Objects and Reasons

Memorandum of OBJECTS AND REASONS This Bill amends Schedule 4 of the Criminal Records (Spent Convictions) Act (2018 Revision) to include a notary public to the list of persons who must disclose expunged criminal records and for connected purposes. Clause 1 provides the short title and commencement of the legislation. Clause 2 defines the word “Act” to mean the Criminal Records (Spent Convictions) Act (2018 Revision). Clause 3 amends Part 1 of Schedule 4 to insert notaries public to the list of persons who must disclose expunged criminal records under the Criminal Records (Spent Convictions) Act (2018 Revision).

CRIMINAL RECORDS (SPENT CONVICTIONS) (AMENDMENT) BILL, 2026

A BILL FOR AN ACT TO AMEND SCHEDULE 4 OF THE CRIMINAL RECORDS (SPENT CONVICTIONS) ACT (2018 REVISION) TO INCLUDE A NOTARY PUBLIC TO THE LIST OF PERSONS WHO MUST DISCLOSE EXPUNGED CRIMINAL RECORDS AND FOR CONNECTED PURPOSES. ENACTED by the Legislature of the Cayman Islands. Short title and commencement (1) This Act may be cited as the Criminal Records (Spent Convictions) (Amendment) Act, 2026. (2) This Act comes into force immediately after the Notaries Public (Amendment) Act, 2026 comes into force. Interpretation In this Act — “Act” means the Criminal Records (Spent Convictions) Act (2018 Revision).

Clause 3

Amendment of Schedule 4 of the Criminal Records (Spent Convictions) Act (2018 Revision) - persons who must disclose expunged criminal records The Criminal Records (Spent Convictions) Act (2018 Revision) is amended in Part 1 of Schedule 4, by inserting after paragraph 5 the following paragraph — “5A. Notary Public”.
