Objects and Reasons

Memorandum of OBJECTS AND REASONS This Bill seeks to amend the Airports Authority Act (2005 Revision) (the “principal Act”) to provide for the collection of fees by the Airports Authority from aircraft operators for the use of air navigation services. The Bill also seeks to amend the principal Act to validate the collection of fees for air navigation services by the Airports Authority and the payment of fees by aircraft operators for air navigation services. Clause 1 provides the short title of the legislation. Clause 2 provides for the amendment of section 5 of the principal Act to include the collection of fees for air navigation services in the functions of the Authority. Clause 3 provides for the amendment of section 20 of the principal Act to include fees for air navigation services received pursuant to the Airports Act (2005 Revision) as a head of receipt. Clause 4 amends section 41 of the principal Act to empower the Authority to make regulations in respect of the collection of fees for the provision of air navigation services, the recovery of unpaid fees for air navigation services and the grounds on which the Authority, among other things, may waive the fee. Clause 5 provides for the validation of fees for air navigation services paid by aircraft operators and collected by the Airports Authority prior to the commencement of this legislation. Clause 6 provides for the validation of any penalties for the non-payment of fees for air navigation services that may have been imposed by the Authority prior to the commencement of this legislation. Clause 7 provides that this amending and validating legislation does not affect an order or a determination made by a court with respect to fees for air navigation services paid and collected by the Airports Authority or penalties imposed for the non-payment of fees for air navigation services without statutory authority prior to the commencement of this legislation.

AIRPORTS AUTHORITY (AMENDMENT AND VALIDATION) BILL, 2026

A BILL FOR AN ACT TO AMEND THE AIRPORTS AUTHORITY ACT (2005 REVISION) TO PROVIDE FOR THE COLLECTION OF FEES BY THE AUTHORITY FROM AIRCRAFT OPERATORS FOR THE USE OF AIR NAVIGATION SERVICES; TO VALIDATE THE COLLECTION OF FEES BY THE AUTHORITY AND THE PAYMENT OF FEES BY AIRCRAFT OPERATORS FOR AIR NAVIGATION SERVICES; TO VALIDATE PENALTIES CHARGED OR PAID FOR THE NON-PAYMENT OF FEES FOR AIR NAVIGATION SERVICES; AND FOR INCIDENTAL AND CONNECTED PURPOSES ENACTED by the Legislature of the Cayman Islands. Short title This Act may be cited as the Airports Authority (Amendment and Validation) Act, Amendment of section 5 of the Airports Authority Act (2005 Revision) - functions of the Authority The Airports Authority Act (2005 Revision), in this Act referred to as the “principal Act”, is amended in section 5(1)(g) by deleting the words “approved dues, rents,” and substituting the words “approved dues, rents, fees for air navigation services,”.

Clause 3

Amendment of section 20 - receipts of the Authority The principal Act is amended in section 20(1) by inserting after paragraph (c), the following paragraph — “(ca) fees for air navigation services as may be received pursuant to this Act;”.4. Amendment of section 41 - regulations The principal Act is amended in section 41(1) by inserting after paragraph (k) the following paragraphs — “(ka) provide generally for the collection of fees from aircraft operators for the provision of air navigation services including the following— (i) the currency in which the fee shall be denominated and paid; (ii) the deadline for the payment of the fee; (iii) the grounds on which the Authority may — (A) waive the fee; (B) require a deposit or pre-payment of the fee before provision of air navigation services; (C) refuse to provide air navigation services; and (D) require the aircraft operator to deposit a security with the Authority; (kb) provide for the recovery of unpaid fees for air navigation services; and (kc) provide for — (i) exemptions; (ii) reductions; (iii) waivers on a case-by-case basis where the Authority determines that it is appropriate; and (iv) discounts, in respect of the payment of fees for air navigation services;”. Validation of payment and collection of fees for air navigation services The fees for air navigation services paid by aircraft operators and collected by the Authority prior to the commencement of this amending and validating Act are validated and taken to have been lawfully paid to and collected by the Authority as if the Authority was empowered under the principal Act and regulations made under that Act to charge and collect those fees.

Clause 6

Validation of penalties imposed and collected for non-payment of fees for air navigation services Any penalties for non-payment of fees for air navigation services imposed or collected by the Authority prior to the commencement of this amending and validating Act are validated and taken to have been lawfully imposed or collected by the Authority as if the Authority was empowered under the principal Act to impose and collect the penalties. Orders or determinations by a court This amending and validating Act does not affect any order or determination made by a court with respect to the fees for air navigation services paid to and collected by the Authority or penalties imposed for non-payment of fees for air navigation services by the Authority without statutory authority prior to the commencement of this amending and validating Act.
