Objects and Reasons

Memorandum of OBJECTS AND REASONS This Bill seeks to amend the Development and Planning Act (2021 Revision) in order to provide that Regulations made under the Act will no longer be subject to the affirmative resolution procedure of the Parliament. The Bill would also amend the Act to give power to the Cabinet to waive fees under Schedule 2 of the Development and Planning Regulations (2024 Revision). Clause 1 of the Bill provides the short title of the legislation. Clause 2 amends section 42 of the Development and Planning Act (2021 Revision) by repealing subsection (3) which currently provides that Regulations must be affirmed by the Parliament. Clause 3 amends section 53(2) of the Development and Planning Act (2021 Revision) to empower the Cabinet to waive fees both under Schedule 1 and Schedule 2 of the Development and Planning Regulations (2024 Revision).

Clause 1

DEVELOPMENT AND PLANNING (AMENDMENT) BILL, 2026 A BILL FOR AN ACT TO AMEND THE DEVELOPMENT AND PLANNING ACT (2021 REVISION) TO PROVIDE THAT REGULATIONS MADE UNDER THE ACT WILL NO LONGER BE SUBJECT TO THE AFFIRMATIVE RESOLUTION OF THE PARLIAMENT; TO PROVIDE THAT CABINET MAY WAIVE FEES UNDER SCHEDULE 2 OF THE DEVELOPMENT AND PLANNING REGULATIONS (2024 REVISION); AND FOR INCIDENTAL AND CONNECTED PURPOSES ENACTED by the Legislature of the Cayman Islands. Short title This Act may be cited as the Development and Planning (Amendment) Act, 2026. Amendment of section 42 of the Development and Planning Act (2021 Revision) - regulations The Development and Planning Act (2021 Revision) is amended in section 42 by repealing subsection (3).

Clause 3

Amendment of section 53 of the Development and Planning Act (2021 Revision) - application The Development and Planning Act (2021 Revision) is amended in section 53(2) by deleting the words “Schedule 1” and substituting the words “Schedules 1 and 2”.
