INTERIM DIRECTIVE BY THE NATIONAL CONSERVATION COUNCIL FOR THE PROTECTION OF AGALINIS KINGSII

ISSUED IN ACCORDANCE WITH SECTION 17 (7) OF THE NATIONAL CONSERVATION LAW

Interim Protection Measures On the advice of the Director of the Department of Environment, and in consideration of the fact that there is an urgent need to immediately protect the portion of the population of this species occurring on property currently proposed for development, this Interim Directive therefore: (i) identifies Critical Habitat for Agalinis kingsii as all sedge wetlands falling in Block 59A, parcel 92, that contains the sedge species Cladium jamaicense (“Cutting Grass”) and as illustrated in figure 3; and (ii) prohibits any disturbance of that critical habitat, or issuance of any permit or permission to disturb that Critical Habitat, or approval of any plan to do so, until such time as a Conservation Plan for Agalinis kingsii has been adopted under National Conservation Law section 17(6).
