Regulation 1
DELEGATION OF THE GOVERNOR'S POWERS (CAYMAN ISLANDS COAST GUARD) In exercise of the powers conferred by section 109(2) of the Constitution set out in Schedule 2 to the Cayman Islands Constitution Orders 2009 to 2020, the Governor makes the following Regulations — Citation These Regulations may be cited as the Delegation of the Governor’s Powers (Cayman Islands Coast Guard) Regulations, 2022. Definitions In these Regulations — “Coast Guard” means the Cayman Islands Coast Guard established under section 3 of the Cayman Islands Coast Guard Act, 2021; “Commandant” means the officer appointed by the Governor under section 14(2)(a) of the Cayman Islands Coast Guard Act, 2021 to have command of the Coast Guard; “commissioned officer” means a person granted a commission by the Governor under section 14(1) of the Cayman Islands Coast Guard Act, 2021 and carrying rank and precedence within the Coast Guard in a rank specified in Part A of Schedule 1 of that Act;

“Deputy Commandant” means the officer appointed by the Governor under section 14(2)(a) of the Cayman Islands Coast Guard Act, 2021; “promote” means to appoint a commissioned officer to a rank specified in Part A of Schedule 1 of the Cayman Islands Coast Guard Act, 2021 which is senior to that of the current rank of the commissioned officer, or to the rank to which the commissioned officer was last substantively appointed, and “promotion” has a corresponding meaning; “the Constitution” means the Constitution set out in Schedule 2 to the Cayman Islands Constitution Orders 2009 to 2020; and “transfer” means to assign or reassign duties to be performed by a commissioned officer and may include — (a) a temporary or permanent change in duties, work location, days of work or duty hours of the commissioned officer; and (b) a change in the previous title, job classification or responsibilities of the commissioned officer, but shall not be interpreted as promoting a commissioned officer or appointing a commissioned officer to a rank other the current rank of the commissioned officer. Delegation of Governor’s power to promote or transfer (1) In accordance with section 109(2) of the Constitution, and subject to paragraph (2), the Governor delegates to the Commandant the power to promote or transfer commissioned officers within the Coast Guard, with the exception of the Deputy Commandant. (2) The Commandant shall exercise the power delegated under paragraph (1) in accordance with any applicable regulations made under section 28 of the Cayman Islands Coast Guard Act, 2021 in relation to the promotion or transfer of commissioned officers in the Coast Guard.
Regulation 4
Principles applicable to the Commandant in respect of promotions and transfers of commissioned officers In exercising the power delegated by the Governor to the Commandant under regulation 3(1), the Commandant shall have regard to the high standards of efficiency necessary to be maintained in the Coast Guard.
