Objects and Reasons
Memorandum of OBJECTS AND REASONS This Bill seeks to amend the Parliament Management Act (2023 Revision), (the “principal Act”), to provide for the establishment of an office and staff for the Leader of the Opposition in order to enable the Leader of the Opposition to more effectively discharge the constitutional functions of that office. This Bill also amends the principal Act to provide constituency office managers to support the constituency offices of elected Members of Parliament and to provide for increases in constituency allowances and other allowances for Members of Parliament. Clause 1 provides the short title of the legislation and contains a commencement provision. Clause 2 provides for general amendments to the legislation in order to ensure consistency when referring to Members of Parliament. Clause 3 amends section 2 of the principal Act to redefine a “constituency assistant” as a person appointed by the Chief Officer with responsibility to provide services to an elected Member of Parliament. This clause also defines a “constituency office manager” as a person appointed by the Chief Officer with responsibility to manage the constituency office of an elected Member of Parliament. Clause 4 amends section 4 of the principal Act which deals with general functions of the Commission. Pursuant to this amendment, the Commission is empowered to- (a) provide constituency office managers to elected Members of Parliament; and (b) provide an office and staff to support the office of the Leader of the Opposition. Clause 5 repeals and substitutes section 12A of the principal Act which deals with constituency assistants. The proposed new section 12A provides that Schedule 2 applies to both constituency office managers and staff of the Leader of the Opposition. Clause 6 amends section 13 of the principal Act which deals with the structure of the Commission, to include references to constituency office managers and staff of the Leader Clause 7 amends Schedule 1 of the principal Act to provide that both the Deputy Speaker and the Deputy Leader of the Opposition are entitled to an increased allowance of ten percent (10%) of their monthly salary for serving in their respective roles as Members of Clause 8 repeals and substitutes Schedule 2 of the principal Act. Schedule 2 now contains provisions governing the terms and conditions on which constituency office managers, and staff of the office of the Leader of the Opposition are to be contracted by the Commission. Schedule 2 is also amended to increase the constituency allowances for each elected Member of Parliament to $6500 per month.

A BILL FOR AN ACT TO AMEND THE PARLIAMENT (MANAGEMENT) ACT (2023 REVISION) TO PROVIDE FOR THE ESTABLISHMENT OF AN OFFICE FOR THE LEADER OF THE OPPOSITION; TO PROVIDE ADEQUATE STAFF TO SUPPORT THE WORK OF THE OFFICE OF THE LEADER OF THE OPPOSITION; TO PROVIDE CONSTITUENCY OFFICE MANAGERS TO SUPPORT THE CONSTITUENCY OFFICES OF ELECTED MEMBERS OF PARLIAMENT; TO INCREASE CONSTITUENCY ALLOWANCES; AND FOR INCIDENTAL AND CONNECTED PURPOSES ENACTED by the Legislature of the Cayman Islands. Short title and commencement (1) This Act may be cited as the Parliament (Management) (Amendment) Act, (2) Subject to subsection (3), this Act comes into force on publication. (3) The following amendments to this Act are deemed to have come into force on 1st January, 2026 — (a) the amendment to Schedule 1; and (b) the amendment to paragraph 1(2) in Part 2 of Schedule 2.
