THE UTILITY REGULATION AND COMPETITION (AMENDMENT) BILL, 2017

MEMORANDUM OF OBJECTS AND REASONS This Bill seeks to amend the Utility Regulation and Competition Law, 2016, Law 49 of 2016, to change the respective designations of two members of the Board of Directors of the Utility Regulation and Competition Office. The following changes would be made - (a) the designation ‘Executive Director of Information’ would be changed to ‘Executive Director of Information and Communications Technology’; and (b) the designation ‘Executive Director of Energy’ would be changed to ‘Executive Director of Energy and Utilities’. The Bill also seeks to confer, on the Office, responsibility for the water sector.

A BILL FOR A LAW TO AMEND THE UTILITY REGULATION AND COMPETITION LAW, 2016, LAW 49 OF 2016, TO CHANGE THE RESPECTIVE DESIGNATIONS OF TWO MEMBERS OF THE BOARD OF DIRECTORS OF THE UTILITY REGULATION AND COMPETITION OFFICE; TO EXPAND THE SECTORS FOR WHICH THAT OFFICE HAS RESPONSIBILITY; AND FOR INCIDENTAL AND CONNECTED PURPOSES

ENACTED by the Legislature of the Cayman Islands. (1) This Law may be cited as the Utility Regulation and Competition (Amendment) Law, 2017. (2) This Law shall come into force on such date as may be appointed by Order made by the Cabinet and different dates may be appointed for different provisions of this Law and in relation to different matters. The Utility Regulation and Competition Law, 2016, in this Law referred to as the “principal Law”, is amended in section 2(1) as follows - Short title and commencement Amendment of section 2 of the Utility Regulation and Competition Law, 2016 - interpretation Law 49 of 2016

(a) in the definition of the words “Executive Director of Energy” by inserting before the words “of the Office” the words “and Utilities”; and (b) in the definition of the words “Executive Director of Information” by inserting before the words “of the Office” the words “and Communications Technologies”. The principal Law is amended in section 29(1) as follows - (a) in paragraph (a) by inserting after the word “Information” the words “and Communications Technologies”; and (b) in paragraph (b) by inserting after the word “Energy” the words “and Utilities”. The principal Law is amended in Schedule 2 by inserting, in the appropriate alphabetical sequence, the following items - “The Wastewater Collection and Treatment Law, 2011, Law 3 of 2011 The Water Authority Law (2011 Revision) The Water (Production and Supply) Law, 2011, Law 2 of 2011”.
