Caymanian Protection Act (2022 Revision) CAYMANIAN PROTECTION (FEES) PUBLISHING DETAILS Regulation 1 Caymanian Protection Act (2022 Revision) CAYMANIAN PROTECTION (FEES) In exercise of the powers conferred by 72 of the Caymanian Protection Act (2022 Revision), the Cabinet makes the following Regulations — Citation and commencement (1) These Regulations may be cited as the Caymanian Protection (Fees) (2) These Regulations come into force immediately after the Immigration (Transition) (Amendment and Validation) Act, 2026 comes into force. Prescribed fees The prescribed fees for the purposes of the Act are specified in the Schedule and where a fee is indicated to be an annual fee, it shall be payable annually. Fees: refund, waiver, reduction and exemption (1) The Cabinet may refund, waive or reduce any or all of the fees in the Schedule in relation to a person or group of persons. (2) Where a permanent resident is granted the right to be Caymanian within three, six or nine months of having paid the relevant annual fee in respect of permanent residence, that person is entitled to a refund of the annual fee as follows— Regulation 3 (a) if the fee was paid less than three months before the grant, to seventy-five per cent of the fee paid; (b) if the fee was paid between three months and less than six months before the grant, to fifty per cent of the fee paid; and if the fee was paid between six months and up to nine months before the grant, to twenty-five per cent of the fee paid, within three months after the receipt of the request for refund. (3) The employer of a person working by operation of law shall be refunded fifty per cent of the fee paid where that person ceases to so work within six months of the commencement of the period in respect of which the fee was paid. (4) In accordance with section 67(2)(b) of the Act, no fee shall be charged in respect of — (a) the application for a work permit or the grant of a work permit authorising the gainful occupation of the classes of persons set out at Item 24 in the Schedule; and (b) repatriation of the classes of persons set out at Item 24 in the Schedule. $10,400 2,500 5,000 3.2 Issue fee for Residency and Employment Rights Certificate for persons who have been legally and ordinarily resident in the Islands for a minimum period of eight years: 1,250 2,500 3,750 5,000 9,000 3.3 Certificate 3.4 Annual fee where the dependant has been included in the original application for or has subsequently been added on variation to, the grant or renewal of a (a) where annual work permit fee for the holder is $2,100 or less 350 per dependant (b) where annual work permit fee for the holder is between $2,101 - $10,400 525 per dependant (c) where annual work permit fee for the holder is more than $10,400 750 per dependant 3.5 ITEM 3.6 Other than the persons listed in 3.8 (a) to (f) below, all persons holding a Residency and Employment Rights Certificate, (whether or not engaging in gainful occupation in Grand Cayman, Cayman Brac and Little Cayman) or their respective employers are required to pay an annual fee on or before the anniversary date of the issue of the Certificate equivalent to the annual fee payable by a work permit holder in the same Fees) 3.7 Filing fee associated with the filing of annual declarations by the holder 3.8 The following persons are exempt from the requirement to pay the annual fee in respect of a Residency and Employment Rights Certificate: (a) Spouse or civil partner of a Caymanian nil (b) Surviving spouse or civil partner of a Caymanian who has not re-married or reentered a civil partnership with a nonCaymanian nil (c) Contracted Government employees nil (d) A person who is granted asylum under section 111(4) of the Customs and Border Control Act (2024 Revision) nil (e) Employees of the Cayman Islands Monetary Authority nil (f) Persons working for a organisation as defined in section 2 of the Organisations Act Revision) nil (g) Employees of the Health Services Authority nil (h) Employees of the University College of the nil Note 2: Where a Certificate is varied to change occupation and the new occupation attracts a higher annual fee, the fee payable until the following anniversary date shall be the difference between that applicable to the former occupation and that of the new occupation. Thereafter, the fee payable shall be the fee for the new occupation Note 3: In the event that an application for permanent residence is refused, all fees submitted with the application other than the application fee shall be refunded to the applicant. ITEM Note 3: Where a work permit is varied to change occupation and the new occupation attracts the same or a lower fee, the fee payable is $150 per Note 4: Where a work permit is varied to change occupation and the new occupation attracts a higher fee, the fee payable until the following anniversary date shall be the difference between that applicable to the former occupation and that of the new occupation. Thereafter, the fee payable shall be the fee for the new occupation. Note 5: Where an express application is made for a temporary work permit and a decision on that application is not communicated within two business days after receipt of the application, the express application fee shall be refunded to the applicant. An express application may require additional review which would not have been foreseeable at the time of receipt of the express application before a decision is made. Where additional review is required due to statutory, regulatory, administrative or other