DANGEROUS SUBSTANCES (AMENDMENT) Arrangement of Regulations Regulation Amendment of regulation 6(2) of the Dangerous Substances Regulations, 2017 -

Regulation 1

DANGEROUS SUBSTANCES (AMENDMENT) In exercise of the powers conferred by section 24 of the Dangerous Substances Act (2017 Revision), the Cabinet makes the following Regulations — Citation These Regulations may be cited as the Dangerous Substances (Amendment) Amendment of regulation 6(2) of the Dangerous Substances Regulations, 2017 - calibration of meter The Dangerous Substances Regulations, 2017, in these Regulations referred to as the “principal Regulations”, are amended in regulation 6(2), by deleting the word Amendment of regulation 11(1) - verification of quantity at point of delivery The principal Regulations are amended in regulation 11(1), by deleting the word Amendment of regulation 18(2) - display of operating permit The principal Regulations are amended in regulation 18(2), by deleting the word

Regulation 5

Amendment of regulation 30(5) - import permit The principal Regulations are amended in regulation 30(5), by deleting the words “paragraph (3)” and substituting the words “paragraph (4)”. Amendment of regulation 66 - form of ticket, etc. The principal Regulations are amended in regulation 66 as follows — (a) in paragraph (1), by deleting subparagraph (g) and substituting the following subparagraph — “(g) require the person, in the event that the administrative penalty is not paid in accordance with paragraph (6) nor a plea of “not guilty” entered in accordance with regulation 67(1), to attend before the summary court to enter a plea on such date as may be specified, that date being not earlier than ten days after the expiration of the period specified in regulation 65(3); and”; and (b) in paragraph (5), by deleting the words “regulation 65(1)” and substituting the words “regulation 67(1)”. Amendment of regulation 67 - trial after not paying ticket or not agreeing to ticket The principal Regulations are amended in regulation 67 as follows — (a) in paragraph (3), by deleting the words “exercised any of the options referred to in regulation 66(5) or paragraph (1)” and substituting the words “paid the total amount set out in the ticket in accordance with regulation 66(6) or entered a “not guilty” plea in accordance with paragraph (1)”; and (b) in paragraph (8), by deleting the words “to exercise the options under regulation 65(5)” and substituting the words “to pay the total amount set out in the ticket in accordance with regulation 66(6)”.

Regulation 8

Amendment of Schedule 7 - ticketable offences The principal Regulations are amended in Schedule 7 as follows — (a) in the table entitled “TICKETABLE OFFENCES”, by deleting item 8 and substituting the following item —

Failure to comply with regulation 62 or 63 (first offence only). Any further contravention of regulation 62 or 63 shall not be considered as a ticketable offence. Regulation 64 (b) in the form entitled “FORM OF TICKET”, by deleting item 8 and substituting the following item —