Clause 2
General amendments to the Parliament (Management) Act (2023 Revision) - references to member of the Parliament, members of the Parliament, Member of the Parliament and Members of the Parliament The Parliament Management Act (2023 Revision), in this Act referred to as the “principal Act”, is amended in section 2 as follows — (a) by deleting the words “member of the Parliament” wherever they appear and substituting the words “Member of Parliament”; (b) by deleting the words “members of the Parliament” wherever they appear and substituting the words “Members of Parliament”; by deleting the words “Member of the Parliament” wherever they appear and substituting the words “Member of Parliament”; and (d) by deleting the words “Members of the Parliament” wherever they appear and substituting the words “Members of Parliament”. Amendment of section 2 - interpretation The principal Act is amended in section 2 as follows — (a) by deleting the definition of the words “constituency assistant” and substituting the following definition — “ “constituency assistant” means a person appointed by the Chief Officer under Part 1 of Schedule 2 and who is responsible for providing services to an elected Member of Parliament;”; and (b) by inserting after the definition of the words “constituency assistant” the following definition — “ “constituency office manager” means a person appointed by the Chief Officer under Part 1 of Schedule 2 and who is responsible for managing the constituency office of an elected Member of Amendment of section 4 - general functions of the Commission The principal Act is amended in section 4(1) as follows — (a) in paragraph (da), by inserting after the word “providing” the words “constituency office managers and”; and (b) by inserting after paragraph (da) the following paragraph — “(db) providing an office and staff to support the office of the Leader

Repeal and substitution of section 12A - constituency assistants The principal Act is amended by repealing section 12A and substituting the following section — “Constituency office managers, constituency assistants and staff to support the office of the Leader of the Opposition 12A. (1) Part 1 of Schedule 2 shall apply to the constituency office managers and constituency assistants who are appointed by the Chief Officer to provide services to elected Members of Parliament. (2) Part 3 of Schedule 2 shall apply to staff who are appointed by the Chief Officer to provide services to support the office of the Leader Amendment of section 13 - structure of the Commission The principal Act is amended in section 13(1) by repealing paragraph (c) and substituting the following paragraph — “(c) amend Schedule 2 that — (i) provides for the appointment of constituency office managers, constituency assistants and staff of the Leader of the Opposition; and (ii) sets out allowances for — (A) elected Members of Parliament for Cayman Brac and Little Cayman; (B) constituency offices; (C) the Premier; and (D) the Leader of the Opposition.”. Amendment of Schedule 1 - Salaries, Allowances and other benefits of Members of the Cabinet and Elected Members of the Parliament The principal Act is amended in Schedule 1, in the table, as follows — (a) in relation to the position of Deputy Speaker, under the column with the heading “Rules”, by deleting the words “Earns an allowance of 2.5%” and substituting the words “Earns an allowance of 10%”; and (b) in relation to the position of Deputy Leader of the Opposition, under the column with the heading “Rules”, by deleting the words “Earns an allowance of 2.5%” and substituting the words “Earns an allowance of
Repeal and substitution of Schedule 2 - Constituency Assistants; Constituency Allowance for Members of the Parliament; Allowances for the Offices of the Premier and the Leader of the Opposition and for Members of the Parliament for Cayman Brac and Little Cayman The principal Act is amended by repealing Schedule 2 and substituting the following Schedule — “SCHEDULE 2 (Sections 12A and 13(1)(c)) CONSTITUENCY OFFICE MANAGERS AND CONSTITUENCY ASSISTANTS; CONSTITUENCY ALLOWANCES FOR MEMBERS OF PARLIAMENT; ALLOWANCES FOR THE PREMIER AND THE LEADER OF THE OPPOSITION AND FOR MEMBERS OF PARLIAMENT FOR CAYMAN BRAC AND LITTLE CAYMAN; AND STAFF TO SUPPORT THE OFFICE OF THE LEADER OF THE OPPOSITION PART 1 CONSTITUENCY OFFICE MANAGERS AND CONSTITUENCY ASSISTANTS (1) Each elected Member of Parliament is entitled to the services of the following staff — (a) in the case of an elected Member of Parliament who is a Minister, either — (i) two full time constituency assistants and one part time constituency assistant; or (ii) one full time constituency office manager, one full time constituency assistant and one part time constituency assistant; (b) in the case of an elected Member of Parliament who is not a Minister, either — (i) one full time constituency assistant and one part time constituency assistant; or (ii) one full time constituency office manager and one part time constituency assistant; and in the case of an elected Member of Parliament who is not a Minister and who has a constituency with more than 1,700 registered voters, one full
