The Cayman Islands Constitution (Amendment) Order 1971

Her Majesty, by virtue and in exercise of the powers vested in Her by sections 5 and 7 of the West Indies Act 1962(a) and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:
1.(1) This Order may be cited as the Cayman Islands Constitution (Amendment) Order 1971.
(2) This Order shall be construed as one with the Cayman Islands (Constitution) Orders 1965 and 1967(b) and those Orders and this Order may be cited together as the Cayman Islands Constitution Orders 1965 to 1971.
(3) The Interpretation Act 1889(c) shall apply with the necessary adaptations for the purpose of interpreting and otherwise in relation to this Order as it applies for the purpose of interpreting and in relation to an Act of Parliament.
(4) This Order shall come into operation on 3rd November 1971.
2.(1) Section 3 of the Constitution of the Cayman Islands is amended by the deletion of paragraph (1) and the substitution of the following:
"(1) There shall be a Governor of the Cayman Islands who shall be appointed by Her Majesty by Commission under Her Sign Manual and Signet and shall hold office during Her Majesty's pleasure".

(2) Any reference in the Cayman Islands Constitution Orders 1965 and 1967 to the Administrator shall be construed as a reference to the Governor.

(3) The Cayman Islands Royal Instructions 1962(a) shall take effect as if they were addressed to the Governor, and any reference in those Instructions to the Administrator shall be construed accordingly.
3.(1) Any reference to the Administrator in any existing law in force or otherwise having effect in, or in relation to, the Cayman Islands immediately before the commencement of this Order shall, in respect of any period commencing on or after the commencement of this Order, be construed as a reference to the Governor.
(2) For the purposes of this Order, the expression "existing law" means any Order in Council, ordinance, law, rule, regulation or other instrument made or having effect as part of the law of the Cayman Islands, but does not include any Act of the Parliament of the United Kingdom so having effect.

EXPLANATORY NOTE
(This Note is not part of the Order.)
This Order changes the title of the Administrator of the Cayman Islands to that of Governor and replaces references to the Administrator by references to the Governor in the Cayman Islands Constitution Orders 1965 and 1967, and in other laws in force in the Cayman Islands.
