Objects and Reasons
Memorandum of OBJECTS AND REASONS This Bill seeks to amend the Public Health Law (2002 Revision) to increase the penalty applicable where an offence is committed for which a specific penalty has not been provided in the Law. Clause 1 of the Bill provides the short title of the legislation. Clause 2 of the Bill provides for the amendment of section 71(2) of the Public Health Law (2002 Revision) to increase penalties for contravention of provisions of the Law for which no specific penalty has been provided. The amendment seeks to increase the fine from one thousand dollars to ten thousand dollars, increase the term of imprisonment from a term of six months to a term of two years and increase the fine for a continuing offence to five hundred dollars for each day that the offence continues after conviction.
Clause 1
A BILL FOR A LAW TO AMEND THE PUBLIC HEALTH LAW (2002 REVISION) TO INCREASE THE PENALTY APPLICABLE WHERE AN OFFENCE IS COMMITTED FOR WHICH A SPECIFIC PENALTY HAS NOT BEEN PROVIDED IN THE LAW; AND FOR INCIDENTAL AND CONNECTED PURPOSES ENACTED by the Legislature of the Cayman Islands. Short title This Law may be cited as the Public Health (Amendment) Law, 2020.
Clause 2
Amendment of section 71 of the Public Health Law (2002 Revision) - penalties The Public Health Law (2002 Revision) is amended by repealing section 71(2) and substituting the following subsection — “(2) Whoever commits an offence for which no specific penalty is provided under this Law is liable on conviction to a fine of ten thousand dollars and to imprisonment for two years and, in the case of a continuing offence, to a further fine of five hundred dollars for every day on which the offence continues after conviction.”.