time constituency assistant in addition to any other staff already provided under paragraph 1(1)(b). (2) For the purposes of this Schedule — (a) a full time constituency office manager or a full time constituency assistant is a person who is contracted to work for the normal hours between 37 ½ and 40 hours per week as may be agreed and consistent with the Personnel Regulations (2025 Revision); and (b) a part time constituency assistant is a person who is contracted to work for the proportion of the normal hours for a full time constituency assistant as may be agreed and consistent with the Personnel Regulations (2025 Revision). Constituency office managers and constituency assistants shall be contractors of the Commission and shall hold office pursuant to the terms of their relevant contracts for services with the Commission. Remuneration under a contract of a constituency office manager or a constituency assistant shall include — (a) salary and pension at the rates as may be prescribed by regulations; and (b) health benefits, that shall be similar to those provided to public officers under the Public Service Management Act (2018 Revision). Subject to paragraph 5, the Chief Officer, acting on the advice of the Member of Parliament for an electoral district, shall appoint constituency office managers or constituency assistants, as applicable, for that electoral district. The duties and responsibilities of a constituency office manager or a constituency assistant shall be specified in the contract for services by the Chief Officer, acting on the advice of the Member of Parliament on whose advice the constituency office manager or the constituency assistant was appointed. The appointment of a constituency office manager or a constituency assistant shall cease — (a) on one month’s notice by the constituency office manager or the constituency assistant, or by the Chief Officer acting on the advice of the Member of Parliament on whose advice the appointment was made, or for just cause without notice; (b) on the date on which the resignation of the constituency office manager or the constituency assistant takes effect; if the Member of Parliament who advised the appointment of the constituency office manager or the constituency assistant ceases to be a Member of Parliament, other than by a dissolution of the Parliament, on the day of the cessation of that membership of Parliament;
(d) after a dissolution of the Parliament, on nomination day, if the Member of Parliament who advised the appointment of the constituency office manager or the constituency assistant is not nominated for election to the Parliament for the same electoral district; or (e) after a dissolution of the Parliament, on polling day, if the Member of Parliament who advised the appointment of the constituency office manager or the constituency assistant is nominated but is not elected to the A constituency office manager or a constituency assistant whose employment is terminated by the Chief Officer under paragraph 6(a) shall receive a termination allowance as may be prescribed by regulations. PART 2 CONSTITUENCY ALLOWANCES FOR MEMBERS OF PARLIAMENT; ALLOWANCES FOR THE PREMIER, THE LEADER OF THE OPPOSITION AND MEMBERS OF PARLIAMENT FOR CAYMAN BRAC AND LITTLE CAYMAN Constituency Allowance (1) A constituency allowance covers payment for the costs of maintaining a constituency office in order to facilitate access to constituents and such costs include — (a) utilities of a constituency office; (b) supplies for a constituency office; and the general maintenance of a constituency office. (2) The constituency allowance is $6,500 per month for each elected Member of
Executive Allowance for the Premier The Premier shall receive an executive allowance of $5,000 per month. Executive Allowance for the Leader of the Opposition The Leader of the Opposition shall receive an executive allowance of $3,500 per month. Allowance for elected Members of Parliament for Cayman Brac and Little Cayman Representatives (1) The monthly allowance for the Cayman Brac and Little Cayman Representatives is $5000 and the allowance shall consist of two components. (2) The two components and their corresponding maximum amounts per month are as follows — (a) accommodation - $2,500; and (b) transportation - $2,500. Severance Each Member of Parliament who does not stand for re-election or, having stood for re-election, is not elected at the next election, shall be entitled to a severance payment equal to three months of the salary paid to that Member of Parliament under Schedule 1 as at the date of that election and the payment does not include any duty allowances under Schedule 1 or any allowances permitted under this Schedule. PART 3 STAFF TO SUPPORT THE OFFICE OF THE LEADER OF THE OPPOSITION (1) The Leader of the Opposition is entitled to the services of the following staff as follows — (a) one Operations and Communications Manager; and (b) one Senior Policy Adviser. (2) The staff of the office of the Leader of the Opposition shall work on a full time basis for such normal hours between 37 ½ and 40 hours per week as may be agreed and are consistent with the Personnel Regulations (2025 Revision). Remuneration under the contract of the Operations and Communications Manager or the Senior Policy Adviser shall include — (a) salary and pension at the rates as may be prescribed by regulations; and
(b) health benefits, that shall be similar to those provided to public officers under the Public Service Management Act (2018 Revision).
