Paragraph 1
ANIMALS (EXEMPTION FOR PURPOSES OF CONSERVATION) ORDER, 2025 In exercise of the powers conferred by section 88 of the Animals Act (2024 Revision), the Cabinet makes the following Order — Citation This Order may be cited as the Animals (Exemption for Purposes of Conservation) Order, 2025. Definitions In this Order — “cat” means a cat of the species Felis catus; “feral cat” means a cat that — (a) is living in the wild; and (b) does not have an identifiable owner who controls its movement and provides shelter, food, water and veterinary care; “pound” means a pound established in accordance with section 50 of the Act; and “poundkeeper” means a person appointed as a poundkeeper in accordance with section 50 of the Act.

Exemption from the application of section 60 of the Act (1) For the purposes of conservation, a person referred to in subparagraph (2) is exempt from the application of section 60 of the Act to the extent that the person drives, leads or entices a feral cat or a stray cat into a place with intent to impound or procure the impounding of the feral cat or the stray cat at a pound for feral cats and stray cats, which is — (a) located in Grand Cayman or Cayman Brac; and (b) operated by the department of Government responsible for agriculture. (2) For the purposes of subparagraph (1), the following persons are exempt — (a) the Director or any other member of staff of the department of Government responsible for agriculture; (b) the Director or any other member of staff of the department of Government responsible for the environment; and any other person, subject to the requirement that the person acts in accordance with — (i) any guidance notes issued by the National Conservation Council under section 3(12)(h) of the National Conservation Act, 2013; and (ii) any procedures issued by the Director of the department of Government responsible for the environment under section 6(2)(k) of the National Conservation Act, 2013. Exemption from the application of section 63 of the Act (1) For the purposes of conservation, a poundkeeper is exempt from the requirement under section 63 of the Act to put an impounded animal up for sale by public auction, where that animal is a feral cat or a stray cat. (2) Where further to subparagraph (1) a poundkeeper does not put an animal up for sale by public auction, the condition to put up an animal for sale referred to in regulation 2(1) of the Animals (Disposal) Regulations, 1997 does not apply.