legal obligations, the applicant shall be informed of this within the two-business day period and a refund shall not be payable if the decision is not delivered within two business days. Note 6: Where an express application is made for an annual work permit and a decision on that application is not communicated within fourteen business days of receipt of the application, the express application fee shall be refunded to the applicant. An express application may require additional review which would not have been foreseeable at the time of receipt of the express application before a decision is made. Where additional review is required due to statutory, regulatory, administrative or other legal obligations, the applicant shall be informed of this within the fourteen-business day period and a refund shall not be payable if the decision is not delivered within fourteen business days 56, 63 ANNUAL WORK PERMIT – RENEWAL 20.1 Application for the renewal of a work permit — 20.2 Renewal of annual work permit fee of Work 20.3 Application for the variation of a work permit — 20.4 Annual fee where the dependant has been included in the original application for, or has subsequently been added on variation to the grant or renewal of a work permit — ITEM (a) where annual work permit fee for the holder is per (b) where annual work permit fee for the holder is between $2,101 - $10,400 per (c) where annual work permit fee for the holder is more than $10,400 per 20.5 Non-refundable repatriation fee (Not required on the renewal of a work permit) Nil 20.6 Non-refundable work permit identification card fee Note 1: Where more than one occupation is authorised on the work permit the fee payable shall be equivalent to the occupation which attracts the higher fee. Thereafter, the fee payable shall be the fee for the new occupation. 20.7 Annual Work Permit and Express Determination Fees: The table below shows the work permit fees and express determination fees for the grant or renewal of an annual work permit. Range of Annual Work Permit Fees Express Fees (a) where the annual work permit fee payable is $375 or less (b) where the annual work permit fee payable is between $376 and $875 (c) where the annual work permit fee payable is between $876 and $2,100 (d) where the annual work permit fee payable is between $2,101 and $10,400 (e) where the annual work permit fee payable is between $10,401 and $32,400 WORK PERMITS ON BASIS OF SPOUSE'S OR CIVIL PARTNER’S UNEXPIRED TERM LIMIT, EMPLOYMENT WITH GOVERNMENT OR WORKING BY OPERATION OF LAW 21.1 Application fee — 21.2 Grant or renewal of a work permit under this provision of Work ITEM WORKING BY OPERATION OF LAW 22.1 Application fee — 22.2 Grant fee payable is equivalent to 50% of annual work permit fee for that occupation and is paid every six months of Work 22.3 per annum. 22.4 over $2,100 per annum Note: Dependants must have been previously approved on last work permit to be added to working by operation of law application PERMISSION BY DIRECTOR OF WORC TO REMAIN IN EMPLOYMENT AND TO HAVE SUCH PERMISSION VARIED 23.1 Application to the Director of WORC for permission to continue in employment whilst awaiting the determination of a permanent residence application — 23.2 Application to the Director of WORC for the variation of permission granted in respect of employment whilst awaiting the determination of a permanent residence 23.3 Approval of application for permission. Fee payable is 50% of annual work permit fee for the occupation, payable every six months Fee varies (See of Annual Work ITEM 23.4 per annum 23.5 over $2,100 per annum Note: Dependants must have been previously approved on final work permits in order to be included in application for permission to continue working. PERSONS EXEMPT FROM WORK PERMIT FEES 24.1 In addition to children and young persons under the age of eighteen, the following persons are exempt from any requirement to pay work permit fees: (a) Spouse or civil partner of a Caymanian (b) Surviving spouse or civil partner of a Caymanian who has not re-married or re-entered a civil partnership with a non-Caymanian (c) Employees of the Government on contract (d) A person who is declared by the Cabinet to be exempt in accordance with section 53(1)(b) (e) Cayman Islands Monetary Authority employees (f) Persons working for a non-profit organisation as defined in of the Organisations Act (2020 Revision) (g) Employees of the Health Services Authority (h) Employees of the University College of the 24.2 The following persons are exempt from the requirement to pay non-refundable repatriation fees or work permit dependant fees: (a) Employees of the Government on contract including teachers who are licensed by the Cayman Islands Education Council (b) Ministers of Religion (c) Cayman Islands Monetary Authority employees (d) Employees of the Health Services Authority (e) Employees of the University College of the Note:

Where a work permit ceases to be effective for any reason and the employee has worked for six months or less, a refund of no more than one half of the annual fee is to be made. Where an employee of the developer of the special economic zone known as Cayman Enterprise City or a special economic zone enterprise carrying on special economic zone business in the special economic zone known as Cayman Enterprise City is granted permanent residence, the annual fee shall be based on the annual work permit fee for the respective occupation specified in Part 2 instead of the annual work permit fee set out in paragraph 1(b).
