ANIMALS (EXPORTATION, IMPORTATION, PROTECTION AND CONTROL) REGULATIONS PUBLISHING DETAILS Revised under the authority of the Law Revision Act (2020 Revision). The Animals Regulations made the 1st February, 1977, as amended by the Citation of Acts of Parliament Act, 2020 [Act 56 of 2020]. ANIMALS (EXPORTATION, IMPORTATION, PROTECTION AND CONTROL) REGULATIONS Regulation PART 1 - Introductory PART 2 - Export and Import of Animals PART 3 - Protection of Animals PART 4 - Control of Animals Regulation 1 ANIMALS (EXPORTATION, IMPORTATION, PROTECTION AND CONTROL) REGULATIONS PART 1 - Introductory Citation These Regulations may be cited as the Animals (Exportation, Importation, Protection and Control) Regulations (2024 Revision). PART 2 - Export and Import of Animals Exportation of live animals No live animal may be exported from the Islands save under licence issued by the Director of the Department of Agriculture (the “Director”), after application made to the Director in writing and payment of the fee prescribed in the First Schedule. Licence for importation of live animals The forms of licences for the import and export of live animals are prescribed in the Importation of carcasses (1) No carcass, whether fresh, frozen, chilled, cured, pickled or otherwise preserved or treated, of any animal, nor any part of such carcass, with the exception of poultry, shall be imported into the Islands from — (a) the Republic of Ireland; (b) the United Kingdom or any other country of the European Union; and any other country or territory in which bovine spongiform encephalopathy (BSE) has been identified by local authorities, until such time as the Director may specify by notice published in the Gazette. (2) No carcass, whether fresh, frozen, chilled, cured, pickled or otherwise preserved or treated, of any animal, nor any part of such carcass, mentioned in column 1 of the Third Schedule, nor any part of such carcass, shall be imported into the Islands unless it is imported — (a) directly from one of the countries specified in the corresponding part of column 2 of the Third Schedule; and (b) in accordance with such conditions as may be laid down by the Director. (3) Thoroughly cooked boneless meat may be imported into the Islands in hermetically sealed metal cans from any country with the exception of — (a) the Republic of Ireland; and (b) the United Kingdom or any other country of the European Union. (4) Notwithstanding subregulation (3), thoroughly cooked boneless meat derived from poultry and swine may be imported into the Islands in hermetically sealed metal cans from any country. (5) The only meat which may be imported into the Islands from Nicaragua is boneless meat. (6) In this regulation — “thoroughly cooked meat” means meat that has been subjected to heat treatment and which has attained a temperature of not less than one hundred and seventy degrees Fahrenheit at the central point for a period of not less than thirty minutes. PART 3 - Protection of Animals Close season The period from 1st February to the 31st July inclusive in each year is prescribed as a close season for the purposes of sections 2 and 67. Regulation 6 Limitation on number of game birds which may be taken The limit on the number of game birds which may be taken by one person on any one day is — (a) twelve White-Winged Doves, twelve White-Crowned Pigeons or any combination thereof: Provided that the number of such birds taken shall not exceed twelve; and (b) three Blue-Winged Teal. PART 4 - Control of Animals Establishment of pounds and poundkeepers The places and persons set forth in Parts I and II of the Fourth Schedule are established as pounds and appointed as poundkeepers respectively for the purposes of section 50. Fee for service of notice of animals impounded The prescribed fee for the service of notices for the purposes of section 51 is ten dollars per animal. Fee for maintenance of impounded animals The daily prescribed daily maintenance fee for impounded animals for the purposes of section 53 is ten dollars per animal. Poundkeepers remuneration
