1 provides the short title and commencement of the legislation. Clause 2 amends the definition of the term “pedal cycle” set out in section 2 of the principal Act. By virtue of paragraph (c) of the current definition, a pedal cycle is described as a “motorised bicycle or cycle propelled by means of pedals capable of being driven in excess of 15 miles per hour”. The proposed amendment to paragraph (c) would remove, from the definition, the reference to speed. Clauses 3 and 4 relate to the validation of fees collected by the Director of Licensing. Clause 3 deals with cases where, prior to the commencement of this amending and validating legislation, the Director of Licensing charged and collected fees for the provision of a single registration plate or a single trade plate in relation to motor cycles or trailers. Since no fee is currently prescribed for the provision of single registration plates or single trade plates, clause 3 seeks to validate the fees that were charged and collected without statutory authority prior to the commencement of this amending and validating legislation. Clause 4 provides that this amending and validating legislation does not affect a court order relating to fees collected by the Director of Licensing, prior to the commencement of this amending and validating legislation, for the provision of a single registration plate or a single trade plate in relation to motor cycles or trailers.

A BILL FOR AN ACT TO AMEND THE TRAFFIC ACT (2023 REVISION) IN ORDER TO REDEFINE THE TERM “PEDAL CYCLE” FOR THE PURPOSES OF THE ACT; TO VALIDATE CERTAIN PREVIOUS REVENUE COLLECTION ACTIONS OF THE DIRECTOR OF LICENSING; AND FOR INCIDENTAL AND CONNECTED PURPOSES ENACTED by the Legislature of the Cayman Islands. Short title and commencement (1) This Act may be cited as the Traffic (Amendment and Validation) Act, 2026. (2) This Act comes into force on such date as may be appointed by Order made by the Cabinet. Amendment of section 2 of the Traffic Act (2023 Revision) - interpretation The Traffic Act (2023 Revision) is amended in section 2, in the definition of the word “pedal cycle”, by repealing paragraph (c) and substituting the following paragraph — “(c) a motorised bicycle or cycle propelled by means of pedals;”.

Validation of payment and collection of fees Where, prior to the commencement of this amending and validating Act, the Director of Licensing, without statutory authority, charged and collected fees for the provision of a single registration plate or a single trade plate in relation to motor cycles or trailers, the charging and collection of those fees are — (a) validated; and (b) taken to have been lawfully charged by, paid to and collected by the Director of Licensing, as if the Director of Licensing was empowered under the Traffic Act (2023 Revision) to charge and collect those fees. Orders or determination by court not affected This amending and validating Act does not affect any order or determination made by a court with respect to fees charged by, paid to and collected by the Director of Licensing prior to the commencement of this amending and validating Act for the provision of a single registration plate or a single trade plate in relation to motor cycles and trailers.
